<official-title>To amend title XXI of the Social Security Act to eliminate the remainder of funding shortfalls for the State Children's Health Insurance Program (SCHIP) for fiscal year 2007, and for other purposes.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Elimination of remainder of SCHIP funding shortfalls for fiscal year 2007</header> 
<subsection id="idC71D5CC65310490984412EC70A0EDC84"><enum>(a)</enum><header>In general</header><text>Section 2104(h) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1397dd(h)), as added by section 201(a) of the National Institutes of Health Reform Act of 2006 (Public Law 109–482), is amended—</text> 
<paragraph id="ID4EBA38F3DBCA4DC2912CE7C471C82DE8"><enum>(1)</enum><text>in the heading for paragraph (2), by striking <quote><header-in-text level="paragraph">remainder of reduction</header-in-text></quote> and inserting <quote><header-in-text level="paragraph">part</header-in-text></quote>; and</text> </paragraph>
<paragraph id="ID16F6275293FE40F38FEDF756C2006C6B"><enum>(2)</enum><text>by striking paragraph (4) and inserting the following:</text>

<paragraph id="IDBF103D6C7808491799855EE8F67D8285"><enum>(4)</enum><header>Additional amounts to eliminate remainder of fiscal year 2007 funding shortfalls</header> 
<subparagraph id="IDC65A48F2D55742EC8C99E65411A71FD0"><enum>(A)</enum><header>In general</header><text>The Secretary shall allot to each remaining shortfall State described in subparagraph (B) such amount as the Secretary determines will eliminate the estimated shortfall described in such subparagraph for the State for fiscal year 2007.</text> </subparagraph>
<subparagraph id="ID46C7C7BD3F1D4BA1B07481136B384559"><enum>(B)</enum><header>Remaining shortfall state described</header><text>For purposes of subparagraph (A), a remaining shortfall State is a State with a State child health plan approved under this title for which the Secretary estimates, on the basis of the most recent data available to the Secretary as of the date of the enactment of this paragraph, that the projected federal expenditures under such plan for the State for fiscal year 2007 will exceed the sum of—</text> 
<clause id="ID7E327277773A4C6F8AE29009335BFA63"><enum>(i)</enum><text>the amount of the State’s allotments for each of fiscal years 2005 and 2006 that will not be expended by the end of fiscal year 2006;</text> </clause>
<clause id="ID178739409B674500813B0EC2B87EE72A"><enum>(ii)</enum><text>the amount of the State’s allotment for fiscal year 2007; and</text> </clause>
<clause id="ID8BD3736AA54A4C56B801B5BCDF3C7962"><enum>(iii)</enum><text>the amounts, if any, that are to be redistributed to the State during fiscal year 2007 in accordance with paragraphs (1) and (2).</text> </clause></subparagraph>
<subparagraph id="IDA2D9BFF9677741E98825AA610C8E7A9B"><enum>(C)</enum><header>Appropriation; allotment authority</header><text>For the purpose of providing additional allotments to remaining shortfall States under this paragraph there is appropriated, out of any funds in the Treasury not otherwise appropriated, such sums as are necessary for fiscal year 2007. Amounts appropriated pursuant to the preceding sentence are designated as an emergency requirement pursuant to section 402 of H. Con. Res. 95 (109th Congress).</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection>
<subsection id="id1DC4CA4A6C4C4CBB8E45C098F28D5316"><enum>(b)</enum><header>Conforming amendments</header><text>Section 2104(h) of such Act (42 U.S.C. 1397dd(h)) (as so added), is amended—</text> 
<paragraph id="ID1241BE093A3F4815B909763153EEFE37"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>subject to paragraph (4)(B) and</quote>;</text> </paragraph>
<paragraph id="ID3E6116E423FE48CFBA63B10354B7C480"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>subject to paragraph (4)(B) and</quote>;</text> </paragraph>
<paragraph id="ID61B14335283D4DBAAC5F7BD39BDC4B0B"><enum>(3)</enum><text>in paragraph (5)(A), by striking <quote>and (3)</quote> and inserting <quote>(3), and (4)</quote>; and</text> </paragraph>
<paragraph id="ID9455E1D6D9C647D5A3C9C1C1893AF4F0"><enum>(4)</enum><text>in paragraph (6)—</text> 
<subparagraph id="ID24ED4F06C3A24DD9860FE1585EE57405"><enum>(A)</enum><text>in the first sentence—</text> 
