		<official-title>To amend the Elementary and Secondary Education Act of
		  1965 to provide parental choice for those students that attend schools that are
		  in need of improvement and have been identified for
		  restructuring.</official-title>

		<section id="H8DFC10CF4F0F40BE92D1DD90F6A8DB77" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Empowering Parents Through Choice
			 Act</short-title></quote>.</text>
		</section><section id="HC2FE723DA56C4A50B68651F800C27EF6"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this Act to support
			 State and local efforts to enable students from low-income families who attend
			 a school identified for restructuring under section 1116(b)(8) of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 6316(b)(8))—</text>
			<paragraph id="H9F450CC94DF1402BA14FD70029902D11"><enum>(1)</enum><text>to attend a
			 private elementary school or secondary school, or a public elementary school or
			 secondary school outside the student’s home school district, including a public
			 charter school; or</text>
			</paragraph><paragraph id="HCB5A965778214145A8A020832308C37F"><enum>(2)</enum><text>to receive
			 intensive, sustained supplemental educational services.</text>
			</paragraph></section><section id="H66F3F82500A64D3E98B9DA638C59289C"><enum>3.</enum><header>Promise
			 scholarships for parents and students</header><text display-inline="no-display-inline">Section 1116(b)(8) of that Act (20 U.S.C.
			 6316(b)(8)) is amended—</text>
			<paragraph id="H54C0C9CC27D14619A4E506F6A83300CB"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="HF3E1619E3E1E43DE8FEFB99EA7E9D37"><enum>(A)</enum><text>in clause (ii) by
			 striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="H140425569641438CA968C50080259CD3"><enum>(B)</enum><text>by redesignating
			 clause (iii) as clause (iv); and</text>
				</subparagraph><subparagraph id="HEC7DBBBEE7154A57833D6957FA51B3CB"><enum>(C)</enum><text>by inserting after
			 clause (ii) the following:</text>
					<quoted-block id="H588BAC1277924A84BB36EE5753A4742E" style="OLC">
						<clause id="H061A9E14426148DFB3EC1E921B86F8E1"><enum>(iii)</enum><text>make
				scholarships available to students to attend a private elementary or secondary
				school chosen by the student’s parents;
				and</text>
						</clause><after-quoted-block>; </after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HCCAE16A3C129496893E016B5A79D98F4"><enum>(2)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (F); and</text>
			</paragraph><paragraph id="HD307EE06F87B499DB352385DF302BDDC"><enum>(3)</enum><text>by inserting after
			 subparagraph (B) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H7B4254D3C7374F5B88AD8B003D00B030" style="OLC">
					<subparagraph id="HD2919B3BF1C04E68B6E41B00F18028A"><enum>(C)</enum><header>Special rule for
				private school choice</header><text>If a local education agency implements
				subparagraph (A)(iii), it shall—</text>
						<clause id="HA7F81E1492DC4A759976CE90C7CBCDED"><enum>(i)</enum><text>apply fair and
				equitable procedures for awarding scholarships under that subparagraph when the
				number of applicants exceeds available funding, which must include giving
				priority to students whose schools are in the second or a later year of
				restructuring under section 1116(b)(8);</text>
						</clause><clause id="H6CF990B1F0FB4BB38E0089FAB575BD1C"><enum>(ii)</enum><text>make scholarship
				payments to the parents of the students, in a manner that ensures that those
				payments are used only for the payment of tuition, fees, and necessary
				transportation expenses, in accordance with this section;</text>
						</clause><clause id="H4B5B68EC9F2148D5008BA800DD00A995"><enum>(iii)</enum><text>ensure that the
				amount a student receives under such a scholarship for an academic year,
				together with any funds the student receives under section 1116(e) for that
				academic year—</text>
							<subclause id="H70F7C0C5744B47F198FE3803AC30214B"><enum>(I)</enum><text>does not exceed
				$4,000; and</text>
							</subclause><subclause id="H4560700EB1A54510BA6CCA6968BFAA48"><enum>(II)</enum><text>does not exceed
