				<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
		title</header><text display-inline="no-display-inline">This Act may be cited as
		the <quote><short-title>Inspector General Reform Act of
		2008</short-title><added-phrase reported-display-style="italic"></added-phrase></quote>.</text>
				</section><section id="idA27A3714C6464638A8FB817DEF37013E"><enum>2.</enum><header>Appointment and
		qualifications of Inspectors General</header><text display-inline="no-display-inline">Section 8G(c) of the Inspector General Act
		of 1978 (5 U.S.C. App.) is amended by adding at the end <quote>Each Inspector
		General shall be appointed without regard to political affiliation and solely
		on the basis of integrity and demonstrated ability in accounting, auditing,
		financial analysis, law, management analysis, public administration, or
		investigations.</quote>.</text>
				</section><section id="id36D7A8CBC56042E7A08569050CF9CA81"><enum>3.</enum><header>Removal of
		Inspectors General</header>
					<subsection id="id81B912B198CC44E4A7247796DC98B3C4"><enum>(a)</enum><header>Establishments</header><text>Section
		3(b) of the Inspector General Act of 1978 (5 U.S.C. App.) is amended by
		striking the second sentence and inserting <quote>If an Inspector General is
		removed from office or is transferred to another position or location within an
		establishment, the President shall communicate in writing the reasons for any
		such removal or transfer to both Houses of Congress, not later than 30 days
		before the removal or transfer. Nothing in this subsection shall prohibit a
		personnel action otherwise authorized by law, other than transfer or
		removal.</quote>.</text>
					</subsection><subsection id="idA2B3C61A88074CB4B4D1B61554B522AC"><enum>(b)</enum><header>Designated
		Federal Entities</header><text display-inline="yes-display-inline">Section
		8G(e) of the Inspector General Act of 1978 (5 U.S.C. App.) is amended by
		striking <quote>shall promptly communicate in writing the reasons for any such
		removal or transfer to both Houses of the Congress.</quote> and inserting
		<quote>shall communicate in writing the reasons for any such removal or
		transfer to both Houses of Congress, not later than 30 days before the removal
		or transfer. Nothing in this subsection shall prohibit a personnel action
		otherwise authorized by law, other than transfer or removal.</quote>.</text>
					</subsection></section><section id="id5056CB8DD73E437E95F018837F499506"><enum>4.</enum><header>Pay
		of Inspectors General</header>
					<subsection id="IDf33f44b228154f75a084c5684348e1cb"><enum>(a)</enum><header>Inspectors
		General at Level III of Executive Schedule</header>
						<paragraph id="ID00ffd27fd13e4461be372013350b5ace"><enum>(1)</enum><header>In
		general</header><text>Section 3 of the Inspector General Act of 1978 (5 U.S.C.
		App.), is amended by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idC1C63664196C4DB0A1400A67F142FA64" style="OLC">
								<subsection id="IDea7d4d5fec084aa3a8ecb7dc2fb2f93b"><enum>(e)</enum><text>The annual rate
		  of basic pay for an Inspector General (as defined under section 12(3)) shall be
		  the rate payable for level III of the Executive Schedule under section 5314 of
		  title 5, United States Code, plus 3
		  percent.</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph><paragraph id="IDe30385299fdf4d88836181acb028eb75"><enum>(2)</enum><header>Technical and
		conforming amendments</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/5315">Section 5315</external-xref> of title 5, United States
		Code, is amended by striking the item relating to each of the following

		to other Inspectors General</header>
							<subparagraph commented="no" id="id09952E888B7D44D391B3CEB470F85EB0"><enum>(A)</enum><header>In
		general</header><text>Notwithstanding any other provision of law, the annual
		rate of basic pay of the Inspector General of the Central Intelligence Agency,
		the Special Inspector General for Iraq Reconstruction, and the Special
		Inspector General for Afghanistan Reconstruction shall be that of an Inspector
