			</subsection></section><section id="ID6860501280114dbaa1a732998dcc03a1"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="ID19ff2b54d8be4b18a2d9b7f172a21bba"><enum>(1)</enum><text>to integrate and
			 organize the administration of the agricultural research, extension, education,
			 and related programs administered by the Secretary of Agriculture to respond to
			 21st century challenges and continue to meet the needs of society from a local,
			 tribal, State, national, and international perspective;</text>
			</paragraph><paragraph id="ID336dbe31b83547c09c51cfc014c41475"><enum>(2)</enum><text>to minimize
			 duplication, and maximize coordination and integration, among all of the
			 programs at all levels through a solution-based approach;</text>
			</paragraph><paragraph id="IDa6420a2236d444c8ae792cba6efb6b39"><enum>(3)</enum><text>to enhance the
			 capacity of all participating institutions to more effectively carry out the
			 programs, with special emphasis given to 1890 Institutions, 1994 Institutions,
			 Insular Area Institutions, ASCARR Institutions, and Small 1862 Land-Grant
			 Institutions;</text>
			</paragraph><paragraph id="ID3e73c318d395492089639cde01e508f7"><enum>(4)</enum><text>to provide for a
			 more balanced portfolio of available resources and funding between capacity
			 programs and competitive programs through the enhanced growth of competitive
			 funds;</text>
			</paragraph><paragraph id="IDc40db5d4e49c45049bf7e86bdcbb10dd"><enum>(5)</enum><text>to position the
			 agricultural research, extension, education, and related programs system to
			 increase the contribution of the system to society through the expansion of the
			 portfolio of the system; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd51ddb069181478d83dc0a0c300881df"><enum>(6)</enum><text>to provide
			 funding to achieve the purposes of this Act and other purposes by enhancing by
			 100 percent the authorized funding for agricultural research, extension,
			 education, and related programs over 7 fiscal years.</text>
			</paragraph></section><section id="IDe255ede946fd42f2b2d1d9931eb24454"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID5EFC9608B392409D8D7E36455F3CCC81"><enum>(1)</enum><header>1862
			 Institution</header><text>The term <term>1862 Institution</term> means a
			 college or university eligible to receive funds under the Act of July 2, 1862
			 (7 U.S.C. 301 et seq.).</text>
			</paragraph><paragraph id="IDAFE3498E90E04D56A94DF8A03D99F29C"><enum>(2)</enum><header>1890
			 Institution</header><text>The term <term>1890 Institution</term> means a
			 college or university eligible to receive funds under the Act of August 30,
			 1890 (7 U.S.C. 321 et seq.), including Tuskegee University.</text>
			</paragraph><paragraph id="ID63BC1D0F3DBF4C42A09633781C1293ED"><enum>(3)</enum><header>1994
			 Institution</header><text>The term <term>1994 Institution</term> means 1 of the
			 1994 Institutions (as defined in section 532 of the Equity in Educational
			 Land-Grant Status Act of 1994 (Public Law 103–382; 7 U.S.C. 301 note)).</text>
			</paragraph><paragraph id="IDd58cd28ab6e94d2b90a50bfc4ec7b7eb"><enum>(4)</enum><header>ASCARR
			 Institution</header>
				<subparagraph id="idA343AF3BD2D74A8B81D9023CCB11B0AB"><enum>(A)</enum><header>In
			 general</header><text>The term <term>ASCARR Institution</term> means a public
			 college or university offering a baccalaureate or higher degree in the study of
			 agriculture.</text>
				</subparagraph><subparagraph id="idE551955D92A5473099BDFE187D3CD40D"><enum>(B)</enum><header>Exclusions</header><text>The
			 term <term>ASCARR Institution</term> does not include an institution eligible
			 to receive funds under—</text>
					<clause id="id5FD1D3CCE7E24D1190C98C09142C88C7"><enum>(i)</enum><text>the
			 Act of July 2, 1862 (commonly known as the <quote>First Morrill Act</quote>) (7
			 U.S.C. 301 et seq.);</text>
					</clause><clause id="idDF410B5E8B8B4E2998EAC37F7E8202FB"><enum>(ii)</enum><text>the Act of
			 August 30, 1890 (commonly known as the <quote>Second Morrill Act</quote>) (7
			 U.S.C. 321 et seq.); or</text>
					</clause><clause id="idB8258C87B3A84537B93B319A242D7B7A"><enum>(iii)</enum><text>the Equity in
			 Educational Land-Grant Status Act of 1994 (Public Law 103–382; 7 U.S.C. 301
			 note).</text>
					</clause></subparagraph></paragraph><paragraph id="ID54a54bf6ecf54a66be29e4bcb8b5891e"><enum>(5)</enum><header>Capacity
			 program</header><text>The term <term>capacity program</term> means each of the
			 following agricultural research, extension, education, and related programs for
			 which the Secretary has administrative or other authority as of the day before
			 the date of enactment of this Act:</text>
				<subparagraph id="ID3093d8952aff4586af9724e31941a0fa"><enum>(A)</enum><text>Each program
			 established under the Act of July 2, 1862 (commonly known as the <quote>First
			 Morrill Act</quote>) (7 U.S.C. 301 et seq.).</text>
				</subparagraph><subparagraph id="ID537d77c83f7d4adc80279a3179c46676"><enum>(B)</enum><text>Each program
			 providing funding to any of the 1994 Institutions under sections 533, 534(a),
			 and 535 of the Equity in Educational Land-Grant Status Act of 1994 (Public Law
			 103–382; 7 U.S.C. 301 note) (commonly known as <quote>financial assistance,
			 technical assistance, and endowments to tribal colleges and Navajo Community
			 College</quote>).</text>
				</subparagraph><subparagraph id="IDfea8dc2c33f0458db45ead1d1f510f66"><enum>(C)</enum><text>The program
			 established under section 536 of the Equity in Educational Land-Grant Status
			 Act of 1994 (Public Law 103–382; 7 U.S.C. 301 note) providing research grants
			 for 1994 institutions.</text>
				</subparagraph><subparagraph id="IDb0531ed077a64c64b974ac131ccb0fbe"><enum>(D)</enum><text>Each program
			 established under subsections (b), (c), and (d) of section 3 of the Smith-Lever
			 Act (7 U.S.C. 343).</text>
				</subparagraph><subparagraph id="ID3af88344a78e455cad4109ab33143866"><enum>(E)</enum><text>Each program
			 established under the Hatch Act of 1887 (7 U.S.C. 361a et seq.).</text>
				</subparagraph><subparagraph id="IDafd7c34b506e42499fe171536a03ffe7"><enum>(F)</enum><text>Each grant
			 program established under section 2501 of the Food, Agriculture, Conservation,
			 and Trade Act of 1990 (7 U.S.C. 2279) providing outreach and assistance for
			 socially disadvantaged farmers and ranchers.</text>
				</subparagraph><subparagraph id="IDba39c6b6252f4985b40663c18c67237c"><enum>(G)</enum><text>Each program
			 established under section 1417(b)(4) of the National Agricultural Research,
			 Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3152(b)(4)), including
			 grant programs under that section (commonly known as the <quote>1890
			 Institution Teaching and Research Capacity Building Grants
			 Program</quote>).</text>
				</subparagraph><subparagraph id="ID24a15a1737c9458490cb2a0f372e2074"><enum>(H)</enum><text>The animal health
			 and disease research program established under subtitle E of the National
			 Agricultural Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C.
			 3191 et seq.).</text>
				</subparagraph><subparagraph id="IDcb8a08f107a94d5aa87c624144be8d60"><enum>(I)</enum><text>Each extension
			 program available to 1890 Institutions established under sections 1444 and 1464
			 of the National Agricultural Research, Extension, and Teaching Policy Act of
			 1977 (7 U.S.C. 3221, 3312).</text>
				</subparagraph><subparagraph id="ID1c2c8adfa3ee44caa148d363d34e3a59"><enum>(J)</enum><text>The program
			 established under section 1445 of the National Agricultural Research,
			 Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3222) (commonly known as
			 the <quote>Evans-Allen Program</quote>).</text>
				</subparagraph><subparagraph id="ID4bb3144816f64764bcf23ad5b67bccbf"><enum>(K)</enum><text>The program
			 providing grants to upgrade agricultural and food sciences facilities at 1890
			 Institutions established under section 1447 of the National Agricultural
			 Research, Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3222b).</text>
				</subparagraph><subparagraph id="ID33ea508b91b5453cacf5f3cd2f668c98"><enum>(L)</enum><text>The program
			 providing distance education grants for insular areas established under section
			 1490 of the National Agricultural Research, Extension, and Teaching Policy Act
			 of 1977 (7 U.S.C. 3362).</text>
				</subparagraph><subparagraph id="ID2f02e864cfea4573b4618642f7ee6aa0"><enum>(M)</enum><text>The program
			 providing resident instruction grants for insular areas established under
			 section 1491 of the National Agricultural Research, Extension, and Teaching
			 Policy Act of 1977 (7 U.S.C. 3363).</text>
				</subparagraph><subparagraph id="ID495d94a758a04c4e9d6fc80967bc87c6"><enum>(N)</enum><text>Each program
			 available to 1890 Institutions established under section 406 of the
			 Agricultural Research, Extension, and Education Reform Act of 1998 (7 U.S.C.
