		<official-title display="yes">To modify pay provisions relating to
		  certain senior-level positions in the Federal Government, and for other
		  purposes.</official-title>

		<section id="idE9B25DFC7E7C4361A0A3A9F174608DBE" section-type="section-one"><enum><?LEXA-Label Name="AMDT_5072"?>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Senior Professional Performance Act of
			 2008</short-title></quote>.</text>
		</section><section id="idAD308D849D074592A7C8C1985AAA5378" section-type="subsequent-section"><enum>2.</enum><header>Pay provisions
			 relating to certain senior-level positions</header>
			<subsection id="ID2cf38fab8ce94154b8f047b7dd44db52"><enum>(a)</enum><header>Locality
			 pay</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5304">Section 5304</external-xref> of title 5, United States Code, is
			 amended—</text>
				<paragraph id="IDcac5fa9231d640619868b2b5435ea95e"><enum>(1)</enum><text>in subsection
			 (g), by amending paragraph (2) to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idBE45CA26C12340368BF2A7298135925A" style="OLC">
						<paragraph id="IDd3ada26e4c5845738ce2872b7d8dd934"><enum>(2)</enum><text>The applicable
				maximum under this subsection shall be level III of the Executive Schedule
				for—</text>
							<subparagraph id="ID4364dcf7e5754bf5806f212ec2c7be3a"><enum>(A)</enum><text>positions under
				subparagraphs (A) and (B) of subsection (h)(1); and</text>
							</subparagraph><subparagraph id="IDf1c72b3cda9a4875a1467873dea94fe9"><enum>(B)</enum><text>any positions
				under subsection (h)(1)(C) as the President may
				determine.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID0cbd860a6e9844958694556abc2fd45d"><enum>(2)</enum><text>in subsection
			 (h)—</text>
					<subparagraph id="ID3561fc75331a4fa29b3003f78442e6b2"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="IDcaed05fecf524bb79b45965a38df93bd"><enum>(i)</enum><text>by
			 striking subparagraph (A);</text>
						</clause><clause id="ID16efea4f5c394aff8b376271dee5d4c3"><enum>(ii)</enum><text>in
			 subparagraph (D)—</text>
							<subclause id="id84967C8112FD4BF5ABF4EAED4875DD5C"><enum>(I)</enum><text>in clause (v), by
			 striking <quote>or</quote> at the end;</text>
							</subclause><subclause id="ID3fcb17fef499454fbe3b5fc31116b737"><enum>(II)</enum><text>in clause (vi),
			 by striking the period at the end and inserting <quote>; or</quote>; and</text>
							</subclause><subclause id="IDe83a63ea499e4ab4891e866af2203da1"><enum>(III)</enum><text>by adding at
			 the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="idC0A15FFB41BE4628B1C5AF843D6E0B00" style="OLC">
									<clause id="ID440041dabbdf4c1e8598002cf1d7dc47"><enum>(vii)</enum><text>a position to
				which section 5376 applies (relating to certain senior-level and scientific and
				professional positions).</text>
									</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause><clause id="ID106bd5ac50f3440cb13d3d74c6fc440b"><enum>(iii)</enum><text>by
			 redesignating subparagraphs (B), (C), and (D) as subparagraphs (A), (B), and
			 (C), respectively; and</text>
						</clause></subparagraph><subparagraph id="IDb25395802fc04a87b66dfd656ed15ecd"><enum>(B)</enum><text>in paragraph
			 (2)(B)—</text>
						<clause id="IDe1a6e0bda8794a60a2df0ac4ef716ada"><enum>(i)</enum><text>in
			 clause (i)—</text>
							<subclause id="IDf64f08d5098d445799769a5e01f19a64"><enum>(I)</enum><text>by striking
			 <quote>subparagraphs (A) through (C)</quote> and inserting <quote>subparagraphs
			 (A) and (B)</quote>; and</text>
							</subclause><subclause id="IDe18676b7ffdc43d480c7c052d17704af"><enum>(II)</enum><text>by striking
			 <quote>or (vi)</quote> and inserting <quote>(vi), or (vii)</quote>; and</text>
							</subclause></clause><clause id="ID0013dce50b4e4f56a7d7d7455a3b8a2f"><enum>(ii)</enum><text>in
			 clause (ii)—</text>
