			<section commented="no" display-inline="no-display-inline" id="ID52482E6565A94B57B1824EC3DC3E6DB7" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Capital loss deduction allowed with respect
			 to sale or exchange of principal residence in certain rural areas</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID77611763C056430A91E7E5069E1F7D2E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (c) of section 165 of the
			 Internal Revenue Code of 1986 (relating to limitation on losses of individuals)
			 is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="IDF875CC5FCA8B402495E9156F4E267838"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and</quote> at the end
			 of paragraph (2),</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC76B337E5DE8495A926F2FF598B75F7F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking the period at the end of
			 paragraph (3) and inserting <quote>; and</quote>, and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDA2DF0EDC4F14BA895534CAF33B8BA4A"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="ID5AC32F031A9E4991952535AC9D8F1B93" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="ID44700B51CDF94DF8BFAE6084B9CB8AF9"><enum>(4)</enum><text display-inline="yes-display-inline">losses arising from the sale or exchange of
				the principal residence (within the meaning of section 121) of the taxpayer,
				but only if such principal residence—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id379E5735B51D4D68A8FBB835076E4BA5"><enum>(A)</enum><text display-inline="yes-display-inline">is located in a nonmetropolitan county
				which, based on information contained in the 2000 decennial census, has a
				population which resides in areas more than 50 percent of which are classified
				as rural by the Secretary of Agriculture, and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12BFB2ABD956433F939B9D0C8F04AA5B"><enum>(B)</enum><text display-inline="yes-display-inline">was acquired by the taxpayer after the date
				of the enactment of this
				paragraph.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC94D150D4B8A495489D606396AC345E8"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 67(b)(3) is amended by striking
			 <quote>paragraph (2) or (3)</quote> and inserting <quote>paragraph (2), (3), or
			 (4)</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB25DA733BC0846DAADE5E2A27DC822E6"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to sales and exchanges after the date of the enactment
			 of this Act, in taxable years ending after such date.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id7E9EC08B8AA4424E9184BAACA995B9D6" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Rural student loan forgiveness</header>
				<subsection commented="no" display-inline="no-display-inline" id="ID31aed75591ab47b9aae3cb03662a5485"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID6d70865612de4706b3d1f38cb3242d7e"><enum>(1)</enum><header display-inline="yes-display-inline">Degree</header><text display-inline="yes-display-inline">The term <term>degree</term> means an
			 associate's degree or baccalaureate degree awarded by an institution of higher
			 education.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdfa4b071b81443bf932cd4b1a7bbe611"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible borrower</header><text display-inline="yes-display-inline">The term <term>eligible borrower</term>
			 means any borrower who is not in default on any of the borrower's student loans
			 under part B, D, or E of title IV of the Higher Education Act of 1965.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf77c6e2457054360b1aaf49da125a710"><enum>(3)</enum><header display-inline="yes-display-inline">Institution of higher
			 education</header><text display-inline="yes-display-inline">The term
			 <term>institution of higher education</term> has the meaning given the term in
			 section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID67ccf91a48eb4da1a4cbcae6c38c6336"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible area</header><text display-inline="yes-display-inline">The term <term>eligible area</term> means a
			 nonmetropolitan county that, based on information contained in the 2000
			 decennial census, has a population that resides in areas more than 50 percent
			 of which are classified as rural by the Secretary of Agriculture.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5704ff9e323e452ebabb196667b353f0"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Education.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID831eb10bb8f44a2f9d735f1bc29273cc"><enum>(b)</enum><header display-inline="yes-display-inline">Program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID3b14b0675624460ca0dd8a0c5a790838"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a program of
			 assuming or cancelling the obligation to repay, pursuant to subsection (c), a
			 loan made, insured, or guaranteed under part B, D, or E of title IV of the
			 Higher Education Act of 1965 (20 U.S.C. 1071 et seq., 20 U.S.C. 1087a et seq.,
			 20 U.S.C. 1087aa et seq.), excluding loans made under section 428B of such Act
			 or comparable loans made under part D of such Act, for any borrower who—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID44b558f29077432aba2c770ff4e53892"><enum>(A)</enum><text display-inline="yes-display-inline">obtains a degree;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa41efd83a03545d2bc6ba2215cd32293"><enum>(B)</enum><text display-inline="yes-display-inline">resides in an eligible area; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1df30c8b4b4a476b9e213699ef87d2a9"><enum>(C)</enum><text display-inline="yes-display-inline">is employed in an eligible area.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc4a4a60aa57a44259ccab81100355342"><enum>(2)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary is authorized to prescribe
			 such regulations as may be necessary to carry out the provisions of this
			 section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID582de8aa3138470ca17866db3f66d364"><enum>(c)</enum><header display-inline="yes-display-inline">Loan repayment or cancellation</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID904c7e51c7f443d6853640f0fd513371"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall assume or cancel the
			 obligation to repay, after each of the first 5 years of the residency and
			 employment described in subparagraphs (B) and (C) of subsection (b)(1) that
			 occur after the date of enactment of this Act, 10 percent of the total amount
			 of all loans made to a student under the provisions of title IV of the Higher
			 Education Act of 1965 as described in subsection (b)(1), up to a maximum amount
			 of $2,000 each year.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDff245cb42af64c319d850528dd5eadb0"><enum>(2)</enum><header display-inline="yes-display-inline">Construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
			 to authorize the refunding of any repayment of a loan made, insured, or
			 guaranteed under part B, D, or E of title IV of the Higher Education Act of
			 1965.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID797f0fd3de4d417fb4afb058273fcafd"><enum>(3)</enum><header display-inline="yes-display-inline">Interest</header><text display-inline="yes-display-inline">If a portion of a loan is repaid or
			 cancelled by the Secretary under this section for any year, the proportionate
			 amount of interest on such loan that accrues for such year shall be repaid or
			 cancelled by the Secretary so long as the total amount repaid or cancelled by
			 the Secretary in any 1 year does not exceed $2,000.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3da6e692189c47528ec73570f8bfdc62"><enum>(d)</enum><header display-inline="yes-display-inline">Repayment to eligible lenders</header><text display-inline="yes-display-inline">The Secretary shall pay to each eligible