			 7626).</text>
				</subparagraph><subparagraph id="IDd3f07fd852b74cc6a85379f813924187"><enum>(O)</enum><text>The program
			 providing competitive extension grants to eligible 1994 Institutions under
			 section 1464 of National Agricultural Research, Extension, and Teaching Policy
			 Act of 1977 (7 U.S.C. 3312) and the Equity in Educational Land-Grant Status Act
			 of 1994 (Public Law 103–382; 7 U.S.C. 301 note) established under section 406
			 of the Agricultural Research, Extension, and Education Reform Act of 1998 (7
			 U.S.C. 7626).</text>
				</subparagraph><subparagraph id="ID108edeeab59e4b5fbb1cfd911121576c"><enum>(P)</enum><text>Each research and
			 development and related program established under Public Law 87–788 (commonly
			 known as the <quote>McIntire-Stennis Cooperative Forestry Act</quote>) (16
			 U.S.C. 582a et seq.).</text>
				</subparagraph><subparagraph id="IDf4b9ff744349449d870e716335b18320"><enum>(Q)</enum><text>Each program
			 established under the Renewable Resources Extension Act of 1978 (16 U.S.C. 1671
			 et seq.).</text>
				</subparagraph><subparagraph id="IDf4b793d55e444cf1b9bf9556d140cf33"><enum>(R)</enum><text>Each grant
			 program for ASCARR Institutions established under section 202.</text>
				</subparagraph><subparagraph id="ID21030bfe308c49a79abc29d46b0b2c6c"><enum>(S)</enum><text>Each program and
			 related activities administered (as of the day before the date of enactment of
			 this Act) by the Agricultural Research Service of the Department.</text>
				</subparagraph><subparagraph id="IDbc2c54853a4c4c63bbd7cac74eeb456b"><enum>(T)</enum><text>Each program and

			 this Act) by the Economic Research Service of the Department.</text>
				</subparagraph><subparagraph id="IDdc633c7d84c54e2cb07e4a9222774627"><enum>(U)</enum><text>Each forest and
			 rangeland research and development program of the Forest Service that is
			 administered by the Department.</text>
				</subparagraph></paragraph><paragraph id="IDac049b9447a74a27a609a5836a32ec9c"><enum>(6)</enum><header>Capacity
			 program critical base funding</header><text>The term <term>capacity program
			 critical base funding</term> means the aggregate amount of Federal funds made
			 available for all or individual capacity programs for fiscal year 2007, as
			 appropriate.</text>
			</paragraph><paragraph id="id2EF2320F50F9459AB287F456FBA27FC0"><enum>(7)</enum><header>Competitive
			 program</header><text>The term <term>competitive program</term> means each of
			 the following agricultural research, extension, education, and related programs
			 for which the Secretary has administrative or other authority as of the day
			 before the date of enactment of this Act:</text>
				<subparagraph id="IDe48451c506794a06819e4303af55c1d0"><enum>(A)</enum><text>The competitive
			 grant program established under section 2 of the Competitive, Special, and
			 Facilities Research Grant Act (7 U.S.C. 450i), commonly known as the
			 <quote>National Research Initiative Competitive Grants Program</quote>).</text>
				</subparagraph><subparagraph id="ID59768dc315e84be293390e11cb1d5b09"><enum>(B)</enum><text>The program
			 providing grants and related assistance established under section 1417(b)(5) of
			 the National Agricultural Research, Extension, and Teaching Policy Act of 1977
			 (7 U.S.C. 3152(b)(5)) commonly known as the <quote>Higher Education
			 Multicultural Scholars Program</quote>.</text>
				</subparagraph><subparagraph id="ID8f39a1f41b584527a891c79f9a1ce9c3"><enum>(C)</enum><text>The Food and
			 Agricultural Sciences grant program established under section 1417 of the
			 National Agricultural Research, Extension, and Teaching Policy Act of 1977 (7
			 U.S.C. 3152), commonly known as the <quote>Food and Agricultural Sciences
			 National Needs Graduate Fellowship Grants Program</quote>.</text>
				</subparagraph><subparagraph id="ID836ecdb6b71547979dacb093ba0f390d"><enum>(D)</enum><text>The program
			 providing grants under section 1417(j) of the National Agricultural Research,
			 Extension, and Teaching Policy Act of 1977 (7 U.S.C. 3152(j)), commonly known
			 as <quote>Institution Challenge Grants</quote>.</text>
				</subparagraph><subparagraph id="ID8875d4db623d443eba9d4eaf9cd40f45"><enum>(E)</enum><text>The program
			 providing grants for Hispanic-serving institutions established under section
			 1455 of the National Agricultural Research, Extension, and Teaching Policy Act
			 of 1977 (7 U.S.C. 3241).</text>
				</subparagraph><subparagraph id="IDf8e623c87cc3439abd0e881f764a7d71"><enum>(F)</enum><text>The Initiative
			 for Future Agriculture and Food Systems established under section 401 of the
			 Agricultural Research, Extension, and Education Reform Act of 1998 (7 U.S.C.
			 7621) or any substantially similar program or authority.</text>
				</subparagraph><subparagraph id="IDd90496d08c7d4f2eb1e2863228bd0718"><enum>(G)</enum><text>The integrated
			 research, education, and extension competitive grants program established under
			 section 406 of the Agricultural Research, Extension, and Education Reform Act
			 of 1998 (7 U.S.C. 7626).</text>
				</subparagraph></paragraph><paragraph id="idD9C13211871E403881F36016477E3435"><enum>(8)</enum><header>Competitive
			 program critical base funding</header><text>The term <term>competitive program
			 critical base funding</term> means the aggregate amount of Federal funds made
			 available for all or individual competitive programs for fiscal year 2007, as
			 appropriate.</text>
			</paragraph><paragraph id="ID8271e19a03f04546bdc3a0b51d1a4503"><enum>(9)</enum><header>Council</header><text>The
			 term <term>Council</term> means the Standing Council of Advisors established
			 under section 102(h).</text>
			</paragraph><paragraph id="ID25c73c123a5e4ea18712ca7b67cefd19"><enum>(10)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Agriculture.</text>
			</paragraph><paragraph id="ID2ff281c7ba5a4dba95bd5b91c0234b36"><enum>(11)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the National Institutes for
			 Food and Agriculture.</text>
			</paragraph><paragraph id="IDa6922145270d4117a3c920c34a7f8aba"><enum>(12)</enum><header>Extramural
			 activity</header><text>The term <term>extramural activity</term> includes each
			 program and related activity administered or otherwise carried out by the
			 entities or under an authority described in subparagraphs (A) through (R) of
			 paragraph (5).</text>
			</paragraph><paragraph id="IDdc65df4869e84283b399b9f7ab3c1a19"><enum>(13)</enum><header>Fundamental
			 research</header><text>The term <term>fundamental research</term> means
			 research that, as determined by the Director—</text>
				<subparagraph id="ID4d38338f66cc4175863eda4726ed6143"><enum>(A)</enum><text>advances the
			 frontiers of knowledge so as to lead to practical results or to further
			 scientific discovery; and</text>
				</subparagraph><subparagraph id="ID626492a2d33c4289a3f1172a3dfc0b76"><enum>(B)</enum><text>has an effect
			 on—</text>
					<clause id="idC1508EB5487F43469E36D23194F70F85"><enum>(i)</enum><text>agriculture,
			 food, forestry, human health, or another purpose of this Act;</text>
					</clause><clause id="id9A6F27B4D40E494F820C8C624DCA8BFC"><enum>(ii)</enum><text>a
			 priority area of the National Institutes for Food and Agriculture; or</text>
					</clause><clause id="id90FBD04511604C6CB6BF49D6D524BCF9"><enum>(iii)</enum><text>another goal or
			 purpose of a National Institutes for Food and Agriculture program.</text>
					</clause></subparagraph></paragraph><paragraph id="id003270600BD44965840BB498129B4919"><enum>(14)</enum><header>Insular Area
			 Institution</header><text>The term <term>Insular Area Institution</term> has
			 the meaning given the term <term>eligible institution</term> in section 1489 of
			 the National Agricultural Research, Extension, and Teaching Policy Act of 1977
			 (7 U.S.C. 3361).</text>
			</paragraph><paragraph id="ID3948e0afe68945e9a174da0616c4d271"><enum>(15)</enum><header>Intramural
			 activities</header><text>The term <term>intramural activities</term> includes
			 each of the programs and related activities administered or otherwise carried
			 out by the entities described in subparagraphs (S), (T), and (U) of paragraph
			 (5).</text>
			</paragraph><paragraph id="ID29d7a54ad88345b187b004c88f5345c0"><enum>(16)</enum><header>National
			 Institutes for Food and Agriculture</header><text>The term <term>National
			 Institutes for Food and Agriculture</term> means the National Institutes for
			 Food and Agriculture established under section 101.</text>
			</paragraph><paragraph id="ID1905fa63c80446f2b412d99933b9c265"><enum>(17)</enum><header>National
			 Institutes for Food and Agriculture program</header><text>The term
			 <term>National Institutes for Food and Agriculture program</term> includes each
			 capacity program, competitive program, and any other program, authority, power,
			 or activity of the National Institutes for Food and Agriculture, including
			 those described in section 101.</text>
			</paragraph><paragraph id="IDa7fd93e9194342b98f9a7f5c69018d9c"><enum>(18)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph><paragraph id="IDda3e735f6aae4b2f99739268c738553c"><enum>(19)</enum><header>Small 1862
			 Land-Grant Institutions</header><text>The term <term>Small 1862 Land-Grant
			 Institution</term> means each 1862 institution that received, for the 3 fiscal
			 years immediately preceding the applicable fiscal year (based on a 3-year
			 rolling average), less than 1 percent of—</text>
				<subparagraph id="IDa6478f31848b44499899dd6afe367ffe"><enum>(A)</enum><text>in the case of a
			 fiscal year beginning before the date of the enactment of this Act and the
			 implementation of the National Institutes for Food and Agriculture programs (as
			 determined by the Director), the funds received by each such institution from
			 among available programs of the Cooperative State Research, Education, and
			 Extension Service; and</text>
				</subparagraph><subparagraph id="IDe68bb94ceab546b5871ca90a70abfe82"><enum>(B)</enum><text>in the case of a
			 fiscal year beginning after the date of the enactment of this Act and the
			 implementation of the National Institutes for Food and Agriculture programs (as
			 determined by the Director), the funds received by each such institution from
			 among available National Institutes for Food and Agriculture programs, other
			 than funds reserved or distributed under paragraph (2)(B)(ii)(I),
			 (2)(C)(ii)(I), or (3)(A)(ii) of section 105(c).</text>
				</subparagraph></paragraph><paragraph id="IDA1FB7A1B01824FA8BB2812BEBBC29A7C"><enum>(20)</enum><header>State</header><text>The
			 term <term>State</term> means—</text>
