<section display-inline="yes-display-inline" section-type="undesignated-section" id="HEA68980F2EB449D0B1D5188F265E3386"><text display-inline="yes-display-inline">That upon the adoption of this resolution the bill (H.R. 797) entitled <quote>An Act to amend title 38, United States Code, to improve compensation benefits for veterans in certain cases of impairment of vision involving both eyes, to provide for the use of the National Directory of New Hires for income verification purposes, to extend the authority of the Secretary of Veterans Affairs to provide an educational assistance allowance for qualifying work study activities, and to authorize the provision of bronze representations of the letter <quote>V</quote> for the graves of eligible individuals buried in private cemeteries in lieu of Government-provided headstones or markers.</quote>, with the Senate amendment thereto, shall be considered to have been taken from the Speaker’s table to the end that the Senate amendment thereto be, and the same is hereby, agreed to with the following amendments:</text> 
<paragraph id="H63FDD1620C594ACABB34501691CC6C6E"><enum></enum><text>Strike all after the enacting clause and insert the following:</text></paragraph></section> 
<section id="HA01B15EB0C504013A6DE7827A7578E" section-type="section-one"><enum>1.</enum><header>Short title; table of contents</header> 
<subsection id="HEE9ED9B1AE2642588CF2595B92A8F530"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Dr. James Allen Veteran Vision Equity Act of 2007</short-title></quote>.</text></subsection>

<section id="H8A287ACE2F0B4530A771A7E3A8DEC4ED"><enum>101.</enum><header>Modification of rate of visual impairment for payment of disability compensation</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1114">Section 1114(o)</external-xref> of title 38, United States Code, is amended by striking <quote>5/200</quote> and inserting <quote>20/200 </quote>.</text></section> 
<section id="H89728F6AA1F04D12A85C15004D00AF3"><enum>102.</enum><header>Improvement in compensation for veterans in certain cases of impairment of vision involving both eyes</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1160">Section 1160(a)(1)</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H5841C11B324A4720B5C7D7D4CDE6FCE6"><enum>(1)</enum><text>by striking <quote>blindness</quote> both places it appears and inserting <quote>impairment of vision</quote>;</text></paragraph> 
<paragraph id="H5BACF11403034AF8802C3C0029A07511"><enum>(2)</enum><text>by striking <quote>misconduct;</quote> and inserting <quote>misconduct and—</quote>; and</text></paragraph> 
<paragraph id="H63C7818055064412A9B733BD004C5FE8"><enum>(3)</enum><text>by adding at the end the following new subparagraphs:</text> 
<quoted-block id="HA43975F892B542728E973B284497F08" style="USC"> 
<subparagraph id="H9B56298611CC4B9EB5386F9EABE920AF"><enum>(A)</enum><text>the impairment of vision in each eye is rated at a visual acuity of 20/200 or less; or</text></subparagraph> 
<subparagraph id="HF4EDB7560B6E4D98B61FA62F6EFBAB64"><enum>(B)</enum><text>the peripheral field of vision for each eye is 20 degrees or less;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="HB8403B6C9D41400F8CC4689644860B4"><enum>II</enum><header>Matters relating to Burial and Memorial Affairs</header> 
<section id="H769F3B743F9F41BEAE87E135D3C45C24"><enum>201.</enum><header>Provision of medallion or other device for privately-purchased grave markers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/2306">Section 2306(d)</external-xref> of title 38, United States Code, is amended by adding at the end the following new paragraph:</text>

<paragraph id="H813C7AEFB9024BCD975BEB29C900A802" indent="up1"><enum>(5)</enum><text>In lieu of furnishing a headstone or marker under this subsection, the Secretary may furnish, upon request, a medallion or other device of a design determined by the Secretary to signify the deceased’s status as a veteran, to be attached to a headstone or marker furnished at private expense.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H57F6602D0F734DBFB711D2873EFD3CD"><enum>202.</enum><header>Improvement in provision of assistance to States relating to the interment of veterans in cemeteries other than national cemeteries</header> 
<subsection id="H519EBC2B92414C5699CEDD47B185D6BE"><enum>(a)</enum><header>Repeal of Time Limitation for State Filing for Reimbursement for Interment Costs</header> 
<paragraph id="H81CC4752C09648C0B23BE00A31311B4"><enum>(1)</enum><header>In general</header><text>The second sentence of <external-xref legal-doc="regulation" parsable-cite="cfr/38/3.1604">section 3.1604(d)(2)</external-xref> of title 38, Code of Federal Regulations, shall have no further force or effect as it pertains to unclaimed remains of a deceased veteran.</text></paragraph> 
