			<subsection commented="no" display-inline="no-display-inline" id="IDe9f00eb21ab440a3a2752cf9b7fb18fc"><enum>(a)</enum><header display-inline="yes-display-inline">Application of nondisplacement and good
			 faith recruitment requirements to all H–1B employers</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idF5186A092F8D4AD18995D79A35CE64B8"><enum>(1)</enum><header display-inline="yes-display-inline">Amendments</header><text display-inline="yes-display-inline">Section 212(n) of the Immigration and
			 Nationality Act (8 U.S.C. 1182(n)) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDec637e2e143141bb99f6296114562ff8"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID475421da810e4deca5229cf5abb3dd7a"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (E);</text>
							<subclause commented="no" display-inline="no-display-inline" id="id82D50941085943DD87258034DB438439"><enum>(I)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>(E)(i) In

			 nondisplacement</header><text display-inline="yes-display-inline">Section
			 212(n) of such Act, as amended by subsection (a), is further amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDf565b55df2734e8cb04b1ecb6dd8c097"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>

			 periods occurring more than 90 days before such date.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8b16c30d1bf64743927cf96bac7d9683"><enum>(c)</enum><header display-inline="yes-display-inline">Public listing of available
			 positions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDdd507ea7412a4cdc8a1cf01993d5ed8b"><enum>(1)</enum><header display-inline="yes-display-inline">Listing of available
			 positions</header><text display-inline="yes-display-inline">Section
			 212(n)(1)(C) of such Act is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID72364fa3be424e3f9d689f1cdea561c4"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>(i) has
			 provided</quote> and inserting the following:</text>

			 (II); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEF2C08FA66C14A9786E425730D5795DE"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting before clause (ii), as
			 redesignated, the following:</text>
						<quoted-block display-inline="no-display-inline" id="id981629B4B6E9435BAF278EA0D5F61B27" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="id5340E87B22C944F28C54E06A9F9EC693" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">has advertised the job availability on the
				list described in paragraph (6), for at least 30 calendar days;
				and</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf24360d95762492a9f4cba6c013b333a"><enum>(2)</enum><header display-inline="yes-display-inline">List maintained by the department of
			 labor</header><text display-inline="yes-display-inline">Section 212(n) of such
			 Act, as amended by this section, is further amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idDA000AE512E846D8AC1165FCE7F8BAF5" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID5ce130e3e57f49c4800b5f64b180ce22" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idB20E9C8B7BE845389AC902A5D88C3B2A"><enum>(A)</enum><text display-inline="yes-display-inline">Not later than 90 days after the date of
				the enactment of this paragraph, the Secretary of Labor shall establish a list
				of available jobs, which shall be publicly accessible without charge—</text>
								<clause commented="no" display-inline="no-display-inline" id="idFD147AC87DB44BD3894565938F86AF0C" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">on
				a website maintained by the Department of Labor, which website shall be
				searchable by—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id6463673204464F279162FDF7C1DC0E98"><enum>(I)</enum><text display-inline="yes-display-inline">the name, city, State, and zip code of the
				employer;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id472178F3F75648B2AF507685D9289631"><enum>(II)</enum><text display-inline="yes-display-inline">the date on which the job is expected to
				begin;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id51189D3207354296A9ACAD17B7CBC4AE"><enum>(III)</enum><text display-inline="yes-display-inline">the title and description of the job;
				and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idF3AC64887C0A45E6A22F2F83053D7DF8"><enum>(IV)</enum><text display-inline="yes-display-inline">the State and city (or county) at which the
				work will be performed; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id408D6133C58C4614BC918736C55869AF" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">at each 1-stop center created under the
				Workforce Investment Act of 1998 (Public Law 105–220).</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa1fb1b0acc004e078a2c106ede4bd93a" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Each available job advertised on the list
				shall include—</text>
								<clause commented="no" display-inline="no-display-inline" id="id4DA4D9FA05194F1FA84D49FAC7C67411"><enum>(i)</enum><text display-inline="yes-display-inline">the employer’s full legal name;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id7E688C6E03D94B878BD922CC8BAFF9FE"><enum>(ii)</enum><text display-inline="yes-display-inline">the address of the employer’s principal
				place of business;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id0EDAEC382269489E81B36367915A530E"><enum>(iii)</enum><text display-inline="yes-display-inline">the employer’s city, State and zip
				code;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id89B3E3E395B842CEA7A23496B6B6E1D2"><enum>(iv)</enum><text display-inline="yes-display-inline">the employer’s Federal Employer
				Identification Number;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id59520550B7BB44A59C82AFFC0533099C"><enum>(v)</enum><text display-inline="yes-display-inline">the phone number, including area code and
				extension, as appropriate, of the hiring official or other designated official
				of the employer;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idA1E323A482F242068CA5585C789F62C7"><enum>(vi)</enum><text display-inline="yes-display-inline">the e-mail address, if available, of the
				hiring official or other designated official of the employer;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id1D679544FC684425A154F8F36AD019CF"><enum>(vii)</enum><text display-inline="yes-display-inline">the wage rate to be paid for the position
				and, if the wage rate in the offer is expressed as a range, the bottom of the
				wage range;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idBC918F6810774E02AB442626C7A7045F"><enum>(viii)</enum><text display-inline="yes-display-inline">whether the rate of pay is expressed on an
				annual, monthly, biweekly, weekly, or hourly basis;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id1D7BFA53555C4A6B853CACAEFB7E10A3"><enum>(ix)</enum><text display-inline="yes-display-inline">a
				statement of the expected hours per week that the job will require;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id379BEFDF7C704FBDBF2CA7482F4C97AB"><enum>(x)</enum><text display-inline="yes-display-inline">the date on which the job is expected to