				<subparagraph id="IDFF879DE85E0E4FEC9C688D61E9026CDD"><enum>(A)</enum><text>each of the
			 several States of the United States;</text>
				</subparagraph><subparagraph id="ID3101047A4BF14895A4996D0E3B56607E"><enum>(B)</enum><text>the Commonwealth
			 of Puerto Rico;</text>
				</subparagraph><subparagraph id="ID7162086E82BE4862A921D0568448B976"><enum>(C)</enum><text>Guam;</text>
				</subparagraph><subparagraph id="IDC397CB348D70414D852ED0B69C50A495"><enum>(D)</enum><text>American

			 Virgin Islands.</text>
				</subparagraph></paragraph><paragraph id="IDEEA2354104E24BEC8D80C69691273D5C"><enum>(21)</enum><header>United
			 States</header><text>The term <term>United States</term>, when used in a
			 geographical sense, means all of the States.</text>

			 Institutes for Food and Agriculture</header>
			<section id="IDdfbedf4689824f09a93e938a4b00093f"><enum>101.</enum><header>Establishment
			 of National Institutes for Food and Agriculture</header>
				<subsection id="IDfde69a80f9554b17982f9967958e76e5"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="idE0984C76A23B4A6BB87BA4E881D43930"><enum>(1)</enum><header>In
			 general</header><text>There is established within the Executive branch an
			 independent agency to be known as the <quote>National Institutes for Food and
			 Agriculture</quote>.</text>
					</paragraph><paragraph id="id3C1A3F36A7524A278C0B07D5A8D1ECF4"><enum>(2)</enum><header>Members</header><text>The
			 National Institutes for Food and Agriculture shall consist of—</text>
						<subparagraph id="id08B2F62E742B4CCE8ACF68243868782B"><enum>(A)</enum><text>the
			 Director;</text>
						</subparagraph><subparagraph id="id6818BE21893B42B380F8A207368F3601"><enum>(B)</enum><text>the
			 Council;</text>
						</subparagraph><subparagraph id="id500C49917F69433486D25D28298845F1"><enum>(C)</enum><text>the individual
			 institutes established under section 103; and</text>
						</subparagraph><subparagraph id="id87D3730CBA1A418FA6AEFDB69F65272C"><enum>(D)</enum><text>the staff and
			 employees of National Institutes for Food and Agriculture.</text>
						</subparagraph></paragraph></subsection><subsection id="IDc245c9ecb50b4c85b0c67d585fad9d50"><enum>(b)</enum><header>Authorities</header>
					<paragraph id="IDe650c620f585479195e48ef5f7d4e811"><enum>(1)</enum><header>Transfer of
			 authorities</header><text>There are transferred to National Institutes for Food
			 and Agriculture the authorities (including all budget authorities and
			 personnel), duties, obligations, and related legal and administrative functions
			 prescribed by law or otherwise granted to the Secretary, the Department, or any
			 other agency or official of the Department under—</text>
						<subparagraph id="idEEE85FD63C9B43A991CB0B8318BD4EC6"><enum>(A)</enum><text>the capacity
			 programs;</text>
						</subparagraph><subparagraph id="id1DF86C621E354066A457A25A6B0F7792"><enum>(B)</enum><text>the competitive
			 programs;</text>
						</subparagraph><subparagraph id="id28ED23AA0AA44CE88E5FA053A737B111"><enum>(C)</enum><text>the research,
			 education, economic, cooperative State research programs, cooperative extension
			 and education programs, international programs, and other functions and
			 authorities delegated by the Secretary to—</text>
							<clause id="idE84230F1C58143CCBC5D5E4D12623E05"><enum>(i)</enum><text>the
			 Under Secretary of Agriculture for Research, Education, and Economics
			 (including under section 251 of the Federal Crop Insurance Reform and
			 Department of Agriculture Reorganization Act of 1994 (7 U.S.C. 6971));
			 and</text>
							</clause><clause id="idD928D21C5A774878B4D8EC50B6BCE923"><enum>(ii)</enum><text>the
			 Administrator of the Cooperative State Research, Education, and extension
			 Service pursuant to section 2.66 of title 7, Code of Federal Regulations (or
			 successor regulations); and</text>
							</clause></subparagraph><subparagraph id="id1FAE3B9699924CD4AA0EB7CFCA224B86"><enum>(D)</enum><text>any and all other
			 authorities administered by—</text>
							<clause id="idFE9562C1B47D4FD09A35CB9CACFA29EA"><enum>(i)</enum><text>the
			 Under Secretary of Agriculture for Research, Education, and Economics;</text>
							</clause><clause id="idABC0F78A0C5C42239B20DCC6B411D8C6"><enum>(ii)</enum><text>the
			 Administrator of the Cooperative State Research, Education, and extension
			 Service;</text>
							</clause><clause id="id291ABE248768427B9C182392B8FA95FA"><enum>(iii)</enum><text>the
			 Administrator of the Agricultural Research Service (including the National
			 Agricultural Library);</text>
							</clause><clause id="id9968D665D6DD4A4086843018AD6D7209"><enum>(iv)</enum><text>the Chief of the
			 Forest Service (relating to research and development); and</text>
							</clause><clause id="idC88C544738664C27BF20E893F62B441B"><enum>(v)</enum><text>the
			 Administrator of the Economic Research Service.</text>
							</clause></subparagraph></paragraph><paragraph id="ID1f6e176b0f0245909f22ce3021f842e9"><enum>(2)</enum><header>Consolidation
			 of authorities</header><text>To carry out this Act, in accordance with the
			 transfer and continuation of the authorities, budgetary functions, and
			 personnel resources under this subsection, the administrative entities within
			 the Department known as the Cooperative State Research, Education, and
			 Extension Service, the Agricultural Research Service (including the National
			 Agricultural Library), and the Economic Research Service, and the research and
			 development functions of the Forest Service, shall terminate on the earlier
			 of—</text>
						<subparagraph id="id769940A47A6F42EAB1A8E056EF88C2CF"><enum>(A)</enum><text>October 1, 2008;
			 or</text>
						</subparagraph><subparagraph id="id7C03CA406DC7498F9DBDAE3B2BF4DBB3"><enum>(B)</enum><text>such earlier date
			 as the Director determines to be appropriate.</text>
						</subparagraph></paragraph><paragraph id="ID637afe9146144424aa5a49207725c3d7"><enum>(3)</enum><header>Reservation</header><text>Notwithstanding
			 any other provision of this Act, any and all administrative authority over the
			 functions and activities of the National Agricultural Statistics Service,
			 consistent with those authorities, functions, and activities as in effect on
			 the day before the date of enactment of this Act, shall remain under the
			 authority of the Secretary.</text>
					</paragraph></subsection><subsection id="IDe9b4d0bed8874e269592c4a9abe91149"><enum>(c)</enum><header>Powers</header><text>The
			 Director may—</text>
					<paragraph id="ID55d4cbd6292d4d718215dfe8b66e4601"><enum>(1)</enum><text>promulgate such
			 regulations as the Director determines to be necessary to govern the
			 operations, organization, and personnel of the National Institutes for Food and
			 Agriculture;</text>
					</paragraph><paragraph id="ID72353b2b92844d8daebfe14500aee0cc"><enum>(2)</enum><text>make such
			 expenditures as are necessary to carry out this Act;</text>
					</paragraph><paragraph id="ID7586b6afd71a499caa198a95086516ea"><enum>(3)</enum><text>enter into
			 contracts or other arrangements, or modifications of contracts or other
			 arrangements—</text>
						<subparagraph id="IDfd433c9fb4e34f5ab658eb01498c1ccc"><enum>(A)</enum><text>to provide for
			 the carrying out, by organizations or individuals in the United States
			 (including agencies of the Department and other Government agencies) of such
			 National Institutes for Food and Agriculture programs as the Director
			 determines to be necessary to carry out this Act; and</text>
						</subparagraph><subparagraph id="ID3a511874814642f3987cf34735126e1d"><enum>(B)</enum><text>at the request of
			 the President or the Secretary, for the carrying out of such specific National
			 Institutes for Food and Agriculture program-related activities as are in the
			 national interest or are otherwise of critical importance, as determined by the
			 President or the Secretary, with the concurrence of the Director;</text>
						</subparagraph></paragraph><paragraph id="IDb07aa58dd64146d2bc9929ded46ae032"><enum>(4)</enum><text>make advance,
			 progress, and other payments relating to National Institutes for Food and
			 Agriculture programs without regard to the subsections (a) and (b) of section
			 3324 of title 31, United States Code;</text>
					</paragraph><paragraph id="ID259b2170ff274fb09ad10d80f56d8fb2"><enum>(5)</enum><text>acquire by
			 purchase, lease, loan, gift, or condemnation, and hold and dispose of by grant,
			 sale, lease, or loan, real and personal property of all kinds necessary for, or
			 resulting from, the exercise of authority under this Act;</text>
					</paragraph><paragraph id="ID6e2147c253d14b3abfee7f44853c77f1"><enum>(6)</enum><text>receive and use
			 donated funds, if the funds are donated without restriction other than that the
			 funds be used in furtherance of National Institutes for Food and Agriculture
			 programs or 1 or more of the purposes of this Act;</text>
					</paragraph><paragraph id="IDd4735a241fab4fd1b789afde855e27d3"><enum>(7)</enum><text>publish or
			 arrange for the publication of information so as to further the full
			 dissemination of information of value consistent with the purposes of this Act
			 and the national interest, without regard to section 501 of title 44, United
			 States Code;</text>
					</paragraph><paragraph id="ID68dcdee95f504a77a055b8232cde48eb"><enum>(8)</enum><text>accept and use
			 the services of voluntary and uncompensated personnel, and provide such
			 transportation and subsistence as are authorized by section 5703 of title 5,
			 United States Code, for persons serving without compensation;</text>
					</paragraph><paragraph id="ID999e1ccb54b14cf3938e2bcd51e93efd"><enum>(9)</enum><text>prescribe, with
			 the approval of the Comptroller General of the United States, the extent to
			 which vouchers for funds expended under contracts for authorized activities
			 shall be subject to itemization or substantiation prior to payment, without
			 regard to the limitations of other laws relating to the expenditure and
			 accounting of public funds; and</text>
					</paragraph><paragraph id="ID5467cc821be842308d6283758120fb02"><enum>(10)</enum><text>arrange with and
			 reimburse the Secretary and the heads of other Federal agencies for the
			 performance of any activity that the National Institutes for Food and
			 Agriculture is authorized to conduct.</text>
					</paragraph></subsection><subsection id="IDe8d4f1870b0248faa4d41acccc1154dc"><enum>(d)</enum><header>Consultation</header><text>The
			 Director shall consult with the Secretary on an ongoing basis to ensure that
			 the national interest is being served by the administration of the National