<paragraph id="H02C2BE6FB2B247E8B80064025B1524D3"><enum>(2)</enum><header>Retroactive application</header><text display-inline="yes-display-inline">Paragraph (1) shall take effect as of October 1, 2006 and apply with respect to interments and inurnments occurring on or after that date.</text></paragraph></subsection> 
<subsection id="H028D29F12B474DADBB96F8D6DDB07B8D"><enum>(b)</enum><header>Grants for Operation and Maintenance of State Veterans’ Cemeteries</header> 
<paragraph id="H40A823C071434FB3ADBA7FA9BDE9EF69"><enum>(1)</enum><header>In general</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/38/2408">section 2408</external-xref> of title 38, United States Code, is amended to read as follows:</text> 
<quoted-block style="USC" id="H250847359D7448018259F5E767B07F7" display-inline="no-display-inline"> 
<subsection id="HCEDEDFC9AF5243A18B4EC105DD675B8D"><enum>(a)</enum> 
<paragraph id="HA329191747D949F0B04FCE435936C866" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to subsection (b), the Secretary may make a grant to any State for the following purposes:</text> 
<subparagraph id="H24CCFE99921C4AB289729D636FC39114" indent="up1"><enum>(A)</enum><text>Establishing, expanding, or improving a veterans’ cemetery owned by the State.</text></subparagraph> 
<subparagraph id="H7DE787821D1B4DF38E7DD86695E46155" indent="up1"><enum>(B)</enum><text>Operating and maintaining such a cemetery.</text></subparagraph></paragraph> 
<paragraph id="HA54AD95005A24C58A6976815003800F8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A grant under paragraph (1) may be made only upon submission of an application to the Secretary in such form and manner, and containing such information, as the Secretary may require.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H8327D5EE0A634CB9B5FD4C5D55592320"><enum>(2)</enum><header>Limitation on amounts awarded</header><text>Subsection (e) of such section is amended—</text> 
<subparagraph id="HB7619CCF57CC402F9EF50900A501F1E7"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>Amounts</quote>; and</text></subparagraph> 
<subparagraph id="H0EE13E01F1EA4A9883EF6DAD1621324C"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HDC001A6824C24789A3D352756792B6C6" style="USC"> 
<paragraph id="HDA9080A04BFB4F56A1C1535EDEE0D93F" indent="up1"><enum>(2)</enum><text>In any fiscal year, the aggregate amount of grants awarded under this section for the purposes specified in subsection (a)(1)(B) may not exceed $5,000,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HA908C0D4239846D396C31BA1DDC92786"><enum>(3)</enum><header>Conforming amendments</header><text display-inline="yes-display-inline">Such section is further amended—</text> 
<subparagraph id="HF7510A47F1A64A37897DA1E060D41200" display-inline="no-display-inline"><enum>(A)</enum><text>in subsection (b)—</text> 
<clause id="H61A934D4175E412FAFE090C451FE6E5B"><enum>(i)</enum><text>by striking <quote>Grants under this section</quote> and inserting <quote>A grant under this section for a purpose described in subsection (a)(1)(A)</quote>; and</text></clause> 
<clause id="H5FCA7D891B244304B6A800A3009C904E"><enum>(ii)</enum><text>by striking <quote>a grant under this section</quote> each place it appears and inserting <quote>such a grant</quote>;</text></clause></subparagraph> 
<subparagraph id="HF2F72219C8E04590B3C018D85702DE83"><enum>(B)</enum><text>in subsection (d), by striking <quote>to assist such State in establishing, expanding, or improving a veterans’ cemetery</quote>; and </text></subparagraph> 
<subparagraph id="H95360EFB2087472DB46FCD7FC19E9BB8"><enum>(C)</enum><text>in subsection (f)(1), by inserting <quote>, or in operating and maintaining such cemeteries,</quote> after <quote>veterans’ cemeteries</quote>.</text></subparagraph></paragraph> 
<paragraph id="HB456D37D96CC44459F68198CFE57F7BA"><enum>(4)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall prescribe regulations to carry out the amendments made by this subsection.</text></paragraph></subsection></section> 
<section id="H415D6C8972BD4AC000CD1E691954098F"><enum>203.</enum><header>Modification of authorities on provision of Government headstones and markers for burials of veterans at private cemeteries</header> 
<subsection id="H2784A646E1954DAE874C861259B765E9"><enum>(a)</enum><header>Repeal of Expiration of Authority</header><text>Subsection (d) of <external-xref legal-doc="usc" parsable-cite="usc/38/2306">section 2306</external-xref> of title 38, United States Code, as amended by section 201, is further amended—</text> 
<paragraph id="H51B64276ECDA42A4AD87F49FB6AB64AA"><enum>(1)</enum><text>by striking paragraph (3); and</text></paragraph> 
<paragraph id="H3A1AA9B2EA394663B8254E99FD60F68E"><enum>(2)</enum><text>by redesignating paragraphs (4) and (5), as added by that section, as paragraphs (3) and (4), respectively.</text></paragraph></subsection> 