				begin;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id5A962AC9AFE34C1A838F20F9FED32CF9"><enum>(xi)</enum><text display-inline="yes-display-inline">the date on which the job is expected to
				end, if applicable;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id579B2CD55C9747D7975287FDFAFCAA3B"><enum>(xii)</enum><text display-inline="yes-display-inline">the number of persons expected to be
				employed for the job;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id4143F8B6C18241FAB39190B9773F05B2"><enum>(xiii)</enum><text display-inline="yes-display-inline">the job title;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id0501C48A098F44658891D652A7BAE090"><enum>(xiv)</enum><text display-inline="yes-display-inline">the job description;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id43CA5BACE2854F69A017893262FE22FC"><enum>(xv)</enum><text display-inline="yes-display-inline">the city and State of the physical location
				at which the work will be performed; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idF91615BFD22B45B0BD74B1D7B5126E4C"><enum>(xvi)</enum><text display-inline="yes-display-inline">a description of a process by which a
				United States worker may submit an application to be considered for the
				job.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id27D72DA47BA740DD8A29D71941F2A6BA" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The Secretary of Labor may charge a nominal
				filing fee to employers who advertise available jobs on the list established
				under this paragraph to cover expenses for establishing and administering the
				requirements under this paragraph.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE306C30A55AC4931ABAAC9A39BEBAA91" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary may promulgate rules, after
				notice and a period for comment—</text>
								<clause commented="no" display-inline="no-display-inline" id="id545E337790704B4F93E75AD4AA6F54F2"><enum>(i)</enum><text display-inline="yes-display-inline">to
				carry out the requirements of this paragraph; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id53AEADEEA4C44E04959CA25967E2CD81"><enum>(ii)</enum><text display-inline="yes-display-inline">that require employers to provide other
				information in order to advertise available jobs on the
				list.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ed7035ec5ea48289d3d2ff1e8a6dbf4"><enum>(3)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">Paragraph (1) shall take
			 effect for applications filed at least 30 days after the creation of the list
			 described in paragraph (2).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8653d41615504aca9ebc0f4a1470437f"><enum>(d)</enum><header display-inline="yes-display-inline">H–1B nonimmigrants not admitted for jobs
			 advertised or offered only to H–1B nonimmigrants</header><text display-inline="yes-display-inline">Section 212(n)(1) of such Act, as amended
			 by this section, is further amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1F76CFCF2AF44D4F955A6B5F330D1E0D"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (G) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idC4717E61DA9940B3B32529710C7B7730" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id17D076DC84F04FD79F755FFF8393812F" indent="up1"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="id2831F8E9D36E4120AD7F375FB4C3FB1D"><enum>(i)</enum><text display-inline="yes-display-inline">The employer has not advertised the
				available jobs specified in the application in an advertisement that states or
				indicates that—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idF6C8B81F63714859864F20685B48F8B9" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">the job or jobs are only available to
				persons who are or who may become H–1B nonimmigrants; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id3F7D7F8B390C45C6A954DC457CA3529E" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">persons who are or who may become H–1B
				nonimmigrants shall receive priority or a preference in the hiring
				process.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA3481DF91C674A3CABF79DA17CF24E9C" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The employer has not only recruited persons
				who are, or who may become, H–1B nonimmigrants to fill the job or
				jobs.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72E98493560A4F2392B4F26C5E0513AA"><enum>(2)</enum><text display-inline="yes-display-inline">in the undesignated paragraph at the end,
			 by striking <quote>The employer</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6D28979C958943D9A8CE04F2CA872B88" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id77B5AD01BAFF4F4DBB0D46964784C91F" indent="up1"><enum>(K)</enum><text display-inline="yes-display-inline">The
				employer</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4da78477c1ee4a51bae00cee2c654270"><enum>(e)</enum><header display-inline="yes-display-inline">Prohibition of outplacement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0f38f74bf9dc474aa998752076a3cec8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 212(n) of such Act, as amended by
			 this section, is further amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID2d9d945d1ee9436f9e524f2d9177315e"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by amending subparagraph
			 (F) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id11C31F87C30340DBBB5EEA32CF6ED749" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="ID74cfcee699254e1a9879e2a3dedc0cc8" indent="up1"><enum>(F)</enum><text display-inline="yes-display-inline">The employer shall not place, outsource,
				lease, or otherwise contract for the placement of an alien admitted or provided

			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4626227904d24754bf5b68cad8fba670"><enum>(g)</enum><header display-inline="yes-display-inline">Wage determination</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID814963040de34deaac94419567169a40"><enum>(1)</enum><header display-inline="yes-display-inline">Change in minimum wages</header><text display-inline="yes-display-inline">Section 212(n)(1) of such Act, as amended
			 by this section, is further amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4D678547B4CD45748AFAE9AAF1417B4E"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as
			 follows:</text>

									<subclause commented="no" display-inline="no-display-inline" id="ID08cc0a2d33534c9fa89fcb88c59396cc"><enum>(I)</enum><text display-inline="yes-display-inline">the locally determined prevailing wage
				level for the occupational classification in the area of employment;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1b7f0535e80d401e9e3ce627cb19b0b3"><enum>(II)</enum><text display-inline="yes-display-inline">the median average wage for all workers in
				the occupational classification in the area of employment; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID420242f0386d4818ac2eb070fffde59e"><enum>(III)</enum><text display-inline="yes-display-inline">the median wage for skill level 2 in the
				occupational classification found in the most recent Occupational Employment