			 lender or holder for each fiscal year an amount equal to the aggregate amount
			 of loans which are subject to repayment pursuant to this section for such
			 year.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID39c15cb8a83c4a6c909379e192eff355"><enum>(e)</enum><header display-inline="yes-display-inline">Application for repayment or
			 cancellation</header>
					<paragraph commented="no" display-inline="no-display-inline" id="ID2e1d32d9500941739fb2184adfb091a6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An eligible borrower desiring loan
			 repayment or cancellation under this section shall submit a complete and
			 accurate application to the Secretary at such time, in such manner, and
			 containing such information as the Secretary may require.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf3648ee0b3e04b90a596c7c5a88f0942"><enum>(2)</enum><header display-inline="yes-display-inline">Conditions</header><text display-inline="yes-display-inline">An eligible borrower may apply for loan
			 repayment or cancellation under this section after completing each year of
			 qualifying residency and employment. The eligible borrower shall receive
			 forbearance while engaged in qualifying residency and employment unless the
			 borrower is in deferment while so engaged.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8a9574e5dc984146be502e82d52763ec"><enum>(f)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="IDab8501b7a2f24d788b01a42cb828f980"><enum>(1)</enum><header display-inline="yes-display-inline">Loan repayment and
			 cancellation</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to carry out this section such sums as may be
			 necessary.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc90b0f8987c34bfd877bada53df749f2"><enum>(2)</enum><header display-inline="yes-display-inline">Perkins loan funds</header><text display-inline="yes-display-inline">There are authorized to be appropriated
			 such sums as may be necessary for Federal capital contributions to student loan
			 funds established under part E of title IV of the Higher Education Act of
			 1965.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID802b686b17844238b977f8f6e571fe59"><enum>(g)</enum><header display-inline="yes-display-inline">Repayment or cancellation excluded from
			 gross income</header><text display-inline="yes-display-inline">Section
			 108(f)(1) of the Internal Revenue Code of 1986 (relating to student loans) is
			 amended by inserting <quote>or pursuant to section 102 of the
			 <short-title>Rural Investment to Strengthen our Economy
			 Act of 2007</short-title></quote> after <quote>employers</quote>.</text>
				</subsection></section></title><title commented="no" id="id42566A0485A942828A1381AB5C1CCC84" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Access to credit for rural entrepreneurs
			 and microenterprises</header>
			<section commented="no" display-inline="no-display-inline" id="id8D5A8C9F1E5249C493D5B65C966B4D2C" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Rural entrepreneurship and microenterprise
			 program</header><text display-inline="no-display-inline">Subtitle D of the
			 Consolidated Farm and Rural Development Act is amended by inserting after
			 section 364 (7 U.S.C. 2006f) the following:</text>

					<section commented="no" display-inline="no-display-inline" id="IDf9ddc5052c0e40b7b26f8fdbcd3ec567" section-type="subsequent-section"><enum>365.</enum><header display-inline="yes-display-inline">Rural entrepreneurship and microenterprise
				program</header>
						<subsection commented="no" display-inline="no-display-inline" id="id7A79EF112EA04508811952D47E12BB81"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID67f223d89fa547f29d3330368bf492dd"><enum>(1)</enum><header display-inline="yes-display-inline">Economically disadvantaged
				microentrepreneur</header><text display-inline="yes-display-inline">The term
				<term>economically disadvantaged microentrepreneur</term> means an owner,
				majority owner, or developer of a microenterprise in an eligible area that has
				the ability to compete in the private sector but has been impaired due to
				diminished capital and credit opportunities, as compared to other
				microentrepreneurs in the industry.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5CCE9BDDD44147FE9E70B671B8E8C279"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible area</header><text display-inline="yes-display-inline">The term <term>eligible area</term> means a
				nonmetropolitan county that, based on information contained in the 2000
				decennial census, has a population that resides in areas more than 50 percent
				of which are classified as rural by the Secretary.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0e9b421f65a8496289bf800acffd15ee"><enum>(3)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the
				meaning given the term in section 4 of the Indian Self-Determination and
				Education Assistance Act (25 U.S.C. 450b).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID90c063879fb342ac873787207e8c9bc4"><enum>(4)</enum><header display-inline="yes-display-inline">Intermediary</header><text display-inline="yes-display-inline">The term <term>intermediary</term> means an
				entity that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id7B41C2F09395401D875B5D6B1A3F03A8"><enum>(A)</enum><text display-inline="yes-display-inline">makes and services microloans to eligible
				small business concerns; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD95AD0D7AC36489BB8B824E52619F191"><enum>(B)</enum><text display-inline="yes-display-inline">provides marketing, management, and
				technical assistance to borrowers, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDb878766c15004153b6ba7638156fe825"><enum>(i)</enum><text display-inline="yes-display-inline">a microenterprise development organization
				or program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDd47280dd0d7e4a7a9019803f4ed88904"><enum>(ii)</enum><text display-inline="yes-display-inline">a private, nonprofit community development
				corporation;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID89289ba4b1074923b38fa39826356b6b"><enum>(iii)</enum><text display-inline="yes-display-inline">a consortium of private, nonprofit
				community development corporations or other entities;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID415c2d0450e542c387134d967fb30d24"><enum>(iv)</enum><text display-inline="yes-display-inline">a quasi-governmental economic development
				entity, other than a State, county, municipal government, or any agency of a
				State, county, or municipal government; or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID6dd8a7ab97ff4628bda7998b01d78afd"><enum>(v)</enum><text display-inline="yes-display-inline">an agency of, or a nonprofit entity
				established by, a tribal government.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7a35a61477834d668a2091b64cb38e8f"><enum>(5)</enum><header display-inline="yes-display-inline">Low-income individual</header><text display-inline="yes-display-inline">The term <term>low-income individual</term>
				means an individual with an income (adjusted for family size) of not more than
				the greater of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDd531536b0bde4e3fb255c42f70d5bb00"><enum>(A)</enum><text display-inline="yes-display-inline">80 percent of median income of an area;
				or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3af126a83b5f42dab57f45cff4593847"><enum>(B)</enum><text display-inline="yes-display-inline">80 percent of the statewide nonmetropolitan
				area median income.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc57c9ddf3c3946bfbfa23c64b89b1e64"><enum>(6)</enum><header display-inline="yes-display-inline">Microcredit</header><text display-inline="yes-display-inline">The term <term>microcredit</term> means a
				business loan or loan guarantee of not more than $50,000 provided to a rural
