		<official-title display="yes">To amend title XIX of the Social Security
		  Act to expand access to contraceptive services for women and men under the
		  Medicaid program, help low income women and couples prevent unintended
		  pregnancies and reduce abortion, and for other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Unintended Pregnancy Reduction Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idD9A4A13213214AEBA3CAEE5BD1D7747C" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id0B352B137DEA4041926E7DC04BEF7AFA"><enum>(1)</enum><text display-inline="yes-display-inline">Rates of unintended pregnancy in the United
			 States increased by nearly 30 percent among low-income women between 1994 and
			 2002, and a low-income woman today is 4 times as likely to have an unintended
			 pregnancy as her higher income counterpart.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDab47da92b92744a3886f60b37deaf42e"><enum>(2)</enum><text display-inline="yes-display-inline">Abortion rates decreased among higher
			 income women but increased among low income women between 1994 and 2002, and a
			 low income woman is more than 4 times as likely to have an abortion as her
			 higher income counterpart.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2b44e64a2eca435ebad3a6d9b3dd2509"><enum>(3)</enum><text display-inline="yes-display-inline">Contraceptive use reduces a woman’s
			 probability of having an abortion by 85 percent.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDea12c7d246c8406dbfbb4e61c31654be"><enum>(4)</enum><text display-inline="yes-display-inline">Levels of contraceptive use among
			 low-income women at risk of unintended pregnancy declined significantly between
			 1994 and 2002, from 92 percent to 86 percent.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42224d6336fc4ec58138e3b566206b19"><enum>(5)</enum><text display-inline="yes-display-inline">Publicly funded contraceptive services have
			 been shown to prevent 1,300,000 unintended pregnancies each year, and in the
			 absence of these services the United States abortion rate would likely be 40
			 percent higher than it is.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID012964cc6e0343518958595ec2ef81f2"><enum>(6)</enum><text display-inline="yes-display-inline">By helping couples avoid unintended
			 pregnancy, Medicaid-funded contraceptive services are highly cost-effective,
			 and every public dollar spent on family planning saves $3 in the cost of
			 pregnancy-related care alone.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID60c9bdf51e4943a3970c8e19f1f5aa47"><enum>(7)</enum><text display-inline="yes-display-inline">Federal law requires State Medicaid
			 programs to cover pregnancy-related care for women with incomes up to 133
			 percent of poverty, and 17 States have expanded this coverage to women with
			 incomes up to 200 percent of poverty.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa33769a6be6049e7ad14da442f7c461f"><enum>(8)</enum><text display-inline="yes-display-inline">17 States have expanded Medicaid coverage
			 for family planning services to at least the same level at which they provide
			 Medicaid funded pregnancy-related care.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID30c2eda23e0d4ec99dd480fdc3cba4d4"><enum>(9)</enum><text display-inline="yes-display-inline">Equalizing the eligibility levels for
			 family planning and pregnancy-related care nationwide would maximize the
			 cost-savings to both the Federal and State Governments.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID85b9da821e0d4425899e1844d58e109f"><enum>(10)</enum><text display-inline="yes-display-inline">A woman should have equal access to
			 contraceptive services to help prevent an unintended pregnancy and to
			 pregnancy-related care if she does become pregnant.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID056fd2031ade4ea69bf158cba5b52950" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Expansion of family planning
			 services</header>
			<subsection commented="no" display-inline="no-display-inline" id="id329E2553C1184052B7AE8B585677BF35"><enum>(a)</enum><header display-inline="yes-display-inline">Coverage as Mandatory Categorically Needy
			 Group</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID56412f9ac7824eb2b0a0e2a9fca5c8fb"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1902(a)(10)(A)(i) of the Social
			 Security Act (42 U.S.C. 1396a(a)(10)(A)(i)) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID0c54f6d435de417a9ddc7b7500046074"><enum>(A)</enum><text display-inline="yes-display-inline">in subclause (VI), by striking
			 <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID28ee19e7d7214e0d946dc1928ace8a8a"><enum>(B)</enum><text display-inline="yes-display-inline">in subclause (VII), by adding
			 <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcc20f78795fc4205a2829d0c77057b21"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subclause:</text>
						<quoted-block display-inline="no-display-inline" id="id3429A07505D9481DBC17B1ED6931F4A6" style="OLC">
							<subclause commented="no" display-inline="no-display-inline" id="ID4a928ebe421742f899f07466d15165c0"><enum>(VIII)</enum><text display-inline="yes-display-inline">who are described in subsection (dd)
				(relating to individuals who meet the income standards for pregnant
				women);</text>
							</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID713332813bb94980b0b673626dfe168d"><enum>(2)</enum><header display-inline="yes-display-inline">Group described</header><text display-inline="yes-display-inline">Section 1902 of the Social Security Act (42