		General as defined under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /12">section 12(3)</external-xref> of the Inspector General Act of 1978 (5
		U.S.C. App.) (as amended by section 7(a) of this Act).</text>
							</subparagraph><subparagraph commented="no" id="idB8E341667B734292A01402CF73AF5E92"><enum>(B)</enum><header>Prohibition of
		cash bonus or awards</header><text>Section 3(f) of the Inspector General Act of
		1978 (5 U.S.C. App.) (as amended by section 5 of this Act) shall apply to the
		Inspectors General described under subparagraph (A).</text>
							</subparagraph></paragraph><paragraph id="ID7329f731c47a4241a3ceff098fd40560"><enum>(4)</enum><header>Additional
		technical and conforming amendment</header><text>Section 194(b) of the National
		and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12651e">42 U.S.C. 12651e(b)</external-xref>) is amended by striking
		paragraph (3).</text>
						</paragraph></subsection><subsection id="idC3751DF53FF04BBEA8708E6080F7E069"><enum>(b)</enum><header>Inspectors
		General of designated Federal entities</header>
						<paragraph id="idD1D9DB7601AC4AE78A8267C1D9B4C79E"><enum>(1)</enum><header>In
		General</header><text>Notwithstanding any other provision of law, the Inspector
		General of each designated Federal entity (as those terms are defined under
		<external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /8G">section 8G</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.)) shall, for pay
		and all other purposes, be classified at a grade, level, or rank designation,
		as the case may be, at or above those of a majority of the senior level
		executives of that designated Federal entity (such as a General Counsel, Chief
		Information Officer, Chief Financial Officer, Chief Human Capital Officer, or
		Chief Acquisition Officer). The pay of an Inspector General of a designated
		Federal entity (as those terms are defined under section 8G of the Inspector
		General Act of 1978 (5 U.S.C. App.)) shall be not less than the average total
		compensation (including bonuses) of the senior level executives of that
		designated Federal entity calculated on an annual basis.</text>
						</paragraph><paragraph id="id3B00D89045D44641BDD6175EF5EC3936"><enum>(2)</enum><header>Limitation on
		adjustment</header>
							<subparagraph id="id7B6F5AFA1A0A488C8B865DC7D5753409"><enum>(A)</enum><header>In
		general</header><text>In the case of an Inspector General of a designated
		Federal entity whose pay is adjusted under paragraph (1), the total increase in
		pay in any fiscal year resulting from that adjustment may not exceed 25 percent
		of the average total compensation (including bonuses) of the Inspector General
		of that entity for the preceding 3 fiscal years.</text>
							</subparagraph><subparagraph id="id954F8EBD905D46F88A640D9ACF040BEB"><enum>(B)</enum><header>Sunset of
		limitation</header><text>The limitation under subparagraph (A) shall not apply
		to any adjustment made in fiscal year 2013 or each fiscal year
		thereafter.</text>
							</subparagraph></paragraph></subsection><subsection id="ID36c9034ec5af4fec97ee9b7c9d61f9b9"><enum>(c)</enum><header>Savings
		provision for newly appointed Inspectors General</header>
						<paragraph id="id624637EDAA14462BA50C851DBF5FE504"><enum>(1)</enum><header>In
		general</header><text>The provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/3392">section 3392</external-xref> of title 5, United States
		Code, other than the terms <term>performance awards</term> and <term>awarding
		of ranks</term> in subsection (c)(1) of such section, shall apply to career
		appointees of the Senior Executive Service who are appointed to the position of
		Inspector General.</text>
						</paragraph><paragraph id="IDf9364bf8f8ad4631903d44ae49a22be9"><enum>(2)</enum><header>Nonreduction in
		pay</header><text>Notwithstanding any other provision of law, career Federal
		employees serving on an appointment made pursuant to statutory authority found
		other than in <external-xref legal-doc="usc" parsable-cite="usc/5/3392">section 3392</external-xref> of title 5, United States Code, shall not suffer a
