		<official-title>To amend section 218 of the Immigration and Nationality
		  Act to modify the method of calculating the wages to be paid to H–2A
		  workers.</official-title>

		<section display-inline="no-display-inline" id="H5B245E41C3A542E4AFE5484B1143009B" section-type="section-one"><enum>1.</enum><header>Calculation of wages for H–2A
			 workers</header><text display-inline="no-display-inline">Section 218(a) of the
			 Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1188">8 U.S.C. 1188(a)</external-xref>) is amended—</text>
			<paragraph id="H598931C952CF4DB9A596C14D4EA0022"><enum>(1)</enum><text>by
			 redesignating paragraph (2) as paragraph (3); and</text>
			</paragraph><paragraph id="H5C371A5B3BFC42C6A4FFD9876D3C5C"><enum>(2)</enum><text>by
			 inserting after paragraph (1) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HA952221A409D4D60AF7F23E8B23EBE9" style="OLC">
					<paragraph id="H46689730D6154F209DFC576720221760" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB7BBE497D85C48F39D484E0154EDA12E"><enum>(A)</enum><text display-inline="yes-display-inline">The requirement in paragraph (1)(B) with
				respect to wages shall be considered to be satisfied if the alien will be paid
				not less than the greater of—</text>
							<clause id="HCD4558FFB6BF4D2A892EE928A787AF4B"><enum>(i)</enum><text>the applicable State minimum wage;
				or</text>
							</clause><clause id="HB4B055F8C13341979484D23C004264F9"><enum>(ii)</enum><text display-inline="yes-display-inline">the prevailing wage level for the
				agricultural occupational classification in the county (or similar geographical
				area) of intended employment.</text>
							</clause></subparagraph><subparagraph id="H5EC5F31D3AE740A880E2F4CA659DAB9" indent="up1"><enum>(B)</enum><text>The wage levels under subparagraph
				(A) shall be calculated based on the best information available at the time of
				the filing of the application.</text>
						</subparagraph><subparagraph id="H3441A3C063AD4CE4B6A28F3B2E7CECDB" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">For purposes of subparagraph (A)(ii), the
				prevailing wage level shall be determined as follows:</text>
							<clause id="H374E3D75BE7E403D9B86819CE6AAE35B"><enum>(i)</enum><text>If the job opportunity is covered by a
				collective bargaining agreement between a union and the employer, the
				prevailing wage shall be the wage rate set forth in the collective bargaining
				agreement.</text>
							</clause><clause id="HEAFD9F5D0C6648D293BEC96224413E29"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF2872804F7534715A387A0182D4DB9E6"><enum>(I)</enum><text>If the job opportunity
				is not covered by such an agreement, the prevailing wage level shall be based
				on entry level, farm establishment data and methodology to be established by
				the Bureau of Labor Statistics.</text>
								</subclause><subclause id="H9B966557EF244F0CA0EFE8AC4D15A214" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">In lieu of subclause (I), an employer may
				rely on other wage information, including a level-one wage in an agricultural
				standard occupational classification in the county (or similar geographical
				area) of intended employment from an occupational employment or other survey
				provided by the Bureau of Labor
				Statistics.</text>