			 Institutes for Food and Agriculture, National Institutes for Food and
			 Agriculture programs, and other authorities provided under this Act.</text>
				</subsection><subsection id="IDd0dcccd4c828438d98d8bc90536de7cf"><enum>(e)</enum><header>Reporting</header><text>Not
			 later than December 31, 2007, and biennially thereafter, the Director shall
			 submit to the Secretary, the Committee on Agriculture of the House of
			 Representatives, the Committee on Agriculture, Nutrition, and Forestry of the
			 Senate, the Committee on Appropriations of the House of Representatives, and
			 the Committee on Appropriations of the Senate a comprehensive report that
			 describes the National Institutes for Food and Agriculture programs and related
			 activities funded, initially implemented, and otherwise carried out by the
			 National Institutes for Food and Agriculture during the period covered by the
			 report.</text>
				</subsection></section><section id="idD5D800429E82438A9613595510454AFA"><enum>102.</enum><header>Offices;
			 administration</header>
				<subsection id="IDab3762fa8a864dcf9cfbf2106a903b3e"><enum>(a)</enum><header>Location</header><text>The
			 National Institutes for Food and Agriculture shall be located in Washington,
			 District of Columbia.</text>
				</subsection><subsection id="IDa02e72a1e9934d5dbcb2bf843fd2b3a7"><enum>(b)</enum><header>Director</header>
					<paragraph id="IDc576ed10338749968bd78766b6ceb00f"><enum>(1)</enum><header>Appointment</header>
						<subparagraph id="id0DD91FF7C7034D688745FFDC7928E5B7"><enum>(A)</enum><header>In
			 general</header><text>The Director shall be—</text>
							<clause id="id39E248B715B1453EB7FC194AD808E8E4"><enum>(i)</enum><text>a
			 distinguished expert in 1 or more National Institutes for Food and Agriculture
			 programs (or issues addressed by or fields relating to those programs);
			 and</text>
							</clause><clause id="id4074B31CE228462094769D4AE6C76A7E"><enum>(ii)</enum><text>appointed by the
			 President, by and with the advice and consent of the Senate.</text>
							</clause></subparagraph><subparagraph id="id147A96979EA84D50A60F1F6D6EE2026D"><enum>(B)</enum><header>Recommendations</header><text>Before
			 any person is appointed as Director, the President shall afford the Council an
			 opportunity to make recommendations to the President with respect to the
			 appointment.</text>
						</subparagraph><subparagraph id="idEC9E0268A1A8439ABE6F09A1F92F4A28"><enum>(C)</enum><header>Rate of
			 pay</header><text>The Director shall receive basic pay at the rate provided for
			 level II of the Executive Schedule under section 5513 of title 5, United States
			 Code.</text>
						</subparagraph></paragraph><paragraph id="IDb95b5cafeb7d49ccb6363c8dc88bb942"><enum>(2)</enum><header>Term</header><text>The
			 Director shall serve for a single, 6-year term.</text>
					</paragraph><paragraph id="IDa3bd436591bb40aab3e56ca8176f0ba9"><enum>(3)</enum><header>Authority</header><text>Except
			 as may be otherwise provided in this Act—</text>
						<subparagraph id="ID06e5db0bd269432ea31675c52e3a227c"><enum>(A)</enum><text>the Director
			 shall—</text>
							<clause id="IDb381235c786c481db58fb77c89d25011"><enum>(i)</enum><text>exercise all of
			 the authority granted to the National Institutes for Food and Agriculture by
			 this Act;</text>
							</clause><clause id="IDfd7cf4f638b24e6dbf9a807de033460a"><enum>(ii)</enum><text>in
			 consultation with the Council, formulate programs in accordance with policies
			 adopted by the National Institutes for Food and Agriculture;</text>
							</clause><clause id="IDf1accd2311e544acb4c9b3ac26fe8760"><enum>(iii)</enum><text>establish
			 committees and offices within the National Institutes for Food and Agriculture,
			 as appropriate;</text>
							</clause><clause id="IDa743d444c0c54618b9cf414df0d5a5a3"><enum>(iv)</enum><text>establish
			 procedures for the provision and administration of capacity program funding and
			 competitive program grants by the National Institutes for Food and Agriculture
			 in accordance with this Act and other applicable law;</text>
							</clause><clause id="ID0554b7c4df7a4c3e90609080a7ed53f1"><enum>(v)</enum><text>establish
			 procedures for the peer or merit review of National Institutes for Food and
			 Agriculture program activities in accordance with this Act and other applicable
			 law, as appropriate;</text>
							</clause><clause id="ID6cab2e45acf04517bac99a17918f6e70"><enum>(vi)</enum><text>assess the
			 personnel needs of research, education, extension, and other fields in the
			 areas supported by National Institutes for Food and Agriculture programs;
			 and</text>
							</clause><clause id="ID9843dfa644e24b21b65fe0629a2a160b"><enum>(vii)</enum><text>cooperate with
			 the Council to plan programs that assist in meeting the future personnel needs
			 of disciplines and activities in the areas supported by National Institutes for
			 Food and Agriculture programs, including portable fellowship and training
			 programs, as applicable; and</text>
							</clause></subparagraph><subparagraph id="ID611b6a886e634035a637cf6b1e44382b"><enum>(B)</enum><text>all actions taken
			 by the Director pursuant to this Act shall be final and binding upon the
			 National Institutes for Food and Agriculture.</text>
						</subparagraph></paragraph><paragraph id="ID3e6c5133f51140d0a14f74ecc89a85ba"><enum>(4)</enum><header>Delegation and
			 redelegation of functions</header><text>The Director may, from time to time,
			 establish such procedures as the Director determines to be appropriate to
			 authorize the performance by any other officer, agency, or employee of the
			 National Institutes for Food and Agriculture of any of the functions of the
			 Director under this Act.</text>
					</paragraph><paragraph id="IDa7c847eb430d470a81153744b3bff41d"><enum>(5)</enum><header>Formulation of
			 programs</header><text>The formulation of programs in accordance with the
			 policies of the National Institutes for Food and Agriculture shall be carried
			 out by the Director, in consultation with the Council.</text>
					</paragraph><paragraph id="IDdeec09215ff84649b1b730d5a946ad50"><enum>(6)</enum><header>Authority to
			 grant and contract</header><text>The Director may make grants and enter into
			 contracts and other arrangements pursuant to this Act and other applicable
			 law.</text>
					</paragraph><paragraph id="ID7522b811716f46ebb0f0be306db818e4"><enum>(7)</enum><header>Status; power
			 to vote and hold office</header>
						<subparagraph id="id3296034055B44A3AACB32764E0A20E49"><enum>(A)</enum><header>In
			 general</header><text>The Director shall—</text>
							<clause id="id824B874C411A44FFAF0B50A568995C87"><enum>(i)</enum><text>serve as a voting
			 ex officio member of the Council; and</text>
							</clause><clause id="idB1F162D1681949ABB44AF58FF912D309"><enum>(ii)</enum><text>except with
			 respect to compensation and tenure, serve in a manner commensurate with the
			 other members of the Council.</text>
							</clause></subparagraph><subparagraph id="id4533BC7015114C5688D01AC56BC821F2"><enum>(B)</enum><header>Election</header><text>The
			 Director shall be eligible for election by the Council as Chairperson or Vice
			 Chairperson of the Council.</text>
						</subparagraph></paragraph></subsection><subsection id="IDd416bb1c3b604310b85518889eb6f4b3"><enum>(c)</enum><header>Staff
			 appointment</header><text display-inline="yes-display-inline">The Director
			 shall, in accordance with such policies as the Council may from time to time
			 establish, recruit, hire, prescribe, appoint, and fix the compensation of such
			 personnel as are necessary to carry out this Act, including the appointment,
			 for a limited term or on a temporary basis, of appropriate—</text>
					<paragraph id="id511F30CFAC264E58BE5AC77B6EEFF134"><enum>(1)</enum><text>scientific and
			 other expert and accomplished staff; and</text>
					</paragraph><paragraph id="id779162D628E5419B972098ED5E20B97C"><enum>(2)</enum><text>other technical
			 and professional personnel on leave of absence from academic, industrial, or
			 research institutions.</text>
					</paragraph></subsection><subsection id="ID61ea9978d92847de8681b658fe76ae56"><enum>(d)</enum><header>Rotating
			 credentialed staff</header>
					<paragraph id="id4C277F68D836415A8948322E93A548FD"><enum>(1)</enum><header>In
			 general</header><text>The Director shall be assisted by an
			 appropriately-credentialed staff of experts in—</text>
						<subparagraph id="idF2799B90B18540328B2209F6032CA7FA"><enum>(A)</enum><text>National
			 Institutes for Food and Agriculture programs; and</text>
						</subparagraph><subparagraph id="idCB8D2EAFB94845FC974E4B1CBB040878"><enum>(B)</enum><text>issues addressed
			 by, and fields relating to, those programs.</text>
						</subparagraph></paragraph><paragraph id="id7A6AAB736EB24BC98283E7E66F408CA6"><enum>(2)</enum><header>Requirements</header><text>Credentialed
			 staff members described in paragraph (1) shall be—</text>
						<subparagraph id="idD1B15559055D472B894BFFF2A041C158"><enum>(A)</enum><text>recruited from
			 the community of National Institutes for Food and Agriculture programs or
			 related fields; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB8666277BC2D41849A3566D56E4C894B"><enum>(B)</enum><text>appointed by the
			 Director to serve on the basis of 4-year rotating appointments.</text>
						</subparagraph></paragraph></subsection><subsection id="IDc7c4159a32564aa5990925fcd8c32e58"><enum>(e)</enum><header>Temporary
			 staff</header><text>Staff hired by the Director under this section may include
			 researchers, scientists, and other credentialed, technical, or professional
			 personnel hired for limited terms, or on temporary bases, including individuals
			 on leave of absence from academic, industry, research, science, or other
			 institutions.</text>
				</subsection><subsection id="IDaca014e7a20e4a34a316fd64d069700c"><enum>(f)</enum><header>Volunteers</header>
					<paragraph id="id7C3247655705453F8BCCD9111C1E895C"><enum>(1)</enum><header>In
			 general</header><text>The Director may accept the services of voluntary,
			 uncompensated personnel, on appropriate terms and conditions and in accordance
			 with other applicable law.</text>
					</paragraph><paragraph id="idAFED0F07E8584B00B06D87CDA1F0030F"><enum>(2)</enum><header>Freedom from
			 liability</header><text>Voluntary personnel described in paragraph (1) shall be
			 held free from liability in accordance with the Volunteer Protection Act of
			 1997 (42 U.S.C. 14501 et seq.).</text>
					</paragraph></subsection><subsection id="IDba6e27d1d9134b30989e92a97037f837"><enum>(g)</enum><header>Transfer of
