		<official-title display="yes">To amend the Farm Security and Rural
		  Investment Act of 2002 to provide coordination and direction for commodity
		  programs, and to ensure the distribution of fresh fruits and vegetables to
		  schools and service institutions in the United States.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>School Food Fresh Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id0551A6C86DD949C88C0CF71262CC5B07" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id55A07F078DB54E229E4CEFE40719C0B0"><enum>(1)</enum><header display-inline="yes-display-inline">Commodity program</header><text display-inline="yes-display-inline">The term <term>commodity program</term>
			 means any of—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id906DAFF119E74DF88D611432CFFE2E5F"><enum>(A)</enum><text display-inline="yes-display-inline">the commodity supplemental food program
			 established under section 5 of the Agriculture and Consumer Protection Act of
			 1973 (7 U.S.C. 612c note; Public Law 93–86);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa135e0fb88834d6f9bb2d24ee74a1907"><enum>(B)</enum><text display-inline="yes-display-inline">the food distribution program on Indian
			 reservations established under section 4(b) of the Food Stamp Act of 1977 (7
			 U.S.C. 2013(b));</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc8d6186a03154896ad9a84c677362fee"><enum>(C)</enum><text display-inline="yes-display-inline">the emergency food assistance program
			 established under the Emergency Food Assistance Act of 1983 (7 U.S.C. 7501 et
			 seq.) and section 27 of the Food Stamp Act of 1977 (7 U.S.C. 2036);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5944E53F79484A7E99F93322F7C05C0D"><enum>(D)</enum><text display-inline="yes-display-inline">the school lunch program established under
			 the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch
			 Act</act-name> (42 U.S.C. 1751 et seq.);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC3DB122A215549619CAC9C53144E6793"><enum>(E)</enum><text display-inline="yes-display-inline">the summer food service program for
			 children established under section 13 of that Act (42 U.S.C. 1761);</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB1950EC709AE4F2EB396A95D46A108C9"><enum>(F)</enum><text display-inline="yes-display-inline">the child and adult care food program
			 established under section 17 of that Act (42 U.S.C. 1766); and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA749E13A614C46DFB979D656745ED1F1"><enum>(G)</enum><text display-inline="yes-display-inline">the school breakfast program established
			 under section 4 of that Act (42 U.S.C. 1773).</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE99F0AAFD9054712BFDF847B8AE900C9"><enum>(2)</enum><header display-inline="yes-display-inline">Department</header><text display-inline="yes-display-inline">The term <term>Department</term> means the
			 Department of Agriculture.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A3B814B02054437B1B97E3AA1B16EB8"><enum>(3)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of Agriculture.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9DCD1AAD9BF941D3BD76B4D0A8BBCE01"><enum>(4)</enum><header display-inline="yes-display-inline">Task Force</header><text display-inline="yes-display-inline">The term <term>Task Force</term> means the
			 multiagency task force established under section 3(a).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID938ba862a8d74c55980d9d912ddcc55c" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Multiagency Task Force</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID830e90271e464997ad43d5a2c4a1a973"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish, in the
			 office of the Under Secretary for Food, Nutrition, and Consumer Services, a
			 multiagency task force for the purpose of providing coordination and direction
			 for commodity programs.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDce9b665ba98742a48426021a06b4723b"><enum>(b)</enum><header display-inline="yes-display-inline">Composition</header><text display-inline="yes-display-inline">The Task Force shall be composed of at
			 least 4 members, including—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDd36ac3ab500243398b911499e7927067"><enum>(1)</enum><text display-inline="yes-display-inline">a representative from the Food Distribution
			 Division of the Food and Nutrition Service, who shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id82CF6292128543B58C370F3621423B8B"><enum>(A)</enum><text display-inline="yes-display-inline">be appointed by the Under Secretary for
			 Food, Nutrition, and Consumer Services; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id198F2BC1C1A64DB69D0F0095C13110FC"><enum>(B)</enum><text display-inline="yes-display-inline">serve as Chairperson of the Task
			 Force;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfdb0594654fe426f8255ef5378f1f509"><enum>(2)</enum><text display-inline="yes-display-inline">at least 1 representative from the
			 Agricultural Marketing Service, who shall be appointed by the Under Secretary
			 for Marketing and Regulatory Programs;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5256b204b4514f00a656403d54b68644"><enum>(3)</enum><text display-inline="yes-display-inline">at least 1 representative from the Farm
			 Services Agency, who shall be appointed by the Under Secretary for Farm and
			 Foreign Agricultural Services; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd2006585f61e43cc8d65f248c975da1c"><enum>(4)</enum><text display-inline="yes-display-inline">at least 1 representative from the Food
			 Safety and Inspection Service, who shall be appointed by the Under Secretary