				entrepreneur.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID74a88ca7afc4407d86bb53d01023393f"><enum>(7)</enum><header display-inline="yes-display-inline">Microenterprise</header><text display-inline="yes-display-inline">The term <term>microenterprise</term> means
				a sole proprietorship, joint enterprise, limited liability company,
				partnership, corporation, or cooperative that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDe94ec5e257804f3388f826ddc62c77f3"><enum>(A)</enum><text display-inline="yes-display-inline">has 5 or fewer employees; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8135a020dc504a5b8489dd4375933b5e"><enum>(B)</enum><text display-inline="yes-display-inline">is unable to obtain sufficient credit,
				equity, or banking services elsewhere, as determined by the Secretary.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDde7c9de8d6ad4962ab9a0a4b0ce17631"><enum>(8)</enum><header display-inline="yes-display-inline">Microenterprise development
				organization</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID3deec5e0e4214261b08633f406699b40"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>microenterprise development
				organization</term> means a nonprofit entity that provides training and
				technical assistance to rural entrepreneurs and access to capital or another
				service described in subsection (b) to rural entrepreneurs.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID65118f556ce2470e948cdc64574ea355"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>microenterprise development
				organization</term> includes an organization described in subparagraph (A) with
				a demonstrated record of delivering services to economically disadvantaged
				microentrepreneurs.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID101e269682294350b14abcfaa28d2cca"><enum>(9)</enum><header display-inline="yes-display-inline">Microenterprise development
				program</header><text display-inline="yes-display-inline">The term
				<term>microenterprise development organization</term> means a program
				administered by a organization serving an eligible area.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDee93758390094c6d8ee896e894712bb3"><enum>(10)</enum><header display-inline="yes-display-inline">Microentrepreneur</header><text display-inline="yes-display-inline">The term <term>microentrepreneur</term>
				means the owner, operator, or developer of a microenterprise.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7bc6d79b42d949a6a3d63a7595be5ef0"><enum>(11)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
				rural entrepreneur and microenterprise program established under subsection
				(b)(1).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID24a14b8b9b8748828416c690a92ba94c"><enum>(12)</enum><header display-inline="yes-display-inline">Qualified organization</header><text display-inline="yes-display-inline">The term <term>qualified
				organization</term> means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID20d6837257b7451891adc1e962e6002a"><enum>(A)</enum><text display-inline="yes-display-inline">a microenterprise development organization
				or microenterprise development program that has a demonstrated record of
				delivering microenterprise services to rural entrepreneurs, as demonstrated by
				the development of an effective plan of action and the possession of necessary
				resources to deliver microenterprise services to rural entrepreneurs
				effectively, as determined by the Secretary;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID93e2a363eb874bfb88be6dc2bce3eb5d"><enum>(B)</enum><text display-inline="yes-display-inline">an intermediary that has a demonstrated
				record of delivery assistance to microenterprise development organizations or
				microenterprise development programs;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9d1288dfb1d34251af706c5c3374ca91"><enum>(C)</enum><text display-inline="yes-display-inline">a microenterprise development organization
				or microenterprise development program that—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID0856da8c258046c09ab3f43564e1f5bf"><enum>(i)</enum><text display-inline="yes-display-inline">serves rural entrepreneurs; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID967a2b583f524f0fb92bcc541f2314fd"><enum>(ii)</enum><text display-inline="yes-display-inline">enters into an agreement with a local
				community, in conjunction with a State or local government or Indian tribe, to
				provide assistance described in subsection (b);</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6c9e35f40d3448528656a99c8e0a421c"><enum>(D)</enum><text display-inline="yes-display-inline">an Indian tribe, the tribal government of
				which certifies to the Secretary that no microenterprise development
				organization or microenterprise development program exists under the
				jurisdiction of the Indian tribe;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa4a3683eb78b420ba3b98df3740d147c"><enum>(E)</enum><text display-inline="yes-display-inline">a group of 2 or more organizations or
				Indian tribes described in subparagraph (A), (B), (C), or (D) that agree to act
				jointly as a qualified organization under this section; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDab2f60c290304d9cafa89609ef356716"><enum>(F)</enum><text display-inline="yes-display-inline">for purposes of subsection (b), an
				institution of higher education (as defined in section 101(a) of the
				<act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
				U.S.C. 1001(a))).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9d7b8eb7163846119463a4999a1fa613"><enum>(13)</enum><header display-inline="yes-display-inline">Rural capacity building
				service</header><text display-inline="yes-display-inline">The term <term>rural
				capacity building service</term> means a service provided to an organization
				that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDd49bbbd5a5294bcfa952fd9e2b102b8e"><enum>(A)</enum><text display-inline="yes-display-inline">is, or is in the process of becoming, a
				microenterprise development organization or microenterprise development
				program; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID106865389722460fa316ffeca8cb5da2"><enum>(B)</enum><text display-inline="yes-display-inline">serves eligible areas for the purpose of
				enhancing the ability of the organization to provide training, technical
				assistance, and other related services to rural entrepreneurs.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2e70c5d563cd4be2b710bca4a4a2cd36"><enum>(14)</enum><header display-inline="yes-display-inline">Rural entrepreneur</header><text display-inline="yes-display-inline">The term <term>rural entrepreneur</term>
				means a microentrepreneur, or prospective microentrepreneur—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID8b5a93e20364429287e5f89905019db3"><enum>(A)</enum><text display-inline="yes-display-inline">the principal place of business of which is
				in an eligible area; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3bbef89a9208488287f1903c45f490e1"><enum>(B)</enum><text display-inline="yes-display-inline">that is unable to obtain sufficient
				training, technical assistance, or microcredit elsewhere, as determined by the
				Secretary.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9643366aa624454fbc8184fe2c8baad7"><enum>(15)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of Agriculture, acting through the Administrator of the Rural
				Business-Cooperative Service.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7808E8547C1E4A8D8F8ED6D32F1CC175"><enum>(16)</enum><header display-inline="yes-display-inline">Small business concern</header><text display-inline="yes-display-inline">The term <term>small business
				concern</term> has the meaning given the term in section 3 of the
				<act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.