				Statistics survey; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID9a524df87755444ca6ed13c59b14b28a"><enum>(ii)</enum><text display-inline="yes-display-inline">will provide working conditions for such a
				nonimmigrant that will not adversely affect the working conditions of workers
				similarly employed.</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F4A5B80E6B24FE2917D9DBD7C724E3D"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (D), by inserting
			 <quote>the wage determination methodology used under subparagraph
			 (A)(i),</quote> after <quote>shall contain</quote>.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb9d1f27e08234215813dbf28ba223fc4"><enum>(2)</enum><header display-inline="yes-display-inline">Provision of W–2 forms</header><text display-inline="yes-display-inline">Section 212(n)(1) of such Act is amended by
			 inserting after subparagraph (I), as added by subsection (f), the
			 following:</text>

				with respect to such nonimmigrants for such
				period.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8c386bc080e94abeb431b737e2058909"><enum>(3)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall apply to applications filed on or after the date of the
			 enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id24775AAA84D14AF9912F1DFCE48C87B0"><enum>(h)</enum><header display-inline="yes-display-inline">Immigration documents</header><text display-inline="yes-display-inline">Section 204 of such Act (8 U.S.C. 1154) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id65D887DFEA43461A9BFE49FB02ED670F" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idD1262AA43A814255A1AE0EFAE1C58BD3"><enum>(l)</enum><header display-inline="yes-display-inline">Employer To share all immigration paperwork
				exchanged with Federal agencies</header><text display-inline="yes-display-inline">Not later than 10 working days after
				receiving a written request from a former, current, or future employee or
				beneficiary, an employer shall provide the employee or beneficiary with the
				original (or a certified copy of the original) of all petitions, notices, and
				other written communication exchanged between the employer and the Department
				of Labor, the Department of Homeland Security, or any other Federal agency that
				is related to an immigrant or nonimmigrant petition filed by the employer for
				the employee or
				beneficiary.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id64139F78A94147CA8208405052E5A7FD" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">H–1B government authority and
			 requirements</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID2ba4f6bfca6d4e4fadeb903362115123"><enum>(a)</enum><header display-inline="yes-display-inline">Safeguards against fraud and
			 misrepresentation in application review process</header><text display-inline="yes-display-inline">Section 212(n)(1)(K) of the Immigration and
			 Nationality Act, as redesignated by section 2(d)(2), is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9dbc62dbfe0248a6a74fe1cf595db0ef"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>and through the
			 Department of Labor’s website, without charge.</quote> after
			 <quote>D.C.</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID055f7f91600743bf82b21a8458f74201"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>, clear indicators of
			 fraud, misrepresentation of material fact,</quote> after
			 <quote>completeness</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa90701a3e2de4ad192899cd5a84517e6"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>or obviously
			 inaccurate</quote> and inserting <quote>, presents clear indicators of fraud or
			 misrepresentation of material fact, or is obviously inaccurate</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9cd58de7d95c4177bada7fe0d74b35ff"><enum>(4)</enum><text display-inline="yes-display-inline">by striking <quote>within 7 days of</quote>
			 and inserting <quote>not later than 14 days after</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfd763b1c82c445c7b941ce8619f9fd63"><enum>(5)</enum><text display-inline="yes-display-inline">by adding at the end the following: “If the
			 Secretary’s review of an application identifies clear indicators of fraud or
			 misrepresentation of material fact, the Secretary may conduct an investigation
			 and hearing under paragraph (2).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0b23da275d8e4dac92f0fc1fcf321357"><enum>(b)</enum><header display-inline="yes-display-inline">Investigations by department of
			 labor</header><text display-inline="yes-display-inline">Section 212(n)(2) of
			 such Act is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4B27EF307F4E4BCD8EF3DE11BAE21C8C"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id17CAF29F0F0F458A814C4ED368FAAA99"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>12 months</quote> and
			 inserting <quote>24 months</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCFC86481F66E4A48BADA6DCA4393A807"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary shall
			 conduct</quote> and all that follows and inserting <quote>Upon the receipt of
			 such a complaint, the Secretary may initiate an investigation to determine if
			 such a failure or misrepresentation has occurred.</quote>;</text>

			 Secretary</quote> and all that follows and inserting <quote>with regard to the
			 employer’s compliance with the requirements of this subsection.</quote>;</text>

			 investigation into the employer’s compliance with the requirements of this

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3CB51469455A4671B9510360F6D3A3CB"><enum>(C)</enum><text display-inline="yes-display-inline">in clause (iii), by striking the last
			 sentence;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6918950F26CA42DABE3A54A43EC43666"><enum>(D)</enum><text display-inline="yes-display-inline">by striking clauses (iv) and (v);</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC39B4379B25D4A91A9F8181F76144A54"><enum>(F)</enum><text display-inline="yes-display-inline">in clause (iv), as redesignated, by
			 striking <quote>meet a condition described in clause (ii), unless the Secretary
			 of Labor receives the information not later than 12 months</quote> and
			 inserting <quote>comply with the requirements under this subsection, unless the
			 Secretary of Labor receives the information not later than 24
			 months</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9FA10DDC2C484CD8AFD3F6C5BD04B7AC"><enum>(G)</enum><text display-inline="yes-display-inline">by amending clause (v), as redesignated, to
			 read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="idD80A9FB6896C4A54BFD569318C29B902" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="id01CF91EE30E84CF69CDA67DDA51485DE" indent="up3"><enum>(v)</enum><text display-inline="yes-display-inline">The Secretary of Labor shall provide notice
				to an employer of the intent to conduct an investigation. The notice shall be
				provided in such a manner, and shall contain sufficient detail, to permit the
				employer to respond to the allegations before an investigation is commenced.