			 funds from other government departments or agencies</header>
					<paragraph id="id4D84730B2DF441DC8B160AB7F2F13A4A"><enum>(1)</enum><header>In
			 general</header><text>Funds available to the Department, or any other
			 department or agency of the Federal Government for activities that are
			 analogous to, or could contribute to the purposes or goals of, National
			 Institutes for Food and Agriculture programs, other relevant research,
			 extension, or education programs, or related or other relevant activities,
			 shall be available for transfer, in whole or in part, to the National
			 Institutes for Food and Agriculture, with the approval of the Secretary or the
			 head of the other appropriate department or agency transferring the funds, for
			 such use as is consistent with the purposes for which the funds were initially
			 made available.</text>
					</paragraph><paragraph id="idB185113C9DD340879571C7A8F658D8E3"><enum>(2)</enum><header>Use of
			 funds</header><text>Funds transferred under paragraph (1) shall be expendable
			 by the National Institutes for Food and Agriculture for the purposes for which
			 the transfer was made.</text>
					</paragraph></subsection><subsection id="IDa82ed5d90cd842298667fe3e2284b40e"><enum>(h)</enum><header>Standing
			 council of advisors</header>
					<paragraph id="ID7db4a8bcb2d844df9e337c653322071d"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a Standing Council of Advisors,</text>
					</paragraph><paragraph id="id7FA7FB13D0E74FCE976DEC8B638A8939"><enum>(2)</enum><header>Membership</header>
						<subparagraph id="idBD98DF6C792248CE9362FD3EC46DD695"><enum>(A)</enum><header>Composition</header><text>The
			 Council shall be composed of 13 members, of which—</text>
							<clause id="idEE8967413EE84E729483D170CB3241DD"><enum>(i)</enum><text>1
			 member shall be the Director; and</text>
							</clause><clause id="id3D2C9A0533A3462A9B14293D9D3D7AE4"><enum>(ii)</enum><text>12
			 members shall be qualified non-Federal stakeholders appointed in accordance
			 with subparagraph (B) who are distinguished members of the public, including
			 representatives of—</text>
								<subclause id="idA7331EEDAB314CE8A6D35484DABE57F1"><enum>(I)</enum><text>agriculture,
			 food, nutrition, and forestry organizations;</text>
								</subclause><subclause id="id37E76A1C197C418A9E6060D9C581167A"><enum>(II)</enum><text>industry;
			 and</text>
								</subclause><subclause id="id97865AD1AD9D417687166D208F5A62F1"><enum>(III)</enum><text>the scientific,
			 research, education, extension, international, stakeholder, consumer, customer,
			 family, community and youth, and professional entities in whose interest the
			 National Institutes for Food and Agriculture is authorized to carry out
			 National Institutes for Food and Agriculture programs and related
			 activities.</text>
								</subclause></clause></subparagraph><subparagraph id="ID23eb34fcbcdc4c11a0d0403955153bcd"><enum>(B)</enum><header>Appointments</header><text>Of
			 the members of the Council described in subparagraph (A)(ii)—</text>
							<clause id="id24B3906EAAAD4C7CA5EFB3CC05417855"><enum>(i)</enum><text>4
			 members shall be—</text>
								<subclause id="idB2F5DAB1E16848AC992D7D88581F7E4F"><enum>(I)</enum><text>appointed by the
			 Secretary, with the consent of the Director;</text>
								</subclause><subclause id="id404B96EDD19149A382E6C0C1E598F45E"><enum>(II)</enum><text>selected on the
			 basis of established records of expertise and distinguished accomplishment;
			 and</text>
								</subclause><subclause id="id3B26F959A25F40BBA7045E9D07AB5DC5"><enum>(III)</enum><text>selected so as
			 to provide representation across the spectrum of views of National Institutes
			 for Food and Agriculture programs and related fields from all regions of the
			 United States, taking into consideration the need for representation from the
			 State, local, and tribal levels;</text>
								</subclause></clause><clause id="id38D67DAD542E45DC9102488ABEDBEE01"><enum>(ii)</enum><text>4
			 members shall be—</text>
								<subclause id="id8950625471544CF68B5D655AC4D42044"><enum>(I)</enum><text>appointed by the
			 Chairman and Ranking Member of the Committee on Agriculture of the House of
			 Representatives, with the consent of the Director; and</text>
								</subclause><subclause id="id9523986237F84B5CBF9D3EB5F7B93562"><enum>(II)</enum><text>selected so as
			 to provide representation of the views of stakeholder leaders in all regions of
			 the United States, taking into consideration the need for representation from
			 the State, local, and tribal levels; and</text>
								</subclause></clause><clause id="id48E66ED0256349058785056C13BE2A5F"><enum>(iii)</enum><text>4
			 members shall be—</text>
								<subclause id="id3F7917D885ED45A1A2E8F43D3C4CA631"><enum>(I)</enum><text>appointed by the
			 Chairman and Ranking Member of the Committee on Agriculture, Nutrition, and
			 Forestry of the Senate, with the consent of the Director; and</text>
								</subclause><subclause id="id1A773F3160664CD0B9504F6D6C872A1F"><enum>(II)</enum><text>selected so as
			 to provide representation of the views of stakeholder leaders in all areas of
			 the United States, taking into consideration the need for representation from
			 the State local, and tribal levels.</text>
								</subclause></clause></subparagraph><subparagraph id="id84CF5ECD0ABE43A0AC2556D8A4FB786E"><enum>(C)</enum><header>Term</header><text>Each
			 of the groups of 4 members appointed under clauses (i) through (iii) of
			 subparagraph (B) shall be appointed to 4-year, staggered terms.</text>
						</subparagraph></paragraph><paragraph id="IDe318a52825a642ad88ae72b09620d74c"><enum>(3)</enum><header>Duties</header>
						<subparagraph id="id981C6F0E3AE24533A208078A30835F88"><enum>(A)</enum><header>In
			 general</header><text>The Council shall assist the Director in—</text>
							<clause id="id19A065D70E5344A596D9BEF02B329C8B"><enum>(i)</enum><text>establishing
			 priorities of the National Institutes for Food and Agriculture; and</text>
							</clause><clause id="id7C30A6B6EB654B9A9018A404F212D4B9"><enum>(ii)</enum><text>reviewing,
			 judging, and maintaining the relevance of National Institutes for Food and
			 Agriculture programs.</text>
							</clause></subparagraph><subparagraph id="id0A180055F62F4B5290681D8D30556936"><enum>(B)</enum><header>Oversight
			 review</header><text>To ensure that the purposes of this Act and the needs of
			 the United States are being met, the Council shall conduct an annual oversight
			 review of—</text>
							<clause id="id26CB0D6E320E4A019DCB36113C7DB85A"><enum>(i)</enum><text>the
			 administration of the National Institutes for Food and Agriculture;</text>
							</clause><clause id="idA57FF70F8F2241A68F88AA7A32C409AF"><enum>(ii)</enum><text>activities
			 funded through the capacity programs;</text>
							</clause><clause id="id2B7D19B36F8C45F08BCBD6C96A70973A"><enum>(iii)</enum><text>proposals and
			 other activities funded through the competitive programs; and</text>
							</clause><clause id="idF52E393DA0BC462A955C0C989DEAEEC8"><enum>(iv)</enum><text>other activities
			 of the National Institutes for Food and Agriculture.</text>
							</clause></subparagraph></paragraph><paragraph id="IDf184de56b57944a5a182403418159631"><enum>(4)</enum><header>Meetings</header>
						<subparagraph id="idAFDCC6098BF74EE0900C04D01A0C0146"><enum>(A)</enum><header>In
			 general</header><text>The Council shall hold periodic meetings to provide an
			 interface between the Council and stakeholders, and to ensure that the National
			 Institutes for Food and Agriculture is linking national goals with realistic
			 opportunities.</text>
						</subparagraph><subparagraph id="idB6AC5EA35D35409384D2F72AF368688A"><enum>(B)</enum><header>Frequency</header><text>Meetings
			 described in subparagraph (A) shall be held at the call of the Director, or at
			 the joint call of the Director and the Secretary, but not less often than twice
			 annually.</text>
						</subparagraph></paragraph><paragraph id="ID6aa49ec666d849fe9021c5cf96803128"><enum>(5)</enum><header>Expenses</header>
						<subparagraph id="ID164c5dcfe51d4bc589806d009879fdba"><enum>(A)</enum><header>In
			 general</header><text>The Director shall, from any administrative funds
			 otherwise available to the National Institutes for Food and Agriculture, pay
			 the reasonable expenses incurred by the Council in holding meetings and
			 conducting related activities, as determined to be appropriate by the
			 Director.</text>
						</subparagraph><subparagraph id="ID90d974736fc748a8969f404f054bc90b"><enum>(B)</enum><header>Limitation</header><text>The
			 expenses of the Council paid by the Director under subparagraph (A) shall not
			 be counted toward any general limitation on the expenses of advisory
			 committees, panels, commissions, or task forces of the Department contained in
			 any Act making appropriations for the Department, whether enacted before, on,
			 or after the date of enactment of this Act, unless the Act of appropriation
			 specifically—</text>
							<clause id="id733CC3E50BE94A29BBE87638517C32A7"><enum>(i)</enum><text>refers to this
			 paragraph; and</text>
							</clause><clause id="idE85572F07ABF46F18F2CC4A959FB0572"><enum>(ii)</enum><text>includes the
			 Council within the general limitation.</text>
							</clause></subparagraph></paragraph></subsection></section><section id="idE0F25590ED7147ADBE41E6B9A7184D9C"><enum>103.</enum><header>Organization
			 of National Institutes for Food and Agriculture</header>
				<subsection id="IDeccf75f9cc54429599616bebeb1ccec7"><enum>(a)</enum><header>Organization</header>
					<paragraph id="idF552BBCCEB244A109FCC9164F0A4B17F"><enum>(1)</enum><header>In
			 general</header><text>The Director shall organize the National Institutes for
			 Food and Agriculture into 6 institutes (referred to in this section as
			 <term>individual institutes</term>) to administer the programs and activities
			 of the National Institutes for Food and Agriculture in an integrated,
			 multidisciplinary, interdisciplinary, transdisciplinary, interagency, and
			 inter-institutional manner, to the maximum extent practicable.</text>
					</paragraph><paragraph id="ID9a1a9b5526e6427c982949c69d0966e3"><enum>(2)</enum><header>Institutes</header><text>The
			 individual institutes shall be the following:</text>
						<subparagraph id="ID11a166c1864d41919684641a19731829"><enum>(A)</enum><text>The Institute for
			 Economic Opportunities in Agriculture and Natural Resources.</text>
						</subparagraph><subparagraph id="ID6c61c01a5b15455daf436640f5d28d25"><enum>(B)</enum><text>The Institute for
