		<section display-inline="no-display-inline" id="H9B9701A7F29242898400EADF1D409635" section-type="section-one"><enum>1.</enum><header>Adjustment of status for
			 certain aliens who were aboard the Golden Venture</header>
			<subsection id="HA019075B53AD43E19457CB7C00D5F015"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding subsections (a) and (b) of section 201 of
			 the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1151), the Secretary of Homeland Security shall adjust the status of
			 each alien referred to in subsection (b) to that of an alien lawfully admitted
			 for permanent residence, if the alien—</text>
				<paragraph id="HD9BB5DD7BF40454A89065EDF74EC9359"><enum>(1)</enum><text>applies for such
			 adjustment;</text>
				</paragraph><paragraph id="HA1D3CC66DB3D43BF00FCF5000192F24D"><enum>(2)</enum><text>has been
			 physically present in the United States for at least 1 year and is physically
			 present in the United States on the date the application for such adjustment is
			 filed;</text>
				</paragraph><paragraph id="HBA4C27223FB44DD2AFEE7248CE0292D5"><enum>(3)</enum><text>is admissible to
			 the United States as an immigrant under the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8 U.S.C. 1101
			 et seq.), except that, for the purposes of determining admissibility under this
			 paragraph, the grounds for inadmissibility specified in paragraphs (4), (5),
			 and (7)(A) and subparagraphs (A), (D), and (E) of paragraph (6) of section
			 212(a) of the <act-name parsable-cite="INA">Immigration and Nationality
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)</external-xref>) shall not apply; and</text>
				</paragraph><paragraph id="HD5065118019A4F4E8C24997F2E122895"><enum>(4)</enum><text>pays a fee
			 (determined by the Secretary of Homeland Security) for the processing of such
			 application.</text>
				</paragraph></subsection><subsection id="H66FA9B22D31D4EBEB5DD36B5B5BAB00"><enum>(b)</enum><header>Aliens eligible
			 for adjustment of status</header><text>The adjustment of status provided for
			 under subsection (a) shall apply to the following aliens:</text>

				</paragraph></subsection><subsection id="H7C580F450E9E48F4B299A11DC5D400BA"><enum>(c)</enum><header>Offset in number
			 of visas available</header><text>Upon each granting to an alien of the status
			 of having been lawfully admitted for permanent residence under this section,
			 the Secretary of State shall instruct the proper officer to reduce by 1, during
			 the current or next following fiscal year, the total number of immigrant visas
			 that are made available to natives of the country of the alien’s birth under
			 section 203(a) of the <act-name parsable-cite="INA">Immigration and Nationality
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>) or, if applicable, the total number of
			 immigrant visas that are made available to natives of the country of the
			 alien’s birth under section 202(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1152">8 U.S.C. 1152(e)</external-xref>).</text>
			</subsection><subsection id="H7839D1DE003E48BBBB81BEB4F802800"><enum>(d)</enum><header>Application of
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name>
			 provisions</header><text>The definitions contained in the
			 <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (8
			 U.S.C. 1101 et seq.) shall apply in the administration of this section. The
			 fact that an alien may be eligible to be granted the status of having been
			 lawfully admitted for permanent residence under this section shall not preclude
			 the alien from seeking such status under any other provision of law for which
			 the alien may be eligible.</text>
