		<official-title>To provide stronger protections to parents regarding
		  their children's access to sexually explicit material over the
		  Internet.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Cyber Safety for Kids Act of
			 2007</short-title></quote>.</text>
		</section><section id="idCD488449DFBA4E5A9435260E84AA3ED5"><enum>2.</enum><header>Prohibition on
			 commercial websites containing material that is harmful to minors</header>
			<subsection id="id3C52D7626C96482EB17880E2E7079D21"><enum>(a)</enum><header>In
			 general</header><text>No person who operates a website located on the Internet
			 where such website is primarily operated for commercial purposes may knowingly,
			 and with knowledge of the character of the material, place material that is
			 harmful to minors on such website unless—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID96E30227FD214721A34AAE3546954D27"><enum>(1)</enum><text>the home page, or
			 any other page or screen that is initially viewable by a visitor to such
			 website, does not include any material that is harmful to minors;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DD2F36DC62F4478879249D263888CEC"><enum>(2)</enum><text>access to any
			 such material is restricted to a specific set of individuals through an age
			 verification requirement; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA03DF45C30FC4988A9583217A8C5AA6A"><enum>(3)</enum><text>the source code
			 of such website contains the content description tag assigned to such website
			 by the National Telecommunications and Information Administration.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id43995C54F7054123B1DAF5A47DBC574E"><enum>(b)</enum><header>NTIA
			 description tag</header><text>Not later than 90 days after the date of
			 enactment of this Act, the National Telecommunications and Information
			 Administration shall develop a common content description tag that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id74E055C2B55E4724B32D150880259358"><enum>(1)</enum><text>will provide
			 consumers with advance warning and information about the content of any website
			 that contains material that is harmful to minors;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id450C69E6CF144CC5AD4EB2CB5951F9F1"><enum>(2)</enum><text>will allow
			 consumers, based on such tag, to block or filter access to, and display of, any
			 website that contains material that is harmful to minors; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0CB6361024ED4CF4840C8574BD91ED8E"><enum>(3)</enum><text>is
			 technologically capable of being embedded into the source code a
			 website.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id0B7729069CDB4CB6A881376311C2B090"><enum>3.</enum><header>Registration
			 requirements</header>
			<subsection commented="no" display-inline="no-display-inline" id="id683ABF29D2F248D1912FEFA47389D59A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any operator of a
			 website who seeks to register such website, or who is required to re-register
			 any existing website with ICANN, shall, at a minimum and in addition to any
			 other information required by ICANN, provide to ICANN the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4C99FAEFC6F44B80AC46F91EF236EAC2"><enum>(1)</enum><text>The name of such
			 operator.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF1E749C72514533BBB1682D1791EA89"><enum>(2)</enum><text>The Uniform
			 Resource Locator or URL for such website.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8437D3E7D02B4D78AD3E371CD4CAC0FE"><enum>(3)</enum><text>The Internet
			 Protocol address for such website.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCAC3A5BA55FB43F4B9B226A5A0802A9C"><enum>(4)</enum><text>The content
			 description tag of such website under section 2(b).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB970FFE15F3F45F0B05A6BED136E61DB"><enum>(b)</enum><header>NTIA action
			 required</header><text>Not later than 30 days after the date of the enactment
			 of this Act, the Secretary of Commerce, acting through the National
			 Telecommunications and Information Administration, shall—</text>
				<paragraph id="ID32DAD6BE631B40FF9D90DB93C246ADD4"><enum>(1)</enum><text>enter into any
			 memorandums of understanding, agreements, and contracts with ICANN, as may be
			 necessary to carry out the requirement under subsection (a); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id242B427DB95B46EB929DE2A53DF3B0A2"><enum>(2)</enum><text>make any
			 amendments to any existing memorandums of understandings, agreements, and
			 contracts with ICANN, as may be necessary to carry out the requirement under
			 subsection (a).</text>
				</paragraph></subsection></section><section id="ID541736A6AA1B48968D74C15E87B6F9E5"><enum>4.</enum><header>Enforcement</header>
			<subsection id="ID62E23A1D246245D8B3E89259D50292F6"><enum>(a)</enum><header>Violation</header><text>Any
			 person who violates this Act shall be subject to such civil penalties as the
