		<official-title>To amend the Agriculture and Consumer Protection Act of
		  1973 to assist the neediest of senior citizens by modifying the eligibility
		  criteria for supplemental foods provided under the commodity supplemental food
		  program to take into account the extraordinarily high out-of-pocket medical
		  expenses that senior citizens pay, and for other purposes.</official-title>

		<section id="IDBD840BE1174C47F6BD6916A21D122ECA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Senior Nutrition Act of
			 2007</short-title></quote>.</text>
		</section><section id="IDEFB942DA7B354EF98EBE51809F96E657"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="IDC3FF8C87968344D7007F88CA9407E971"><enum>(1)</enum><text>senior citizens
			 in the United States have significant out-of-pocket costs for medical expenses,
			 especially for prescription drugs;</text>
			</paragraph><paragraph id="IDA2BA541F003A401AAB33B159396F4EF1"><enum>(2)</enum><text>as medical costs
			 continue to rise, many senior citizens are forced to make the difficult choice
			 between purchasing prescription drugs and purchasing food;</text>
			</paragraph><paragraph id="ID677CA71FDE9D4B1BB2AE35E49FA8A1AA"><enum>(3)</enum><text>the commodity
			 supplemental food program provides supplemental nutritious foods to senior
			 citizens in a number of States and localities;</text>
			</paragraph><paragraph id="ID77569A4BACAF4A84BC6105AB94B67E76"><enum>(4)</enum><text>under the
			 commodity supplemental food program—</text>
				<subparagraph id="IDDBD0673A052A41CC8E275CFDA56E2E67"><enum>(A)</enum><text>women, infants,
			 and children with household incomes up to 185 percent of the Federal Poverty
			 Income Guidelines published annually by the Department of Health and Human
			 Services may be eligible for supplemental foods; but</text>
				</subparagraph><subparagraph id="IDAA765A187812475181F58B9649669400"><enum>(B)</enum><text>senior citizens
			 are ineligible for supplemental foods if their household incomes are greater
			 than 130 percent of the Federal Poverty Income Guidelines;</text>
				</subparagraph></paragraph><paragraph id="IDc54229ac55b3458182b3ec3866fe5f6d"><enum>(5)</enum><text>during fiscal
			 year 2006—</text>
				<subparagraph id="IDf4a36f7b86284140b51a9ab98c52ed9b"><enum>(A)</enum><text>an average of
			 463,124 people each month participated in the commodity supplemental food
			 program; and</text>
				</subparagraph><subparagraph id="IDb8572a9d1e0148de8db3cbbc1f19d017"><enum>(B)</enum><text>the majority of
			 those participants, 423,098, were senior citizens; and</text>
				</subparagraph></paragraph><paragraph id="IDF738024FDEDB4FE58C21E9398CE1DB42"><enum>(6)</enum><text>in order to serve
			 the neediest senior citizens, taking into account their high out-of-pocket
			 medical (including prescription drug) expenses, the eligibility requirements
			 for the commodity supplemental food program should be modified to make more
			 senior citizens eligible for the supplemental foods provided under the
			 program.</text>
			</paragraph></section><section id="IDD6FB45344F4142F0BBD0E9CE213389DC"><enum>3.</enum><header>Eligibility of
			 elderly persons under the commodity supplemental food program</header>
			<subsection id="IDE21C30C30DD946689E6B3BE2A21C239D"><enum>(a)</enum><header>In
			 general</header><text>Section 5 of the Agriculture and Consumer Protection Act
			 of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c note">7
			 U.S.C. 612c note</external-xref>;
			 <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law
			 93–86</external-xref>) is amended—</text>
				<paragraph id="ID576851CA9AD948698395817F2C8E9EFC"><enum>(1)</enum><text>in the first
			 sentence of subsection (d)(2)—</text>
					<subparagraph id="IDD4189AFA186E4FCFB1D10237A4A8B9A9"><enum>(A)</enum><text>by striking