				The Secretary is not required to comply with this clause if the Secretary
				determines that such compliance would interfere with an effort by the Secretary
				to investigate or secure compliance by the employer with the requirements of
				this subsection. A determination by the Secretary under this clause shall not
				be subject to judicial
				review.</text>
							</clause><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idABADEDEF9E844516955A0EEEFFEE2157"><enum>(H)</enum><text display-inline="yes-display-inline">in clause (vi), as redesignated, by
			 striking <quote>An investigation</quote> and all that follows through
			 <quote>the determination.</quote> and inserting <quote>If the Secretary of
			 Labor, after an investigation under clause (i) or (ii), determines that a
			 reasonable basis exists to make a finding that the employer has failed to
			 comply with the requirements under this subsection, the Secretary shall provide
			 interested parties with notice of such determination and an opportunity for a
			 hearing in accordance with section 556 of title 5, United States Code, not
			 later than 120 days after the date of such determination.</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAB6800E35F494A008FD9134B22436869"><enum>(I)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id2C3C12FD66D24A23976C2F249FD79A5F" style="OLC">
							<clause commented="no" display-inline="no-display-inline" id="id2DCBB23FD7DD4E439D38610C47544FCC" indent="up3"><enum>(vii)</enum><text display-inline="yes-display-inline">If the Secretary of Labor, after a hearing,
				finds a reasonable basis to believe that the employer has violated the
				requirements under this subsection, the Secretary may impose a penalty under
				subparagraph (C).</text>
							</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1F685D9510064BE18F235272D9618A43"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subparagraph (H).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID39689b31b79e43368f1f62bbb01ac7a6"><enum>(c)</enum><header display-inline="yes-display-inline">Information sharing between department of
			 labor and department of homeland security</header><text display-inline="yes-display-inline">Section 212(n)(2) of such Act, as amended
			 by this section, is further amended by inserting after subparagraph (G) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id94B003DDBB4B4E03B3C3D63CD1C782C6" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="idAA2AAE570DBA44C080F0E701DCEBDE9C" indent="up1"><enum>(H)</enum><text display-inline="yes-display-inline">The Director of United States Citizenship
				and Immigration Services shall provide the Secretary of Labor with any
				information contained in the materials submitted by H–1B employers as part of
				the adjudication process that indicates that the employer is not complying with
				H–1B visa program requirements. The Secretary may initiate and conduct an
				investigation and hearing under this paragraph after receiving information of
				noncompliance under this
				subparagraph.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0b9939d1849240bb9913e99c0c49cc52"><enum>(d)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">Section 212(n)(2)(A) of such Act, as
			 amended by this section, is further amended by adding at the end the following:
			 <quote>The Secretary may conduct surveys of the degree to which employers
			 comply with the requirements under this subsection and may conduct annual
			 compliance audits of employers that employ H–1B nonimmigrants. The Secretary
			 shall conduct annual compliance audits of not less than 1 percent of the
			 employers that employ H–1B nonimmigrants during the applicable calendar year.
			 The Secretary shall conduct annual compliance audits of each employer with more
			 than 100 employees who work in the United States if more than 15 percent of
			 such employees are H–1B nonimmigrants.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8EB42E5AD9F649A98375B0B7E4C0B5D3"><enum>(e)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">Section 212(n)(2)(C) of such Act, as
			 amended by this section, is further amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idCAE38C3114E04E2AA74C7ED8731E3288"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i)(I), by striking
			 <quote>$1,000</quote> and inserting <quote>$2,000</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB0AED5FBFED44A5086E91DA1D16C6F1E"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (ii)(I), by striking
			 <quote>$5,000</quote> and inserting <quote>$10,000</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEB825BBC33FC4247A7A5D3891F69ACB1"><enum>(3)</enum><text display-inline="yes-display-inline">in clause (vi)(III), by striking
			 <quote>$1,000</quote> and inserting <quote>$2,000</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID34db937f2a26441a96375b8dd78b8602"><enum>(f)</enum><header display-inline="yes-display-inline">Information provided to H–1B nonimmigrants
			 upon visa issuance</header><text display-inline="yes-display-inline">Section
			 212(n) of such Act, as amended by this section, is further amended by inserting
			 after paragraph (2) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB2551863836F4DF9BDE959DE3AC00109" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID3302a72f43e2482ba756e5a85813b055" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE89F9377EF2540F582A3995665D9B274"><enum>(A)</enum><text display-inline="yes-display-inline">Upon issuing an H–1B visa to an applicant
				outside the United States, the issuing office shall provide the applicant
				with—</text>
							<clause commented="no" display-inline="no-display-inline" id="id9253CF9AF4C14B7C8032742B1D890A8E" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">a
				brochure outlining the employer’s obligations and the employee’s rights under
				Federal law, including labor and wage protections;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idE8F4EE1B59F54350A2D8B9CD3297A708" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the contact information for Federal
				agencies that can offer more information or assistance in clarifying employer
				obligations and workers’ rights; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id339F9CED26F140C296D1426DD4145F84" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">a copy of the employer’s H–1B application
				for the position that the H–1B nonimmigrant has been issued the visa to
				fill.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1C42133FA1A74923A3FBFA4F1C450AA9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Upon the issuance of an H–1B visa to an
				alien inside the United States, the officer of the Department of Homeland
				Security shall provide the applicant with—</text>
							<clause commented="no" display-inline="no-display-inline" id="idB5936ECE64C944A0B90A020FD475EB88"><enum>(i)</enum><text display-inline="yes-display-inline">a
				brochure outlining the employer’s obligations and the employee’s rights under