							<subclause id="IDc77a9164eaef4d288da0fa49d2d71254"><enum>(I)</enum><text>by striking
			 <quote>paragraph (1)(D)</quote> and inserting <quote>paragraph (1)(C)</quote>;
			 and</text>
							</subclause><subclause id="IDd86a4b59598d414b8dcfcad574dace67"><enum>(II)</enum><text>by striking
			 <quote>or (vi)</quote> and inserting <quote>(vi), or (vii)</quote>.</text>
							</subclause></clause></subparagraph></paragraph></subsection><subsection id="id2D4EFA389C0D48C2B63B2CFC8C13E40D"><enum>(b)</enum><header>Access to
			 higher maximum rate of basic pay</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5376">Section 5376(b)</external-xref> of title 5,
			 United States Code, is amended—</text>
				<paragraph id="id3BE2216F1ACA47748044750C303F86E4"><enum>(1)</enum><text>in paragraph (1),
			 by striking subparagraph (B) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id03B38307151E4CBCB6DC3F87F67712CE" style="OLC">
						<subparagraph id="id3DFBD236D6274BFE8112A6A829703647"><enum>(B)</enum><text>subject to
				paragraph (3), not greater than the rate of basic pay payable for level III of
				the Executive Schedule.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id5F6C208363914AD78D7A683F23ED09C1"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6A2FB857DB664EAB8EAF69FD412BACE2" style="OLC">
						<paragraph id="idF4FD6BA81B21416783F802DE54DAA596"><enum>(3)</enum><text>In the case of an
				agency which has a performance appraisal system which, as designed and applied,
				is certified under section 5307(d) as making meaningful distinctions based on
				relative performance, paragraph (1)(B) shall apply as if the reference to
				<quote>level III</quote> were a reference to <quote>level II</quote>.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD63A54F889C4831B59002B57804AC55"><enum>(4)</enum><text>No employee may
				suffer a reduction in pay by reason of transfer from an agency with an
				applicable maximum rate of pay prescribed under paragraph (3) to an agency with
				an applicable maximum rate of pay prescribed under paragraph
				(1)(B).</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID63e31b23f6524f31ab48075f302c4525"><enum>(c)</enum><header>Authority for
			 employment; appointments; classification standards</header><text>Title 5,
			 United States Code is amended—</text>
				<paragraph id="ID736de6ad9a2e47128317018ea00d0526"><enum>(1)</enum><text>in section
			 3104(a), in the second sentence, by striking <quote>prescribes</quote> and
			 inserting <quote>prescribes and publishes in such form as the Director may
			 determine</quote>;</text>
				</paragraph><paragraph id="ID14719f00cd8c4608aacbf4cee64d3ae0"><enum>(2)</enum><text>in section
			 3324(a) by striking <quote>the Office of Personnel Management</quote> and
			 inserting: <quote>the Director of the Office of Personnel Management on the
			 basis of qualification standards developed by the agency involved in accordance
			 with criteria specified in regulations prescribed by the
			 Director</quote>;</text>
				</paragraph><paragraph id="IDf5aa8f45323043f6b6e24f3b72cc07d1"><enum>(3)</enum><text>in section
			 3325—</text>
					<subparagraph id="ID34f4de715f274862a89a368fa1109788"><enum>(A)</enum><text>in subsection
			 (a), in the second sentence, by striking <quote>or its designee for this
			 purpose</quote> and inserting the following: <quote>on the basis of standards
			 developed by the agency involved in accordance with criteria specified in
			 regulations prescribed by the Director of the Office of Personnel
			 Management</quote>; and</text>
					</subparagraph><subparagraph id="ID45b2615284014281a63be037bf85e057"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id03AFD0B8ED1043E29C98410B92BF949E" style="OLC">
							<subsection id="IDff10c6d859a94cf0ab6dcee52d43d3d9"><enum>(c)</enum><text>The Director of
