1.This Act may be cited as the
Military Reservist and Veteran Small
Business Reauthorization Act of 2007
.
2.In this Act—
(1)the term activated means
receiving an order placing a Reservist on active duty;
(2)the term active duty has the
meaning given that term in section 101 of title 10, United States Code;
(3)the terms Administration and
Administrator mean the Small Business Administration and the
Administrator thereof, respectively;
(4)the term Reservist means a
member of a reserve component of the Armed Forces, as described in section
10101 of title 10, United States Code;
(5)the term Service Corps of Retired
Executives means the Service Corps of Retired Executives authorized by
section 8(b)(1) of the Small Business Act (15 U.S.C. 637(b)(1));
(6)the terms service-disabled
veteran and small business concern have the meanings given
those terms in section 3 of the Small Business Act (15 U.S.C. 632);
(7)the term small business development
center means a small business development center described in section 21
of the Small Business Act (15 U.S.C. 648); and
(8)the term women's business
center means a women's business center described in section 29 of the
Small Business Act (15 U.S.C. 656).
<enum>I</enum><header display-inline="yes-display-inline">Military Reservist Loans</header>
<section commented="no" display-inline="no-display-inline" id="id9E0815A3150B46379162D17B8EA4B637" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Grant assistance for military Reservists'
small businesses</header>
<subsection commented="no" display-inline="no-display-inline" id="id06E2D32DBED64D568FA4494166FB50FF"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of grants</header><text display-inline="yes-display-inline">Section 7(b)(3)(B) of the Small Business
Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)(B)</external-xref>) is amended by inserting <quote>or grants</quote>
after <quote>or a deferred basis)</quote>.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="idA2B040E738544CC79A0385BCCE10DFF0"><enum>(b)</enum><header display-inline="yes-display-inline">Grant specifications</header><text display-inline="yes-display-inline">Section 7(b)(3) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)</external-xref>) is amended by inserting after subparagraph (F) the
following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="idE0755DA4D7644A4E8F53EF2F19669FCD"><enum>(G)</enum><text display-inline="yes-display-inline">Grants made under subparagraph (B)—</text>
<clause commented="no" display-inline="no-display-inline" id="id4717EB5541E04CC8A8933522E84087D4"><enum>(i)</enum><text display-inline="yes-display-inline">may be awarded in addition to any loan made
under subparagraph (B);</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id913B778E092941618221B68DC4501574"><enum>(ii)</enum><text display-inline="yes-display-inline">shall not exceed $25,000; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id570CB4AC723546F88286C0DCD36F2C37"><enum>(iii)</enum><text display-inline="yes-display-inline">shall be made only to a small business
concern—</text>
<subclause commented="no" display-inline="no-display-inline" id="id2172D6CF415F401E982F6F51B677BACF"><enum>(I)</enum><text display-inline="yes-display-inline">that provides a business plan demonstrating
viability for not less than 3 years after the date of the application for that
grant;</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id36D67BA71F444105BC1069F85C17D136"><enum>(II)</enum><text display-inline="yes-display-inline">with 10 or fewer employees; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id6DEB0CDF172B43499BD68E7B1ED4481C"><enum>(III)</enum><text display-inline="yes-display-inline">that has not received a grant under
subparagraph (B) during the 2-year period ending on the date of the application
for that
grant.</text>
</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection><subsection commented="no" display-inline="no-display-inline" id="id0BAED18AB13342FBBAA68288EFCAE2E6"><enum>(c)</enum><header display-inline="yes-display-inline">Authorization of
appropriations</header><text display-inline="yes-display-inline">Section
20(e)(2) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/631">15 U.S.C. 631</external-xref> note) is amended by inserting
after subparagraph (B) the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="idBF5E6F03F768448EBFC54B228C9AC35C"><enum>(C)</enum><header display-inline="yes-display-inline">Grant assistance for military Reservists'
small businesses</header><text display-inline="yes-display-inline">There are
authorized to be appropriated for grants under section 7(b)(3)(B)—</text>
<clause commented="no" display-inline="no-display-inline" id="id0B08001E79F6419A991576584199E906"><enum>(i)</enum><text display-inline="yes-display-inline">$5,000,000 for the first fiscal year
beginning after the date of enactment of the <short-title>Military Reservist and Veteran Small Business