<clause id="ID29C7D6B4A54C41F7B23542DEEF4D3AEF"><enum>(i)</enum><text>by inserting <quote>or allotted</quote> after <quote>redistributed</quote>; and</text> </clause>
<clause id="IDEBD3D84E6E27462CB4CC3F8A61B0CAF1"><enum>(ii)</enum><text>by inserting <quote>or allotments</quote> after <quote>redistributions</quote>; and</text> </clause></subparagraph>
<subparagraph id="ID6E911C8AAF08469C8BE91BDB3FC87E2A"><enum>(B)</enum><text>by striking <quote>and (3)</quote> and inserting <quote>(3), and (4)</quote>.</text> </subparagraph></paragraph></subsection></section>
<section id="id3ADE003ACDBB4D8B85445FE01F1843CC"><enum>2.</enum><header>Funding provisions</header> 
<subsection commented="no" display-inline="no-display-inline" id="idEBE0B1E0AED148C58910C92FC1B1FFDA"><enum>(a)</enum><header>Requirement for use of tamper-resistant prescription pads under the Medicaid program</header> 
<paragraph id="H84EB4C0EB1DA4DDEA0E1BC4F5F00924F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1903(i) of the Social Security Act (42 U.S.C. 1396b(i)) is amended—</text> 
<subparagraph id="H3A78EE264E194C5485D4D9CBBE145570"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of paragraph (21);</text> </subparagraph>
<subparagraph id="H4689D7DDADCB4C8E95C5BFFFE741BA9"><enum>(B)</enum><text>by striking the period at the end of paragraph (22) and inserting <quote>; or</quote>; and</text> </subparagraph>
<subparagraph id="HB2B53D19A77E493F86750042A937E06F"><enum>(C)</enum><text>by inserting after paragraph (22) the following new paragraph:</text>

<paragraph id="H68236F9C9200470C8818009CE434175F"><enum>(23)</enum><text>with respect to amounts expended for medical assistance for covered outpatient drugs (as defined in section 1927(k)(2)) for which the prescription was executed in written (and non-electronic) form unless the prescription was executed on a tamper-resistant pad.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H3BC65AB74EE049B39291FAAFFC4B9C55"><enum>(2)</enum><header>Effective date</header><text>The amendments made by paragraph (1) shall apply to prescriptions executed after September 30, 2007.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H852592C37FDC44ECA7DF318FD53F31F"><enum>(b)</enum><header>Repeal of the limited continuous enrollment provision for certain beneficiaries under the Medicare Advantage program</header> 
<paragraph commented="no" id="H9C7112CE18EB41D4A9FF236900011902"><enum>(1)</enum><header>In general</header><text>Subparagraph (E) of section 1851(e)(2) of the Social Security Act (42 U.S.C. 1395w–21(e)(2)), as added by section 206(a) of division B of the Tax Relief and Health Care Act of 2006 (Public Law 109–432), is repealed.</text> </paragraph>
<paragraph commented="no" id="H84061EF47A014250B0C1A2991216EC1"><enum>(2)</enum><header>Conforming amendment</header><text>Section 1860D–1(b)(1)(B)(iii) of the Social Security Act (42 U.S.C. 1395w–101(b)(1)(B)(iii)), as amended by 206(b) of division B of the Tax Relief and Health Care Act of 2006 (Public Law 109–432), is amended by striking <quote>subparagraphs (B), (C), and (E)</quote> and inserting <quote>subparagraphs (B) and (C)</quote>.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HAF186CF47E9244F586A21C7C04C13D0"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the day after the date of enactment of this Act.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H40A331ECBE154163AB8DE900AB6742EB"><enum>(c)</enum><header>Denial of payments for hospital services or ambulatory surgical center services that directly harm patients</header> 
<paragraph commented="no" id="H7D097C5C67414810A0B0D070AE003924"><enum>(1)</enum><header>In general</header><text>Section 1862(a) of the Social Security Act (42 U.S.C. 1395y(a)) is amended—</text> 
<subparagraph commented="no" id="H9A085260F7714F41BC13E9317BAA3D7D"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of paragraph (21);</text> </subparagraph>
<subparagraph commented="no" id="HB5130E9200F44E43BA48A6A036B1444D"><enum>(B)</enum><text>by striking the period at the end of paragraph (22) and inserting <quote>; or</quote>; and</text> </subparagraph>
<subparagraph commented="no" id="H94DE32F630C44F17A38FCFF40BFF839"><enum>(C)</enum><text>by inserting after paragraph (22) the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H7140A2017F214C4A9E8ECC49372E77C" style="OLC"> 