				the Office of Personnel Management shall prescribe such regulations as may be
				necessary to carry out the purpose of this
				section.</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID6cd282ca9497405c9555d29987c1b5c5"><enum>(4)</enum><text>in section
			 5108(a)(2) by inserting <quote>published by the Director of the Office of
			 Personnel Management in such form as the Director may determine</quote> after
			 <quote>and procedures</quote>.</text>
				</paragraph></subsection><subsection id="ID15f14cc3aa6444feb94fd4817119033d"><enum>(d)</enum><header>Effective date
			 and application</header>
				<paragraph id="id1289E0D387A547248DDC34FBFB073B0A"><enum>(1)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 first day of the first pay period beginning on or after the 180th day following
			 the date of enactment of this Act.</text>
				</paragraph><paragraph id="ID2eff9e98d4fa4fbf87553d2a2f6eed96"><enum>(2)</enum><header>No reductions
			 in rates of pay</header>
					<subparagraph id="id09EAD04031744022A2AD9709FFC7AE60"><enum>(A)</enum><header>In
			 general</header><text>The amendments made by this section may not result, at
			 the time such amendments take effect, in a reduction in the rate of basic pay
			 for an individual holding a position to which <external-xref legal-doc="usc" parsable-cite="usc/5/5376">section 5376</external-xref> of title 5, United
			 States Code, applies.</text>
					</subparagraph><subparagraph id="IDa96f87b0a3804102a118af5f1f06d764"><enum>(B)</enum><header>Determination
			 of rate of pay</header><text>For the purposes of subparagraph (A), the rate of
			 basic pay for an individual described in that subparagraph shall be deemed to
			 be the rate of basic pay set for the individual under <external-xref legal-doc="usc" parsable-cite="usc/5/5376">section 5376</external-xref> of title 5,
			 United States Code, plus any applicable locality pay paid to that individual on
			 the day before the effective date under paragraph (1), subject to regulations
			 that the Director of the Office of Personnel Management may prescribe.</text>
					</subparagraph></paragraph><paragraph id="IDee890d4d1b2840aa9cf53c903b73414d"><enum>(3)</enum><header>References to
			 maximum rates</header><text>Except as otherwise provided by law, any reference
			 in a provision of law to the maximum rate under <external-xref legal-doc="usc" parsable-cite="usc/5/5376">section 5376</external-xref> of title 5, United
			 States Code—</text>
					<subparagraph id="ID12736d13b1e543d2a904c0eb52681b97"><enum>(A)</enum><text>as provided
			 before the effective date of the amendments made by this section, shall be
			 considered a reference to the rate of basic pay for level IV of the Executive
			 Schedule; and</text>
					</subparagraph><subparagraph id="IDed275c2aaa4a4a5c95c9ea35ffc307dd"><enum>(B)</enum><text>as provided on or
			 after the effective date of the amendments made by this section, shall be
			 considered a reference to—</text>
						<clause id="id7EB7C69558E846949601B904CC8CAC06"><enum>(i)</enum><text>the
			 rate of basic pay for level III of the Executive Schedule; or</text>
						</clause><clause id="id738CC63F336644F2806A22D204BE313D"><enum>(ii)</enum><text>if
			 the head of the agency responsible for administering the applicable pay system
			 certifies that the employees are covered by a performance appraisal system
			 meeting the certification criteria established by regulation under section
			 5307(d), level II of the Executive Schedule.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="IDf4c1aa1712b444bcb5e76c5191dde804"><enum>3.</enum><header>Limitations on
			 certain payments</header>
			<subsection id="idD8D39A7B25D1423A9C1E7C1FFD4C836B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 5307(d) of
			 title 5, United States Code, is amended—</text>
