		<official-title>To expand a Department of Defense survivor annuity
		  program that covers unremarried surviving spouses of certain members of the
		  uniformed services who died before October 1, 1978, to include any otherwise
		  eligible surviving spouse who remarries after age 55 or whose remarriage before
		  age 55 is terminated.</official-title>

		<section id="H334C9EB1BA7943DD986637A9B7F35BC8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Forgotten Military Widows Annuity Act
			 of 2007</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HCE30E4E1338D449BB97E7256262187BE" section-type="subsequent-section"><enum>1.</enum><header>Annuity eligibility
			 for certain surviving spouses who remarry</header>
			<subsection id="H98A66EC577594582AEA9AE618603169F"><enum>(a)</enum><header>Eligibility</header><text>Paragraph
			 (2) of section 644(a) of the National Defense Authorization Act for Fiscal Year
			 1998 (<external-xref legal-doc="public-law" parsable-cite="pl/105/85">Public Law 105–85</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/1448">10 U.S.C. 1448</external-xref> note) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HE7424C17F4D842D2B32C988B767982E7" style="OLC">
					<paragraph id="HFF3DAA9046804779811EA45233DD07B0" indent="up1"><enum>(2)</enum><text>A qualified surviving spouse for
				purposes of this section is a surviving spouse of a member of the uniformed
				services described in subparagraph (A) or (B) of paragraph (1) who—</text>
						<subparagraph id="H679B7AEA0DC641F0003D9037B734F98B"><enum>(A)</enum><text>has not remarried;</text>
						</subparagraph><subparagraph id="H479AB94B5FD446698465C1296739153F"><enum>(B)</enum><text>remarried after age 55; or</text>
						</subparagraph><subparagraph id="H0F310CDE509B42348F49D760F55028E0"><enum>(C)</enum><text>remarried, whether before or after age
				55, but is no longer married as a result of the termination of the subsequent
				marriage due to death, annulment, or
				divorce.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H99CE840C770A4002AB78E31987F8804"><enum>(b)</enum><header>Effective date of
			 restored annuity; prospective applicability</header><text>Such section is
			 further amended by adding at the end the following new paragraphs:</text>
				<quoted-block display-inline="no-display-inline" id="H9DCA0FE7B78249ABAEA441CC00DC1D40" style="OLC">
					<paragraph id="H55479D10210E4F58A126B696002C2F75" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If eligibility for an annuity under this
				section is established or restored by reason of subparagraph (B) or (C) of
				paragraph (2), payment of the annuity shall be commenced or resumed effective,
				subject to paragraph (4), as of the first day of the month in which—</text>
						<subparagraph id="H74F826226EE54725B93286D6F14E338F"><enum>(A)</enum><text display-inline="yes-display-inline">the subsequent marriage occurs, in the case
				of eligibility under subsection (B); or</text>
						</subparagraph><subparagraph id="H63C10F3DA3624D30913D3F0601F75BED"><enum>(B)</enum><text display-inline="yes-display-inline">the subsequent marriage is terminated, in
				the case of eligibility under subsection (C).</text>
						</subparagraph></paragraph><paragraph id="HF6C7553F54CE47118FAF1DDEFECF4410" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">No annuity or other benefit shall accrue to
				any person by reason of subparagraph (B) or (C) of paragraph (2) for any period
				before the first day of the first month beginning on or after the date of the
				enactment of the <short-title>Forgotten Military Widows
				Annuity Act of
				2007</short-title>.</text>