		reduction in pay, not including any bonus or performance award, as a result of
		being appointed to the position of Inspector General.</text>
						</paragraph></subsection><subsection id="ID4ef9d5d6486e40f89ec754b3aadaf04c"><enum>(d)</enum><header>Savings
		provision</header><text>Nothing in this section shall have the effect of
		reducing the rate of pay of any individual serving on the date of enactment of
		this section as an Inspector General of—</text>
						<paragraph id="id516397C4E81649B7B8A2146C0262313B"><enum>(1)</enum><text>an
		establishment as defined under section 12(2) of the Inspector General Act of
		1978 (5 U.S.C. App.) (as amended by section 7(a) of this Act);</text>
						</paragraph><paragraph id="id1790540B81734FBA90E3654F790F7178"><enum>(2)</enum><text>a
		designated Federal entity as defined under section 8G(2) of the Inspector
		General Act of 1978 (5 U.S.C. App.);</text>
						</paragraph><paragraph id="id104F8713AD154DA5B3E3984340058B68"><enum>(3)</enum><text>a
		legislative agency <added-phrase reported-display-style="italic"></added-phrase>for which the position of
		Inspector General is established by statute; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5AA5E1C6F6E84F3889EF36463ABC7E96"><enum>(4)</enum><text>any other entity
		of the Government for which the position of Inspector General is established by
		statute.</text>
						</paragraph></subsection></section><section id="id6E7310BE87164E488AB8CE492326EA37"><enum>5.</enum><header>Prohibition of
		cash bonus or awards</header><text display-inline="no-display-inline">Section 3
		of the Inspector General Act of 1978 (5 U.S.C. App.) (as amended by section 4
		of this Act) is further amended by adding at the end the following:</text>
					<quoted-block id="ID2A7D94B15C0E489B99C11699B3C31905" style="OLC">
						<subsection id="ID15D3BB1CEBE54BF4B82C8B04B566C482"><enum>(f)</enum><text>An Inspector
		  General (as defined under section 8G(a)(6) or 12(3)) may not receive any cash
		  award or cash bonus, including any cash award under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/45">chapter 45</external-xref> of title 5,
		  United States
		  Code.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="idFB9B9EC1A88E4FA099AE9C1C9E7550DA"><enum>6.</enum><header>Separate counsel
		to support Inspectors General</header>
					<subsection id="idD165E86B8F354CE7ABF8BCE6127361B8"><enum>(a)</enum><header>Counsels to
		Inspectors General of Establishment</header><text>Section 3 of the Inspector
		General Act of 1978 (5 U.S.C. App.) (as amended by sections 4 and 5 of this
		Act) is further amended by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id8A16F13D670A46FBA915444CF7ADB41F" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="H78F3A5474A8AF066380368A2319863D"><enum>(g)</enum><text display-inline="yes-display-inline">Each Inspector General shall, in accordance
		  with applicable laws and regulations governing the civil service, obtain legal
		  advice from a counsel either reporting directly to the Inspector General or
		  another Inspector
		  General.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="idF64D7EED595046168EB736EBADC6B65F"><enum>(b)</enum><header>Counsels to
		Inspectors General of designated Federal entities</header><text>Section 8G(g)
		of the Inspector General Act of 1978 (5 U.S.C. App.) is amended by adding at
		the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idE3BD6CBD69E34E97895F55A02450666B" style="OLC">
							<paragraph id="IDf1d4594030bb4763ae8ec0faf9cb0f47"><enum>(4)</enum><text>Each Inspector
		  General shall—</text>
								<subparagraph id="ID19308af76ca247c2a0514e8aa26c1bbf" indent="up2"><enum>(A)</enum><text>in accordance with applicable laws
		  and regulations governing appointments within the designated Federal entity,
		  appoint a Counsel to the Inspector General who shall report to the Inspector
		  General;</text>
								</subparagraph><subparagraph id="ID4a6c3d4fb60e4b0b8bf899524575e62c" indent="up2"><enum>(B)</enum><text>obtain the services of a counsel
		  appointed by and directly reporting to another Inspector General on a