Reauthorization Act of 2007</short-title>; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idB7585CEB074549FC85A1A07826810FD9"><enum>(ii)</enum><text display-inline="yes-display-inline">$5,000,000 for each of the 2 fiscal years
following the fiscal year described in clause
(i).</text>
</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</subsection></section><section commented="no" display-inline="no-display-inline" id="id9B25AFDE262F4823B45F4B680A6540DC" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Noncollateralized loans</header><text display-inline="no-display-inline">Section 7(b)(3) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)</external-xref>) is amended by inserting after subparagraph (G), as added
by this Act, the following:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="idCF7537D88D7042EE9F900E8C06297968"><enum>(H)</enum><clause commented="no" display-inline="yes-display-inline" id="idCD1E217583B74D82AE180A6A53DA27D5"><enum>(i)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
the Administrator may make a loan under this paragraph of not more than
$100,000 without collateral.</text>
</clause><clause commented="no" display-inline="no-display-inline" id="idD82608F1A69644AE9AE14D00FE433BCD" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Administrator may defer payment of
principal and interest on a loan described in clause (i) during the longer
of—</text>
<subclause commented="no" display-inline="no-display-inline" id="id82BD1FAA0C0642F2A6796AB71E687C85"><enum>(I)</enum><text display-inline="yes-display-inline">the 1-year period beginning on the date of
the initial disbursement of the loan; and</text>
</subclause><subclause commented="no" display-inline="no-display-inline" id="id0801D829E09F4EED8CA44A86F109C038"><enum>(II)</enum><text display-inline="yes-display-inline">the period during which the relevant
essential employee is on active
duty.</text>
</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><section commented="no" display-inline="no-display-inline" id="id6BB5175870C44127827025981AF2F6C1" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Application period</header><text display-inline="no-display-inline">Section 7(b)(3)(C) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)(C)</external-xref>) is amended by striking <quote>90 days</quote> and
inserting <quote>1 year</quote>.</text>
</section><section commented="no" display-inline="no-display-inline" id="idCEFFF00870CD419DAA0A00AB7B62614E" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Preapproval process</header>
<subsection commented="no" display-inline="no-display-inline" id="idBBA9C3A281B2431FAEA6157FE1BB5332"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>eligible
Reservist</term> means a Reservist who—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id01DD0A14615A4AE2877DB50CE96F9943"><enum>(1)</enum><text display-inline="yes-display-inline">has not been ordered to active duty;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1710514DDDF84C03BF68D74C6EC513D5"><enum>(2)</enum><text display-inline="yes-display-inline">expects to be ordered to active duty during
a period of military conflict (as that term is defined in section 7(n)(1) of
the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(n)(1)</external-xref>); and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id69571890C41444729AE25444B685E817"><enum>(3)</enum><text display-inline="yes-display-inline">can reasonably demonstrate that the small
business concern for which that Reservist is a key employee will suffer
economic injury in the absence of that Reservist.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id21625719660149B8B96E1EE4CFA0F1B4"><enum>(b)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
enactment of this Act, the Administrator shall establish a preapproval process,
under which—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id5751B45EFE02470AA4E6516BDC4F8320"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator may approve a loan or
grant to a small business concern under section 7(b)(3) of the Small Business
Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)</external-xref>), as amended by this Act, before an eligible Reservist
employed by that small business concern is activated; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1FA750B55D6F4A838983E67BB49A919B"><enum>(2)</enum><text display-inline="yes-display-inline">the Administrator shall distribute funds
for any loan or grant approved under paragraph (1) if that eligible Reservist
is activated.</text>
</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE67A85A7C215469BB7B1F765758E7ED1" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Outreach and technical assistance
program</header>
<subsection commented="no" display-inline="no-display-inline" id="id66E0D154BC0F45EA9B933F9CD681B50E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
enactment of this Act, the Administrator, in consultation with the Secretary of