				632).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf69ac528213d440f85484c59abdb83a6"><enum>(17)</enum><header display-inline="yes-display-inline">Training and technical and financial
				assistance</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDe4cc73d10cf84d128f5b2dba59cd888e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>training and technical and
				financial assistance</term> means assistance provided to rural entrepreneurs to
				develop the skills the rural entrepreneurs need to plan, market, and manage
				their own business.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID63ad7a8dcbc541b2820b70c979cdff84"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>training and technical and
				financial assistance</term> includes assistance provided for the purpose
				of—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDc29d8cdaeafe41cf820241709d122c78"><enum>(i)</enum><text display-inline="yes-display-inline">enhancing business planning, marketing,
				management, or financial management skills; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDd8a75666433744348fc76cc22feb801c"><enum>(ii)</enum><text display-inline="yes-display-inline">obtaining microcredit.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45bb084e4cdb4505a6e11a9b1faa354f"><enum>(18)</enum><header display-inline="yes-display-inline">Tribal government</header><text display-inline="yes-display-inline">The term <term>tribal government</term>
				means the governing body of an Indian tribe.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf6482cdad8fd49e3b5ccc5c0d3b11027"><enum>(b)</enum><header display-inline="yes-display-inline">Rural entrepreneur and microenterprise
				program</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID029094ae90fd4c17b011e8dec61b06c9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From amounts made available under
				subsection (h), the Secretary shall establish a rural entrepreneurship and
				microenterprise program.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaffcee826c8d48bda11e4bdc9d0d1a63"><enum>(2)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of the program are—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID1ad8b0c3892a46788fd309cea8c34648"><enum>(A)</enum><text display-inline="yes-display-inline">to make grants to qualified organizations
				and intermediaries to be used for marketing, management, and technical
				assistance to the target population of the program;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID23e7ede7e47d43a9940b32334e2e3382"><enum>(B)</enum><text display-inline="yes-display-inline">to make grants to assist in researching and
				developing the best practices in delivering and evaluating training, technical
				assistance, and microcredit programs to rural entrepreneurs;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4fb4ca56f91143bdbf8166892f5f3d24"><enum>(C)</enum><text display-inline="yes-display-inline">to make direct and guaranteed loans to
				qualified organizations and intermediaries for the purpose of making microloans
				to low-income individuals and moderate-income individuals in rural areas to
				establish and sustain new small business concerns; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe25679ad5c874962916342a973ade486"><enum>(D)</enum><text display-inline="yes-display-inline">to carry out such other projects and
				activities as the Secretary determines are consistent with this section.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID88d0a12cfbfa482eb94e7a7e2a52151d"><enum>(3)</enum><header display-inline="yes-display-inline">Allocation</header><text display-inline="yes-display-inline">From the total amount of funds made
				available for a fiscal year to make grants and loans under this section, the
				Secretary shall ensure that not less than 50 percent of funds are used to carry
				out activities described in subparagraphs (A) and (B) of paragraph (2).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID96f4c2a700a6436f91f0dd1f9f85c14b"><enum>(c)</enum><header display-inline="yes-display-inline">Grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID78141aa050df4245a64e58f5ad446a0f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A qualified organization or intermediary
				shall be eligible to receive a grant under the program to provide marketing,
				management, and technical assistance to small business concerns.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0794ffea38d7416b9580cd0acaed10cf"><enum>(2)</enum><header display-inline="yes-display-inline">Grant limitations</header><text display-inline="yes-display-inline">No single qualified organization may
				receive more than 10 percent of the total funds that are made available for a
				fiscal year to carry out this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa50fe69d8e943febe1a2da69af7877a"><enum>(3)</enum><header display-inline="yes-display-inline">Subgrants</header><text display-inline="yes-display-inline">Subject to such regulations as the
				Secretary may promulgate, a qualified organization that receives a grant under
				this section may use the grant to provide assistance to other qualified
				organizations, including small or emerging qualified organizations.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID676c7b0dd33445de85ffb0d3732de4dc"><enum>(d)</enum><header display-inline="yes-display-inline">Loan administration</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID3733be8230734c94b67b47f5fa2a6edf"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out the program, the Secretary
				may provide loans to qualified organizations and intermediaries to provide
				microcredit to rural entrepreneurs and microenterprises, under such terms and
				conditions as the Secretary may prescribe.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDaa7150ba4be749ca891be08397966166"><enum>(2)</enum><header display-inline="yes-display-inline">Loan duration</header><text display-inline="yes-display-inline">Loans made under this paragraph shall be
				for a term of 10 years.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDeb643e1990ba4fd2a17f11c10a80fa22"><enum>(3)</enum><header display-inline="yes-display-inline">Application interest rates</header><text display-inline="yes-display-inline">Loans made under this paragraph to a
				qualified organization or intermediary shall bear an interest rate equal to 2
				percentage points below the rate determined by the Secretary of the Treasury
				for obligations of the United States with a period of maturity of 5 years,
				adjusted to the nearest one-eighth of 1 percent.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID75c7c42249fa40d4b4f162a691816667"><enum>(e)</enum><header display-inline="yes-display-inline">Administrative expenses</header><text display-inline="yes-display-inline">Not more than 15 percent of the total
				amount of assistance received by a qualified organization of intermediary for a
				fiscal year under this section may be used for administrative expenses.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1ea162f749a142a48d9389c2cc36a156"><enum>(f)</enum><header display-inline="yes-display-inline">Targeted populations</header><text display-inline="yes-display-inline">In making grants and loans under this
				section, the Secretary shall ensure, to the maximum extent practicable,
				that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id789B4A10E7104F22BE05A1A0C1711BEB"><enum>(1)</enum><text display-inline="yes-display-inline">grant and loan recipients include qualified
				organizations and intermediaries—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idFF4D66240447420290932A7F33280C09"><enum>(A)</enum><text display-inline="yes-display-inline">of varying sizes; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE9B8E67DEDFA4D40B2C9BA457DE416F2"><enum>(B)</enum><text display-inline="yes-display-inline">that serve racially, ethnically and
				geographically diverse populations, and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0C81057C6C1249CFA0E6B629B317A8F3"><enum>(2)</enum><text display-inline="yes-display-inline">not less than 50 percent of the grants and
				loans made under this section are used to benefit low-income individuals,
				women, or minorities, as identified by the Secretary, including individuals
				residing on Indian reservations.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf005d9a903d441ba9c971a33b1f13de2"><enum>(g)</enum><header display-inline="yes-display-inline">Cost share</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID2629b05c8e6d410187cc1041ffabf0cf"><enum>(1)</enum><header display-inline="yes-display-inline">Federal share</header><text display-inline="yes-display-inline">The Federal share of the cost of a project