			 for Food Safety.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa79102976e9448279b9b82642c3ca993"><enum>(c)</enum><header display-inline="yes-display-inline">Duties</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id969DDF6B97074CE8B0342722BD202828"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Task Force shall be responsible for
			 evaluation and monitoring of the commodity programs to ensure that the
			 commodity programs meet the mission of the Department—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idA54C415AA71541F3ADF002FCC95816BB"><enum>(A)</enum><text display-inline="yes-display-inline">to support the United States farm
			 sector;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idADD59550735A4C4CABFEA5C5F36F6E9D"><enum>(B)</enum><text display-inline="yes-display-inline">to comply with the most recent Dietary
			 Guidelines for Americans published under section 301 of the National Nutrition
			 Monitoring and Related Research Act of 1990 (7 U.S.C. 5341); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5DD79A1DA09548B7BD9D306BE8D64968"><enum>(C)</enum><text display-inline="yes-display-inline">to contribute to the health and well-being
			 of individuals in the United States through the distribution of domestic
			 agricultural products through commodity programs.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B32CA41B6FD4D9EAA5F51A3597B4934"><enum>(2)</enum><header display-inline="yes-display-inline">Specific duties</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Task
			 Force shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID013b74d3235c40ccb9361e78ed6ecd4b"><enum>(A)</enum><text display-inline="yes-display-inline">review and make recommendations regarding
			 the specifications used for the procurement of food commodities, taking into
			 consideration recommendations based on the results of evaluations carried out
			 using grants made available under section 4;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe0c65b46ef9d40639c40454a746cd865"><enum>(B)</enum><text display-inline="yes-display-inline">review and make recommendations regarding
			 the effective distribution of food commodities;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb82f1785d18a4387b3b28b78d4c9bb7b"><enum>(C)</enum><text display-inline="yes-display-inline">review and make recommendations regarding
			 efficient and effective systems to ensure the best use of Federal funds to
			 maximize the quantity and quality of foods purchased for recipient agencies and
			 the best use of those purchased foods by recipient agencies; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id38EAC460016C4F70AB215503F3032987"><enum>(D)</enum><text display-inline="yes-display-inline">on the request of the Secretary, review and
			 make recommendations regarding future updates of the Dietary Guidelines for
			 Americans published under section 301 of the National Nutrition Monitoring and
			 Related Research Act of 1990 (7 U.S.C. 5341).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID960d17aff1634816b3beb4703623098e"><enum>(d)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, and annually thereafter, the Secretary shall submit to
			 Congress a report that describes, for the period covered by the report—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idDBE187FA5F9448349140650C133BE202"><enum>(1)</enum><text display-inline="yes-display-inline">the findings and recommendations of the
			 Task Force; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id844E856853CC4596B27D3E594CD2C4A9"><enum>(2)</enum><text display-inline="yes-display-inline">policies implemented for the betterment of
			 commodity programs.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID37cf788d04ca49e08843657c3e13ab94" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Grants for specification
			 development</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDca2a6f956c3747f5b1cbe550471440de"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, the Secretary shall provide 5 competitive grants to
			 nonprofit research institutions (including research universities) selected by
			 the Secretary for use in evaluating the product specifications of food
			 commodity products procured through commodity programs to determine—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID3f597fa6213b4f45846277b70900db03"><enum>(1)</enum><text display-inline="yes-display-inline">the consistency of those specifications
			 with the nutritional goals of the commodity program;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd9da3e71187a4228b7cf21790a18354b"><enum>(2)</enum><text display-inline="yes-display-inline">the acceptability of the products procured
			 under the specifications by recipient agencies and consumers; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID96199efe50e2414c9094e0670861b4d9"><enum>(3)</enum><text display-inline="yes-display-inline">the extent to which food commodities
			 purchased through commodity programs are comparable to any commercial
			 counterparts to those commodities.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDb3e6911881564debbd291e15864995ba"><enum>(b)</enum><header display-inline="yes-display-inline">Types of grants</header><text display-inline="yes-display-inline">Of the 5 grants provided under subsection
			 (a), a grant shall be provided for the evaluation and recommendation of product
			 specifications for each of the categories of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID0b997a4fd2c84d40b03677c21add4dc7"><enum>(1)</enum><text display-inline="yes-display-inline">fruits and vegetables;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID04ce3fa0682540f7a74ccf6641d202d0"><enum>(2)</enum><text display-inline="yes-display-inline">meat;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8ea028ad944b4ae286b04a1842463ce4"><enum>(3)</enum><text display-inline="yes-display-inline">poultry;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7ae697f3f82640c2b0270eb0f0453d43"><enum>(4)</enum><text display-inline="yes-display-inline">grains, nuts, and oils; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID282ad933c90e4e2bb740074e2d813860"><enum>(5)</enum><text display-inline="yes-display-inline">dairy products.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id80B59968093244B985DEF81C593EFA1B"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date on