Veterans Affairs and the Secretary of Defense, shall develop a comprehensive
outreach and technical assistance program (in this section referred to as the
<quote>program</quote>) to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idDC66292F635745B7955BAEF542D395AE"><enum>(1)</enum><text display-inline="yes-display-inline">market the loans and grants available under
section 7(b)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)</external-xref>), as amended by
this Act, to Reservists, and family members of Reservists, that are on active
duty and that are not on active duty; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE0953499EE4D485BAF122AAFD275BA80"><enum>(2)</enum><text display-inline="yes-display-inline">provide technical assistance to a small
business concern applying for a loan or grant under that section.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id079E801C887F4B71A6E2365F54FE357C"><enum>(b)</enum><header display-inline="yes-display-inline">Components</header><text display-inline="yes-display-inline">The program shall—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idB2625807E6C546D8BE6EEC6C80C8DE16"><enum>(1)</enum><text display-inline="yes-display-inline">incorporate appropriate websites maintained
by the Administration, the Department of Veterans Affairs, and the Department
of Defense; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9FE9B7B102C54BE9AE29979B42EC1562"><enum>(2)</enum><text display-inline="yes-display-inline">require that information on the program is
made available to small business concerns directly through—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id8B8E3678046A41C19E51CC56C94898E6"><enum>(A)</enum><text display-inline="yes-display-inline">the district offices and resource partners
of the Administration, including small business development centers, women's
business centers, and the Service Corps of Retired Executives; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0DB0318083D14AF99159EE1B910821D5"><enum>(B)</enum><text display-inline="yes-display-inline">other Federal agencies, including the
Department of Veterans Affairs and the Department of Defense.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE416F7D71F81490488372656D979DE64"><enum>(c)</enum><header display-inline="yes-display-inline">Report</header>
<paragraph commented="no" display-inline="no-display-inline" id="id8A6D7FF114DA4595B2C704F0455B8C76"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of
enactment of this Act, and every 6 months thereafter until the date that is 30
months after such date of enactment, the Administrator shall submit to Congress
a report on the status of the program.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id312C45A8FB9D4F06B4F8B396F8C95079"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1)
shall include—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="idB5B4BB3B4FD04AB5ABB6C6F69F308B95"><enum>(A)</enum><text display-inline="yes-display-inline">for the 6-month period before the date of
that report—</text>
<clause commented="no" display-inline="no-display-inline" id="idE56538B8C7B1461195640E848AA5EC24"><enum>(i)</enum><text display-inline="yes-display-inline">the number of loans and grants approved
under section 7(b)(3) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(3)</external-xref>), as
amended by this Act;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id74FAACF27B134337AD2396181F354C61"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of loans and grants disbursed
under that section; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="id1920448BBA4B4293BB7560A9607B87B0"><enum>(iii)</enum><text display-inline="yes-display-inline">the total amount disbursed under that
section; and</text>
</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB3B83DFF7B6348BABCADE3A990223723"><enum>(B)</enum><text display-inline="yes-display-inline">recommendations, if any, to make the
program more effective in serving small business concerns that employ
Reservists.</text>
</subparagraph></paragraph></subsection></section><enum>II</enum><header display-inline="yes-display-inline">National Reservist Enterprise Transition
and Sustainability</header>
<section commented="no" display-inline="no-display-inline" id="ID622e5d13510445c29de64e0824e856c7" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This title may be cited as the
<quote><short-title>National Reservist Enterprise
Transition and Sustainability Act of 2007</short-title></quote>.</text>
</section><section commented="no" display-inline="no-display-inline" id="ID005c7a210f2b420287571afa19822f37" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this title is to establish a
program to—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDd048150992924f63a32b7973d99a2c50"><enum>(1)</enum><text display-inline="yes-display-inline">provide managerial, financial, planning,
development, technical, and regulatory assistance to small business concerns