				the costs, including necessary transportation and other expenses, to attend the
				private elementary or secondary school;</text>
							</subclause></clause><clause id="HB5396CBE3A6646C2A3F5ED7C61DC856D"><enum>(iv)</enum><text>if a student uses
				such a scholarship, continue to provide such a scholarship to that student for
				each academic year thereafter until the student completes the grade that is the
				final grade taught at the school that the student attended before using the
				scholarship;</text>
						</clause><clause id="H04B80EFABB284FCEBF4C28D97BF3A186"><enum>(v)</enum><text>assess that
				student in reading or language arts, mathematics, and science (at the grade
				levels specified in section 1111(b)(3)(C)) by using the State assessments
				administered under section 1111(b)(3), and include the student’s scores on
				those assessments in its annual report cards under section 1111(h)(2) and in
				determining whether the school and local educational agency made adequate
				yearly progress under section 1111;</text>
						</clause><clause id="H13009D7EADD04B19887E95FFB8A82D6E"><enum>(vi)</enum><text>separately
				display, for the local educational agency as a whole, the assessment results
				for students using the scholarships in its annual report cards under section
				1111(h)(2), except where doing so would reveal personally identifiable
				information about an individual student.</text>
						</clause></subparagraph><subparagraph id="H02822B2794064260B499FBE44B14C7C4"><enum>(D)</enum><header>Special rule for
				private schools</header><text>A private elementary or secondary school that
				enrolls a student who is using a scholarship under subparagraph (A)(iii)
				shall—</text>
						<clause id="HB4D2F80506B147D88B6B7D3F2643A8E1"><enum>(i)</enum><text>assess that
				student in reading or language arts, mathematics, and science (at the grade
				levels specified in section 1111(b)(3)(C)) by using either the State
				assessments administered under section 1111(b)(3) or nationally normed
				assessments; and</text>
						</clause><clause id="H593BB57FD2394347BF157B3C55EA1D2"><enum>(ii)</enum><text>provide the
				results of those assessments to the local educational agency that made the
				scholarship available.</text>
						</clause></subparagraph><subparagraph id="H8D5B29AE53DE4B9BA72F95722957F115"><enum>(E)</enum><header>Nondiscrimination</header>
						<clause id="HCF134170873A45D1A0699D87DA886862"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">A local educational
				agency or private elementary or secondary school participating in any program
				under subparagraph (A)(iii) shall not discriminate against participants or
				applicants on the basis of race, color, national origin, religion, or
				sex.</text>
						</clause><clause id="H325CA1C8BA2D47F88819538222526378"><enum>(ii)</enum><header>Religious
				tenets or beliefs with respect to sex</header><text display-inline="yes-display-inline">The prohibition of sex discrimination in
				clause (i) does not apply to a participating school that is operated by,
				supervised by, controlled by, or connected to a religious organization to the
				extent that the application of that prohibition is inconsistent with the
				religious tenets or beliefs of the school.</text>
						</clause><clause id="H1AD37C4B46C344C58E89796ED8B3ACF6"><enum>(iii)</enum><header>Single-sex
				education</header><text>Notwithstanding the prohibition of sex discrimination
				in clause (i), a participating school may offer, and a participating parent may
				choose, a single-sex school, class, or activity.</text>
						</clause><clause id="H160D702BD9584AF48DE7BE8F698DCF"><enum>(iv)</enum><header>Neutrality</header><text display-inline="yes-display-inline">Section 909 of the Education Amendments of
				1972 (20 U.S.C. 1688) shall apply to a program under subparagraph
				(A)(iii).</text>
						</clause><clause id="H76EA81C6287640BFB9A0CFC6B8FD3398"><enum>(v)</enum><header>Children with
				disabilities</header><text display-inline="yes-display-inline">Subparagraphs
				(C), (D), and (E) do not affect any requirement of the Individuals with
