		<legis-type>A BILL</legis-type>
		<official-title>To provide compensation to individuals who, during the
		  Vietnam conflict, were employees of the Federal Government or contractor
		  employees of the Department of Defense and suffered disability or death from
		  exposure to Agent Orange.</official-title>

	<legis-body id="HBC646A6B1A5F458F9513EE007450A7E2" style="OLC">
		<section display-inline="no-display-inline" id="H42D5E8ED1F8D402496C36F5951176F72" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Civilian Agent Orange Act of
			 2007</short-title></quote>.</text>
		</section><section id="H5ACDE1C53F7F4E118E75006C129BF9DE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H1114EF6A358047DAA34137006865B14F"><enum>(1)</enum><header>Exposed
			 employee</header><text>The term <term>exposed employee</term> means an
			 individual who—</text>
				<subparagraph id="H96A44F0B38D54A57002F3F2E231BEE00"><enum>(A)</enum><text>during the Vietnam
			 conflict—</text>
					<clause id="H44D82BA4E90D4114A8BDFF2835D6C65F"><enum>(i)</enum><text>was
			 a civilian employee of the Federal Government, or an employee of a contractor
			 (or subcontractor at any tier) of the Department of Defense; and</text>
					</clause><clause id="H3A92F648EB60476098D74024288D60E"><enum>(ii)</enum><text>while so employed,
			 was—</text>
						<subclause id="H559AD0F554BE4039A64C6C368F8F54D"><enum>(I)</enum><text>physically present
			 in the Republic of Vietnam during the period beginning January 9, 1962, and
			 ending on May 7, 1975; or</text>
						</subclause><subclause id="H8FE881CC924940D99D176EFDAFA15863"><enum>(II)</enum><text>in or near the
			 Korean demilitarized zone during the period beginning September 1, 1967, and
			 ending on August 31, 1971;</text>
						</subclause></clause></subparagraph><subparagraph id="HD3E70CA3DC4C47DE9838A574490937AF"><enum>(B)</enum><text>contracted an
			 Agent Orange illness; and</text>
				</subparagraph><subparagraph id="H7FF0681425D84328950957D68F9EB719"><enum>(C)</enum><text>suffered injury or
			 death by reason of that illness.</text>
				</subparagraph></paragraph><paragraph id="HCAC9B22E33F347D08F9D897EBE69D553"><enum>(2)</enum><header>Agent Orange
			 illness</header><text display-inline="yes-display-inline">The term <term>Agent
			 Orange illness</term> means an illness listed by the National Institute of
			 Medicine as having at least a limited or suggestive association with
			 2,4-dichlorophenoxyacetic acid (2,4-D), 1,4,5-trichlorophenoxyacetic acid
			 (2,4,5-T), 4-amino-3,5,6-trichloropicolinic acid (picloram), and cacodylic acid
			 (dimenthylarsenic acid, DMA), and
			 2,3,7,8-tetrachlorodibenzo-<italic>p</italic>-dioxin (TCDD, or dioxin).</text>
			</paragraph></section><section id="HF303BFA2AA2A40FA931887EAAEE120A"><enum>3.</enum><header>Compensation
			 Program</header>
			<subsection id="H56AFC79073134105BB004557A627136F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is hereby
			 established a program to be known as the <quote>Agent Orange Illness
			 Compensation Program</quote> (in this Act referred to as the
			 <quote>compensation program</quote>), to be carried out by the Attorney
			 General.</text>
			</subsection><subsection id="H2212F8D37F484759874F146689B096A5"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of the compensation program is to provide for timely, uniform, and
			 adequate compensation of exposed employees and, where applicable, survivors of
			 such employees, suffering from Agent Orange illnesses incurred by such
			 employees.</text>
			</subsection></section><section id="HFC7513474EC547AFAE2C102D4657A966"><enum>4.</enum><header>Compensation
			 Fund</header>
			<subsection id="HE4F7699579194A9AA944514089009204"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is hereby established on the books of
			 the Treasury a fund to be known as the <quote>Agent Orange Illness Compensation
			 Fund</quote> (in this Act referred to as the <quote>compensation
			 fund</quote>).</text>