owned and operated by Reservists;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe9b05679408d4489ac373aa418184b86"><enum>(2)</enum><text display-inline="yes-display-inline">provide managerial, financial, planning,
development, technical, and regulatory assistance to the temporary heads of
small business concerns owned and operated by Reservists;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb329248d788f4f9db6a1e0a4f9dd3333"><enum>(3)</enum><text display-inline="yes-display-inline">create a partnership between the Small
Business Administration, the Department of Defense, and the Department of
Veterans Affairs to assist small business concerns owned and operated by
Reservists;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9a28e9b3b7a470581969fc0f683c42b"><enum>(4)</enum><text display-inline="yes-display-inline">utilize the service delivery network of
small business development centers, women's business centers, Veterans Business
Outreach Centers, and centers operated by the National Veterans Business
Development Corporation to expand the access of small business concerns owned
and operated by Reservists to programs providing business management,
development, financial, procurement, technical, regulatory, and marketing
assistance;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfa53668c77d94a93ae21a172768c4e1e"><enum>(5)</enum><text display-inline="yes-display-inline">utilize the service delivery network of
small business development centers, women's business centers, Veterans Business
Outreach Centers, and centers operated by the National Veterans Business
Development Corporation to quickly respond to an activation of Reservists that
own and operate small business concerns; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID904370f0cc214e24821d1da903838e18"><enum>(6)</enum><text display-inline="yes-display-inline">utilize the service delivery network of
small business development centers, women's business centers, Veterans Business
Outreach Centers, and centers operated by the National Veterans Business
Development Corporation to assist Reservists that own and operate small
business concerns in preparing for future military activations.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID5cc90dfab6ec4f6e99d88b84ff4ee092" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">National guard and reserve business
assistance</header>
<subsection commented="no" display-inline="no-display-inline" id="IDbb1571602d454e539de33cd29daf1b2a"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 21(a)(1) of the Small Business Act
(<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648(a)(1)</external-xref>) is amended by inserting <quote>any small business
development center, women's business center, Veterans Business Outreach Center,
or center operated by the National Veterans Business Development Corporation
providing enterprise transition and sustainability assistance to Reservists
under section 37,</quote> after <quote>any women's business center operating
pursuant to section 29,</quote>.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1fe7ae64c19545af8524ad8c6fbedb26"><enum>(b)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The Small Business Act (15 U.S.C. 631 et
seq.) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="IDa502dab33f2544009c3e5ab9a9301c8e"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 37 (15 U.S.C. 631
note) as section 38; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID473786e0d3164622920bae7f9de40740"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 36 the
following:</text>

<subsection commented="no" display-inline="no-display-inline" id="ID1817ad08c780460b9cdaae2f32fc29b9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish a program
to provide business planning assistance to small business concerns owned and
operated by Reservists.</text>
</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4b7e61a31a6f46f682197f637dd9fdb0"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID73d162f6a78f43e2ade90b34246592ef"><enum>(1)</enum><text display-inline="yes-display-inline">the terms <term>activated</term> and
<term>activation</term> mean having received an order placing a Reservists on
active duty, as defined by <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(1)</external-xref> of title 10, United States
Code;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8a7d3fe227ea48f49d384b19f8928ebe"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means
the Administrator of the Small Business Administration, acting through the
Associate Administrator for Small Business Development Centers;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5638e37695ce489ab98380454c625de7"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Association</term> means the
association established under section 21(a)(3)(A);</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id800D2072D4EC4049B50CA98846525563"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>eligible applicant</term>