				<paragraph id="ID31a277ee287e4b3bbc61f855692a7901"><enum>(1)</enum><text>in paragraph (2),
			 by striking all after <quote>purposes of</quote> and inserting: <quote>applying
			 the limitation in the calendar year involved, has a performance appraisal
			 system certified under this subsection as making, in its design and
			 application, meaningful distinctions based on relative performance.</quote>;
			 and</text>
				</paragraph><paragraph id="IDf05ec7355af048f08982d422aa7ad429"><enum>(2)</enum><text>in paragraph
			 (3)(B)—</text>
					<subparagraph id="IDec06b9bfb967444a9ac4bde86867c3e4"><enum>(A)</enum><text>by striking all
			 beginning with <quote>An</quote> through <quote>2 calendar years</quote> and
			 inserting <quote>The certification of an agency performance appraisal system
			 under this subsection shall be for a period not to exceed 24 months beginning
			 on the date of certification, unless extended by the Director of the Office of
			 Personnel Management for up to 6 additional months</quote>; and</text>
					</subparagraph><subparagraph id="ID7ff824cc6ef444f2a5feed743a9eb00a"><enum>(B)</enum><text>by striking
			 <quote>, for purposes of either or both of those years,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="IDecfcdfe553c74824bafac81ffef8fb6f"><enum>(b)</enum><header>Extension of
			 certification</header>
				<paragraph id="idD41AC98AB2A24B8FBA54719C52CEE08B"><enum>(1)</enum><header>Extension to
			 2009</header>
					<subparagraph id="idE53128326D3346DEA7233DC4BF865047"><enum>(A)</enum><header>In
			 general</header><text>For any certification of a performance appraisal system
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5307">section 5307(d)</external-xref> of title 5, United States Code, in effect on the date of
			 enactment of this Act and scheduled to expire at the end of calendar year 2008,
			 the Director of the Office of Personnel Management may provide that such a
			 certification shall be extended without requiring additional justification by
			 the agency.</text>
					</subparagraph><subparagraph id="id263E8B034FA940128694EF77D4F38AB2"><enum>(B)</enum><header>Limitation</header><text>The
			 expiration of any extension under this paragraph shall be not later than the
			 later of—</text>
						<clause id="id3BDEF689F41E4EF09223F8304FF6B653"><enum>(i)</enum><text>June 30, 2009;
			 or</text>
						</clause><clause id="id96E50E7D80C2435C9EDE49EFE064C06A"><enum>(ii)</enum><text>the first
			 anniversary of the date of the certification.</text>
						</clause></subparagraph></paragraph><paragraph id="ID84dfe71e278146bdb38a875e765f5969"><enum>(2)</enum><header>Extension to
			 2010</header>
					<subparagraph id="id91B579926D1E4B0F927B369927A21F5A"><enum>(A)</enum><header>In
			 general</header><text>For any certification of a performance appraisal system
			 under <external-xref legal-doc="usc" parsable-cite="usc/5/5307">section 5307(d)</external-xref> of title 5, United States Code, in effect on the date of
			 enactment and scheduled to expire at the end of calendar year 2009, the
			 Director of the Office of Personnel Management may provide that such a
			 certification shall be extended without requiring additional justification by
			 the agency.</text>
					</subparagraph><subparagraph id="idB9CD081AB29D4905BAE787E78126FF52"><enum>(B)</enum><header>Limitation</header><text>The
			 expiration of any extension under this paragraph shall be not later than the
			 later of—</text>
						<clause id="id136627EFBE1440F79EBEC0D9356AE122"><enum>(i)</enum><text>June 30, 2010;
			 or</text>
						</clause><clause id="id8A3DB423678A4104B37A2617DCFE9010"><enum>(ii)</enum><text>the second
			 anniversary of the date of the certification.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID05cd6baf93a24fcdbd9954a2aff6621e"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 date of enactment of this Act.</text>