			 Nutrition and Health.</text>
						</subparagraph><subparagraph id="IDe68e7c617c4b405ab90b713e416b3fe7"><enum>(C)</enum><text>The Institute for
			 Rural and Urban Community Development.</text>
						</subparagraph><subparagraph id="ID3084268d3cfa4a419c5b38f4f33da757"><enum>(D)</enum><text>The Institute for
			 Natural Resources and Environment.</text>
						</subparagraph><subparagraph id="IDb3de218df34a409c9d721298d9e3edc4"><enum>(E)</enum><text>The Institute for
			 Food Safety and Agricultural Security.</text>
						</subparagraph><subparagraph id="ID3e7f4d799a0d46348172d8d81cf2ca59"><enum>(F)</enum><text>The Institute for
			 Families, Youth, and Communities.</text>
						</subparagraph></paragraph><paragraph id="idC1903E3385CA4E148B97E5A7EB92CBDB"><enum>(3)</enum><header>Administration</header>
						<subparagraph id="idA64732309312420DA715157E9887DC57"><enum>(A)</enum><header>In
			 general</header><text>The Director, in conjunction with the head of each
			 individual institute, shall carry out National Institutes for Food and
			 Agriculture programs with the goal of focusing those programs, and the
			 participants, grantees, and other stakeholders of those programs on—</text>
							<clause id="idABAB6EF1FA384D8FBAA90329FE9BAD5B"><enum>(i)</enum><text>understanding
			 important problem areas and opportunities relating to a program;</text>
							</clause><clause id="id4070D397BC8E4126BAAFAC28EC1F36F4"><enum>(ii)</enum><text>discovering and
			 implementing solutions to address those problem areas; and</text>
							</clause><clause id="id1BD6696414B24160B087C70A25F832AA"><enum>(iii)</enum><text>exploring other
			 opportunities provided under the programs.</text>
							</clause></subparagraph><subparagraph id="idDD38727CAC794A2A88F3DB19F448EECF"><enum>(B)</enum><header>Stakeholder
			 input</header><text>The Director, in consultation with the Council and the head
			 of each individual institute, shall solicit input from appropriate
			 participants, grantees, and other stakeholders of the programs and activities
			 of the National Institutes for Food and Agriculture relating to the problem
			 areas, opportunity areas, solution areas, and Institute programs and related
			 activities carried out by the National Institutes for Food and
			 Agriculture.</text>
						</subparagraph></paragraph><paragraph id="id9D95F25AABC242AAA86BBAB794AFD88F"><enum>(4)</enum><header>Modification of
			 organization</header><text>Beginning on October 1 of the fifth full fiscal year
			 beginning after the date of enactment of this Act, the Director, in
			 consultation with the Secretary and the Council, may include in a report
			 required under section 101(e) any recommendation of the Director with respect
			 to the organization of the National Institutes for Food and Agriculture or the
			 individual institutes, as the Director determines to be in the best interest of
			 the United States.</text>
					</paragraph></subsection><subsection id="IDc5168292d3a74ae8a35586e1d3c21433"><enum>(b)</enum><header>Program
			 integration and coordination</header>
					<paragraph id="id47EF8BDF997547F4A8F5EF51B0B5599C"><enum>(1)</enum><header>In
			 general</header><text>In accordance with applicable law (including
			 regulations), the Director, in coordination with the head of each individual
			 institute and taking into consideration the advice of the Council, shall
			 ensure, to the maximum extent practicable, that National Institutes for Food
			 and Agriculture programs are administered, funded, and carried out—</text>
						<subparagraph id="id2B856819124B4E90B800209C0091E7F2"><enum>(A)</enum><text>in an integrated,
			 multidisciplinary, interdisciplinary, transdisciplinary, interagency, and
			 inter-institutional manner that ensures—</text>
							<clause id="id8B8D81859C514E2DAC623618FEA81D13"><enum>(i)</enum><text>the
			 most efficient collaborative use of resources; and</text>
							</clause><clause id="id3C5631189700468E88DD581F4D121713"><enum>(ii)</enum><text>the focus of all
			 resources and activities on strategic, priority, problem, opportunity, and
			 solution areas identified by the Director and the head of each applicable
			 individual institute, taking into consideration the advice of the
			 Council;</text>
							</clause></subparagraph><subparagraph id="idAE92968C85D74DC6BFC39AD2A96D3D00"><enum>(B)</enum><text>among applicable
			 participants, grantees, and stakeholders, in a coordinated manner that
			 encourages and ensures—</text>
							<clause id="id0BC124FB5EC842BAA1551A1FB8FAA900"><enum>(i)</enum><text>the
			 most efficient collaborative application of resources; and</text>
							</clause><clause id="id396124617EE3406B9BFDEAEF7F9EF613"><enum>(ii)</enum><text>the focus of all
			 resources and activities on strategic, priority, problem, opportunity, and
			 solution areas on a local, State, Indian tribal, regional, national, and
			 international basis, as the Director and the head of each applicable individual
			 institute, taking into consideration the advice of the Council, determine to be
			 appropriate.</text>
							</clause></subparagraph></paragraph><paragraph id="idE060E1188EF24C68AF688EE38CC8A3BE"><enum>(2)</enum><header>Scope</header><text>The
			 Director, in consultation with the Secretary and the Council, shall ensure,
			 through the integration and coordination under paragraph (1), that
			 opportunities are maximized with respect to—</text>
						<subparagraph id="idD456F8832AF34DDE8FF67256C9D4C5C5"><enum>(A)</enum><text>the use of
			 appropriate authorities, agencies, institutions, disciplines, and activities of
			 the National Institutes for Food and Agriculture; and</text>
						</subparagraph><subparagraph id="id5032EEDD821D49D69139DC5837E31E88"><enum>(B)</enum><text>the inclusion of
			 appropriate participants and other stakeholders in those activities, including
			 intramural, extramural, government, university, extension, international, and
			 other appropriate stakeholders, as determined by the Director.</text>
						</subparagraph></paragraph></subsection><subsection id="IDd256fc83bd714a838002f2012500da1f"><enum>(c)</enum><header>Matching and
			 leveraging of scarce budget resources</header><text>The National Institutes for
			 Food and Agriculture and the Director shall provide for the matching and
			 leveraging of National Institutes for Food and Agriculture resources by
			 intramural activity and extramural activity program participants and
			 recipients—</text>
					<paragraph id="IDd3d57b5796dd4ba3a89991e6a26468e5"><enum>(1)</enum><text>in accordance
			 with applicable law governing the applicable capacity program, competitive
			 program, or other authority or activity; or</text>
					</paragraph><paragraph id="ID65c8c8c928e54e199e38d82cb8253105"><enum>(2)</enum><text>if not otherwise
			 provided for by law, as the Director, in consultation with the Council,
			 determines to be appropriate, taking into consideration—</text>
						<subparagraph id="id36CAF47651D34E79B5AE8241777A4BF4"><enum>(A)</enum><text>the ability of
			 the participating or recipient institutions or entities to provide matching
			 funds; and</text>
						</subparagraph><subparagraph id="id2F3151F7124647EEBE85FCC915210BF7"><enum>(B)</enum><text>the treatment of
			 the institutions or entities with respect to matching fund and similar
			 requirements under other authorities.</text>
						</subparagraph></paragraph></subsection><subsection id="ID1ad7c777b1c34b6e830c2b6bd42e7fad"><enum>(d)</enum><header>Funding
			 administration</header>
					<paragraph id="ID6acd388b6b6c4d3793d230ac8716c53c"><enum>(1)</enum><header>Capacity
			 programs</header><text>In accordance with other applicable law, in providing
			 program funding to a particular institution or entity, the Director shall
			 develop, in consultation with the Council, and implement, a streamlined plan of
			 work or administrative model designed to simplify, to the maximum extent
			 practicable, the administration, funding, and oversight of capacity
			 programs.</text>
					</paragraph><paragraph id="IDebfc5c02b66d4485a7e162029d230024"><enum>(2)</enum><header>Competitive
			 programs</header><text>In accordance with other applicable law, in making
			 determinations regarding whether to provide program funding to a particular
			 institution, entity, or applicant (as applicable), the Director shall, whenever
			 practicable, implement an administrative model designed to streamline and
			 simplify, to the maximum extent practicable, the application (as applicable),
			 administration, funding, and oversight process.</text>
					</paragraph></subsection></section><section id="id34FECE71DED944EB9F6FF437918D68D7"><enum>104.</enum><header>Funding</header>
				<subsection id="idCC2DFA0217784C9D91AF6FF544E218C9"><enum>(a)</enum><header>Preservation of
			 critical base funding</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 funds provided to National Institutes for Food and Agriculture programs shall
			 be allocated and distributed in accordance with subsection (b).</text>
				</subsection><subsection id="id1D1EE0BCCEA8430DBBF74BC2BA287A5A"><enum>(b)</enum><header>Distribution of
			 funds</header>
					<paragraph id="id1CD9866B92884304AEAE03FF1FF119D3"><enum>(1)</enum><header>Priority for
			 critical base funds</header><text>In distributing funds to carry out capacity
			 programs and competitive programs during a fiscal year, the Director
			 shall—</text>
						<subparagraph id="id1BD263F624FB4C599987DA27D70BC3BC"><enum>(A)</enum><text>first, use funds
			 made available in an amount less than or equal to the capacity program critical
			 base funding level only to carry out capacity programs, in accordance with
			 paragraph (2); and</text>
						</subparagraph><subparagraph id="idE144A1E2043946E0B4119E8292A334E6"><enum>(B)</enum><text>after funds equal
			 to the capacity program critical base funding level have been allocated for
			 capacity programs for the fiscal year, use any funds made available only to
			 carry out competitive programs, until funds are allocated in an amount equal to
			 the competitive program critical base funding level.</text>
						</subparagraph></paragraph><paragraph id="idB23303C1EA294D43A0A455BE1E49AB19"><enum>(2)</enum><header>Proportional
			 funding of capacity programs</header><text>The Director shall apportion funds
			 distributed under paragraph (1)(A) in accordance with the proportion
			 that—</text>
						<subparagraph id="idB162B884B9FE40ED916D24137727EDC6"><enum>(A)</enum><text>the amount
			 received by each applicable capacity program for fiscal year 2007; bears
			 to</text>
						</subparagraph><subparagraph id="id69DCF869C8744CB8A6D4CA7FBC13F359"><enum>(B)</enum><text>the total amount