				Disabilities Education Act (20 U.S.C. 1400 et seq.).</text>
						</clause><clause id="HCD255176077C4B3285DECA4D6FF1D900"><enum>(vi)</enum><header>Matters of
				employment</header><text display-inline="yes-display-inline">Notwithstanding
				clause (i), a private elementary or secondary school participating in any
				program under subparagraph (A)(iii) that is operated by, supervised by,
				controlled by, or connected to a religious organization may exercise its right
				in matters of employment consistent with title VII of the Civil Rights Act of
				1964 (42 U.S.C. 2000e–1 et seq.), including the exemptions in that
				title.</text>
						</clause><clause id="H69284A2AD6664B429B27E4E678D03D21"><enum>(vii)</enum><header>First
				amendment</header><text display-inline="yes-display-inline">Consistent with the
				First Amendment to the Constitution of the United States, a participating
				school shall not, by reason of receiving funds under a program under
				subparagraph (A)(iii), be required to—</text>
							<subclause id="H2F079A73A68E4B40B9E344131209F3F3"><enum>(I)</enum><text>change its
				teaching mission;</text>
							</subclause><subclause id="H2EACDB6EE95A45218EDEB4F7D1E09221"><enum>(II)</enum><text>remove religious
				art, icons, scriptures, or other symbols;</text>
							</subclause><subclause id="HB98534EDF27F43DCBEE005383EC73E"><enum>(III)</enum><text>remove religious
				terms or references from its name, mission statement, or other chartering or
				governing documents; or</text>
							</subclause><subclause id="H7E49BCE6566E41A881DBB009BC3522B"><enum>(IV)</enum><text>refrain from using
				religion as a basis in selecting its board
				members.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HC2EA11C14799437DA1F6F58925DD7DD9"><enum>4.</enum><header>Opportunity
			 scholarships for parents and students</header><text display-inline="no-display-inline">Part B of title I of the Elementary and
			 Secondary Education Act of 1965 is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H568BE5D00FBB43C689E006687D23B295" style="OLC">
				<subpart id="H5FC23197F78F411AAEC9652B55FF242F"><enum>5</enum><header>Opportunity
				Scholarships for Parents and Students</header>
					<section id="HF59F05C1596045D19F7007AED291E2F"><enum>1261.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subpart:</text>
						<paragraph id="H026A2FCF2FDF428D9B246E042D91F69C"><enum>(1)</enum><header>Eligible
				entity</header><text>The term <quote>eligible entity</quote> means—</text>
							<subparagraph id="H4E5190AD876F4B82ADDF43209560F16F"><enum>(A)</enum><text display-inline="yes-display-inline">a local educational agency;</text>
							</subparagraph><subparagraph id="H24ED5785B3EF422BB3D332112CCF2430"><enum>(B)</enum><text>a State
				educational agency; or</text>
							</subparagraph><subparagraph id="H893B06B1B9E140E49400CDA993D844DF"><enum>(C)</enum><text>a nonprofit
				organization or a consortium of nonprofit organizations.</text>
							</subparagraph></paragraph><paragraph id="H424EFC69D15842E2A69CC78BDFA0029"><enum>(2)</enum><header>Eligible
				student</header><text display-inline="yes-display-inline">The term
				<quote>eligible student</quote> means a student from a low-income family
				who—</text>
							<subparagraph id="HAD38E3A1BFF342CF9531FEE5B2FD4627"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to a school identified for
				restructuring under section 1116(b)(8)—</text>
								<clause id="H9B658DB2A3A644CC99A355FFA83C45FA"><enum>(i)</enum><text>is
				eligible to enroll in the beginning grade of the school;</text>
								</clause><clause id="H9AAE4402E31E496588894C763E6CEB50"><enum>(ii)</enum><text>except as
				provided in subparagraph (C), attended the school for the entire school year
				preceding the identification;</text>
								</clause><clause id="H0D08606409A24E5BBB4C17990413C690"><enum>(iii)</enum><text>in the case of a
				student who transfers to the school to attend any grade beyond the beginning
				grade of the school, attends the school for the remainder of the school year in
				which the transfer occurs; or</text>