				Federal law, including labor and wage protections;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idE3FC440F2481452FA49DA8D36484162E"><enum>(ii)</enum><text display-inline="yes-display-inline">the contact information for Federal
				agencies that can offer more information or assistance in clarifying employer's
				obligations and workers' rights; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idA59B0B571A3D4F36B017C78526CC31E6"><enum>(iii)</enum><text display-inline="yes-display-inline">a copy of the employer's H–1B application
				for the position that the H–1B nonimmigrant has been issued the visa to
				fill.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id0BCAC909B00F4AC197A331502272BBF0" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">L–1 visa fraud and abuse
			 protections</header>
			<subsection commented="no" display-inline="no-display-inline" id="idF0798B41E3B3410B9A3B353D6AB134DD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 214(c)(2) of the Immigration and
			 Nationality Act (8 U.S.C. 1184(c)(2)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDe1ce10d10b554c8abbcf190d1e56d68f"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Attorney General</quote>
			 each place it appears and inserting <quote>Secretary of Homeland
			 Security</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6049438acca24e31b2f8ac890065dd2b"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking <quote>In
			 the case of an alien spouse admitted under section 101(a)(15)(L), who</quote>
			 and inserting <quote>Except as provided in subparagraph (H), if an alien spouse
			 admitted under section 101(a)(15)(L)</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDead77071b9864dbc9ac5866fea71094c"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA212BD586984449D8D130B5BC111ACBE" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="IDf940b0da84ef4541ab98b6bedc345eeb" indent="up2"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="idD91F6D29801D49DB8AFDEEEF9EF4186F"><enum>(i)</enum><text display-inline="yes-display-inline">If the beneficiary of a petition under this
				subsection is coming to the United States to open, or be employed in, a new
				facility, the petition may be approved for up to 12 months only if the employer
				operating the new facility has—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idE02E78BD56344DCFB9DC5AB22F19BD58" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">a
				business plan;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idDD53DDE4D60746D8810D6B260B2B4DC0" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">sufficient physical premises to carry out
				the proposed business activities; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id345AB8D2554943EAB312241B2DE2D2A1" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">the financial ability to commence doing
				business immediately upon the approval of the petition.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id1EDB22A5C435407B8553B0E3765C3E52" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">An extension of the approval period under
				clause (i) may not be granted until the importing employer submits an
				application to the Secretary of Homeland Security that contains—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idCF9CEE039195485294159AACDEA27E69"><enum>(I)</enum><text display-inline="yes-display-inline">evidence that the importing employer meets
				the requirements of this subsection;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id421913D4834348C190DE8F6C7069DC14"><enum>(II)</enum><text display-inline="yes-display-inline">evidence that the beneficiary meets the
				requirements under section 101(a)(15)(L);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id9327A5BA81E44105B68CFF838A007978"><enum>(III)</enum><text display-inline="yes-display-inline">a statement summarizing the original
				petition;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idA868CCD2CBF3465BB03CD45A05740D3A"><enum>(IV)</enum><text display-inline="yes-display-inline">evidence that the importing employer has
				fully complied with the business plan submitted under clause (i)(I);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id8360CFF50714415DB5E900096EB14978"><enum>(V)</enum><text display-inline="yes-display-inline">evidence of the truthfulness of any
				representations made in connection with the filing of the original
				petition;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idB811F7B0EF1E47FD99804C7BB9112CBD"><enum>(VI)</enum><text display-inline="yes-display-inline">evidence that the importing employer,
				during the preceding 12 months, has been doing business at the new facility
				through regular, systematic, and continuous provision of goods or services, or
				has otherwise been taking commercially reasonable steps to establish the new
				facility as a commercial enterprise;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id6B05066EF60142A292677063B0F8C9B7"><enum>(VII)</enum><text display-inline="yes-display-inline">a statement of the duties the beneficiary
				has performed at the new facility during the preceding 12 months and the duties
				the beneficiary will perform at the new facility during the extension period
				approved under this clause;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idDCDABF0BB2B6489982E397A08BB8AAFC"><enum>(VIII)</enum><text display-inline="yes-display-inline">a statement describing the staffing at the
				new facility, including the number of employees and the types of positions held
				by such employees;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id7E67059BA07F494FA7994DA0A1F0C06C"><enum>(IX)</enum><text display-inline="yes-display-inline">evidence of wages paid to employees;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id787D66D9342241E28C78C0090B9EE4BC"><enum>(X)</enum><text display-inline="yes-display-inline">evidence of the financial status of the new
				facility; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idD21E91887C1B49028270517FAD6BF02D"><enum>(XI)</enum><text display-inline="yes-display-inline">any other evidence or data prescribed by
				the Secretary.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id3BE511E407AD4442A0829D5D33DEDA45" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">Notwithstanding subclauses (I) through (VI)
				of clause (ii), and subject to the maximum period of authorized admission set
				forth in subparagraph (D), the Secretary of Homeland Security may approve a
				petition subsequently filed on behalf of the beneficiary to continue employment
				at the facility described in this subsection for a period beyond the initially
				granted 12-month period if the importing employer demonstrates that the failure
				to satisfy any of the requirements described in those subclauses was directly
				caused by extraordinary circumstances beyond the control of the importing
				employer.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id25D1E86AF7714B48B73775EB004EDDF5" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">For purposes of determining the eligibility