			 U.S.C. 1396a) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="id622E98582A7D47F0A10E67657700BD8C" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID139f69c8abce41ea8edca6a4e486192c"><enum>(dd)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id85CCE9063E03441BA4A16B7774CB87ED"><enum>(1)</enum><text display-inline="yes-display-inline">Individuals described in this subsection
				are individuals who—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDb98a6a3eb9b1481cb52777271e1cc2a9" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">meet at least the income eligibility
				standards established under the State plan as of January 1, 2007, for pregnant
				women or such higher income eligibility standard for such women as the State
				may establish; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdf4216a8f8294edcb6588c84aee1f8fe" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">are not pregnant.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63DAA8356AD94CFC851936C9B3624438" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">At the option of a State, individuals
				described in this subsection may include individuals who are determined to meet
				the income eligibility standards referred to in paragraph (1)(A) under the
				terms and conditions applicable to making eligibility determinations for
				medical assistance under this title under a waiver to provide the benefits
				described in clause (XV) of the matter following subparagraph (G) of section
				1902(a)(10) granted to the State under section 1115 as of January 1,
				2007.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID711daf9ce9e745a7b14f048655604b33"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation on benefits</header><text display-inline="yes-display-inline">Section 1902(a)(10) of the Social Security
			 Act (42 U.S.C. 1396a(a)(10)) is amended in the matter following subparagraph
			 (G)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID79d00d7e584042118ca38a478da91763"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>and (XIV)</quote> and
			 inserting <quote>(XIV)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaddfbe1f56da425494b8be06221bb747"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>, and (XV) the medical
			 assistance made available to an individual described in subsection (dd) who is
			 eligible for medical assistance only because of subparagraph (A)(10)(i)(VIII)
			 shall be limited to family planning services and supplies described in
			 1905(a)(4)(C), including medical diagnosis or treatment services that are
			 provided pursuant to a family planning service in a family planning setting
			 provided during the period in which such an individual is eligible;</quote>
			 after <quote>cervical cancer</quote>.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd8425c6427cf4f69be83e07dc79bbbaf"><enum>(4)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act
			 (42 U.S.C. 1396d(a)) is amended in the matter preceding paragraph (1)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDae269bbcb61a455086517b8adbac78cd"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (xii), by striking
			 <quote>or</quote> at the end;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID819fb1e3ee6f40579103e27b79782e1c"><enum>(B)</enum><text display-inline="yes-display-inline">in clause (xii), by adding
			 <quote>or</quote> at the end; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8fbcb22dea154628b5aeaeaac1014c8f"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after clause (xiii) the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id72FDAB7365834A5B99FEAFF935366852" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="ID71e0e156569845eead040dbf573f094e"><enum>(xiv)</enum><text display-inline="yes-display-inline">individuals described in section
				1902(dd),</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6513d998a9464cb18596ecc02a074124"><enum>(b)</enum><header display-inline="yes-display-inline">Presumptive eligibility</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDb55a0e7793ae4aae827d6ad8187e9ebb"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Title XIX of the Social Security Act (42
			 U.S.C. 1396 et seq.) is amended by inserting after section 1920B the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idA39EB1D2CB8D4F80A5198FEB1D802901" style="traditional">
						<section commented="no" display-inline="no-display-inline" id="IDb2cc907eb6bc483cb8058d900558623d" section-type="subsequent-section"><enum>1920C.</enum><header>PRESUMPTIVE ELIGIBILITY FOR FAMILY PLANNING
		  SERVICES</header><subsection commented="no" display-inline="yes-display-inline" id="idA3F3DDD3A46345DF9DCA55B681457E5A"><enum>(a)</enum><header display-inline="yes-display-inline">State Option</header><text display-inline="yes-display-inline">A State plan approved under section 1902
				may provide for making medical assistance available to an individual described
				in section 1902(dd) (relating to individuals who meet the income eligibility
				standard for pregnant women in the State) during a presumptive eligibility
				period. In the case of an individual described in section 1902(dd) who is
				eligible for medical assistance only because of subparagraph (A)(10)(i)(VIII),
				such medical assistance may be limited to family planning services and supplies
				described in 1905(a)(4)(C) and, at the State’s option, medical diagnosis or