means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id722D265A53CD4385BBE23992DE0AFEAE"><enum>(A)</enum><text display-inline="yes-display-inline">a small business development center that is
accredited under section 21(k);</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83DDCD1761AF4A94A60DC91256D2CD3B"><enum>(B)</enum><text display-inline="yes-display-inline">a women's business center;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3a749440c7b94ed4a7fb696862c9beb2"><enum>(C)</enum><text display-inline="yes-display-inline">a Veterans Business Outreach Center that
receives funds from the Office of Veterans Business Development; or</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDB0A59620D0B466BBD14847E51F87F42"><enum>(D)</enum><text display-inline="yes-display-inline">an information and assistance center
operated by the National Veterans Business Development Corporation under
section 33;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7087c9e1625f432594adb6061afdadde"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>enterprise transition and
sustainability assistance</term> means assistance provided by an eligible
applicant to a small business concern owned and operated by a Reservist, who
has been activated or is likely to be activated in the next 12 months, to
develop and implement a business strategy for the period while the owner is on
active duty and 6 months after the date of the return of the owner;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb3b67e557235460ea59fa48b2857bc6f"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>Reservists</term> means any
person who is—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDe7e7153d8bf04f1a94573975d449ab0f"><enum>(A)</enum><text display-inline="yes-display-inline">a member of a reserve component of the
Armed Forces, as defined by <external-xref legal-doc="usc" parsable-cite="usc/10/10101">section 10101</external-xref> of title 10, United States Code;
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcdb17d3575b74d55889efc69c494cb3a"><enum>(B)</enum><text display-inline="yes-display-inline">on active status, as defined by section
101(d)(4) of title 10, United States Code;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7ee97c52d7934871b64edef81db01f41"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>small business development
center</term> means a small business development center as described in section
21 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/648">15 U.S.C. 648</external-xref>);</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID601d97f5b03b4d198c718a067138e249"><enum>(8)</enum><text display-inline="yes-display-inline">the term <term>State</term> means each of
the several States of the United States, the District of Columbia, the
Commonwealth of Puerto Rico, the Virgin Islands, American Samoa, and Guam;
and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id077B456BEE594929991B825BD298A682"><enum>(9)</enum><text display-inline="yes-display-inline">the term <term>women's business
center</term> means a women's business center described in section 29 of the
Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>).</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8d7fd5621fd447fd88c2f3c6d44237e1"><enum>(c)</enum><header display-inline="yes-display-inline">Authority</header><text display-inline="yes-display-inline">The Administrator may award grants, in
accordance with the regulations developed under subsection (d), to eligible
applicants to assist small business concerns owned and operated by Reservists
by—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID4e8a73c9fcdd4dcab347ff43dcbddac2"><enum>(1)</enum><text display-inline="yes-display-inline">providing management, development,
financing, procurement, technical, regulatory, and marketing assistance;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID89827db3403e463da4ca7e0d29df8c16"><enum>(2)</enum><text display-inline="yes-display-inline">providing access to information and
resources, including Federal and State business assistance programs;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID148d107104d844c281e5519702b41f8a"><enum>(3)</enum><text display-inline="yes-display-inline">distributing contact information provided
by the Department of Defense regarding activated Reservists to corresponding
State directors;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID20b257a664094b9fb368747e1cd8f0b2"><enum>(4)</enum><text display-inline="yes-display-inline">offering free, one-on-one, in-depth
counseling regarding management, development, financing, procurement,
regulations, and marketing;</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID613accd40b8d4ec48dca3ab1f00b4b3f"><enum>(5)</enum><text display-inline="yes-display-inline">assisting in developing a long-term plan