<paragraph commented="no" id="H87B0D0AD7CA145A09E37BA0048CF1911"><enum>(23)</enum><text display-inline="yes-display-inline">which are inpatient or outpatient hospital services or facility services furnished in an ambulatory surgical facility if in the provision of such services there occurred a type of event (such as a surgical event, product or device event, patient protection event, care management event, environmental event, or criminal event) which the Secretary has determined, based on a consensus process involving clinicians, quality experts, health care providers, and patients, which should never occur.</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph>
<paragraph commented="no" id="H75A87E68AE9D43A8929000EDCE34A6FE"><enum>(2)</enum><header>Potential application of NQF <quote>never events</quote> lists</header><text display-inline="yes-display-inline">Nothing in section 1862(a)(23) of the Social Security Act, as inserted by paragraph (1), shall be construed as preventing the Secretary of Health and Human Services from applying all (or a subset of) the events that are listed and endorsed as <quote>serious reportable events</quote> (also known as <quote>never events)</quote> by the National Quality Forum as of November 16, 2006, (or such subsequent, revised list of such events issued by such Forum as the Secretary may specify) as events described in such section.</text> </paragraph>
<paragraph commented="no" id="H218734E94C5749DBBD92673061009796"><enum>(3)</enum><header>Conforming amendments</header> 
<subparagraph commented="no" id="HA92527574B95415B8BBD12F09FCAAA3D"><enum>(A)</enum><text>Section 1834(j)(4)(C) of the Social Security Act (42 U.S.C. 1395m(j)(4)(C)) is amended by striking <quote>or 1862(a)(23)</quote> after <quote>1862(a)(1)</quote>.</text> </subparagraph>
<subparagraph commented="no" id="H69F40DFC946F4B9C983EEFDAB5C1BAE"><enum>(B)</enum><text>Section 1842(l) of such Act (42 U.S.C. 1395u(l)) is amended—</text> 
<clause commented="no" id="H38E4FD095E8B4E549270936927E1647B"><enum>(i)</enum><text>in paragraph (1)(A)(iii)—</text> 
<subclause commented="no" id="HC0FFA67FB36B4615B4CF6980E3484BE1"><enum>(I)</enum><text>by striking <quote>or (II)</quote> and inserting <quote>, (II)</quote>; and</text> </subclause>
<subclause commented="no" id="H1A225CCFFE9C40C0883DA0D072D5B7E1"><enum>(II)</enum><text>by inserting <quote>, or (III) payment under this title is denied under section 1862(a)(23)</quote> after <quote>section 1154(a)(1)(B)</quote>; and</text> </subclause></clause>
<clause commented="no" id="HEBA46DAEA9264BE300FE9F80EA7772B3"><enum>(ii)</enum><text>in paragraph (2), by inserting <quote>or 1862(a)(23)</quote> after <quote>1862(a)(1)</quote>.</text> </clause></subparagraph>
<subparagraph commented="no" id="H148051F9B4F74AC8953BB8F2A190895F"><enum>(C)</enum><text>Section 1866(a)(1)(K) of such Act (42 U.S.C. 1395cc(a)(1)(K)) is amended by inserting <quote>or is denied under section 1862(a)(23)</quote> after <quote>1154(a)(1)(B)</quote>.</text> </subparagraph></paragraph>
<paragraph commented="no" id="H920220AAA61840E0A3B6EE71A400B5D6"><enum>(4)</enum><header>Report on disclosure</header><text display-inline="yes-display-inline">Not later than January 1, 2009, the Secretary of Health and Human Services shall submit to Congress a report on a process for public disclosure on never events described in section 1862(a)(24) of the Social Security Act, as inserted by paragraph (1)(C), which will ensure protection of patient privacy and will permit the use of the disclosed information for a root cause analysis to inform the public and the medical community about safety issues involved.</text> </paragraph>
<paragraph commented="no" id="H37E9F0F2E8C54F60A9628F6D3CC163CE"><enum>(5)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date of the enactment of this Act and shall apply to payments for—</text> 
<subparagraph commented="no" id="H280B816AF5AA4828A5C530F9DE4ECBDD"><enum>(A)</enum><text>inpatient hospital services for discharges occurring on or after October 1, 2007; and</text> </subparagraph>
<subparagraph commented="no" id="H333C117F13D349B9AE336F75AE153868"><enum>(B)</enum><text>outpatient hospital services and facility services in an ambulatory surgical center furnished on or after January 1, 2008.</text> </subparagraph></paragraph></subsection></section>