				of an alien for classification under section 101(a)(15)(L), the Secretary of
				Homeland Security shall work cooperatively with the Secretary of State to
				verify a company or facility's existence in the United States and
				abroad.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC7C5BDA29A7B4E2F870F894B838C1B6E"><enum>(b)</enum><header display-inline="yes-display-inline">Restriction on blanket
			 petitions</header><text display-inline="yes-display-inline">Section
			 214(c)(2)(A) of such Act is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id085CF6BFE5944A22A85258F760D99227" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id701D04AB279044F2A955BB4AC9D70FF1" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id961D746D4B3D44BC9C7C579EFA1F3BF0"><enum>(A)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may not
				permit the use of blanket petitions to import aliens as nonimmigrants under
				section
				101(a)(15)(L).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id7C8C571B7C2D4025A08EAD00FC09C786"><enum>(c)</enum><header display-inline="yes-display-inline">Prohibition on outplacement</header><text display-inline="yes-display-inline">Section 214(c)(2) of such Act, as amended
			 by this section, is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE1D78768289F408DB23DEBFB0246526B" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="id51BF87FCE5724988BEA4D93744222C27" indent="up2"><enum>(H)</enum><text display-inline="yes-display-inline">An employer who imports 1 or more aliens as
				nonimmigrants described in section 101(a)(15)(L) shall not place, outsource,
				lease, or otherwise contract for the placement of an alien admitted or provided
				status as an L–1 nonimmigrant with another
				employer.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id98B949A71A5044CCBC8F1A094D699BD9"><enum>(d)</enum><header display-inline="yes-display-inline">Investigations and audits by department of
			 Homeland Security</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idD6E181A9828645B4A08C6D169DF1537A"><enum>(1)</enum><header display-inline="yes-display-inline">Department of homeland security
			 investigations</header><text display-inline="yes-display-inline">Section
			 214(c)(2) of such Act, as amended by this section, is further amended by adding
			 at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id67994A5283204D238DF9913EA70A00DC" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id19946609F13940F195E09DB26763BD75" indent="up2"><enum>(I)</enum><clause commented="no" display-inline="yes-display-inline" id="idA093FFC285B4490D9DE097BB1F35E11D"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may
				initiate an investigation of any employer that employs nonimmigrants described
				in section 101(a)(15)(L) with regard to the employer’s compliance with the
				requirements of this subsection.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id35F7551BBD194E8A991C2D2D159D168A" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				receives specific credible information from a source who is likely to have
				knowledge of an employer’s practices, employment conditions, or compliance with
				the requirements under this subsection, the Secretary may conduct an
				investigation into the employer’s compliance with the requirements of this
				subsection. The Secretary may withhold the identity of the source from the
				employer, and the source's identity shall not be subject to disclosure under
				section 552 of title 5.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idE341CC1406D4412DAAFA367928C63283" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall
				establish a procedure for any person desiring to provide to the Secretary of
				Homeland Security information described in clause (ii) that may be used, in
				whole or in part, as the basis for the commencement of an investigation
				described in such clause, to provide the information in writing on a form
				developed and provided by the Secretary of Homeland Security and completed by
				or on behalf of the person.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id368AE5064695459DA199CEF7546915EA" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">No investigation described in clause (ii)
				(or hearing described in clause (vi) based on such investigation) may be
				conducted with respect to information about a failure to comply with the
				requirements under this subsection, unless the Secretary of Homeland Security
				receives the information not later than 24 months after the date of the alleged
				failure.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id6120A62916444A65890498CB51129408" indent="up1"><enum>(v)</enum><text display-inline="yes-display-inline">Before commencing an investigation of an
				employer under clause (i) or (ii), the Secretary of Homeland Security shall
				provide notice to the employer of the intent to conduct such investigation. The
				notice shall be provided in such a manner, and shall contain sufficient detail,
				to permit the employer to respond to the allegations before an investigation is
				commenced. The Secretary is not required to comply with this clause if the
				Secretary determines that to do so would interfere with an effort by the
				Secretary to investigate or secure compliance by the employer with the
				requirements of this subsection. There shall be no judicial review of a
				determination by the Secretary under this clause.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idB0ECE13344934152A5B08717F28B8410" indent="up1"><enum>(vi)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security,
				after an investigation under clause (i) or (ii), determines that a reasonable
				basis exists to make a finding that the employer has failed to comply with the
				requirements under this subsection, the Secretary shall provide interested
				parties with notice of such determination and an opportunity for a hearing in
				accordance with section 556 of title 5, United States Code, not later than 120
				days after the date of such determination. If such a hearing is requested, the
				Secretary shall make a finding concerning the matter by not later than 120 days
				after the date of the hearing.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id7489647B041D4CC3AB16502F7615C946" indent="up1"><enum>(vii)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security,
				after a hearing, finds a reasonable basis to believe that the employer has
				violated the requirements under this subsection, the Secretary may impose a
				penalty under section
				214(c)(2)(J).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0C4B7F69253E4080BA636A3DB0050F1B"><enum>(2)</enum><header display-inline="yes-display-inline">Audits</header><text display-inline="yes-display-inline">Section 214(c)(2)(I) of such Act, as added
			 by paragraph (1), is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB3204FCACE7A4A23B946C83767BB2E8F" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="idDB29E317C7214A288F46A4E3420AAF78" indent="up3"><enum>(viii)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may