for possible future activation; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDef020936c3aa4f58aad7faa9cef09267"><enum>(6)</enum><text display-inline="yes-display-inline">providing enterprise transition and
sustainability assistance.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa0d86d43c7b14ed3b12425fc1d302768"><enum>(d)</enum><header display-inline="yes-display-inline">Rulemaking</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID65cacacef6b04269aaff1798444d6acb"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator, in consultation with the
Association and after notice and an opportunity for comment, shall promulgate
regulations to carry out this section.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID92b4b8d400cb4d8ca2124df2ff163959"><enum>(2)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">The Administrator shall promulgate final
regulations not later than 180 days of the date of enactment of the
<short-title>Military Reservist and Veteran Small Business
Reauthorization Act of 2007</short-title>.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDafedcb997148416c886abb069886ce34"><enum>(3)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The regulations developed by the
Administrator under this subsection shall establish—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDafb9975d9f5c437c97e9e0031964799a"><enum>(A)</enum><text display-inline="yes-display-inline">procedures for identifying, in consultation
with the Secretary of Defense, States that have had a recent activation of
Reservists;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID26fa86e9ba294e0bbb818c4e0d33e173"><enum>(B)</enum><text display-inline="yes-display-inline">priorities for the types of assistance to
be provided under the program authorized by this section;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID53bdf6e9983041e39792fbc6077fb0e6"><enum>(C)</enum><text display-inline="yes-display-inline">standards relating to educational,
technical, and support services to be provided by a grantee;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa8ef8d2f14bc4f37950eaa1182c3716d"><enum>(D)</enum><text display-inline="yes-display-inline">standards relating to any national service
delivery and support function to be provided by a grantee;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID47196f6668d649619fed83379f896968"><enum>(E)</enum><text display-inline="yes-display-inline">standards relating to any work plan that
the Administrator may require a grantee to develop; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID80ee6cad583b4f1f9b4c356a1f61eb19"><enum>(F)</enum><text display-inline="yes-display-inline">standards relating to the educational,
technical, and professional competency of any expert or other assistance
provider to whom a small business concern may be referred for assistance by a
grantee.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa135b3fc3b444cb9b42c9ecf62772a6d"><enum>(e)</enum><header display-inline="yes-display-inline">Application</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID1a7f3c8804bd4617b190481e77baac74"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each eligible applicant desiring a grant
under this section shall submit an application to the Administrator at such
time, in such manner, and accompanied by such information as the Administrator
may reasonably require.</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc9b258929c734a76be9f0d81db24b50a"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each application submitted under paragraph
(1) shall describe—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1afb734af3a2431ba2f133ecc870ce9c"><enum>(A)</enum><text display-inline="yes-display-inline">the activities for which the applicant
seeks assistance under this section; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9fbcdf1b9cfc4102b6a42085b0357c88"><enum>(B)</enum><text display-inline="yes-display-inline">how the applicant plans to allocate funds
within its network.</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd5f7ef175c694d16aff6574afd450eca"><enum>(3)</enum><header display-inline="yes-display-inline">Matching not required</header><text display-inline="yes-display-inline">Subparagraphs (A) and (B) of section
21(a)(4), requiring matching funds, shall not apply to grants awarded under
this section.</text>
</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc6a10d6b2bd347f28e3847712d45f26f"><enum>(f)</enum><header display-inline="yes-display-inline">Award of grants</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDf5d8c7c8b5dd40b9822e1186e4d2a557"><enum>(1)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">The Administrator shall award grants not
later than 60 days after the promulgation of final rules and regulations under
subsection (d).</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID86bd16cf1dce45a28bbaee2d3326f84c"><enum>(2)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">Each eligible applicant awarded a grant