		  reimbursable basis; or</text>
								</subparagraph><subparagraph id="IDc6133c2c2160437da012294f2a5c83b8" indent="up2"><enum>(C)</enum><text>obtain the services of appropriate
		  staff of the Council of the Inspectors General on Integrity and Efficiency on a
		  reimbursable
		  basis.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="id0416E3AD2A7446A9A887D6C2DF0EFCBD"><enum>(c)</enum><header>Rule of
		construction</header><text>Nothing in the amendments made by this section shall
		be construed to alter the duties and responsibilities of the counsel for any
		establishment or designated Federal entity, except for the availability of
		counsel as provided under sections 3(g) and 8G(g) of the Inspector General Act
		of 1978 (5 U.S.C. App.) (as amended by this section). The Counsel to the
		Inspector General shall perform such functions as the Inspector General may
		prescribe.</text>
					</subsection></section><section id="HE2FAC214D001474192B50871FBE248E"><enum>7.</enum><header>Establishment of
		Council of the Inspectors General on Integrity and Efficiency</header>
					<subsection id="H216F81601D274BC78E23E18946CE0096"><enum>(a)</enum><header>Establishment</header><text>The
		Inspector General Act of 1978 (5 U.S.C. App.) is amended by redesignating
		sections 11 and 12 as sections 12 and 13, respectively, and by inserting after
		section 10 the following:</text>

							<section id="H9D32E57C130F41BD85B1CA282137C9CC"><enum>11.</enum><header>Establishment of
		  the Council of the Inspectors General on Integrity and Efficiency</header>
								<subsection id="H66A0EF05B3B94EF58D77BCCD9CC45B7"><enum>(a)</enum><header>Establishment and
		  Mission</header>
									<paragraph id="id9E7FF7FF7CC74364A73A92A8BC231BAA"><enum>(1)</enum><header>Establishment</header><text>There
		  is established as an independent entity within the executive branch the Council
		  of the Inspectors General on Integrity and Efficiency (in this section referred
		  to as the <quote>Council</quote>).</text>
									</paragraph><paragraph id="idC3E8B0C05C774E4CAA40C9F1D0177F47"><enum>(2)</enum><header>Mission</header><text>The
		  mission of the Council shall be to—</text>
										<subparagraph id="id6FA17F53B3284BE3814367923DC19E36"><enum>(A)</enum><text>address
		  integrity, economy, and effectiveness issues that transcend individual
		  Government agencies; and</text>
										</subparagraph><subparagraph id="id20E0D11333D24257A651E0655778E20D"><enum>(B)</enum><text>increase the
		  professionalism and effectiveness of personnel by developing policies,
		  standards, and approaches to aid in the establishment of a well-trained and
		  highly skilled workforce in the offices of the Inspectors General.</text>
										</subparagraph></paragraph></subsection><subsection id="HB042A664778C41049C6C9B9BF38073CA"><enum>(b)</enum><header>Membership</header>
									<paragraph id="H97BBABE40AD04BACB51CCB65418475FA"><enum>(1)</enum><header>In
		  general</header><text>The Council shall consist of the following
		  members:</text>
										<subparagraph id="H9823D6FEA3BA455A93E4C4EDA63006B"><enum>(A)</enum><text>All Inspectors
		  General whose offices are established under—</text>
											<clause id="HC67C64610BBF465887BD307CFDE98EF"><enum>(i)</enum><text>section
		  2; or</text>
											</clause><clause id="H2FF08B95B8634E198F454D0925F50627"><enum>(ii)</enum><text>section
		  8G.</text>
											</clause></subparagraph><subparagraph id="HC7B202623D79489AA933C37D46674D37"><enum>(B)</enum><text>The Inspectors
		  General of the Office of the Director of National Intelligence and the Central
		  Intelligence Agency.</text>
										</subparagraph><subparagraph id="H63AF402451544243A2006F6B9447F1EB"><enum>(C)</enum><text>The Controller of
		  the Office of Federal Financial Management.</text>
										</subparagraph><subparagraph id="HA636BB6D755047F092A77EB5369DC1BE"><enum>(D)</enum><text>A senior level
		  official of the Federal Bureau of Investigation designated by the Director of
		  the Federal Bureau of Investigation.</text>