<subsection id="H5AF2DDBE35784D5F8DA72717D7EE8767"><enum>(b)</enum><header>Retroactive Effective Date</header><text display-inline="yes-display-inline">Notwithstanding subsection (d) of section 502 of the Veterans Education and Benefits Expansion Act of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/103">Public Law 107–103</external-xref>; 115 Stat. 995; <external-xref legal-doc="usc" parsable-cite="usc/38/2306">38 U.S.C. 2306</external-xref> note) or any other provision of law, the amendments made by that section and by subsections (a), (b), (c), (d), and (f) of section 402 of the Veterans Benefits, Health Care, and Information Technology Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/461">Public Law 109–461</external-xref>; 120 Stat. 3429) shall take effect as of November 1, 1990, and shall apply with respect to headstones and markers for the graves of individuals dying on or after that date.</text></subsection></section></title> 
<title id="H034931014ADB43B593936B5BDDD5008F"><enum>III</enum><header>Other Matters</header> 
<section id="HF7276AE5A54045ACA41578B900C146A9"><enum>301.</enum><header>Use of national directory of new hires for income verification purposes for certain veterans benefits</header> 
<subsection id="H912336A422E4463F9F569465F67B00C3"><enum>(a)</enum><header>Authority for information comparisons and disclosures of information to assist in administration of certain veterans benefits</header><text>Section 453(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653(j)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block id="HD55B513B25CB4D40A1A2251210237D3C" style="OLC"> 
<paragraph id="H9966C8D8A4CC4DA181B44F89DE11D48C"><enum>(11)</enum><header>Information comparisons and disclosures to assist in administration of certain veterans benefits</header> 
<subparagraph id="HAABFBDB699904305AF98CBBE3D39559"><enum>(A)</enum><header>Furnishing of information by Secretary of Veterans Affairs</header><text>Subject to the provisions of this paragraph, the Secretary of Veterans Affairs shall furnish to the Secretary, on such periodic basis as determined by the Secretary of Veterans Affairs in consultation with the Secretary, information in the custody of the Secretary of Veterans Affairs for comparison with information in the National Directory of New Hires, in order to obtain information in such Directory with respect to individuals who are applying for or receiving—</text> 
<clause id="H51B28A1A11CE487B9C58FF9247CC686F"><enum>(i)</enum><text>needs-based pension benefits provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/15">chapter 15</external-xref> of title 38, United States Code, or under any other law administered by the Secretary of Veterans Affairs;</text></clause> 
<clause id="H3C3E6D7CC02D4E2BA44C339174FFD6AE"><enum>(ii)</enum><text>parents’ dependency and indemnity compensation provided under <external-xref legal-doc="usc" parsable-cite="usc/38/1315">section 1315</external-xref> of title 38, United States Code;</text></clause> 
<clause id="H565204C24BC54C9B84F0E9A087EC2EA7"><enum>(iii)</enum><text>health care services furnished under subsections (a)(2)(G), (a)(3), or (b) of <external-xref legal-doc="usc" parsable-cite="usc/38/1710">section 1710</external-xref> of title 38, United States Code; or</text></clause> 
<clause id="H7FBDA42EFA9A48EFA370AE61715DE669"><enum>(iv)</enum><text display-inline="yes-display-inline">compensation paid under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/11">chapter 11</external-xref> of title 38, United States Code, at the 100 percent rate based solely on unemployability and without regard to the fact that the disability or disabilities are not rated as 100 percent disabling under the rating schedule.</text></clause></subparagraph> 
<subparagraph id="HDA4F4B80F3C2490A892821CC360840B5"><enum>(B)</enum><header>Requirement to seek minimum information</header><text>The Secretary of Veterans Affairs shall seek information pursuant to this paragraph only to the extent necessary to verify the employment and income of individuals described in subparagraph (A).</text></subparagraph> 
<subparagraph id="H16C436F5CB89473BA90017F900EC40F7"><enum>(C)</enum><header>Duties of the Secretary</header> 
<clause id="HDED053AD33214A3F961BF8DCBE108297"><enum>(i)</enum><header>Information disclosure</header><text>The Secretary, in cooperation with the Secretary of Veterans Affairs, shall compare information in the National Directory of New Hires with information provided by the Secretary of Veterans Affairs with respect to individuals described in subparagraph (A), and shall disclose information in such Directory regarding such individuals to the Secretary of Veterans Affairs, in accordance with this paragraph, for the purposes specified in this paragraph.</text></clause> 