			 made available for all capacity programs for fiscal year 2007.</text>
						</subparagraph></paragraph><paragraph id="id3F7FBCCBABA546A79E0C8D9E4EC4BFF6"><enum>(3)</enum><header>Other than
			 critical base funds</header><text>In distributing funds to carry out capacity
			 programs and competitive programs during a fiscal year, the Director shall use
			 in accordance with section 105(c)—</text>
						<subparagraph id="id8348EC631B924615973B89D3E434D6F5"><enum>(A)</enum><text>amounts made
			 available in excess of the sum of the capacity program critical base funding
			 level and the competitive program critical base funding level; and</text>
						</subparagraph><subparagraph id="id970C2D6EBF2548D186421C7114E44E6A"><enum>(B)</enum><text>amounts made
			 available pursuant to section 105(a).</text>
						</subparagraph></paragraph></subsection></section><section id="id97D900E6A08F49ACADF84A24356A216C"><enum>105.</enum><header>Enhanced
			 funding</header>
				<subsection id="id3FD6979FBF9C40AFBDEA7DCEA8008BB6"><enum>(a)</enum><header>Continuation of
			 mandatory funding</header>
					<paragraph id="IDfc425f293a974a539b67b0b31686c39a"><enum>(1)</enum><header>In
			 general</header><text>Beginning on October 1, 2007, and each October 1
			 thereafter, the Secretary shall transfer to the Director $200,000,000 of funds
			 of the Commodity Credit Corporation to carry out this Act.</text>
					</paragraph><paragraph id="ID1ceb42e8d00d484a8611d6c46fda4863"><enum>(2)</enum><header>Budgetary
			 offset</header><text>Section 401(b)(3) of the Agricultural Research, Extension,
			 and Education Reform Act of 1998 (7 U.S.C. 7621(b)(3)) is amended—</text>
						<subparagraph id="id11133807D9CE4888A83B5B0407ABB7E9"><enum>(A)</enum><text>in subparagraph
			 (B), by adding <quote>and</quote> at the end;</text>
						</subparagraph><subparagraph id="id8D724C2A413D44CD899E4B049D285BD8"><enum>(B)</enum><text>in subparagraph
			 (C), by striking <quote>; and</quote> at the end and inserting a period;
			 and</text>
						</subparagraph><subparagraph id="idC71A359684D04A71914B232890594888"><enum>(C)</enum><text>by striking
			 subparagraph (D).</text>
						</subparagraph></paragraph></subsection><subsection id="ID25d774122aa54e769f1dc5a2a079f1ac"><enum>(b)</enum><header>Increasing
			 currently authorized funding</header><text>Notwithstanding any other provision
			 of law, except as otherwise provided in this section, there are authorized to
			 be appropriated to the Director to carry out programs of the National
			 Institutes for Food and Agriculture under this Act amounts equal to a level of
			 the authorized funding for each such program as in effect on the day before the
			 date of enactment of this Act, to be phased in as follows:</text>
					<paragraph id="ID095210308e144fed8f440356354dbaa6"><enum>(1)</enum><text>For fiscal year
			 2008, 114.3 percent of the level.</text>
					</paragraph><paragraph id="IDfd71788f5f4c486fba0810c256b448b8"><enum>(2)</enum><text>For fiscal year
			 2009, 128.6 percent of the level.</text>
					</paragraph><paragraph id="ID3d7ae803bbec4f1a8c4d074a432f8135"><enum>(3)</enum><text>For fiscal year
			 2010, 142.9 percent of the level.</text>
					</paragraph><paragraph id="ID2c6a3023785b4e8aaa025b15c07bb54d"><enum>(4)</enum><text>For fiscal year
			 2011, 157.2 percent of the level.</text>
					</paragraph><paragraph id="ID9a2c2c2c8f324fd58d126aaa0e63ef80"><enum>(5)</enum><text>For fiscal year
			 2012, 171.5 percent of the level.</text>
					</paragraph><paragraph id="ID3a2154d51883454c89ab767e9c3592f1"><enum>(6)</enum><text>For fiscal year
			 2013, 185.8 percent of the level.</text>
					</paragraph><paragraph id="IDdf688dd7e75d432eb114b399d79765a9"><enum>(7)</enum><text>For fiscal year
			 2014 and thereafter, 200 percent of the level.</text>
					</paragraph></subsection><subsection id="IDf8389daa786446e9a584b45f6f3de5ba"><enum>(c)</enum><header>Distribution of
			 enhanced funding</header>
					<paragraph id="idA6F185A8EFD642B5BB0F69663774271E"><enum>(1)</enum><header>In
			 general</header><text>Any funds made available for a fiscal year for the
			 National Institutes for Food and Agriculture shall be distributed in accordance
			 with this subsection, if the funds are provided—</text>
						<subparagraph id="id4734814D9F6144D595DC008FD342C8F1"><enum>(A)</enum><text>under subsection
			 (a)(1); or</text>
						</subparagraph><subparagraph id="id5D2FF7165EEE457E9A6BEF8FACFFD0D1"><enum>(B)</enum><text>under any other
			 authority under this or any other Act in excess of an amount equal to the sum
			 of the capacity program critical base funding level and the competitive program
			 critical base funding level.</text>
						</subparagraph></paragraph><paragraph id="id6AFA03FD6DE4442AA25E1A158DE0DE5A"><enum>(2)</enum><header>Enhanced
			 competitive program funding</header>
						<subparagraph id="id86E3AC448E3641EBBBBF6C4EC5C972CE"><enum>(A)</enum><header>In
			 general</header><text>The Director shall use 70 percent of amounts described in
			 paragraph (1) to carry out competitive programs, of which—</text>
							<clause id="id67512AE0FE3C41009BDC3EFDB2A6CC9E"><enum>(i)</enum><text>55
			 percent shall be used to carry out fundamental research activities in
			 accordance with subparagraph (B); and</text>
							</clause><clause id="id81DA4B024A7340B0AD653592EDB1892A"><enum>(ii)</enum><text>45
			 percent shall be used to carry out competitive research activities other than
			 fundamental research activities in accordance with subparagraph (C),
			 including—</text>
								<subclause id="IDb8afac031f63423abf4a381655cb0b10"><enum>(I)</enum><text>integrated
			 programs and related activities;</text>
								</subclause><subclause id="IDdbb1e18a3fed4c01838461397c709f7a"><enum>(II)</enum><text>applied research
			 and related activities;</text>
								</subclause><subclause id="ID8b6bb50affee4849a9e380190d2b0e01"><enum>(III)</enum><text>translational
			 research and related activities;</text>
								</subclause><subclause id="ID7a8a2f166eed494780854e5d00bd0019"><enum>(IV)</enum><text>activities
			 substantially similar to activities carried out pursuant to the Initiative for
			 Future Agriculture and Food Systems under section 401 of the Agricultural
			 Research, Extension, and Education Reform Act of 1998 (7 U.S.C. 7621), as in
			 effect on the day before the date of enactment of this Act; and</text>
								</subclause><subclause id="ID861b576f37da44e3af058490823fc303"><enum>(V)</enum><text>education and
			 extension programs and activities (including grants for outreach, research, or
			 education).</text>
								</subclause></clause></subparagraph><subparagraph id="id32015CCE6B6F46FC9FDCBAD1933A9F4F"><enum>(B)</enum><header>Fundamental
			 research activities</header>
							<clause id="idF186C89D4C5E41C28E2854683B781C88"><enum>(i)</enum><header>Open
			 fundamental research pool</header><text>The Director shall allocate not less
			 than 80 percent of amounts described in subparagraph (A)(i) to eligible
			 applicants on a competitive basis, including applicants representing—</text>
								<subclause id="id51BBC004AAB34E7CA76EA4A5A2FBF303"><enum>(I)</enum><text>colleges,
			 universities, and other institutions of higher education;</text>
								</subclause><subclause id="idBA7314F8ADA24F03AE0D3A40446E2E18"><enum>(II)</enum><text>intramural
			 research activity entities of the National Institutes for Food and Agriculture;
			 and</text>
								</subclause><subclause id="id5562ED2F520B4B918794BB40E909CC88"><enum>(III)</enum><text>other
			 individuals and entities eligible to receive funding under the National
			 Research Initiative.</text>
								</subclause></clause><clause id="IDc8314c63aa0542f9a6473a5543e118f4"><enum>(ii)</enum><header>Reservation
			 and reversion</header>
								<subclause id="IDbb56114fb1a64898940c811e47770d3c"><enum>(I)</enum><header>In
			 general</header><text>The Director shall reserve 20 percent of amounts
			 described in subparagraph (A)(i) for allocation to 1890 Institutions, 1994
			 Institutions, Insular Area Institutions, and Small 1862 Land-Grant Institutions
			 on a competitive basis, subject to—</text>
									<item id="id455159E25C0A4240AF2E32150FD0C7FA"><enum>(aa)</enum><text>applicable peer
			 and merit review requirements of Federal law (including regulations);
			 and</text>
									</item><item id="id1E75BB6A264A468192F2472567E04E8A"><enum>(bb)</enum><text>such
			 other peer and merit review requirements as the Director determines to be
			 appropriate.</text>
									</item></subclause><subclause id="ID725fd23fdc3549618981330249af2164"><enum>(II)</enum><header>Reversion of
			 unused reserved funds</header><text>Any amounts reserved under subclause (I)
			 that are not allocated to institutions under that subclause by the end of the
			 2-year period following October 1 of the fiscal year for which the amounts are
			 first made available shall be allocated to open fundamental research pool
			 applicants on a competitive basis in accordance with clause (i).</text>
								</subclause></clause></subparagraph><subparagraph id="ID49190ae6093a40469e9dd7b720a63c9f"><enum>(C)</enum><header>Other research
			 activities</header>
							<clause id="id052F6A5525D74C7A94C2B15734F18C5C"><enum>(i)</enum><header>Open integrated
			 research pool</header><text>The Director shall allocate not less than 80
			 percent of amounts described in subparagraph (A)(ii) to eligible applicants on
			 a competitive basis, including applicants representing—</text>
								<subclause id="idB3BEB04B355747849DC865567207F15A"><enum>(I)</enum><text>colleges,
			 universities, and other institutions of higher education;</text>
								</subclause><subclause id="idC0A687042B4B41FA9BF8166EE55C52A4"><enum>(II)</enum><text>intramural
			 research activity entities of the National Institutes for Food and Agriculture;
			 and</text>
								</subclause><subclause id="idCC81D25075AD4E89BFCDC32851873BD9"><enum>(III)</enum><text>other
			 individuals and entities eligible to receive funding under the National
			 Research Initiative.</text>
								</subclause></clause><clause id="ID049d22fcd48d483884d9daaffd91e101"><enum>(ii)</enum><header>Reservation
			 and reversion</header>
								<subclause id="id7C6C63AAA7794DFDAC38DEFA8AB3687A"><enum>(I)</enum><header>In
			 general</header><text>The Director shall reserve 20 percent of amounts
			 described in subparagraph (A)(ii) for allocation to 1890 Institutions, 1994
			 Institutions, Insular Area Institutions, and Small 1862 Land-Grant Institutions
			 on a competitive basis, subject to—</text>
									<item id="id9C8FDC9024BC4F30B1855D59B59059F4"><enum>(aa)</enum><text>applicable peer