				carried out using funds from a grant under this section shall be 75
				percent.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDba567e206a44471780897e340fc15bc2"><enum>(2)</enum><header display-inline="yes-display-inline">Form of non-Federal share</header><text display-inline="yes-display-inline">The non-Federal share of the cost of a
				project described in paragraph (1) may be provided—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf5f2398f4f984aeb99ec85fcfc15750b"><enum>(A)</enum><text display-inline="yes-display-inline">by public funds, including funds obtained
				through other Federal, State and local fees and grants; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID201a57a1e6a94cb387d1bbc51f2b1b75"><enum>(B)</enum><text display-inline="yes-display-inline">by private funds.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID951e934f75de46fcb4db2ddbc08fda55"><enum>(h)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">There is authorized to be appropriated
				$30,000,000 to carry out this
				section.</text>

				<subsection commented="no" display-inline="no-display-inline" id="idA70929A173A941FCBA01E944B973AB11"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of eligible area</header><text display-inline="yes-display-inline">Section 385B of the Consolidated Farm and
			 Rural Development Act (7 U.S.C. 2009dd–1) is amended by striking paragraph (3)
			 and inserting the following:</text>

			 of the Consolidated Farm and Rural Development Act (7 U.S.C. 2009dd–2(b)(2)(A))
			 is amended by striking clauses (vi) and (vii) and inserting the

					<section commented="no" display-inline="no-display-inline" id="idBE2BA8DEFC2A4C589C36CD7C41301338" section-type="subsequent-section"><enum>385I.</enum><header display-inline="yes-display-inline">Rural regional entrepreneurship
				program</header>
						<subsection commented="no" display-inline="no-display-inline" id="id368718AF16C24C719622F786A9B04601"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of rural
				entrepreneur</header><text display-inline="yes-display-inline">The term
				<term>rural entrepreneur</term> has the meaning given the term in section
				365(a).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id35A6854B9C5B48C7A95E468F0B9D312E"><enum>(b)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The Secretary shall establish a rural
				regional entrepreneurship program under which the Secretary shall provide
				grants to stimulate rural entrepreneurship and provide technical assistance,
				research, and evaluation to rural entrepreneurs.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id6B7E6BC08B7841859A5ECE76B05780FD"><enum>(c)</enum><header display-inline="yes-display-inline">Block grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id915BB6F107514470B11048BDB997AE67"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From amounts made available under
				subsection (f), the Secretary shall use $15,000,000 for each fiscal year to
				make block grants to States in accordance with this subsection.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEF6B991861BF4E23BB504D8D1A517B68"><enum>(2)</enum><header display-inline="yes-display-inline">Amount of grant</header><text display-inline="yes-display-inline">A grant to a State under this subsection
				for any fiscal year shall be in an amount that is, as determined by the
				National Board—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idBD6DD64FCDB84233846ECAD05DA51B69"><enum>(A)</enum><text display-inline="yes-display-inline">not more than $400,000; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D5106DB670B46B7A82A5B3D84ACB62A"><enum>(B)</enum><text display-inline="yes-display-inline">not less than $200,000.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF496B396A518407A944A03EFCCB17718"><enum>(3)</enum><header display-inline="yes-display-inline"> Cost Share</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this subsection, a State shall match any grant funds received under this
				subsection with an equal or greater amount of non-Federal funds.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2B022C5D88824536B2CDC6FFE1D70A04"><enum>(4)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">A State shall use funds received under this
				subsection to support multi-county entrepreneurship development systems focused
				on eligible areas in consultation with the RUPRI Center for Rural
				Entrepreneurship.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2FFE3D7E185341328F637C0282AB29D3"><enum>(d)</enum><header display-inline="yes-display-inline">Competitive regional entrepreneurship
				grants</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id6620B09C1E44449EA1C1CCFB7606CE4A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From amounts made available under
				subsection (f), the Secretary shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idD4611F91680545D4912AA58ADCB61C76"><enum>(A)</enum><text display-inline="yes-display-inline">transfer $15,000,000 for each fiscal year
				to the National Board to make regional entrepreneurship grants to rural
				entrepreneurs through a competitive application process; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58e9eebc7bfb4614907942e94a907449"><enum>(B)</enum><text display-inline="yes-display-inline">use at least $10,000,000 to make grants to
				successful applicants identified as regional intermediaries under subsection
				(e)(3).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAC119FEAA7E74763A505D102639C7887"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The Under Secretary for Rural Development
				shall administer grants under this subsection.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDFA543562E6D444A817F8A756929E0EC"><enum>(e)</enum><header display-inline="yes-display-inline">Center for Rural Entrepreneurship</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id519ADA36CA844E7389A980BCE12DDB12"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">From amounts made available under
				subsection (f), the Secretary shall transfer $10,000,000 for each fiscal year
				to the RUPRI Center for Rural Entrepreneurship (referred to in this subsection
				as the <term>Center</term>) for use in accordance with this subsection.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A4C26C607F841AC9B7869ED428F3B3A"><enum>(2)</enum><header display-inline="yes-display-inline">Research, evaluation, and data collection
				and analysis</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idE643BDF156204A8EBD7E5049A65A9D40"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Of the amount transferred to the Center
				under paragraph (1), the Center shall use $5,000,000 for each fiscal year to
				carry out research, evaluation, and data collection and analysis programs, of
				which not less than $500,000 for each fiscal year shall be used to enter into
				contracts, in accordance with a national research agenda approved by the
				National Board, with each of—</text>
									<clause commented="no" display-inline="no-display-inline" id="id1146060EE0C04B8195098AC268414829"><enum>(i)</enum><text display-inline="yes-display-inline">the regional rural development centers
				described in section 1670(a) of the Food, Agriculture, Conservation, and Trade
				Act of 1990 (7 U.S.C. 5923(a)); and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idD32C890325DA403995596AA6C8FFF818"><enum>(ii)</enum><text display-inline="yes-display-inline">the Economic Research Service.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDA665ECEF2324C07B3E41274158E8685"><enum>(B)</enum><header display-inline="yes-display-inline">Coordination and focus of
				programs</header><text display-inline="yes-display-inline">The programs carried
				out under this paragraph shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="id4B5C01295D374CF6A8D7873FB4008746"><enum>(i)</enum><text display-inline="yes-display-inline">be coordinated by the Center across a broad
				range of higher education institutions and research organizations; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idA1D4823EFDE6469393F942D8772B0559"><enum>(ii)</enum><text display-inline="yes-display-inline">focus on providing insights and creating
				opportunities for sustained entrepreneurship development in rural areas of the
				United States.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id74B40DC2A6B044F9AD3C16A45182BB17"><enum>(3)</enum><header display-inline="yes-display-inline">Regional intermediaries</header><text display-inline="yes-display-inline">Of the amount transferred to the Center