			</subsection><subsection id="HEC7F2904446A42B18C13E638F6159C07"><enum>(b)</enum><header>Amounts</header><text>The
			 compensation fund shall consist of the following amounts:</text>
				<paragraph id="H2C435E4F2AE54EF8825FA936836BF8A3"><enum>(1)</enum><text>Amounts
			 appropriated to the compensation fund pursuant to an authorization of
			 appropriations.</text>
				</paragraph><paragraph id="HE8CC479D0AFD455D99DE6FF051D2EFC1"><enum>(2)</enum><text>Amounts
			 transferred to the compensation fund.</text>
				</paragraph></subsection><subsection id="H5D6856DF4EBC455EA1705835341D15D1"><enum>(c)</enum><header>Financing</header><text>Upon
			 the exhaustion of amounts in the compensation fund, the Secretary of the
			 Treasury shall transfer directly to the compensation fund from the General Fund
			 of the Treasury, without further appropriation, such amounts as are further
			 necessary to carry out the compensation program.</text>
			</subsection><subsection id="HAA08CC66E2424951908EFB2FEE58A788"><enum>(d)</enum><header>Use</header><text>Subject
			 to subsection (e) of this section, amounts in the compensation fund shall be
			 used to carry out the compensation program.</text>
			</subsection><subsection id="H772FC5382CBF4909BE666EE92D4CB16F"><enum>(e)</enum><header>Administrative
			 costs not paid from fund</header><text>No cost incurred in carrying out the
			 compensation program, or in administering the compensation fund, shall be paid
			 from the compensation fund.</text>
			</subsection><subsection id="H1B0AE88DCE3546679C40ACA89F4BE12C"><enum>(f)</enum><header>Monetary
			 allowance not To be considered as income or resources for certain
			 purposes</header><text>Notwithstanding any other provision of law, a monetary
			 allowance paid an individual under this Act shall not be considered as income
			 or resources in determining eligibility for, or the amount of benefits under
			 any Federal or federally assisted program.</text>
			</subsection><subsection id="H477288F8AE4E4C6E9664A766863E5197"><enum>(g)</enum><header>Investment</header><text>Amounts
			 in the compensation fund shall be invested in accordance with section 9702 of
			 title 31, and any interest on, and proceeds from, any such investment shall be
			 credited to and become a part of the compensation fund.</text>
			</subsection><subsection id="H1907EEDD6AE04E438F00B8FB3969FAB2"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There is hereby authorized to be appropriated
			 $100,000,000 to the compensation fund.</text>
			</subsection></section><section id="HC10A130511D7451EB58530C2CDFAF0F4"><enum>5.</enum><header>Compensation to
			 be provided</header>
			<subsection id="HCB6E5C029B73477092779F734BA82441"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">An exposed employee,
			 or the eligible survivor of that employee if the employee is deceased, shall
			 receive compensation for the injury, illness, or death of that employee from
			 that employee’s Agent Orange illness in an amount determined under subsection
			 (b).</text>
			</subsection><subsection id="H8190FB62780E433CB243F836A14ED9CF"><enum>(b)</enum><header>Amount</header><text>For
			 each exposed employee, the Attorney General shall provide compensation in the
			 amount of $100,000.</text>
			</subsection><subsection id="HD8F73942F6B54FE298BDE2C53EB5D7AA"><enum>(c)</enum><header>Payments in the
			 case of deceased persons</header>
				<paragraph id="H059AA5CB991F49C7B5636997A47CFE0"><enum>(1)</enum><header>Survivors
			 eligible</header><text>In the case of an exposed employee who is deceased at
			 the time of payment of compensation under this section, whether or not the
			 death is the result of the employee's Agent Orange illness, such payment may be
			 made only as follows:</text>
					<subparagraph id="H0DCA5949ADDC4F6AAF6000D1ADE32977"><enum>(A)</enum><text>If the employee is
			 survived by a spouse who is living at the time of payment, such payment shall
			 be made to such surviving spouse.</text>