<clause id="H684DCDC5FD144AFC8CF148D746B6F97C"><enum>(ii)</enum><header>Condition on disclosure</header><text>The Secretary shall make disclosures in accordance with clause (i) only to the extent that the Secretary determines that such disclosures do not interfere with the effective operation of the program under this part.</text></clause></subparagraph> 
<subparagraph id="H417AAEE109894FA9B2B1E0E0018E4892"><enum>(D)</enum><header>Use of information by secretary of veterans affairs</header><text>The Secretary of Veterans Affairs may use information resulting from a data match pursuant to this paragraph only—</text> 
<clause id="HE7356BF359564EA5B88E5B3C97123467"><enum>(i)</enum><text>for the purposes specified in subparagraph (B); and</text></clause> 
<clause id="HA2328B14D31842EEA170A5377521007C"><enum>(ii)</enum><text>after removal of personal identifiers, to conduct analyses of the employment and income reporting of individuals described in subparagraph (A).</text></clause></subparagraph> 
<subparagraph id="H6017ED319B114CA2A087833C1D2DF27B"><enum>(E)</enum><header>Reimbursement of HHS costs</header><text>The Secretary of Veterans Affairs shall reimburse the Secretary, in accordance with subsection (k)(3), for the costs incurred by the Secretary in furnishing the information requested under this paragraph.</text></subparagraph> 
<subparagraph id="HF5E5C24DE74B43158300B51B001F8F67"><enum>(F)</enum><header>Consent</header><text>The Secretary of Veterans Affairs shall not seek, use, or disclose information under this paragraph relating to an individual without the prior written consent of such individual (or of a person legally authorized to consent on behalf of such individual).</text></subparagraph> 
<subparagraph id="HBE57F245E5FD4724BA12B51FC2620179"><enum>(G)</enum><header>Expiration of authority</header><text>The authority under this paragraph shall expire on September 30, 2011.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H96DD1D71F9704CB29735B40516EC61D3"><enum>(b)</enum><header>Amendments to veterans affairs authority</header> 
<paragraph id="H195853D805A948D781AAD754BB6F9ECD"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/53">Chapter 53</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/5317">section 5317</external-xref> the following new section:</text> 
<quoted-block style="USC" id="HB1D7EBF64A884D8AA080F8212BEB9211" display-inline="no-display-inline"> 
<section id="H76789FD5CF9846E6839FD6CFF3D112A8"><enum>5317A.</enum><header>Use of income information from other agencies: independent verification required before termination or reduction of certain benefits and services</header> 
<subsection id="H671861914510404FA953FE21D97FA7AB"><enum>(a)</enum><header>Independent verification required</header><text display-inline="yes-display-inline">The Secretary may terminate, deny, suspend, or reduce any benefit or service specified in section 5317(c), with respect to an individual under age 65 who is an applicant for or recipient of such a benefit or service, by reason of information obtained from the Secretary of Health and Human Services under section 453(j)(11) of the Social Security Act, only if the Secretary takes appropriate steps to verify independently information relating to the individual’s employment and income from employment.</text></subsection> 
<subsection id="HF2E163FEE38849B1A6696059A57DA203"><enum>(b)</enum><header>Opportunity to contest findings</header><text>The Secretary shall inform each individual for whom the Secretary terminates, denies, suspends, or reduces any benefit or service under subsection (a) of the findings made by the Secretary under such subsection on the basis of verified information and shall provide to the individual an opportunity to contest such findings in the same manner as applies to other information and findings relating to eligibility for the benefit or service involved.</text></subsection> 
<subsection id="H45E39A846BCF4915B843F009000444C7"><enum>(c)</enum><header>Source of funds for reimbursement to Secretary of Health and Human Services</header><text>The Secretary shall pay the expense of reimbursing the Secretary of Health and Human Services in accordance with section 453(j)(11)(E) of the Social Security Act, for the cost incurred by the Secretary of Health and Human Services in furnishing information requested by the Secretary under section 453(j)(11) of such Act, from amounts available to the Department for the payment of compensation and pensions.</text></subsection> 
<subsection id="H9BFED4F0DA01455595BAAC0DBAB54F5"><enum>(d)</enum><header>Expiration of authority</header><text>The authority under this section shall expire on September 30, 2011.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H7A1523DCADB04C40809628DC356BA7DF"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 5317 the following new item:</text>