				under paragraph (1), the Center shall use $4,000,000 for each fiscal year to
				establish and maintain a nationwide network of regional intermediaries with the
				capacity and tools—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id08F80605FF5447DD898D0DF15C48E48D"><enum>(A)</enum><text display-inline="yes-display-inline">to provide effective entrepreneurship
				development information, training, and technical assistance to rural regions
				and communities in the United States; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id284BDE91B2D5459FA783B77C34D89159"><enum>(B)</enum><text display-inline="yes-display-inline">to enhance the effectiveness of
				organizations that provide direct technical assistance and training services to
				rural entrepreneurs.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68025D90AD594280A6430F9C7D126323"><enum>(4)</enum><header display-inline="yes-display-inline">Management activities and
				reports</header><text display-inline="yes-display-inline">Of the amount
				transferred to the Center under paragraph (1), the Center shall use $1,000,000
				for each fiscal year—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id50E01A5471F3449EA07FC53E92878660"><enum>(A)</enum><text display-inline="yes-display-inline">to enhance and sustain the capacity and
				ability of the Center to direct and manage the programs and activities
				described in paragraphs (1), (2), and (3); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB984E74DC1414A2499B8BEA1A4A39FAF"><enum>(B)</enum><text display-inline="yes-display-inline">to submit—</text>
									<clause commented="no" display-inline="no-display-inline" id="id2FC8E681F4CB47C9846856052D956C49"><enum>(i)</enum><text display-inline="yes-display-inline">to the National Board, an annual report
				that describes those programs and activities carried out during the year
				covered by the report; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id9D5CAEBC4BE14888A419267A3610F13E"><enum>(ii)</enum><text display-inline="yes-display-inline">to the Secretary, an annual report that
				describes the state of entrepreneurship in the United States during the year
				covered by the report.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8CA0D8E619754853A3F970148A4CB78B"><enum>(5)</enum><header display-inline="yes-display-inline">Availability of funds; contracts</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="idDE4B3AF7AA4C48B7A62C39B41759CA01"><enum>(A)</enum><header display-inline="yes-display-inline">Availability of funds</header><text display-inline="yes-display-inline">Funds made available under this subsection
				shall remain available until expended, including for any purpose under this
				section.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id42E82D6EB5374007800980EED839E2B0"><enum>(B)</enum><header display-inline="yes-display-inline">Contracts</header><text display-inline="yes-display-inline">Each contract entered into by the Center
				and an individual or entity shall be based on the performance of the individual
				or entity.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1FEC584F59EE49DE8B75534088F2EB22"><enum>(f)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Of funds made available under section
				385E(b)(3), for each of fiscal years 2008 through 2012, the Secretary shall use
				to carry out this section $40,000,000, to remain available until
				expended.</text>

			<section commented="no" display-inline="no-display-inline" id="ID870236BA30124361ADE56FE789A9BE44" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDE7915F78A7BF4307B2A4D96D17A501AA"><enum>(1)</enum><text display-inline="yes-display-inline">many small businesses lack the financial
			 capacity to support the training of high-skilled workers;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9A555A66760342A19B90963D46C5D55C"><enum>(2)</enum><text display-inline="yes-display-inline">many high-tech companies concerned about
			 worker training consider recruiting employees from overseas because a shortage
			 of information technology workers remains a significant problem;</text>

			 and 4-year colleges and universities and community colleges together to help
			 develop and implement effective programs to make sure workers have the training
			 needed to compete in the modern workplace.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID92AAF8015D1A4DE482363C22E246597F" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Definition of Secretary</header><text display-inline="no-display-inline">In this title, the term
			 <quote>Secretary</quote> means the Secretary of Labor.</text>
			</section><subtitle commented="no" id="ID69696A0D6A474DB6BE56B6FFE7C03D00" level-type="subsequent" style="OLC"><enum>A</enum><header display-inline="yes-display-inline">Skill grants</header>

			 subsection is a consortium that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID40A4F7D4FEB04A118409F8F2DF55547C"><enum>(A)</enum><text display-inline="yes-display-inline">shall consist of representatives from not
			 less than 5 businesses, or a lesser number of businesses if such lesser number
			 of businesses employs at least 30 percent of the employees in the industry
			 involved in the region (or a nonprofit organization that represents such
			 businesses);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2A7B75559D8F4876BD52CC5229D075D7"><enum>(B)</enum><text display-inline="yes-display-inline">may consist of representatives from—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID241766B51952478A84421C6EC36C4EB6"><enum>(i)</enum><text display-inline="yes-display-inline">labor organizations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID8A4A01AD455F4B008EDE00AA6F1FABEE"><enum>(ii)</enum><text display-inline="yes-display-inline">State and local government; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID81DC96ED84BB426197F9BCDE5CAEDE62"><enum>(iii)</enum><text display-inline="yes-display-inline">educational institutions;</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID84538C2653CD4D99897543AEF63186FA"><enum>(C)</enum><text display-inline="yes-display-inline">is established to serve 1 or more
			 particular industries; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDEA9D83D993A48C38DCE97F287BEDB03"><enum>(D)</enum><text display-inline="yes-display-inline">is established to serve an eligible
			 area.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B83ADE08B6D45B8AC65A85B87F21D15"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible area</header><text display-inline="yes-display-inline">The term <term>eligible area</term> means a
			 nonmetropolitan county that, based on information contained in the 2000
			 decennial census—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id866911B807DA41FBAABE36A1C0E8A0F8"><enum>(A)</enum><text display-inline="yes-display-inline">has a population that resides in areas more
			 than 50 percent of which are classified as rural by the Secretary of
			 Agriculture; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2730039738A4F61B52BD637876E4944"><enum>(B)</enum><text display-inline="yes-display-inline">had an average employment percentage change
			 during the period of calendar years 2001 through 2004 that was less than the
			 national average employment percentage change (as determined by the Bureau of
			 Economic Analysis).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEC1DABA3576F4A96912E7DB0BA8E3F71"><enum>(3)</enum><header display-inline="yes-display-inline">Majority of representatives</header><text display-inline="yes-display-inline">A majority of the representatives
			 comprising the consortium shall be representatives described in paragraph
			 (1)(A).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8D0FF41EFCB84035BDF0754604E6C8FB"><enum>(c)</enum><header display-inline="yes-display-inline">Priority for small businesses</header><text display-inline="yes-display-inline">In providing grants under subsection (a),
			 the Secretary shall give priority to an eligible entity if a majority of
			 representatives forming the entity represent small-business concerns (as
			 defined in <external-xref legal-doc="act" parsable-cite="SBA/3(a)">section
			 3(a)</external-xref> of the <act-name parsable-cite="SBA">Small Business
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/632(a)">15
			 U.S.C. 632(a)</external-xref>).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC11AE0BA18144C198ECAA1B9A49E7EDE"><enum>(d)</enum><header display-inline="yes-display-inline">Maximum amount of grant</header><text display-inline="yes-display-inline">The amount of a grant awarded to an
			 eligible entity under subsection (a) may not exceed $1,000,000 for any fiscal