			 <quote>provide not less</quote> and inserting <quote>provide, to the Secretary
			 of Agriculture, not less</quote>;</text>
					</subparagraph><subparagraph id="IDC4060E6D6D0D4CB4B73421693438578B"><enum>(B)</enum><text>by inserting
			 <quote>, or such greater quantities of cheese and nonfat dry milk as the
			 Secretary determines are necessary,</quote> after <quote>nonfat dry
			 milk</quote>; and</text>
					</subparagraph><subparagraph id="ID1D613FB4FA6F4C47A99477EE36C271F8"><enum>(C)</enum><text>by striking
			 <quote>in each of the fiscal years 1991 through 2007 to the Secretary of
			 Agriculture</quote> and inserting <quote>in each fiscal year</quote>;</text>
					</subparagraph></paragraph><paragraph id="IDC1CA4F4F87274DF5A29C6DC29BC7DE97"><enum>(2)</enum><text>in subsection
			 (i)—</text>
					<subparagraph id="ID0DD46B5CCF9249B9A23F86D27B72E548"><enum>(A)</enum><text>by redesignating
			 paragraphs (1), (2), and (3) as subparagraphs (A), (B), and (C), respectively,
			 and indenting appropriately; and</text>
					</subparagraph><subparagraph id="ID597DB5C918304027AED20997D15900FB"><enum>(B)</enum><text>by striking
			 <quote>(i) Each</quote> and inserting the following:</text>
						<quoted-block id="IDDA22139AB0A94D759C1B5B1016AEDEE8">
							<subsection id="IDBFA282F9040741F8B820445506D317FA"><enum>(i)</enum><header>Programs
				serving elderly persons</header>
								<paragraph id="ID869E97E235BB4315B4DC41F0BF29769C"><enum>(1)</enum><header>Eligibility</header><text>An
				elderly person shall be eligible to participate in a commodity supplemental
				food program serving elderly persons if the elderly person is at least 60 years
				of age and—</text>
									<subparagraph id="ID0BFC76FCC1B04632913E1CD5807B18B9"><enum>(A)</enum><text>is eligible for
				food stamp benefits under the <act-name parsable-cite="FSA77">Food Stamp Act of
				1977</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7
				U.S.C. 2011</external-xref> et seq.); or</text>
									</subparagraph><subparagraph id="ID70EC4ED676A4483D80D23BAD3FE0F12B"><enum>(B)</enum><text>has a household
				income that is less than or equal to 185 percent of the most recent Federal
				Poverty Income Guidelines published by the Department of Health and Human
				Services.</text>
									</subparagraph></paragraph><paragraph id="ID76E4AEE2FEEA45EF8B5B28E8DFCE4B00"><enum>(2)</enum><header>Provision of
				information</header><text>Each</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDA248C63E5B4E421DB9199E8110E2708D"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="ID64E208AAFA9D44DDB9F37525BEBFB6AF">
						<subsection id="ID2DE860ADD62F4B28B312740090A59545"><enum>(m)</enum><header>Authorization
				of appropriations</header>
							<paragraph id="ID2F4875B571C54FCBA539B2A9506E9306"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated such sums as are
				necessary to carry out the commodity supplemental food program.</text>
							</paragraph><paragraph id="ID1F8D4D53AC114992B162C475966CBABE"><enum>(2)</enum><header>Limitation on
				use of funds</header><text>None of the funds made available under paragraph (1)
				shall be available to reimburse the Commodity Credit Corporation for
				commodities donated to the commodity supplemental food
				program.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID3550D7AA7AB144258F41DD8701F59649"><enum>(b)</enum><header>Conforming
			 amendments</header><text>Section 5(g) of the Agriculture and Consumer
			 Protection Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/7/612c note">7 U.S.C. 612c note</external-xref>;
			 <external-xref legal-doc="public-law" parsable-cite="pl/93/86">Public Law
			 93–86</external-xref>) is amended by striking <quote>(as defined by the
			 Secretary)</quote> and inserting <quote>described in subsection
			 (i)(1)</quote>.</text>
			</subsection></section></legis-body>