					</subparagraph><subparagraph id="H8DBF957497074F8E8E868BCDD5B22EF"><enum>(B)</enum><text>If there is no
			 surviving spouse described in subparagraph (A), such payment shall be made in
			 equal shares to all children of the employee who—</text>
						<clause id="HB4AA5CE1B84648F3A6E0DF001FF7DC00"><enum>(i)</enum><text>had
			 not yet attained the age of 18 when the employee died or was permanently or
			 totally disabled before the age of 18; and</text>
						</clause><clause id="H5009CB17640A4FD1BCA998ECD426BE0"><enum>(ii)</enum><text>are
			 living at the time of payment.</text>
						</clause></subparagraph></paragraph><paragraph id="H95F42AE381B349889C7D0010845D96FF"><enum>(2)</enum><header>Claims</header><text>If
			 an employee eligible for payment dies before filing a claim under this Act, a
			 survivor of that employee who may receive payment under paragraph (1) may file
			 a claim for such payment.</text>
				</paragraph><paragraph id="HEB5E8C908320462F009F95AF5D7CEFE"><enum>(3)</enum><header>Definitions</header><text>For
			 purposes of this subsection—</text>
					<subparagraph id="HEB7D088D28FE4C54B9312769DE7F7490"><enum>(A)</enum><text>the
			 <quote>spouse</quote> of an individual is a wife or husband of that individual
			 who was married to that individual for at least one year immediately before the
			 death of that individual; and</text>
					</subparagraph><subparagraph id="H05031BEA34CC49899EAE05EB00C0B56"><enum>(B)</enum><text>a
			 <quote>child</quote> includes a recognized natural child, a stepchild who lived
			 with an individual in a regular parent-child relationship, and an adopted
			 child.</text>
					</subparagraph></paragraph></subsection><subsection id="H3BF100393D7D4F499C8CC24301EBB689"><enum>(d)</enum><header>Children with
			 spina bifida</header><text>In any case in which a child of an exposed employee
			 is born with spina bifida by reason of that employee’s exposure to Agent
			 Orange, that child shall directly receive compensation in an amount determined
			 under subsection (b).</text>
			</subsection></section><section id="H7829EB5AE5554317B300A398917E0060"><enum>6.</enum><header>Claims
			 processing</header>
			<subsection id="H05FDD03A230C448489CBCC7F93094C6D"><enum>(a)</enum><header>In
			 general</header><text>Subject to subsections (b), (c), and (d), the Attorney
			 General shall specify standards and criteria for filing applications and for
			 processing, determining, and paying claims.</text>
			</subsection><subsection id="HA0932AFA4B234F34A8FC105065DA2891"><enum>(b)</enum><header>Deadline</header><text>A
			 claim not filed within 20 years after the date of the enactment of this Act is
			 void.</text>
			</subsection><subsection id="HDAB7FD71D3794733B900303C351969CA"><enum>(c)</enum><header>Written medical
			 documentation</header><text>Payment may not be made on a claim except on
			 written medical evidence that the Attorney General, in consultation with the
			 Surgeon General, determines to be adequate.</text>
			</subsection><subsection id="H21303B22DC1E4C70A4C245C48FEE8563"><enum>(d)</enum><header>Review</header><text>Unless
			 otherwise specified by the Attorney General, any determination on a claim under
			 this Act is not subject to administrative or judicial review.</text>
			</subsection></section><section id="H48DFD72CA025480D9835B6F8E519FD67"><enum>7.</enum><header>Implementation</header><text display-inline="no-display-inline">The Attorney General shall prescribe
			 regulations to implement this Act.</text>
		</section><section id="HCB083206F24D41D39B374EE2B4CCD6F6"><enum>8.</enum><header>Offset for
			 certain other payments</header><text display-inline="no-display-inline">A
			 payment of compensation to an individual, or to a survivor of that individual,
			 under this Act shall be offset by the amount of any payment made pursuant to a
			 final award or settlement on a claim, against any person, that is based on the
			 same illness, injury, or death of that individual on account of exposure to
			 Agent Orange herbicides.</text>