			 year.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="IDED610B1416E54188B0898885E3145DEB" section-type="subsequent-section"><enum>412.</enum><header display-inline="yes-display-inline">Use of amounts</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID2164E29215AE4487B8D8F300B0B5A02D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may not award a grant under
			 section 411 to an eligible entity unless the entity agrees to use amounts
			 received from the grant to improve the job skills necessary for employment by
			 businesses in the industry with respect to which the entity was
			 established.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID6004F2683EDD4750B922E6009BC3FA9B"><enum>(b)</enum><header display-inline="yes-display-inline">Conduct of program</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID157E59AE51684310AD5E76D013D38200"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out the program described in
			 subsection (a), the eligible entity may provide for—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDB58356DA80AF4BE697246F99F300B469"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of training and job skill
			 needs for the industry;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD5876894047649FCBF27001CC1FEF074"><enum>(B)</enum><text display-inline="yes-display-inline">the development of a sequence of skill
			 standards that are benchmarked to advanced industry practices;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1F7A48416F664FD2BF6CCDFFE73046F0"><enum>(C)</enum><text display-inline="yes-display-inline">the development of curriculum and training
			 methods, including, where appropriate, e-learning or technology-based
			 training;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID47FEB665500F42B58972C9C1FE92641E"><enum>(D)</enum><text display-inline="yes-display-inline">the purchase, lease, or receipt of
			 donations of training equipment;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID59780EC370BD40A6A565BB9E5823F086"><enum>(E)</enum><text display-inline="yes-display-inline">the identification of training providers
			 and the development of partnerships between the industry and educational
			 institutions, including community colleges;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD0784200DF80448DB4794D63199834CF"><enum>(F)</enum><text display-inline="yes-display-inline">the development of apprenticeship
			 programs;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE77BB12ACCF54993BB3BB400D2B0A025"><enum>(G)</enum><text display-inline="yes-display-inline">the development of training programs for
			 workers, including dislocated workers;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE13B24F4F9C540C8AF8D2D9CCF336453"><enum>(H)</enum><text display-inline="yes-display-inline">the development of training plans for
			 businesses; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF5697EFE1064465FAA0544FA64F27218"><enum>(I)</enum><text display-inline="yes-display-inline">the development of the membership of the
			 entity.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID92E7FE0A93164B8AB05FFF08F52240FB"><enum>(2)</enum><header display-inline="yes-display-inline">Additional requirement</header><text display-inline="yes-display-inline">In carrying out the program described in
			 subsection (a), the eligible entity shall provide for the development and
			 tracking of performance outcome measures for the program and the training
			 providers involved in the program.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD3FF8EB2C382477AB4D1B7A6F7FCCF35"><enum>(c)</enum><header display-inline="yes-display-inline">Administrative costs</header><text display-inline="yes-display-inline">The eligible entity may use not more than
			 10 percent of the amount of a grant to pay for administrative costs associated
			 with the program described in subsection (a).</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="IDDC70D624CEBE467A82E8AD6DFF72C656" section-type="subsequent-section"><enum>413.</enum><header display-inline="yes-display-inline">Requirement of matching funds</header>
					<subsection commented="no" display-inline="no-display-inline" id="IDBDB8983AAE7547E3829033F31E98417B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may not award a grant under
			 section 411 to an eligible entity unless the entity agrees that the entity will
			 make available non-Federal contributions toward the costs of carrying out
			 activities under the grant in an amount that is not less than $2 for each $1 of
			 Federal funds provided under the grant, of which—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID6A851EB3DB434207A7F827331DAEB4E6"><enum>(1)</enum><text display-inline="yes-display-inline">$1 shall be provided by the businesses
			 participating in the entity; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDA544750C62E45C086BF44E2DED67E90"><enum>(2)</enum><text display-inline="yes-display-inline">$1 shall be provided by the State or local
			 government involved.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3EDF7D5DFABC4F7EBEEE14C00096A84C"><enum>(b)</enum><header display-inline="yes-display-inline">Other contributions</header>
						<paragraph commented="no" display-inline="no-display-inline" id="IDB9BCDF7FAA15432E8F8F37254B2422F2"><enum>(1)</enum><header display-inline="yes-display-inline">Equipment</header><text display-inline="yes-display-inline">Equipment donations to facilities that are
			 not owned or operated by the members of the eligible entity involved and that
			 are shared by the members may be included in determining compliance with
			 subsection (a).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE6E7024B6F20497C92FEE504635DEDBB"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idBE8270D9B0B14B0D9BB57E0C8955F95B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An eligible entity may not include in-kind
			 contributions in complying with the requirement of subsection (a).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9CD033A48C9B4D3C9841CBE8477823D4"><enum>(B)</enum><header display-inline="yes-display-inline">Consideration</header><text display-inline="yes-display-inline">The Secretary may consider donations
			 described in subparagraph (A) in ranking applications.</text>
							</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID8CF42CB9AE7C42EE92B4B782DB1000AA" section-type="subsequent-section"><enum>414.</enum><header display-inline="yes-display-inline">Limit on administrative
			 expenses</header><text display-inline="no-display-inline">The Secretary may use
			 not more than 5 percent of the amounts made available to carry out this title
			 to pay the Federal administrative costs associated with awarding grants under
			 this title.</text>
				</section><section commented="no" display-inline="no-display-inline" id="ID49DECBE441FB44B195ED125210C5C51F" section-type="subsequent-section"><enum>415.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this subtitle—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idBE4F9A20EA034891BAA37F43E0A9B2D3"><enum>(1)</enum><text display-inline="yes-display-inline">$50,000,000 for each of fiscal years 2008
			 through 2012; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBFBD776424204968AB2AA2DCE5D5DF30"><enum>(2)</enum><text display-inline="yes-display-inline">such sums as are necessary for each fiscal
			 year thereafter.</text>
					</paragraph></section></subtitle><subtitle commented="no" id="ID827548A4055147D5AD41DCFE4B5D2EFF" level-type="subsequent" style="OLC"><enum>B</enum><header display-inline="yes-display-inline">Planning grants</header>
				<section commented="no" display-inline="no-display-inline" id="ID860626334128450092DBC4FB054D00E8" section-type="subsequent-section"><enum>421.</enum><header display-inline="yes-display-inline">Authorization</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID1156C50445C34619B098ACFFD25E7987"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, in consultation with the
			 Secretary of Commerce, shall award grants to States to enable the States to
			 assist businesses, organizations, and agencies described in section 411(b) in
			 conducting planning to form consortia described in that section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF0005B589A7F4F6E9EF3CABC4935E123"><enum>(b)</enum><header display-inline="yes-display-inline">Maximum amount of grant</header><text display-inline="yes-display-inline">The amount of a grant awarded to a State
			 under subsection (a) may not exceed $500,000 for any fiscal year.</text>