			 which the Secretary provides a grant under this section, the recipient of the
			 grant shall submit to the Secretary and the Task Force a report that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id67983149D40C454996456D7ACAD85A39"><enum>(1)</enum><text display-inline="yes-display-inline">describes the results of evaluations
			 carried out using funds from the grant; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09BD2EA9A55E4BD694F98BF269FF2B15"><enum>(2)</enum><text display-inline="yes-display-inline">includes recommendations based on those
			 results.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID186b0ee8496147f2a9f5b464ad43d34b"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $2,500,000.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID84fad72ba13b47f395d7421a1165ec46" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">USDA school food fresh
			 program</header><text display-inline="no-display-inline">Section 10603 of the
			 Farm Security and Rural Investment Act of 2002 (7 U.S.C. 612c–4) is amended to
			 read as follows:</text>

				<section commented="no" display-inline="no-display-inline" id="idCB0BDCC25B2C49BB917ECE55967330B3" section-type="subsequent-section"><enum>10603.</enum><header display-inline="yes-display-inline">Purchase of specialty crops</header>
					<subsection commented="no" display-inline="no-display-inline" id="id0E5039402CAA402F8F2331ED82A067D4"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idEAF93DBA56594840BE4C93A85E930905"><enum>(1)</enum><header display-inline="yes-display-inline">Fruits, vegetables, other specialty food
				crops</header><text display-inline="yes-display-inline">The terms
				<term>fruits</term>, <term>vegetables</term>, and <term>other specialty food
				crops</term> shall have the meaning given the terms by the Secretary of
				Agriculture.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF5B9248EC9754231A82C83CE16FA5AD2"><enum>(2)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
				Secretary of Agriculture.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8D9E940F882A4CF79B6A42B211883CAC"><enum>(3)</enum><header display-inline="yes-display-inline">Service institution</header><text display-inline="yes-display-inline">The term <term>service institution</term>
				has the meaning given the term in section 13(a) of the Richard B. Russell
				National School Lunch Act (42 U.S.C. 1761(a)).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id49EE15459B82454691C7EBA74CE75EB9"><enum>(b)</enum><header display-inline="yes-display-inline">Purchase authority</header><text display-inline="yes-display-inline">Of the funds made available under section
				32 of the Act of August 24, 1935 (7 U.S.C. 612c), for fiscal year 2008 and each
				subsequent fiscal year, the Secretary shall use not less than $200,000,000 each
				fiscal year to purchase fruits, vegetables, and other specialty food
				crops.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id4600E68CCEDD485EADA8ADE89CB2A0C4"><enum>(c)</enum><header display-inline="yes-display-inline">USDA school food fresh program</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID6236a82c5f964efabbd82723b048b28b"><enum>(1)</enum><header display-inline="yes-display-inline">Definition of eligible
				product</header><text display-inline="yes-display-inline">In this subsection,
				the term <term>eligible product</term> means a fruit or vegetable item
				that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idAFE924A3E10F461AB82E253ADAC43338"><enum>(A)</enum><text display-inline="yes-display-inline">is offered by a vendor approved by the
				Secretary under paragraph (4);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82FB59273A2A4DF5A7134ABD35D378B2"><enum>(B)</enum><text display-inline="yes-display-inline">is fresh, dried, or frozen in a manner that
				maximizes retention of nutrient density; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDDEF343858BF4EAFBD916B82D94DB5E0"><enum>(C)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, reflects
				local preferences and supports local agriculture.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F594D26B5014C3A90C19779CDFD14DE"><enum>(2)</enum><header display-inline="yes-display-inline">Agreements</header><text display-inline="yes-display-inline">The Secretary, acting through such regional
				procurement offices of the Department of Agriculture as the Secretary
				determines to be appropriate, shall carry out a program under which the
				Secretary shall enter into agreements with local and regional distributors to
				supply eligible products to schools and service institutions.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7A4D3267909B4F05B29C06115FC130EF"><enum>(3)</enum><header display-inline="yes-display-inline">Funds</header><text display-inline="yes-display-inline">Eligible products supplied under an
				agreement described in paragraph (2) shall be purchased by schools and service
				institutions using funds that are allocated to the schools or service