				conduct surveys of the degree to which employers comply with the requirements
				under this section and may conduct annual compliance audits of employers that
				employ H–1B nonimmigrants. The Secretary shall conduct annual compliance audits
				of not less than 1 percent of the employers that employ nonimmigrants described
				in section 101(a)(15)(L) during the applicable calendar year. The Secretary
				shall conduct annual compliance audits of each employer with more than 100
				employees who work in the United States if more than 15 percent of such
				employees are nonimmigrants described in section
				101(a)(15)(L).</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFA2DEF2A26514FD19987D4B9F8AAD547"><enum>(3)</enum><header display-inline="yes-display-inline">Reporting requirement</header><text display-inline="yes-display-inline">Section 214(c)(8) of such Act is amended by
			 inserting <quote>(L),</quote> after <quote>(H),</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1911DB1BC52E4437A62BFCBBB3DA47D0"><enum>(e)</enum><header display-inline="yes-display-inline">Penalties</header><text display-inline="yes-display-inline">Section 214(c)(2) of such Act, as amended
			 by this section, is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idC06D2D516C7240FB82822662BA78533F" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="IDd2fe04e8a3f64f58b2354159d211924a"><enum>(J)</enum><clause commented="no" display-inline="yes-display-inline" id="id90A36D2295FA4653A27380F6EE60463C"><enum>(i)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				finds, after notice and an opportunity for a hearing, a failure by an employer
				to meet a condition under subparagraph (F), (G), (H), (I), or (K) or a
				misrepresentation of material fact in a petition to employ 1 or more aliens as
				nonimmigrants described in section 101(a)(15)(L)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id33AACD9724E7464583C0DABBC17502BD" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security may
				impose such other administrative remedies (including civil monetary penalties
				in an amount not to exceed $2,000 per violation) as the Secretary determines to
				be appropriate; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idEB573BFC7CCF4ABC8F9FF38BF312BBAE" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security may not,
				during a period of at least 1 year, approve a petition for that employer to
				employ 1 or more aliens as such nonimmigrants.</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id026534D174EF42138CD76923E42C739A" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				finds, after notice and an opportunity for a hearing, a willful failure by an
				employer to meet a condition under subparagraph (F), (G), (H), (I), or (K) or a
				misrepresentation of material fact in a petition to employ 1 or more aliens as
				nonimmigrants described in section 101(a)(15)(L)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id8C482DD48BE54D0CA92BAF3E662BBDC4"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security may
				impose such other administrative remedies (including civil monetary penalties
				in an amount not to exceed $10,000 per violation) as the Secretary determines
				to be appropriate; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id37E9B415167A49408EC17D043D2546C5"><enum>(II)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security may not,
				during a period of at least 2 years, approve a petition filed for that employer
				to employ 1 or more aliens as such nonimmigrants.</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id9C6BB024CF0F40ADB725B01F6D8D8733" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security
				finds, after notice and an opportunity for a hearing, a willful failure by an
				employer to meet a condition under subparagraph (L)(i)—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idAE31E408547242DC9F4330D6AAAF06DB"><enum>(I)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security may
				impose such other administrative remedies (including civil monetary penalties
				in an amount not to exceed $10,000 per violation) as the Secretary determines
				to be appropriate; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idFF55271994D74ABC9BA5BC86CDC2057A"><enum>(II)</enum><text display-inline="yes-display-inline">the employer shall be liable to employees
				harmed for lost wages and
				benefits.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idF8D4492D05DF4A03AC7E526767D4BF25"><enum>(f)</enum><header display-inline="yes-display-inline">Wage determination</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id0AA28794C05049E8A7430F078EDB66EA"><enum>(1)</enum><header display-inline="yes-display-inline">Change in minimum wages</header><text display-inline="yes-display-inline">Section 214(c)(2) of such Act, as amended
			 by this section, is further amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6D049D75A7F543FAAB63547FB8CE9732" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="id612B9F9EFD824360A837C96F61309A70"><enum>(K)</enum><clause commented="no" display-inline="yes-display-inline" id="id0410E7A1C96049B2AB2C70A830739C41"><enum>(i)</enum><text display-inline="yes-display-inline">An employer that employs a nonimmigrant
				described in section 101(a)(15)(L) shall—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id63EDA678BDE447029762B1A23C9727D6" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">offer such nonimmigrant, during the period
				of authorized employment, wages, based on the best information available at the
				time the application is filed, which are not less than the highest of—</text>
									<item commented="no" display-inline="no-display-inline" id="id976A8C7F93B247098DD0C0D2CCC88273"><enum>(aa)</enum><text display-inline="yes-display-inline">the locally determined prevailing wage
				level for the occupational classification in the area of employment;</text>
									</item><item commented="no" display-inline="no-display-inline" id="idB738C8F1DB59443EB31CDFCF84FFD392"><enum>(bb)</enum><text display-inline="yes-display-inline">the median average wage for all workers in
				the occupational classification in the area of employment; or</text>
									</item><item commented="no" display-inline="no-display-inline" id="idBD185CB2CD304235937588A7066E4DE6"><enum>(cc)</enum><text display-inline="yes-display-inline">the median wage for skill level 2 in the
				occupational classification found in the most recent Occupational Employment
				Statistics survey; and</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="id3C79A886AD964813B260B287DF89D917" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">provide working conditions for such
				nonimmigrant that will not adversely affect the working conditions of workers
				similarly employed.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id19FF37F0DB6A4A7C996C07B05B21F96C" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">If an employer, in such previous period
