		<official-title>To temporarily increase the number of visas which may be
		  issued to certain highly skilled workers.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>High-Tech Worker Relief Act of
			 2007</short-title></quote>.</text>
		</section><section id="idBD47FC0692A748A499E63BC3D351CDA1"><enum>2.</enum><header>Immediate
			 increase of H–1B visas</header><text display-inline="no-display-inline">Section
			 214(g)(1)(A) of the Immigration and Nationality Act (8 U.S.C. 1184(g)(1)(A)) is
			 amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="id90A8BC12EA3446D5AC16382B83F9865A" style="OLC">
				<subparagraph id="ID6f061a1c74a6438a8bae885845458fb0" indent="up1"><enum>(A)</enum><text>under section 101(a)(15)(H)(i)(b) may
				not exceed—</text>
					<clause id="ID8fd6ce55bc76465f92191a7d8d3c4f12"><enum>(i)</enum><text>65,000 in each of the fiscal years
				2004 through 2006;</text>
					</clause><clause id="id2CFE15F90A0249E3A6C507584347B144"><enum>(ii)</enum><text>115,000 in fiscal year
				2007;</text>
					</clause><clause id="id018E338471EC456BBAA3B4C57A34C7F4"><enum>(iii)</enum><text>195,000 in fiscal year 2008;
				and</text>
					</clause><clause id="id0F97F3D31ABE4E6F9D388FE26449D191"><enum>(iv)</enum><text>65,000 in fiscal year 2009 and
				each succeeding fiscal year;
				and</text>
					</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID09e54c5e21d14291a8d63ce862e2640a"><enum>3.</enum><header>Exemption from
			 numerical limits</header>
			<subsection id="id82CD81D739874A5DA524273AEAA0BCD3"><enum>(a)</enum><header>Nonimmigrants
			 with advanced degrees</header><text display-inline="yes-display-inline">Section
			 214(g)(5)(C) of the Immigration and Nationality Act (8 U.S.C. 1184(g)(5)(C)) is
			 amended by striking <quote>, until the number of aliens who are exempted from
			 such numerical limitation during such year exceeds 20,000</quote>.</text>
			</subsection><subsection id="ID94a5be90d46146e8b8021aaae3f35a90"><enum>(b)</enum><header>Employment-based
			 immigrants</header>
				<paragraph id="ID4d120e577311430b916db29a32951914"><enum>(1)</enum><header>In
			 general</header><text>Section 201(b)(1) of the Immigration and Nationality Act
			 (8 U.S.C. 1151(b)(1)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idADEB92E141774C478550614370E0D0A1" style="OLC">
						<subparagraph id="ID4908d2e0a3b748b39bd1e71147033b9d" indent="up1"><enum>(F)</enum><text>Aliens who have earned an advanced
				degree in science, technology, engineering, or math and have been working in a
				related field in the United States under a nonimmigrant visa during the 3-year
				period preceding their application for an immigrant visa under section
				203(b).</text>
						</subparagraph><subparagraph id="id24DB29EFC7C24D369C66773FAE8BF048" indent="up1"><enum>(G)</enum><text>Aliens who—</text>
							<clause id="idF2551898BA314D06BADC371408560F0B"><enum>(i)</enum><text>are described in subparagraph (A)
				or (B) of section 203(b)(1); or</text>
							</clause><clause id="id2A3059B9A71C419ABD4A2F9B100E0162"><enum>(ii)</enum><text>have received a national interest
				waiver under section 203(b)(2)(B).</text>
							</clause></subparagraph><subparagraph id="id122B651FAB634A51A1C4E7028C89981A" indent="up1"><enum>(H)</enum><text>The immediate relatives of an alien
				who is admitted as an employment-based immigrant under section
				203(b).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDf032e5f8e1184a5f8546bdfae8bdba7d"><enum>(2)</enum><header>Applicability</header><text>The
			 amendments made by paragraph (1) shall apply to any visa application—</text>
					<subparagraph id="id46BF70666AC74F8BAC9A6BA195619B5F"><enum>(A)</enum><text>pending on the
			 date of the enactment of this Act; or</text>
					</subparagraph><subparagraph id="idCBFE49E17FE34C339BA50FF358CB3DC0"><enum>(B)</enum><text>filed on or after
			 such date of enactment.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