								</clause><clause id="H7AC1C891EB5F4FE7BE32430186C6D2C7"><enum>(iv)</enum><text>received a
				scholarship under this subpart in a preceding school year due to such
				identification; or</text>
								</clause></subparagraph><subparagraph id="HE765AB46269C409F9E9F4401CE9BCDE7"><enum>(B)</enum><text>is a sibling of a
				student described in any 1 of clauses (i) through (iv) of subparagraph
				(A).</text>
							</subparagraph></paragraph><paragraph id="HF28F0A2F3B004CE196B32D02191B681D"><enum>(3)</enum><header>Low-income
				family</header><text display-inline="yes-display-inline">The term
				<quote>low-income family</quote> means a family whose income does not exceed
				185 percent of the poverty line, except that in the case of a student
				participating in a project under this subpart for a second or any succeeding
				school year the term includes a family whose income does not exceed 220 percent
				of the poverty line.</text>
						</paragraph><paragraph id="H7D8FBA3DC641443B95C684382CC8E4A6"><enum>(4)</enum><header>Poverty
				line</header><text>The term <quote>poverty line</quote> means the income
				official poverty line (as defined by the Office of Management and Budget, and
				revised annually in accordance with section 673(2) of the Community Services
				Block Grant Act (42 U.S.C. 9902(2)) applicable to a family of the size
				involved.</text>
						</paragraph><paragraph id="HFB91344F855E45E0A5309536ED549FD2"><enum>(5)</enum><header>Private
				provider</header><text>The term <quote>private provider</quote> means a
				nonprofit or for-profit private provider of supplemental educational services
				described in section 1116(e)(1) that is on the updated list of approved
				providers maintained by the State educational agency under section
				1116(e)(4)(C).</text>
						</paragraph><paragraph id="HD57C101BA43A4246953854026D2D3576"><enum>(6)</enum><header>Supplemental
				educational services</header><text>The term <quote>supplemental educational
				services</quote> has the meaning given the term in section
				1116(e)(12)(C).</text>
						</paragraph></section><section id="H72FB4AAC47E14D4100FC453D502E5FF5"><enum>1262.</enum><header>Program
				authorized</header>
						<subsection id="HEB2C6A8E771D46B3AC1359CB35F61063"><enum>(a)</enum><header>Authority</header>
							<paragraph id="H9342AC6208654A3A88C0E275733166EE"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to paragraph
				(2) and from amounts appropriated under section 1264 for a fiscal year, the
				Secretary shall award grants, on a competitive basis, to eligible entities to
				support projects that provide—</text>
								<subparagraph id="HFF4CDA9214154B61934547589EB1CA1B"><enum>(A)</enum><text>scholarships to
				enable eligible students to attend—</text>
									<clause id="H1DFA9BE877B84772A2C000708CA39994"><enum>(i)</enum><text>the private
				elementary school or secondary school of their parent’s choice; or</text>
									</clause><clause id="H9D56B6ABC0BC45088CE7174FD6433E36"><enum>(ii)</enum><text>a
				public elementary school or secondary school of their parents’ choice outside
				of the eligible student’s home school district, consistent with State law;
				or</text>
									</clause></subparagraph><subparagraph id="HE22EB9CCA7F84C6A82EA02406800E5CC"><enum>(B)</enum><text>eligible students
				with intensive, sustained supplemental educational services on an annual
				basis.</text>
								</subparagraph></paragraph><paragraph id="H57E05E151F0B4F25BD687C8E25C2853F"><enum>(2)</enum><header>Scholarship
				duration rule</header><text>Each eligible entity that receives a grant under
				this subpart shall award a scholarship under this subpart only to an eligible
				student for—</text>
								<subparagraph id="H25E39CA0414A4B07AA9B91BA42FA355"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H9F4DE3270D284EB192216F91C36F53BE"><enum>(i)</enum><text>in the case of an
				eligible student described in section 1261(2)(A), the first school year for
				which the eligible student is eligible to receive the scholarship with respect
				to a school identified for restructuring under section 1116(b)(8); and</text>