				treatment services that are provided in conjunction with a family planning
				service in a family planning setting provided during the period in which such
				an individual is eligible.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7c60abe2db9440cfac0a66b72f1e8895"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id446620C7AC9E4C53825C4E0FE4C5516A"><enum>(1)</enum><header display-inline="yes-display-inline">Presumptive eligibility
				period</header><text display-inline="yes-display-inline">The term
				<term>presumptive eligibility period</term> means, with respect to an
				individual described in subsection (a), the period that—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id5D17A2F630DF47F899A5A5EB1FE682FA"><enum>(A)</enum><text display-inline="yes-display-inline">begins with the date on which a qualified
				entity determines, on the basis of preliminary information, that the individual
				is described in section 1902(dd); and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6d61b5f6c4cd47968b697cde8d899f0a"><enum>(B)</enum><text display-inline="yes-display-inline">ends with (and includes) the earlier
				of—</text>
										<clause commented="no" display-inline="no-display-inline" id="id6BCA3311A5D94CE39122D4A476A4738B"><enum>(i)</enum><text display-inline="yes-display-inline">the day on which a determination is made
				with respect to the eligibility of such individual for services under the State
				plan; or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID58f61f76874542d7989f6783b96a58f1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of such an individual who does
				not file an application by the last day of the month following the month during
				which the entity makes the determination referred to in subparagraph (A), such
				last day.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID036f5cb6d94e4d5e8b9d21484d0a98c7"><enum>(2)</enum><header display-inline="yes-display-inline">Qualified entity</header>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID3ecfa391035e484c8c77ed548a8ed432"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the term
				<term>qualified entity</term> means any entity that—</text>
										<clause commented="no" display-inline="no-display-inline" id="ID4d782fda86854669ba8cfbe52706bc3b"><enum>(i)</enum><text display-inline="yes-display-inline">is eligible for payments under a State plan
				approved under this title; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID1b66297881de45f9b1945c1dc486eedd"><enum>(ii)</enum><text display-inline="yes-display-inline">is determined by the State agency to be
				capable of making determinations of the type described in paragraph
				(1)(A).</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7f53de1e717d446cada8a54a4cb98f4e"><enum>(B)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary may issue regulations further
				limiting those entities that may become qualified entities in order to prevent
				fraud and abuse and for other reasons.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8061734067a7483aaf8f4ac3654e7771"><enum>(C)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be
				construed as preventing a State from limiting the classes of entities that may
				become qualified entities, consistent with any limitations imposed under
				subparagraph (B).</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7bbf44c48c0b4b679fa11485795b80bd"><enum>(c)</enum><header display-inline="yes-display-inline">Administration</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID685b408dd07a441ca4e185d21043a6d8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The State agency shall provide qualified
				entities with—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID9b90674910a2418b891bcecd911c4b03"><enum>(A)</enum><text display-inline="yes-display-inline">such forms as are necessary for an
				application to be made by an individual described in subsection (a) for medical
				assistance under the State plan; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9c5f0f2926364a288187237d5fd6bd64"><enum>(B)</enum><text display-inline="yes-display-inline">information on how to assist such
				individuals in completing and filing such forms.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd1c32e97b04b4e9396f7081ac05aacf8"><enum>(2)</enum><header display-inline="yes-display-inline">Notification requirements</header><text display-inline="yes-display-inline">A qualified entity that determines under
				subsection (b)(1)(A) that an individual described in subsection (a) is
				presumptively eligible for medical assistance under a State plan shall—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDb46ba97494ee40919f906ee08d72de44"><enum>(A)</enum><text display-inline="yes-display-inline">notify the State agency of the
				determination within 5 working days after the date on which determination is
				made; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc148d6cbcc1348e68828c107da6bb5d3"><enum>(B)</enum><text display-inline="yes-display-inline">inform such individual at the time the
				determination is made that an application for medical assistance is required to
				be made by not later than the last day of the month following the month during
				which the determination is made.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe9f47581a3e84c4c8eda373bf3de2ec8"><enum>(3)</enum><header display-inline="yes-display-inline">Application for medical
				assistance</header><text display-inline="yes-display-inline">In the case of an