				institutions for the purpose of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id544C124D8FCE40BE88A2234CF1A45386"><enum>(A)</enum><text display-inline="yes-display-inline">purchasing fruits and vegetables; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2958FFDDCAE94AE6AF6C5ECF52BEAC3E"><enum>(B)</enum><text display-inline="yes-display-inline">providing nutritious meals.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID73127f90b43d4d76bffe562560f087e0"><enum>(4)</enum><header display-inline="yes-display-inline">Vendors</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID9a0317a8a37e45208c41cc0c06dec896"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A local or regional distributor of eligible
				products that seeks to supply eligible products to schools and service
				institutions under this subsection shall apply to the Secretary for approval as
				a participating vendor.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf4795c6f2c234debbb71a0e01d2e79ee"><enum>(B)</enum><header display-inline="yes-display-inline">Conditions for approval</header><text display-inline="yes-display-inline">The Secretary shall approve a vendor as
				eligible to supply eligible products under this subsection if the
				vendor—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDd0e7440f343f41b88134eef9e7baba04"><enum>(i)</enum><text display-inline="yes-display-inline">demonstrates the ability to supply those
				eligible products;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID64754f7162594e4bb7f51dcdf19210e4"><enum>(ii)</enum><text display-inline="yes-display-inline">complies with standards for food safety
				developed by the Secretary;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDae0dc5cab09a46a3b47bb12935eefa84"><enum>(iii)</enum><text display-inline="yes-display-inline">consistently provides products that meet
				standards of grade, size, freshness, and quality as required by the Secretary
				or a local procurement officer; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID0367c08b77074402a9d721e453d7bc6f"><enum>(iv)</enum><text display-inline="yes-display-inline">demonstrates the ability to supply eligible
				products from local growers and processors.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7419498486954b358d73eec96df19e81"><enum>(C)</enum><header display-inline="yes-display-inline">Monitoring</header>
								<clause commented="no" display-inline="no-display-inline" id="id03884929777A4B7C932445327535FF9F"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall develop and implement a
				system for monitoring vendors approved under this paragraph.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idCB08408ECCCE441DBA3CDDBD91FCC842"><enum>(ii)</enum><header display-inline="yes-display-inline">Certification</header><text display-inline="yes-display-inline">A monitoring system under clause (i) may
				include a requirement to obtain certification—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idADEADC76FDE34AA4A28F399FE6FCCD40"><enum>(I)</enum><text display-inline="yes-display-inline">in accordance with a program designed by
				the Secretary; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id17446369D7524D3E93C0D2F113C3F41E"><enum>(II)</enum><text display-inline="yes-display-inline">for which the Secretary may require
				compensation.</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF985C27BF54F400AB639F1A3F2F8C8A6"><enum>(5)</enum><header display-inline="yes-display-inline">Funding</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id82445324037B435DAADC635D5E98D097"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Of the amount specified in subsection (b),
				the Secretary shall use not less than $50,000,000 each fiscal year for the
				purchase of eligible products for distribution to schools and service
				institutions in accordance with section 6(a) of the Richard B. Russell National
				School Lunch Act (42 U.S.C. 1755(a)).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc328e120e7ba4745ba3098aadd870e82"><enum>(B)</enum><header display-inline="yes-display-inline">Additional available funds</header><text display-inline="yes-display-inline">A school or service institution that uses
				an agreement described in paragraph (2) to purchase eligible products may
				allocate up to 30 percent of the funds of the school or service institution
				authorized under section 6 of the Richard B. Russell National School Lunch Act
				(42 U.S.C. 1755), and such additional funds as are necessary from funds
				allocated to the school or service institution under sections 4 and 11 of that
				Act (42 U.S.C. 1753, 1759a), for the purpose of procuring eligible products
				through vendors approved by the Secretary under paragraph (4).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7B8E55A27B774784862817BE021CB63E"><enum>(C)</enum><header display-inline="yes-display-inline">Authorization of appropriations for
				administrative expenses</header><text display-inline="yes-display-inline">There
				are authorized to be appropriated such sums as are necessary to pay
				administrative costs incurred in carrying out this
				subsection.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID57c040972a49410986075314bcf47818" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Use of commodity entitlement funds</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID2ad8eb6ed9434aa0a8092393440cbfbb"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall, to the maximum extent
			 practicable, purchase for commodity programs foods that are in the
			 least-processed state.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1280c49c1d4f48b2a6332614cb7f9f12"><enum>(b)</enum><header display-inline="yes-display-inline">Processing of foods</header><text display-inline="yes-display-inline">The Secretary, upon the approval of
			 national processing agreements, shall make available to all schools and other
			 recipient agencies the opportunity to divert unprocessed or minimally-processed
			 commodity foods to subsequent processors for conversion into usable end
			 products.</text>