									</clause><clause id="H5BDAC39B5B774CA5BE00C68217B73017" indent="up1"><enum>(ii)</enum><text>in the case of an eligible student
				described in section 1261(2)(B), the first school year taught at the school so
				identified; and</text>
									</clause></subparagraph><subparagraph id="HB9FDBC55D0434611ABA9EE3EDE4334BD"><enum>(B)</enum><text>each subsequent
				school year through the school year applicable to the final grade taught at the
				school so identified.</text>
								</subparagraph></paragraph></subsection><subsection id="H93412445A414496091506FA5EAD21EA6"><enum>(b)</enum><header>Duration of
				grants</header><text>The Secretary may award grants under this subpart for a
				period of not more than 5 years.</text>
						</subsection><subsection id="HAE88F72049104AC49E863E8CC020FCC5"><enum>(c)</enum><header>Priorities</header><text>In
				awarding grants under this subpart, the Secretary shall give priority to
				eligible entities that—</text>
							<paragraph id="HDC006EE0D6484B5D984B8812B72BD8B9"><enum>(1)</enum><text>make scholarships
				available to students to attend a private elementary or secondary school chosen
				by the student’s parents as authorized under section 1116(b)(8)(A)(iii);</text>
							</paragraph><paragraph id="H6C9B385531984789A6CC50A0CA78E457"><enum>(2)</enum><text>propose to serve
				eligible students in a local educational agency with a large number or
				percentage of schools identified for restructuring under section
				1116(b)(8);</text>
							</paragraph><paragraph id="HD23E9EADCE2C462B8D7092599089FEE7"><enum>(3)</enum><text>possess the
				knowledge and capacity to inform parents of eligible students, in urban,
				suburban, and rural areas, about public and private elementary school and
				secondary school options; and</text>
							</paragraph><paragraph id="HB4634FB4630F465E88A986AB59A710D0"><enum>(4)</enum><text>will augment the
				scholarships provided to eligible students under this subpart in order to help
				ensure that parents can afford the cost (including tuition, fees, and necessary
				transportation expenses) of the schools the parents choose to have their
				children attend under this subpart.</text>
							</paragraph></subsection><subsection id="H9668E9CB857E4D35B921C1ADD9882A4"><enum>(d)</enum><header>Application
				requirements</header>
							<paragraph id="H19ABB3A734D3402A00A2702F5967C95D"><enum>(1)</enum><header>In
				general</header><text>To be considered for a grant under this subpart, an
				eligible entity shall submit an application to the Secretary at such time, in
				such manner, and containing such information as the Secretary may reasonably
				require.</text>
							</paragraph><paragraph id="H03775361AFBE453289380000529B8BBF"><enum>(2)</enum><header>Contents</header><text>The
				application shall, at a minimum, include a description of—</text>
								<subparagraph id="HEE015C41F6144BA982C3C5CA46DB00AF"><enum>(A)</enum><text>the eligible
				entity’s plan for—</text>
									<clause id="H85E1EAA57991436486BCCC49C450BEAE"><enum>(i)</enum><text>recruiting private
				schools, local educational agencies, charter schools, and private providers to
				participate in the project in order to meet eligible student demand for private
				and public school admission and supplemental educational services; and</text>
									</clause><clause id="H33054A3772884FA2BC449E69FBF6DF00"><enum>(ii)</enum><text>ensuring that
				participating schools that enroll eligible students receiving scholarships
				under this subpart, and private providers participating in the project, will
				meet the applicable requirements of the project;</text>
									</clause></subparagraph><subparagraph id="H5EA54692F52D44E3A2A4B010678233B0"><enum>(B)</enum><text>each school
				identified for restructuring that will be served under the project,
				including—</text>
									<clause id="H659050DC01774D69AC9FEA5EC91628F5"><enum>(i)</enum><text>the name of each
				such school; and</text>
									</clause><clause id="H321091DEC24F4EA8B9FC76EE6D75B0ED"><enum>(ii)</enum><text>such demographic
				and socioeconomic information as the Secretary may require;</text>