under this section shall receive a grant in an amount—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDad6433c68984416fb1dc0886754e5b03"><enum>(A)</enum><text display-inline="yes-display-inline">not less than $150,000 per fiscal year;
and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd848d99dbca94b4b95979557b9ab53d5"><enum>(B)</enum><text display-inline="yes-display-inline">not greater than $500,000 per fiscal
year.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID545fbce4f620489b9890dd2cf05f34dd"><enum>(g)</enum><header display-inline="yes-display-inline">Report</header>
<paragraph commented="no" display-inline="no-display-inline" id="ID1f205e6beb6e48e9a98af3c8e99155f5"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Comptroller General of the United
States shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID335e7e1da1ed46f28f1c6dac0b30e2e3"><enum>(A)</enum><text display-inline="yes-display-inline">initiate an evaluation of the program not
later than 30 months after the disbursement of the first grant under this
section; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID084158be30944160952a3915ecd25075"><enum>(B)</enum><text display-inline="yes-display-inline">submit a report not later than 6 months
after the initiation of the evaluation under paragraph (1) to—</text>
<clause commented="no" display-inline="no-display-inline" id="ID0fdc85e704e949faad3e1506e5819e3f"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator;</text>
</clause><clause commented="no" display-inline="no-display-inline" id="IDf4e830c79d5149e2b291c9d4c565d524"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Small Business and
Entrepreneurship of the Senate; and</text>
</clause><clause commented="no" display-inline="no-display-inline" id="ID93aca1272b4b48fcacd9ab7d7dcf140c"><enum>(iii)</enum><text display-inline="yes-display-inline">the Committee on Small Business of the
House of Representatives.</text>
</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3dbe3601a4694d78a04c2f6d3881f272"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The report under paragraph (1)
shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID4a54a4dcdf8d43129a8094f5e9ab2e13"><enum>(A)</enum><text display-inline="yes-display-inline">address the results of the evaluation
conducted under paragraph (1); and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbf3fb0e6305246da9d568877d9f8bf47"><enum>(B)</enum><text display-inline="yes-display-inline">recommend changes to law, if any, that it
believes would be necessary or advisable to achieve the goals of this
section.</text>
</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf955734c5e314d6c852bcc3a2258df79"><enum>(h)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
<paragraph commented="no" display-inline="no-display-inline" id="IDf321fc5c6f62409286ce735b4833c8c7"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
carry out this section—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="ID8b9120a52cf74a3b9ae0b20a8faead3d"><enum>(A)</enum><text display-inline="yes-display-inline">$5,000,000 for the first fiscal year
beginning after the date of enactment of the <short-title>Military Reservist and Veteran Small Business
Reauthorization Act of 2007</short-title>; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDff2da292521b41088f821cf6b7b3b3e9"><enum>(B)</enum><text display-inline="yes-display-inline">$5,000,000 for each of the 3 fiscal years
following the fiscal year described in subparagraph (A).</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID793cb0b980c74737952a728b45878be4"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on use of other
funds</header><text display-inline="yes-display-inline">The Administrator may
carry out the program authorized by this section only with amounts appropriated
in advance specifically to carry out this
section.</text>
</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
</paragraph></subsection></section><enum>III</enum><header display-inline="yes-display-inline">Veteran entrepreneur loans</header>
<section commented="no" display-inline="no-display-inline" id="ID7927a1f162c247969d285851fa825394" section-type="subsequent-section"><enum>301.</enum><header display-inline="yes-display-inline">Authorization</header><text display-inline="no-display-inline">The first sentence of section 7(a) of the
Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636</external-xref>) is amended by inserting <quote>new veteran
entrepreneurs under paragraph (32) and</quote> and after <quote>loans to any
qualified small business concern, including</quote>.</text>
</section><section commented="no" display-inline="no-display-inline" id="ID6b9825d4626f4111a645b5b96c5af7cd" section-type="subsequent-section"><enum>302.</enum><header display-inline="yes-display-inline">Specifications</header><text display-inline="no-display-inline">Section 7(a) of the Small Business Act (15
U.S.C. 636(a)) is amended by adding after paragraph (31) the following:</text>