				individual described in subsection (a) who is determined by a qualified entity
				to be presumptively eligible for medical assistance under a State plan, the
				individual shall apply for medical assistance by not later than the last day of
				the month following the month during which the determination is made.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID552b73ba1ddc42edbbe0918c6a6a6a56"><enum>(d)</enum><header display-inline="yes-display-inline">Payment</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				title, medical assistance that—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID70a99a31364c4e5ebf33bbfbe567398d"><enum>(1)</enum><text display-inline="yes-display-inline">is furnished to an individual described in
				subsection (a)—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="IDbe9577c44b354469b99c08d6fef42efb"><enum>(A)</enum><text display-inline="yes-display-inline">during a presumptive eligibility
				period;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2adedc4fe9914ec3ab40bdadab194294"><enum>(B)</enum><text display-inline="yes-display-inline">by a entity that is eligible for payments
				under the State plan; and</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1413e526ac5143fdb096bff1089353fe"><enum>(2)</enum><text display-inline="yes-display-inline">is included in the care and services
				covered by the State plan, shall be treated as medical assistance provided by
				such plan for purposes of clause (4) of the first sentence of section
				1905(b).</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID919504703e3c429e925fa3efa0adc46a"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendments</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDa7b8709d9f4d4de3bfdfbb6fae8a8a66"><enum>(A)</enum><text display-inline="yes-display-inline">Section 1902(a)(47) of the Social Security
			 Act (42 U.S.C. 1396a(a)(47)) is amended by inserting before the semicolon at
			 the end the following: <quote>and provide for making medical assistance
			 available to individuals described in subsection (a) of section 1920C during a
			 presumptive eligibility period in accordance with such section.</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd520a86c761c44a7bcfd785c01053069"><enum>(B)</enum><text display-inline="yes-display-inline">Section 1903(u)(1)(D)(v) of such Act (42
			 U.S.C. 1396b(u)(1)(D)(v)) is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDd87dc334172c4484abdab693921884d3"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>or for</quote> and
			 inserting <quote>, for</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID6403b43f3baf46faa0bc6f00be1a6455"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting before the period the
			 following: <quote>, or for medical assistance provided to an individual
			 described in subsection (a) of section 1920C during a presumptive eligibility
			 period under such section</quote>.</text>
						</clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idDF744BB5967D46D296820E6419E3C8C0" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Clarification of coverage of family
			 planning services and supplies</header><text display-inline="no-display-inline">Section 1937(b) of the Social Security Act
			 (42 U.S.C. 1396u–7(b)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H62638AE5B1D24354A88086004ED8D1A3" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="H8CB406A05B6049BA89E8ED042D682FA5"><enum>(5)</enum><header display-inline="yes-display-inline">Coverage of family planning services and
				supplies</header><text display-inline="yes-display-inline">Notwithstanding the
				previous provisions of this section, a State may not provide for medical
				assistance through enrollment of an individual with benchmark coverage or
				benchmark-equivalent coverage under this section unless such coverage includes
				for any individual described in section 1905(a)(4)(C), medical assistance for
				family planning services and supplies in accordance with such
				section.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="idE02DAA7ED81A49C1BC39F08072EA6526" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Effective date</header>
			<subsection commented="no" display-inline="no-display-inline" id="id26283A6E5A3D4C1C9454669D3789C58B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
			 amendments made by this Act take effect on October 1, 2007.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id34B4CCCF2ACE4E0E91886DF97DBBCE34"><enum>(b)</enum><header display-inline="yes-display-inline">Extension of effective date for state law
			 amendment</header><text display-inline="yes-display-inline">In the case of a
			 State plan under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.)
			 which the Secretary of Health and Human Services determines requires State
			 legislation in order for the plan to meet the additional requirements imposed
			 by the amendments made by this Act, the State plan shall not be regarded as
			 failing to comply with the requirements of such title solely on the basis of
			 its failure to meet these additional requirements before the first day of the
			 first calendar quarter beginning after the close of the first regular session
			 of the State legislature that begins after the date of enactment of this Act.
			 For purposes of the previous sentence, in the case of a State that has a 2-year
			 legislative session, each year of the session is considered to be a separate
			 regular session of the State legislature.</text>