										</subparagraph><subparagraph id="H64906B3526E749D18B28D2099E00C667"><enum>(E)</enum><text>The Director of
		  the Office of Government Ethics.</text>
										</subparagraph><subparagraph id="H3136580ADFC8446F901701A724CA543E"><enum>(F)</enum><text>The Special
		  Counsel of the Office of Special Counsel.</text>
										</subparagraph><subparagraph id="H1FCE9F7CFBC54A3EAABD45D3F8564537"><enum>(G)</enum><text>The Deputy
		  Director of the Office of Personnel Management.</text>

		  Director for Management of the Office of Management and Budget.</text>
										</subparagraph><subparagraph id="id0160A7F669C1428DB2B70459B7C93430"><enum>(I)</enum><text>The Inspectors
		  General of the Library of Congress, Capitol Police, Government Printing Office,
		  Government Accountability Office, and the Architect of the Capitol.</text>
										</subparagraph></paragraph><paragraph id="H2DD09A6C8464499FAD4FA21FC4CE7FBF"><enum>(2)</enum><header>Chairperson and
		  executive chairperson</header>
										<subparagraph id="H0FD73469F5AC4308BB684388C639D248"><enum>(A)</enum><header>Executive
		  chairperson</header><text>The Deputy Director for Management of the Office of
		  Management and Budget shall be the Executive Chairperson of the Council.</text>
										</subparagraph><subparagraph id="H810191B784654AF68C8740000036FBBA"><enum>(B)</enum><header>Chairperson</header><text>The
		  Council shall elect 1 of the Inspectors General referred to in paragraph (1)(A)
		  or (B) to act as Chairperson of the Council. The term of office of the
		  Chairperson shall be 2 years.</text>
										</subparagraph></paragraph><paragraph id="H1CEB6759ACF241FF8F321E3C449D0138"><enum>(3)</enum><header>Functions of
		  chairperson and executive chairperson</header>
										<subparagraph id="H5AE6C9C005724DD981622200F2993861"><enum>(A)</enum><header>Executive
		  chairperson</header><text>The Executive Chairperson shall—</text>
											<clause id="H3E9CE89BF0834D00B77E757E3C5B8398"><enum>(i)</enum><text>preside over
		  meetings of the Council;</text>
											</clause><clause id="H4A4A76E1E0634AA0818C88531733A6DD"><enum>(ii)</enum><text>provide to the
		  heads of agencies and entities represented on the Council summary reports of
		  the activities of the Council; and</text>
											</clause><clause id="H599136BEA9704F829C00C204088091FD"><enum>(iii)</enum><text display-inline="yes-display-inline">provide to the Council such information
		  relating to the agencies and entities represented on the Council as assists the
		  Council in performing its functions.</text>
											</clause></subparagraph><subparagraph id="HC2F78FAC5A5D4A799138F4DFAF55C348"><enum>(B)</enum><header>Chairperson</header><text>The
		  Chairperson shall—</text>
											<clause id="H2E2CB04780E44649A544CA1E2FB8A600"><enum>(i)</enum><text>convene meetings
		  of the Council—</text>
												<subclause id="H87DC41505BB94BCBAD874D0812218BE4"><enum>(I)</enum><text>at
		  least 6 times each year;</text>
												</subclause><subclause id="H1244865B9EB443A9AEA86E95590A359"><enum>(II)</enum><text>monthly to the
		  extent possible; and</text>
												</subclause><subclause id="H82497D18BBF34F0FBE43464BD3F0DF03"><enum>(III)</enum><text>more frequently
		  at the discretion of the Chairperson;</text>
												</subclause></clause><clause id="HE6C2211676D441E0AEFDC2800DFBD54"><enum>(ii)</enum><text>carry
		  out the functions and duties of the Council under subsection (c);</text>
											</clause><clause id="H5D06EB75B1624C11AB82CB75A7575BD9"><enum>(iii)</enum><text>appoint a Vice
		  Chairperson to assist in carrying out the functions of the Council and act in
		  the absence of the Chairperson, from a category of Inspectors General described
		  in subparagraph (A)(i), (A)(ii), or (B) of paragraph (1), other than the
		  category from which the Chairperson was elected;</text>
											</clause><clause id="H490F509367B44DBD99A63C42119BA7FB"><enum>(iv)</enum><text>make
		  such payments from funds otherwise available to the Council as may be necessary
		  to carry out the functions of the Council;</text>
