		<section display-inline="no-display-inline" id="HAA3E022D514649B19FAF599337403433" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Fund for Excellence in
			 American Indian Education Amendments Act of 2007</short-title></quote>.</text>
		</section><section id="H0556EB3E0879448CAE034D2BC1B27295"><enum>2.</enum><header>National Fund for
			 Excellence in American Indian Education</header><text display-inline="no-display-inline">Section 501 of the
			 <act-name parsable-cite="ISDA">Indian Self-Determination and Education
			 Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/458bbb">25 U.S.C. 458bbb</external-xref>) is amended—</text>
			<paragraph id="H448AB5FF2FC742C4AD6DC76C88AFCC00"><enum>(1)</enum><text>in subsection (g),
			 by striking paragraphs (1) and (2) and inserting the following:</text>
				<quoted-block id="H08728BF15446450CB99E5E7618F87F03">
					<paragraph id="HEE09B080689F41C090F97777E515056"><enum>(1)</enum><header>In
				general</header><text>The officers of the Foundation shall be—</text>
						<subparagraph id="H872054BF66D24735BD24EC6DCC35AE7D"><enum>(A)</enum><text>a chief operating
				officer, to be appointed in accordance with paragraph (2); and</text>
						</subparagraph><subparagraph id="H1673CE676E8347C682FDB27837FB6E18"><enum>(B)</enum><text>any other
				officers, to be appointed or elected in accordance with the constitution and
				bylaws of the Foundation.</text>
						</subparagraph></paragraph><paragraph id="HEF631190CACF468689CC0415A4E04060"><enum>(2)</enum><header>Chief operating
				officer</header>
						<subparagraph id="HEF90153C8DD24B6B917E4BA6633026E9"><enum>(A)</enum><header>Appointment</header><text>The
				Board shall appoint a chief operating officer to the Foundation.</text>
						</subparagraph><subparagraph id="H18173ED4142B4BB0A5D2007C3D1EEF5D"><enum>(B)</enum><header>Requirements</header><text>The
				chief operating officer of the Foundation shall—</text>
							<clause id="H7CC8A6F1A3A54F6E88D609F21F58C47C"><enum>(i)</enum><text>demonstrate
				experience and knowledge in matters relating to—</text>
								<subclause id="H7A38C94D3CA040E8814DA4A04C317BBC"><enum>(I)</enum><text>education, in
				general; and</text>
								</subclause><subclause id="H794427180D2E4D05B982445FA25545EA"><enum>(II)</enum><text>education of
				Indians, in particular; and</text>
								</subclause></clause><clause id="H37BAEEBB4C2246F393D5D38546E83F59"><enum>(ii)</enum><text>serve at the
				direction of the
				Board.</text>
							</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HCA9A37705D644E949FAAFAA7DB375700"><enum>(2)</enum><text>in subsection
			 (l)(1), by striking “Beginning with” and all that follows through subparagraph
			 (B) and inserting the following: “For each fiscal year following the first
			 fiscal year during which the Foundation is in operation, the administrative
			 costs of the Foundation shall not exceed—</text>
				<quoted-block id="H1F967340EECF4849A945F225A96BE24">
					<subparagraph id="H0EA803C66280467781D958A16E8828D2"><enum>(A)</enum><text>for the first
				fiscal year, an amount equal to 20 percent of the sum of—</text>
						<clause id="H2E240AD20159413BBB74E97D315BF58F"><enum>(i)</enum><text>the amounts
				transferred to the Foundation under subsection (m) during the preceding fiscal
				year; and</text>
						</clause><clause id="H0B75CD07E6074481B1A1E4012F120739"><enum>(ii)</enum><text>donations
				received from private sources during the preceding fiscal year;</text>
						</clause></subparagraph><subparagraph id="HA8D444CC1916437EB56205BB5EA35C44"><enum>(B)</enum><text>for the second
				fiscal year, an amount equal to 15 percent of the sum of—</text>
						<clause id="H9807FAC7422B42B8ACF967E8AB67BE9B"><enum>(i)</enum><text>the amounts
				transferred to the Foundation under subsection (m) during the preceding fiscal
				year; and</text>
						</clause><clause id="H61F25FE896BD4961A48372B052FD115C"><enum>(ii)</enum><text>donations
				received from private sources during the preceding fiscal year; and</text>
						</clause></subparagraph><subparagraph id="HD4DE944067A94537B1C972C43C2C6E5"><enum>(C)</enum><text>for the third
				fiscal year, and each fiscal year thereafter, an amount equal to 10 percent of
				the sum of—</text>
						<clause id="HB74AEE4F4FE74A14B953AC9D543DF4B1"><enum>(i)</enum><text>the amounts
				transferred to the Foundation under subsection (m) during the preceding fiscal
				year; and</text>
						</clause><clause id="HED7F4A144F9D4CF3BA661D07466B02E2"><enum>(ii)</enum><text>donations
				received from private sources during the preceding fiscal
				year.</text>
						</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HD50663E6505940B1AA33066C76480027"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

					<subsection id="HC22095B5249F42C7B6E196F02F665C17"><enum>(o)</enum><header>Authorization of
				appropriations</header>
						<paragraph id="HC6FEE773235C494BAD1D747E048F4C41"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated to carry out this
				section $5,000,000 for each of fiscal years 2008 through 2010.</text>
						</paragraph><paragraph id="H0AADD1EC2A674872A27CEA3D009234AF"><enum>(2)</enum><header>Effect on other
				funds</header><text>Funds appropriated under paragraph (1) shall not reduce the
				amount of funds available for any other program relating to Indian
				education.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="H23E2F6A4306444CC846B8FB6E78BC8DD"><enum>3.</enum><header>Administrative
			 services and support</header><text display-inline="no-display-inline">Section
			 502 of the <act-name parsable-cite="ISDA">Indian Self-Determination and
			 Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/458bbb-1">25 U.S.C. 458bbb–1</external-xref>) is amended—</text>
			<paragraph id="H91ADBDB73E1F498100C2F06E6953DBF3"><enum>(1)</enum><text>in subsection (a),
			 by striking paragraph (2) and inserting the following:</text>
				<quoted-block id="H1A0029D674244FD9BD37A45E56DC8E6">
					<paragraph id="H79CF9DA4F71847F18C199B79A884B5BD"><enum>(2)</enum><text>may provide
				funds—</text>
						<subparagraph id="HBB367948A89F4994A6E0DDB8C6D768D3"><enum>(A)</enum><text>to pay the
				operating costs of the Foundation; and</text>
						</subparagraph><subparagraph id="HAFC31A33B5BC46FEBA4D0979BF17E6C2"><enum>(B)</enum><text>to reimburse
				travel expenses of a member of the Board under section 501;
				and</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HAF60B0BEC071451E9CE8F06F3975C7BB"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H9B7884815BA045ADA9602CFFE243A37B"><enum>(A)</enum><text>in the subsection
			 heading, by striking <quote>Reimbursementt</quote> and inserting
			 <quote>Reimbursement</quote>; and</text>
				</subparagraph><subparagraph id="H9C12AFEE33084D0C85A64845A6E8F84"><enum>(B)</enum><text>by inserting
			 <quote>operating and</quote> before <quote>travel expenses</quote>.</text>