									</clause></subparagraph><subparagraph id="H99965126EC73467489961171A59600BC"><enum>(C)</enum><text>how the eligible
				entity will work with the identified schools and the local educational agency
				to identify the parents of eligible students (including through contracts or
				cooperative agreements with the public school or local educational agency)
				consistent with the requirements of the Family Educational Rights and Privacy
				Act of 1974 (20 U.S.C. 1232g);</text>
								</subparagraph><subparagraph id="H71BF5BCF862443D3A42C3540E2CD3140"><enum>(D)</enum><text>how the eligible
				entity will structure the project in a manner that permits eligible students to
				participate in the second and succeeding school years of the project if the
				schools the eligible students attend with scholarship assistance under this
				subpart are subsequently identified for restructuring under section
				1116(b)(8);</text>
								</subparagraph><subparagraph id="H23117C69402A4E6B86E0CE7F06CEC452"><enum>(E)</enum><text>how the eligible
				entity will use funds received under this subpart;</text>
								</subparagraph><subparagraph id="H0A12A99DB4934B09BE759787CEFEF213"><enum>(F)</enum><text>how the eligible
				entity will ensure that if more eligible students seek admission to the project
				than the project can accommodate, the eligible students will be selected
				through a random selection process;</text>
								</subparagraph><subparagraph id="HA339D9889F6140CD9D17B68B581027CD"><enum>(G)</enum><text>how the eligible
				entity will notify parents of eligible students of the expanded choice
				opportunities provided under the project and how the eligible entity will
				provide parents with sufficient information to enable the parents to make an
				informed decision;</text>
								</subparagraph><subparagraph id="HF544A7BE8ABC47D88D8CC769EA1D1CB3"><enum>(H)</enum><text>how the eligible
				entity will ensure that the schools receiving eligible students under the grant
				are financially responsible and will use the grant funds received under this
				subpart effectively;</text>
								</subparagraph><subparagraph id="H38302883E060453581E607B2D3EC9845"><enum>(I)</enum><text>how the eligible
				entity will prioritize between providing scholarships and providing sustained,
				intensive supplemental educational services, including the timing and duration
				of offering the opportunity for parents to determine which provision the
				parents prefer; and</text>
								</subparagraph><subparagraph id="H980F1F5571354C3883FFF4BE9AB00BD"><enum>(J)</enum><text>how the eligible
				entity will address the renewal of support for participating eligible students,
				including continued eligibility.</text>
								</subparagraph></paragraph></subsection><subsection id="HE981E21A30D84BC3A29E61443334DF08"><enum>(e)</enum><header>Uses of
				funds</header>
							<paragraph id="H54ACE2504EDB469F80B6E61323C2043F"><enum>(1)</enum><header>In
				general</header><text>Each eligible entity that receives a grant under this
				subpart may—</text>
								<subparagraph id="HB1C8A44F1B3F44DFBD32484D13EC7D61"><enum>(A)</enum><text>reserve not more
				than 5 percent of the grant funds for administrative expenses, including costs
				associated with recruiting and selecting eligible students, private schools,
				and private providers, to participate in the project;</text>
								</subparagraph><subparagraph id="H9EC44C909D4C450B8CC29E649EA02BEA"><enum>(B)</enum><text>only for the first
				year for which grant funds are received under this subpart, reserve not more
				than 5 percent of the grant funds (in addition to the funds reserved under
				subparagraph (A)), for initial implementation expenses, including costs
				associated with outreach, providing information to parents and school
				officials, and other administrative expenses;</text>
								</subparagraph><subparagraph id="H8B503D06E38F4F7FA58EF366FFA0D6F4"><enum>(C)</enum><text>use the grant
				funds to provide scholarships to eligible students to pay for the cost,
				including tuition, fees, and necessary transportation expenses to attend the