			 and merit review requirements of Federal law (including regulations);
			 and</text>
									</item><item id="id769306C2BFF941E7A9116FBA40C768AA"><enum>(bb)</enum><text>such
			 other peer and merit review requirements as the Director determines to be
			 appropriate.</text>
									</item></subclause><subclause id="idA3CB984EB614486D9C50E082783350B2"><enum>(II)</enum><header>Reversion of
			 unused reserved funds</header><text>Any amounts reserved under subclause (I)
			 that are not allocated to institutions under that subclause by the end of the
			 2-year period following October 1 of the fiscal year for which the amounts are
			 first made available shall be allocated to open integrated research pool
			 applicants on a competitive basis in accordance with clause (i).</text>
								</subclause></clause></subparagraph><subparagraph id="id47CF96D69D4C44AABB90741302A5B5E8"><enum>(D)</enum><header>Education and
			 extension integration</header><text>The Director shall integrate into
			 competitive programs of the National Institutes for Food and Agriculture
			 national and global educational and extension initiatives, to the maximum
			 extent practicable.</text>
						</subparagraph><subparagraph id="ID003dcdffcc434d42b60e2fb707c92a87"><enum>(E)</enum><header>Indirect
			 costs</header>
							<clause id="idB9634D6108274D28B990B6DBFBBB5EB8"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in clause (ii), the Director shall
			 provide for the payment of allowable indirect costs associated with competitive
			 programs of the National Institutes for Food and Agriculture in accordance with
			 section 1462 of the National Agricultural Research, Extension, and Teaching
			 Policy Act of 1977 (7 U.S.C. 3310).</text>
							</clause><clause id="idDA6A0BE2F503434BAB64979660836363"><enum>(ii)</enum><header>Exception</header><text>For
			 each of fiscal years 2008 through 2014, the Director shall ensure that
			 allowable indirect costs, associated with competitive programs of the National
			 Institutes for Food and Agriculture that are funded under section 104(b)(1)(B),
			 shall not be paid at a rate that exceeds the levels generally provided for
			 those competitive programs for fiscal year 2007.</text>
							</clause></subparagraph></paragraph><paragraph id="IDc1a554c4e2a641c7bb6acdd9265b7e24"><enum>(3)</enum><header>Enhanced
			 capacity program funding</header><text>The Director shall use 30 percent of
			 amounts described in paragraph (1) to carry out capacity programs, of
			 which—</text>
						<subparagraph id="idAA2DD8721097423B92B08EDFD06BA27D"><enum>(A)</enum><text>for each of
			 fiscal years 2008 through 2014—</text>
							<clause id="id8A6A00AF60B84EF781448638000F14F1"><enum>(i)</enum><text>77.5 percent
			 shall be allocated to capacity programs in accordance with the proportion
			 that—</text>
								<subclause id="id393042CD005A4C3FA6AC66C0C40D6F10"><enum>(I)</enum><text>the amount
			 received by the applicable capacity program during fiscal year 2007; bears
			 to</text>
								</subclause><subclause id="idE44E017187AC43F7900219735CE2325D"><enum>(II)</enum><text>the total amount
			 made available for all capacity programs for fiscal year 2007; and</text>
								</subclause></clause><clause id="idCE598B40659B4F54AD8B12C2D0109555"><enum>(ii)</enum><text>17.5 percent
			 shall be allocated to 1890 Institutions, 1994 Institutions, Insular Area
			 Institutions, Small 1862 Land-Grant Institutions, and ASCARR Institutions for
			 institutional enhancement capacity programs, of which—</text>
								<subclause id="id85B78C7781584AD1889E70A679FC7476"><enum>(I)</enum><text>36 percent shall
			 be for 1890 Institutions;</text>
								</subclause><subclause id="idE99529AF6076401BB99DF389996EDF9B"><enum>(II)</enum><text>26 percent shall
			 be for 1994 Institutions, except that an amount from that 26 percent shall be
			 allocated to Insular Area Institutions in accordance with the proportion
			 that—</text>
									<item id="id1FE34E740F9A441E88423ED61B10729C"><enum>(aa)</enum><text>the
			 amount received by the applicable Institution during fiscal year 2007; bears
			 to</text>
									</item><item id="idA270EA9AD82040F4B2F222A9D7F83C18"><enum>(bb)</enum><text>the
			 total amount made available for all 1890 Institutions, 1994 Institutions,
			 Insular Area Institutions, Small 1862 Land-Grant Institutions, and ASCARR
			 Institutions for fiscal year 2007;</text>
									</item></subclause><subclause id="id6B21FE11A5544320852C97C67CEC003A"><enum>(III)</enum><text>26 percent
			 shall be for Small 1862 Land-Grant Institutions; and</text>
								</subclause><subclause id="id90C5C9CC06EF4E16A50D88EAA582BBC6"><enum>(IV)</enum><text>12 percent shall
			 be for ASCARR Institutions; and</text>
								</subclause></clause></subparagraph><subparagraph id="id84D36BD862BF446AAA1D7B75CD19FE7E"><enum>(B)</enum><text>5 percent shall
			 be deposited into the enhancement fund of the National Institutes for Food and
			 Agriculture to fund capacity investments that are consistent with capacity
			 programs of the National Institutes for Food and Agriculture, as determined by
			 the Director, in consultation with the Secretary and the Council.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idB0F09FE548004BEEBA3D40B0793916E0" section-type="subsequent-section"><enum>106.</enum><header>Single budget
			 submission</header><text display-inline="no-display-inline">The President shall
			 submit to Congress, together with the annual budget submission of the
			 President, a single combined budget line item reflecting the total amount
			 requested by the President for funding for the National Institutes for Food and
			 Agriculture, including funding for capacity programs, competitive programs, and
			 other applicable National Institutes for Food and Agriculture programs.</text>
			</section><section id="id711C0FC0055E4591AD349727D1A85B5D"><enum>107.</enum><header>Capacity
			 building grants for ASCARR Institutions</header>
				<subsection id="ID99da40868ff14fe3b27168b1e48eed66"><enum>(a)</enum><header>Grant
			 program</header>
					<paragraph id="IDd2074b38de6a42ea82fc5ec34d58644c"><enum>(1)</enum><header>In
			 general</header><text>The Secretary or the Director, as appropriate, shall make
			 grants to ASCARR Institutions to assist the ASCARR Institutions in maintaining
			 and expanding the capacity of the ASCARR Institutions to conduct education,
			 research, and outreach activities relating to—</text>
						<subparagraph id="id46E105057D2F4B3FA17BEF99362E5804"><enum>(A)</enum><text>agriculture;</text>
						</subparagraph><subparagraph id="id10047F6A0CF247E696AE3C7236FAABFA"><enum>(B)</enum><text>renewable
			 resources; and</text>
						</subparagraph><subparagraph id="idE297CBFD17DD42CC8221AC6E456F4CF2"><enum>(C)</enum><text>other similar
			 disciplines.</text>
						</subparagraph></paragraph><paragraph id="ID40636e14b2c84f3d857a9abd696a4f89"><enum>(2)</enum><header>Requirements</header><text>The
			 Secretary or the Director, as appropriate, shall make grants under this
			 section—</text>
						<subparagraph id="ID02d043cefb844ef38e4970471734f916"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id9B65C4C607494EA299024112ED4D5FE3"><enum>(i)</enum><text>through a competitive
			 application process under which appropriate officials of ASCARR Institutions
			 may submit applications in such form and manner as the Secretary or the
			 Director, as appropriate, may prescribe; or</text>
							</clause><clause id="id909AEC4A4F9B4FE59E9417B7E532EB9F" indent="up1"><enum>(ii)</enum><text>through a noncompetitive
			 application process; and</text>
							</clause></subparagraph><subparagraph id="ID8851ffb9020843e3af408271737f7600"><enum>(B)</enum><text>in such manner as
			 to ensure geographic diversity with respect to the ASCARR Institutions that are
			 the subjects of the grants.</text>
						</subparagraph></paragraph><paragraph id="ID4907b2c7ce754998ad13f81a7e32857e"><enum>(3)</enum><header>Use of
			 funds</header><text>An ASCARR Institution that receives a grant under
			 subsection (a)(1) may use the funds made available through the grant to
			 maintain and expand the capacity of the ASCARR Institution—</text>
						<subparagraph id="ID467c93adc6654fa28eb5de49ad1ae73c"><enum>(A)</enum><text>to successfully
			 compete for funds from Federal grants and other sources to carry out
			 educational, research, and outreach activities that address priority concerns
			 of national, regional, State, and local interest;</text>
						</subparagraph><subparagraph id="IDc87bbcd3f403454dbc5b3636a621189e"><enum>(B)</enum><text>to disseminate
			 information relating to priority concerns to—</text>
							<clause id="idC5396E10CD474706BE80A4E69CADD918"><enum>(i)</enum><text>interested
			 members of the agriculture, renewable resources, and related stakeholder
			 communities;</text>
							</clause><clause id="id17CB58DD1B0C4C2083CEFAEE80F7BD0F"><enum>(ii)</enum><text>the public;
			 and</text>
							</clause><clause id="id22486B8ABF1C4BFDBB5C91FF9136D4AE"><enum>(iii)</enum><text>any other
			 interested entity;</text>
							</clause></subparagraph><subparagraph id="IDa5fafbf46c2d435b9cdce5ffac853b54"><enum>(C)</enum><text>to encourage
			 members of the agriculture, renewable resources, and related stakeholder
			 communities to participate in priority education, research, and outreach
			 activities by providing matching funding to leverage grant funds; and</text>
						</subparagraph><subparagraph id="ID9e23773803c4415ab4760433db5dd558"><enum>(D)</enum><text>through—</text>
							<clause id="id313AF26B4E67418D919E8A2566A43546"><enum>(i)</enum><text>the
			 purchase or other acquisition of equipment and other infrastructure (not
			 including the construction of new buildings);</text>
							</clause><clause id="IDf76f287984854603957ab18a196068d6"><enum>(ii)</enum><text>the renovation
			 of facilities;</text>
							</clause><clause id="IDfae9bb5441a2435ca03aeca01774e8c4"><enum>(iii)</enum><text>the
			 professional growth and development of the faculty of the ASCARR Institution;
			 and</text>
							</clause><clause id="ID8e945755309d4a06971c9ed431dffa7f"><enum>(iv)</enum><text>the development
			 of human capital (including through the use of graduate assistantships).</text>
							</clause></subparagraph></paragraph></subsection><subsection id="IDa071fc8294ed48f4874255b4f1089bae"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to
			 carry out this section—</text>
					<paragraph id="ID7aa493b77bb04136bdb5aa3b9da33248"><enum>(1)</enum><text>$5,000,000 for
			 fiscal year 2008;</text>
					</paragraph><paragraph id="ID4cc8e32d367e4ec9aebbde8f26cb12a5"><enum>(2)</enum><text>$7,000,000 for