					</subsection></section><section commented="no" display-inline="no-display-inline" id="ID7DD2FDAF59084169A4DF00942D546FA1" section-type="subsequent-section"><enum>422.</enum><header display-inline="yes-display-inline">Application</header><text display-inline="no-display-inline">The Secretary may not award a grant under
			 section 421 to a State unless the State submits to the Secretary an application
			 at such time, in such manner, and containing such information as the Secretary
			 may reasonably require.</text>
				</section><section commented="no" display-inline="no-display-inline" id="ID7BF5B45B06B4401EA7B4D34DB065974E" section-type="subsequent-section"><enum>423.</enum><header display-inline="yes-display-inline">Requirement of matching funds</header><text display-inline="no-display-inline">The Secretary may not award a grant under
			 section 421 to a State unless the State agrees that the State will make
			 available non-Federal contributions toward the costs of carrying out activities
			 under this subtitle in an amount that is not less than $1 for each $1 of
			 Federal funds provided under the grant.</text>
				</section><section commented="no" display-inline="no-display-inline" id="ID6825022E3421412CB6003C76A362B602" section-type="subsequent-section"><enum>424.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to carry out this subtitle $5,000,000 for fiscal
			 year 2008.</text>
				</section></subtitle></title><title commented="no" id="id851A5805DDE4481C84E1406C17E026BE" level-type="subsequent"><enum>V</enum><header display-inline="yes-display-inline">Small business jobs tax credit</header>
			<section commented="no" display-inline="no-display-inline" id="IDCE4026B19F6248CD80DDC9B6E4A25A77" section-type="subsequent-section"><enum>501.</enum><header display-inline="yes-display-inline">Expansion of work opportunity tax
			 credit</header>
				<subsection commented="no" display-inline="no-display-inline" id="IDD7639CB27E374AC581F990C6455BA893"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Section 51(d)(1) of the Internal Revenue
			 Code of 1986 (relating to members of targeted groups) is amended by striking
			 <quote>or</quote> at the end of subparagraph (H), by striking the period at the
			 end of subparagraph (I) and inserting <quote>, or</quote>, and by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="IDB532ABDCEF894E6D864DD5F27C274EBF" style="OLC">

				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2D4A4A2755B84082913FE794AE3DC6D7"><enum>(b)</enum><header display-inline="yes-display-inline">Qualified Small Business
			 Employee</header><text display-inline="yes-display-inline">Section 51(d) of the
			 Internal Revenue Code of 1986 is amended by redesignating paragraphs (11)
			 through (13) as paragraphs (12) through (14), respectively, and by inserting
			 after paragraph (10) the following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID3876A86A2FAD496EBCE088B6404ED7AD"><enum>(11)</enum><header display-inline="yes-display-inline">Qualified small business employee</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDA92C1DE8828D49D3A93A8452211BD09B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>qualified small business
				employee</term> means any individual—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID45F996C39035462EBD022391495ABB4B"><enum>(i)</enum><text display-inline="yes-display-inline">hired by a qualified small business located
				in an eligible area, or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID35B3C699C8924BE980DC988AA8D7CFFA"><enum>(ii)</enum><text display-inline="yes-display-inline">hired by a qualified small business and who
				is certified by the designated local agency as residing in such an eligible
				area.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF947F6716FEB41459C579A515ABA4FB0"><enum>(B)</enum><header display-inline="yes-display-inline">Qualified small business</header><text display-inline="yes-display-inline">The term <term>qualified small
				business</term> has the meaning given the term <term>small employer</term> by
				section 4980D(d)(2).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id533B0EF6956C4B3DA8A860306AC4C408"><enum>(C)</enum><header display-inline="yes-display-inline">Eligible area</header><text display-inline="yes-display-inline">The term <term>eligible area</term> means a
				nonmetropolitan county that, based on information contained in the 2000

				national average employment percentage change (as determined by the Bureau of
				Economic Analysis).</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC577A3EABD7E4530986FF886D5F0FCD6"><enum>(D)</enum><header display-inline="yes-display-inline">Number of designations</header><text display-inline="yes-display-inline">The Secretary, after consultation with the
				Secretary of Housing and Urban Development and the Secretary of Agriculture,
				may not designate more than 400 eligible areas.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6400DCC415A84B80BDD952518E80545A"><enum>(E)</enum><header display-inline="yes-display-inline">Special rules for determining amount of
				credit</header><text display-inline="yes-display-inline">For purposes of
				applying this subpart to wages paid or incurred to any qualified small business
				employee—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDA5FADCB9854A44FFA45620BC22943F79"><enum>(i)</enum><text display-inline="yes-display-inline">subsection (a) shall be applied by
				substituting <quote>20 percent of the qualified first, second, third, fourth,
				or fifth year wages</quote> for <quote>40 percent of the qualified first year
				wages</quote>, and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID22D2D4F9B08D44769B98F167A150C359"><enum>(ii)</enum><text display-inline="yes-display-inline">in lieu of paragraphs (2) and (3) of
				subsection (b), the following definitions and special rule shall apply:</text>
									<subclause commented="no" display-inline="no-display-inline" id="ID313758B9D4C54F8F9635D5C725DCBF0A"><enum>(I)</enum><header display-inline="yes-display-inline">Qualified first-year wages</header><text display-inline="yes-display-inline">The term <term>qualified first-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning with the
				day the individual begins work for the employer.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1DDC1CFE032C47189BB1976DD5B0FAAD"><enum>(II)</enum><header display-inline="yes-display-inline">Qualified second-year wages</header><text display-inline="yes-display-inline">The term <term>qualified second-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning on the day
				after the last day of the 1-year period with respect to such individual
				determined under subclause (I).</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID23D8E5B2C6DB4707B5ECBF1661770564"><enum>(III)</enum><header display-inline="yes-display-inline">Qualified third-year wages</header><text display-inline="yes-display-inline">The term <term>qualified third-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning on the day
				after the last day of the 1-year period with respect to such individual
				determined under subclause (II).</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID6699E37AED464ADC9050783EBFC24EB0"><enum>(IV)</enum><header display-inline="yes-display-inline">Qualified fourth-year wages</header><text display-inline="yes-display-inline">The term <term>qualified fourth-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning on the day
				after the last day of the 1-year period with respect to such individual
				determined under subclause (III).</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7276C34227204273B4016118475712B6"><enum>(V)</enum><header display-inline="yes-display-inline">Qualified fifth-year wages</header><text display-inline="yes-display-inline">The term <term>qualified fifth-year
				wages</term> means, with respect to any individual, qualified wages
				attributable to service rendered during the 1-year period beginning on the day
				after the last day of the 1-year period with respect to such individual
				determined under subclause (IV).</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2BC9AB62E3BE447BB9FD3465B06055E0"><enum>(VI)</enum><header display-inline="yes-display-inline">Only first $15,000 of wages per year taken
				into account</header><text display-inline="yes-display-inline">The amount of
				the qualified first, second, third, fourth, and fifth year wages which may be
				taken into account with respect to any individual shall not exceed $15,000 per
				year.</text>
									</subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2B42A1B4F5CF42BBA22A2E32EAD7BB5C"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to individuals who begin work for the employer after
			 the date of the enactment of this Act.</text>