			 Secretary of Commerce shall prescribe.</text>
			</subsection><subsection id="ID75665AF9B433467B97A2A4804932B170"><enum>(b)</enum><header>Enforcement</header><text>The
			 Secretary of Commerce shall have the power to enforce the provisions of this
			 Act, including—</text>
				<paragraph id="idEEA03F92CD03468D8B7B2E9BE84CD6A6"><enum>(1)</enum><text>any requirements
			 or limitations applicable to a registrant under section 3; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B7AD06C846E4625873893439B36539E"><enum>(2)</enum><text>the imposition
			 and collection of civil penalties under subsection (a).</text>
				</paragraph></subsection></section><section id="id0D7433279D3C4A6D8BA61AAC73AD51A9"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions shall
			 apply:</text>
			<paragraph id="IDA3A7FA7CB9C24FCDADD4E9661B46F466"><enum>(1)</enum><header>ICANN</header><text>The
			 term <term>ICANN</term> means the Internet Corporation for Assigned Names and
			 Numbers.</text>
			</paragraph><paragraph id="ID9273f67087a74279bb6c8355c7003d7e"><enum>(2)</enum><header>Internet</header><text>The
			 term <term>Internet</term> means the combination of computer facilities and
			 electromagnetic transmission media, and related equipment and software,
			 comprising the interconnected worldwide network of computer networks that
			 employ the Transmission Control Protocol/Internet Protocol or any successor
			 protocol to transmit information.</text>
			</paragraph><paragraph id="IDECD00A4FE90745EEB5DA4445C2E7DA57"><enum>(3)</enum><header>Material that
			 is harmful to minors</header><text>The term <term>material that is harmful to
			 minors</term> means any communication, picture, image, graphic image file,
			 article, recording, writing, or other matter of any kind that is obscene, or
			 that a reasonable person would find—</text>
				<subparagraph id="IDFDA980FFC8F54A709F2BA49444B9501C"><enum>(A)</enum><text>taking the
			 material as a whole and with respect to minors, is designed to appeal to, or is
			 designed to pander to, the prurient interest;</text>
				</subparagraph><subparagraph id="ID2C6AB62405C8439193B3EC34168C1898"><enum>(B)</enum><text>depicts,
			 describes, or represents, in a manner patently offensive with respect to
			 minors—</text>
					<clause id="idC4BF3DAB327B4A8A9B8DD0B79B4C8E3E"><enum>(i)</enum><text>an
			 actual or simulated sexual act or sexual contact;</text>
					</clause><clause id="id81783E9F2AEE48768B1EEA28FB64D4C9"><enum>(ii)</enum><text>an
			 actual or simulated normal or perverted sexual act; or</text>
					</clause><clause id="id762601D450264CCDAA9590BEF1E1325F"><enum>(iii)</enum><text>a
			 lewd exhibition of the genitals or post-pubescent female breast; and</text>
					</clause></subparagraph><subparagraph id="ID3E63F45B3DA6414DA0EAABEF73F28168"><enum>(C)</enum><text>taking the
			 material as a whole, lacks serious literary, artistic, political, or scientific
			 value for minors.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC00FBB07ECB3415EBC22A9FE74525291"><enum>(4)</enum><header>Minor</header><text>The
			 term <term>minor</term> means any person under 18 years of age.</text>
			</paragraph><paragraph id="idF75D28C0531343EB8F882BBFA51F3F00"><enum>(5)</enum><header>Source
			 code</header><text>The term <quote>source code</quote> means the combination of
			 text and other characters comprising the content, both viewable and
			 non-viewable, of a webpage, including any—</text>
				<subparagraph id="idE1696DEC1A754A1E8B4678922A58DDBB"><enum>(A)</enum><text>website
			 publishing language;</text>
				</subparagraph><subparagraph id="id6FD7F1357B8F422BB307C2BD0F935161"><enum>(B)</enum><text>programming
			 language;</text>
				</subparagraph><subparagraph id="id9458AB5E910948F7AA3758B5E0815AC6"><enum>(C)</enum><text>protocol or
			 functional content; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2F1CD52D860E4C54916BCB7CB37FA6FA"><enum>(D)</enum><text>successor
			 languages or protocols.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2949C758F49A471899DEB3C6BAACAA0F"><enum>(6)</enum><header>Tag</header><text>The
			 term <quote>tag</quote> means a descriptive keyword or term associated with or
			 assigned to a piece of information (such as a picture, article, or video clip),
			 that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id24E210AD85034FBE86C43AA8B0E21A73"><enum>(A)</enum><text>describes such
			 information; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id411713239ED144B0B853CC0866D45303"><enum>(B)</enum><text>enables
			 keyword-based classification and filtering of such information as required
			 under this Act.</text>
				</subparagraph></paragraph><paragraph id="IDC24B70E70919458C85F151EC397F2586"><enum>(7)</enum><header>Website</header><text>The
			 term <term>website</term> means any collection of material placed in a computer
			 server-based file archive so that it is publicly accessible over the Internet
			 using hypertext transfer protocol, or any successor protocol.</text>