				specified by the Secretary of Homeland Security, employed 1 or more L–1
				nonimmigrants, the employer shall provide to the Secretary of Homeland Security
				the Internal Revenue Service Form W–2 Wage and Tax Statement filed by the
				employer with respect to such nonimmigrants for such period.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9DE40139FAE44244B9E90282B676F26B" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">It is a failure to meet a condition under
				this subparagraph for an employer, who has filed a petition to import 1 or more
				aliens as nonimmigrants described in section 101(a)(15)(L), to—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id6337A37BAE7F448089CE78DE483EB61D"><enum>(I)</enum><text display-inline="yes-display-inline">require such a nonimmigrant to pay a
				penalty for ceasing employment with the employer before a date mutually agreed
				to by the nonimmigrant and the employer; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id4D7B72EE113946119C691659571D9BA2"><enum>(II)</enum><text display-inline="yes-display-inline">fail to offer to such a nonimmigrant,
				during the nonimmigrant’s period of authorized employment, on the same basis,
				and in accordance with the same criteria, as the employer offers to United
				States workers, benefits and eligibility for benefits, including—</text>
									<item commented="no" display-inline="no-display-inline" id="idF55654C336ED4F55B63234BA293CA783"><enum>(aa)</enum><text display-inline="yes-display-inline">the opportunity to participate in health,
				life, disability, and other insurance plans;</text>
									</item><item commented="no" display-inline="no-display-inline" id="id4685964D7504467EB25E93E8564A5670"><enum>(bb)</enum><text display-inline="yes-display-inline">the opportunity to participate in
				retirement and savings plans; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="idDEA978727E8A42FB8EBF967EE4695456"><enum>(cc)</enum><text display-inline="yes-display-inline">cash bonuses and noncash compensation, such
				as stock options (whether or not based on performance).</text>
									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="id671E510FA84B4AA0B9D2302A868B7810" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security shall
				determine whether a required payment under clause (iii)(I) is a penalty (and
				not liquidated damages) pursuant to relevant State
				law.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0B98CC32828441689B0CBABB0825E67F"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall apply to applications filed on or after the date of the
			 enactment of this Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID4b9f7c838b8c48e4b2a3f0ba62ae5702" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Whistleblower protections</header>
			<subsection commented="no" display-inline="no-display-inline" id="id6D90C877207E45AF8144A4AC6689878C"><enum>(a)</enum><header display-inline="yes-display-inline">H–1B whistleblower
			 protections</header><text display-inline="yes-display-inline">Section
			 212(n)(2)(C)(iv) of the Immigration and Nationality Act (8 U.S.C.
			 1182(n)(2)(C)(iv)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idC1EA1B02D2734F40A28E52556DC1F6A6"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>take, fail to take, or
			 threaten to take or fail to take, a personnel action, or</quote> before
			 <quote>to intimidate</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id476636C6111041C6A0C623C61196DEDC"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:
			 <quote>An employer that violates this clause shall be liable to the employees
			 harmed by such violation for lost wages and benefits.</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id87F9197A803A498985FBA8527F640BA5"><enum>(b)</enum><header display-inline="yes-display-inline">L–1 whistleblower protections</header><text display-inline="yes-display-inline">Section 214(c)(2) of such Act, as amended
			 by section 4, is further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE8CD36033B444FE4B70C1B78741A63BA" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="id1010057F9FF44FF28C60E3478F13E4AF" indent="up2"><enum>(L)</enum><clause commented="no" display-inline="yes-display-inline" id="id54A306468AAC4C0CB1083CF0E3B1AAEA"><enum>(i)</enum><text display-inline="yes-display-inline">It is a violation of this subparagraph for
				an employer who has filed a petition to import 1 or more aliens as
				nonimmigrants described in section 101(a)(15)(L) to take, fail to take, or
				threaten to take or fail to take, a personnel action, or to intimidate,
				threaten, restrain, coerce, blacklist, discharge, or discriminate in any other
				manner against an employee because the employee—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id8B91AB1DD8044731B5E7C793A3151ED7" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">has disclosed information that the employee
				reasonably believes evidences a violation of this subsection, or any rule or
				regulation pertaining to this subsection; or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id8D2E4D77C1EB41DDA72DB1C4814A3D8A" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">cooperates or seeks to cooperate with the
				requirements of this subsection, or any rule or regulation pertaining to this
				subsection.</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id8B0DCFCF4C3A458284FA35BD03F3511F" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">An employer that violates this subparagraph
				shall be liable to the employees harmed by such violation for lost wages and
				benefits.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id6E214DADF5B74B5CB85C323B0603D000" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">In this subparagraph, the term
				<term>employee</term> includes—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id2E043C37216C4F5297CABC54D11320E5"><enum>(I)</enum><text display-inline="yes-display-inline">a
				current employee;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id79533BF9A47F48DAA98EDCF188BAF06B"><enum>(II)</enum><text display-inline="yes-display-inline">a
				former employee; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idC42263B3AC314B36BDB56555624BAB41"><enum>(III)</enum><text display-inline="yes-display-inline">an applicant for
				employment.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idC234208C38234A978AA2E650B4833044" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Additional Department of Labor
			 employees</header>
			<subsection commented="no" display-inline="no-display-inline" id="id65679157793B4531AE44D7B4084D526F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Labor is authorized to
			 hire 200 additional employees to administer, oversee, investigate, and enforce
			 programs involving H–1B nonimmigrant workers.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8F8B621373B54D159C6FF341A778B6E4"><enum>(b)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 section.</text>