				private school of their parents’ choice or a public elementary school or
				secondary school of their parents’ choice outside of the eligible students’
				home school district (consistent with State law), except that the scholarship
				shall not exceed $4,000 per student per school year; and</text>
								</subparagraph><subparagraph id="H6F3CC16978F249F6BAF0A1EBCD56DEF1"><enum>(D)</enum><text>use the grant
				funds to pay the costs, including reasonable transportation costs, of
				supplemental educational services (including summer school or after-school
				programs) provided by a private provider to eligible students, except that the
				costs shall not exceed $3,000 per student per school year.</text>
								</subparagraph></paragraph><paragraph id="H3C2E10ACD4AE41D795BE7C726FFE744D"><enum>(2)</enum><header>Funding
				order</header><text>Each eligible entity that receives a grant under this
				subpart shall—</text>
								<subparagraph id="H07145596CBC3475EAAFED4E9F1410B5"><enum>(A)</enum><text>first fund
				scholarships for eligible students to attend the private school of their
				parents’ choice or a public elementary school or secondary school of their
				parents’ choice outside of the eligible students’ home school district
				(consistent with State law); and</text>
								</subparagraph><subparagraph id="HE13ECE516A2247B696CB6F2F53CD006F"><enum>(B)</enum><text>use any remaining
				grant funds to provide eligible students with access to supplemental
				educational services.</text>
								</subparagraph></paragraph><paragraph id="H591E26C65A014BFAB4BAA6871123B2A"><enum>(3)</enum><header>Payment</header><text>Each
				eligible entity that receives a grant under this subpart shall make scholarship
				payments under this subpart to the parent of the eligible student participating
				in the project, in a manner that ensures that the payments will be used only
				for the payment of tuition, fees, and necessary transportation expenses, in
				accordance with this subpart.</text>
							</paragraph></subsection><subsection id="H92E465F27BC54786A0FD2F3B5908D9E"><enum>(f)</enum><header>Prohibition</header><text>A
				student who receives supplemental educational services under this subpart shall
				not be eligible to receive other such services under section 1116(e).</text>
						</subsection><subsection id="H32170DDB26AA4711883680CF03781136"><enum>(g)</enum><header>Project
				performance</header><text>Each eligible entity receiving a grant under this
				subpart shall prepare and submit to the Secretary a final report on the results
				of the project assisted under this subpart that contains such information as
				the Secretary may require. At a minimum, the report shall include information
				on the academic achievement of students receiving scholarships and supplemental
				educational services under the project.</text>
						</subsection><subsection id="H6CF418593DE14CC799F3D711A7B5807B"><enum>(h)</enum><header>Performance
				information</header><text>Each eligible entity that receives a grant under this
				subpart shall collect and report such performance information as the Secretary
				may require for the national evaluation conducted under subsection (i).</text>
						</subsection><subsection id="H9612006B37E849CAA1619BF03D3E2522"><enum>(i)</enum><header>National
				evaluation</header><text>From the amount made available for any fiscal year
				under section 1264, the Secretary shall reserve such sums as may be necessary
				to conduct an independent evaluation, by grant or by contract, of the program
				carried out under this subpart, which shall include an assessment of the impact
				of the program on student achievement. The Secretary shall report the results
				of the evaluation to the appropriate committees of Congress.</text>
						</subsection></section><section id="HD10D707F712D42B2AA340080FCCDAE32"><enum>1263.</enum><header>Nondiscrimination</header>
						<subsection id="HB848BAFCE38D4E3EB0EFE9D565FD36CE"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">An eligible entity or
				a school participating in a project under this subpart shall not discriminate