<paragraph commented="no" display-inline="no-display-inline" id="IDf5811614e2504e21a6e5c4179e7401dd"><enum>(32)</enum><header display-inline="yes-display-inline">Veteran entrepreneur loans</header><text display-inline="yes-display-inline">Each loan to a new veteran entrepreneur
under this subsection shall—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="IDa50b47bf1e564d0c9a91079db1af9142"><enum>(A)</enum><text display-inline="yes-display-inline">be made directly to the new veteran
entrepreneur;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID455a810b194c4bcb9b77b7f050edd158"><enum>(B)</enum><text display-inline="yes-display-inline">not exceed $100,000; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6c70be25a38446dd8859311ec9118b72"><enum>(C)</enum><text display-inline="yes-display-inline">be made at the same interest rate as loans
made under the second proviso of the unnumbered paragraph of subsection
(b).</text>

</section><section commented="no" display-inline="no-display-inline" id="ID142532b967b94ff1a58006631a98cc85" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Section 3(q) of the Small Business Act (15
U.S.C. 632(q)) is amended by adding after paragraph (4) the following:</text>

concern or established a new small business concern during the 6-month period
ending on the date of the request for a loan; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID565133e4e2af458396fd3914f814bbfc"><enum>(C)</enum><text display-inline="yes-display-inline">does not own or control any other
business.</text>
</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
</section><enum>IV</enum><header display-inline="yes-display-inline">Other provisions</header>
<section commented="no" display-inline="no-display-inline" id="ID6c1fa427ade54c39ab4f08fda8cd09a4" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Increased funding for the Office of
Veterans Business Development</header><text display-inline="no-display-inline">There are authorized to be appropriated to
the Office of Veterans Business Development of the Administration, to remain
available until expended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID4905b98495604141bbd8c13b95fc5bda"><enum>(1)</enum><text display-inline="yes-display-inline">$2,100,000 for fiscal year 2008;</text>

<subsection commented="no" display-inline="no-display-inline" id="IDbb639487e9b944dfa9841071ebff99bc"><enum>(a)</enum><header display-inline="yes-display-inline">Assumption of duties</header><text display-inline="yes-display-inline">Section 33 of the Small Business Act (15
U.S.C. 657c) is amended—</text>
<paragraph commented="no" display-inline="no-display-inline" id="ID4cf716caa39249f59928a650bff207c7"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (h); and</text>

</subsection></section><section commented="no" display-inline="no-display-inline" id="ID73ac8cefb74f4fad821fbe656416b1af" section-type="subsequent-section"><enum>403.</enum><header display-inline="yes-display-inline">Reservists study</header><text display-inline="no-display-inline">Not later than 180 days after the date of
enactment of this Act, the Comptroller General of the United States shall
submit to the Committee on Small Business and Entrepreneurship of the Senate
and the Committee on Small Business of the House of Representatives a report
regarding whether there has been a reduction in the hiring of Reservists by
business concerns because of—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id4AFA4FF931544CFA9D488632953C1851"><enum>(1)</enum><text display-inline="yes-display-inline">any increase in the use of Reservists after
September 11, 2001; or</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB1FF0A25B174E3C9DB5C600F6907069"><enum>(2)</enum><text display-inline="yes-display-inline">any change in any policy of the Department
of Defense relating to Reservists after September 11, 2001.</text>
</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDdf9efeee0d764a01aaec42eaaf016a51" section-type="subsequent-section"><enum>404.</enum><header display-inline="yes-display-inline">Service-disabled veterans</header><text display-inline="no-display-inline">Not later than 180 days after the date of
enactment of this Act, the Comptroller General of the United States shall
submit to the Committee on Small Business and Entrepreneurship of the Senate
and the Committee on Small Business of the House of Representatives a report
describing—</text>
<paragraph commented="no" display-inline="no-display-inline" id="idDDC000ED5882475FB74C30A0F1B02712"><enum>(1)</enum><text display-inline="yes-display-inline">the types of assistance needed by
service-disabled veterans who wish to become entrepreneurs; and</text>
</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC3BF5DBFD25943EABEECCCE551F4D3CF"><enum>(2)</enum><text display-inline="yes-display-inline">any resources that would assist such
service-disabled veterans.</text>
</paragraph></section>