				against an individual participant in, or an individual applicant to participate
				in, the project on the basis of race, color, religion, sex, or national
				origin.</text>
						</subsection><subsection id="H59D947F1B24C4D20B17B30EB9A99BE3"><enum>(b)</enum><header>Religious tenets
				or beliefs</header><text>Notwithstanding any other provision of law, the
				prohibition of sex discrimination described in subsection (a) shall not apply
				to a school described in subsection (a) that is operated by, supervised by,
				controlled by, or connected to, a religious organization, to the extent that
				the application of subsection (a) is inconsistent with the religious tenets or
				beliefs of the organization.</text>
						</subsection><subsection id="H6F93E9DE82CB41789E3EAD47285F21C9"><enum>(c)</enum><header>Single-sex
				education</header><text>Notwithstanding the prohibition of sex discrimination
				in subsection (a), a participating school may offer, and a participating parent
				may choose, a single-sex school, class, or activity.</text>
						</subsection><subsection id="HD4FB9979DB094E9AA5DB166369CA0438"><enum>(d)</enum><header>Neutrality</header><text>Section
				909 of the Education Amendments of 1972 (20 U.S.C. 1688) shall apply to this
				subpart.</text>
						</subsection><subsection id="HF5ABFC6498AB4128AEFB00D8F4C9BD7"><enum>(e)</enum><header>Children with
				disabilities</header><text>This subpart does not affect any requirement of the
				Individuals with Disabilities Education Act (20 U.S.C. 1400 et seq.).</text>
						</subsection><subsection id="H0A8A18FAB7FD4DA09F90099769C21449"><enum>(f)</enum><header>Matters of
				employment</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (a), a participating school that is operated by, supervised by,
				controlled by, or connected to a religious organization may exercise its right
				in matters of employment consistent with title VII of the Civil Rights Act of
				1964 (42 U.S.C. 2000e–1 et seq.), including the exemptions in that
				title.</text>
						</subsection><subsection id="HEDA50E1C090E48F0914C74E271DB85F5"><enum>(g)</enum><header>First
				amendment</header><text>Consistent with the First Amendment to the Constitution
				of the United States, a participating school shall not, by reason of receiving
				funds under this subpart, be required to—</text>
							<paragraph id="H4A70CA9A2E634DFCAC3BE4E00500E852"><enum>(1)</enum><text>change its
				teaching mission;</text>
							</paragraph><paragraph id="HB2AB2E30F4BF4EA3867C4BFF5D9EEBAD"><enum>(2)</enum><text>remove religious
				art, icons, scriptures, or other symbols;</text>
							</paragraph><paragraph id="H5D4D495D1E6545579607003CB3C80024"><enum>(3)</enum><text>remove religious
				terms or references from its name, mission statement, or other chartering or
				governing documents; or</text>
							</paragraph><paragraph id="HC227E05E661D4A39B5005DE3EA110680"><enum>(4)</enum><text>refrain from using
				religion as a basis in selecting its board members.</text>
							</paragraph></subsection><subsection id="H0A27BFA238A44E0DAC444FAB6550C6F8"><enum>(h)</enum><header>Rules of
				construction</header><text>For purposes of Federal law, a scholarship provided
				under this subpart to a student shall be considered to be assistance to the
				parent of the student and shall not be considered to be assistance to the
				school that enrolls the student. The amount of any scholarship (or other form
				of support for the provision of supplemental educational services) provided to
				a parent of an eligible student under this subpart shall not be treated as
				income of a parent of the eligible student for purposes of Federal tax laws or
				for purposes of determining eligibility for any other Federal program, other
				than the program carried out under this subpart.</text>
						</subsection></section><section id="HA142354A929546E0BF2CA6CD5771A06"><enum>1264.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated to carry out this subpart $300,000,000 for fiscal
				year 2008 and such sums as may be necessary for each of the 4 succeeding fiscal
				years.</text>