											</clause><clause id="HE1B30DE979924252B4C629519E211294"><enum>(v)</enum><text>select, appoint,
		  and employ personnel as needed to carry out the functions of the Council
		  subject to the provisions of title 5, United States Code, governing
		  appointments in the competitive service, and the provisions of chapter 51 and
		  subchapter III of chapter 53 of such title, relating to classification and
		  General Schedule pay rates;</text>
											</clause><clause id="HB276075825494677903DA2B8B6D62EBD"><enum>(vi)</enum><text>to
		  the extent and in such amounts as may be provided in advance by appropriations
		  Acts, made available from the revolving fund established under subsection
		  (c)(3)(B), or as otherwise provided by law, enter into contracts and other
		  arrangements with public agencies and private persons to carry out the
		  functions and duties of the Council;</text>
											</clause><clause id="H93A2CB08C2414FC4B1EA8F8D66F2F27"><enum>(vii)</enum><text>establish, in
		  consultation with the members of the Council, such committees as determined by
		  the Chairperson to be necessary and appropriate for the efficient conduct of
		  Council functions; and</text>
											</clause><clause id="H76E199E2986A4B6BBC4EF430952C00F6"><enum>(viii)</enum><text>prepare and
		  transmit a report annually on behalf of the Council to the President on the
		  activities of the Council.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="HE2F1B702998E4F6FB72089DB00014611"><enum>(c)</enum><header>Functions and
		  duties of council</header>
									<paragraph id="HA25C40792F254EF384522E019580E0B5"><enum>(1)</enum><header>In
		  general</header><text>The Council shall—</text>
										<subparagraph id="HD9DE3914324C41A2B721E10C9ECF6E0"><enum>(A)</enum><text>continually
		  identify, review, and discuss areas of weakness and vulnerability in Federal
		  programs and operations with respect to fraud, waste, and abuse;</text>
										</subparagraph><subparagraph id="H46C8CC40A40842329E5BF5D531BFA00"><enum>(B)</enum><text>develop plans for
		  coordinated, Governmentwide activities that address these problems and promote
		  economy and efficiency in Federal programs and operations, including
		  interagency and interentity audit, investigation, inspection, and evaluation
		  programs and projects to deal efficiently and effectively with those problems
		  concerning fraud and waste that exceed the capability or jurisdiction of an
		  individual agency or entity;</text>
										</subparagraph><subparagraph id="H062F67E95E4F4703B9A55D5DEAF0310"><enum>(C)</enum><text>develop policies
		  that will aid in the maintenance of a corps of well-trained and highly skilled
		  Office of Inspector General personnel;</text>
										</subparagraph><subparagraph id="H86AF607ABDE4467EBC1DDFCD42A788C2"><enum>(D)</enum><text>maintain an
		  Internet website and other electronic systems for the benefit of all Inspectors
		  General, as the Council determines are necessary or desirable;</text>
										</subparagraph><subparagraph id="H20173B965BC34223878560958DDDCFF4"><enum>(E)</enum><text>maintain 1 or more
		  academies as the Council considers desirable for the professional training of
		  auditors, investigators, inspectors, evaluators, and other personnel of the
		  various offices of Inspector General;</text>
										</subparagraph><subparagraph id="id604DD44EEF5545239E74806C3C85320B"><enum>(F)</enum><text>submit
		  recommendations of individuals to the appropriate appointing authority for any
		  appointment to an office of Inspector General described under subsection
		  (b)(1)(A) or (B);</text>
										</subparagraph><subparagraph id="HF646666F1FA549F58D66BB00410064DC"><enum>(G)</enum><text>make such reports
		  to Congress as the Chairperson determines are necessary or appropriate;
		  and</text>
										</subparagraph><subparagraph id="id0C555B371F25479F86CB3D4AAFEF54A5"><enum>(H)</enum><text>perform other
		  duties within the authority and jurisdiction of the Council, as
		  appropriate.</text>
										</subparagraph></paragraph><paragraph id="H0ED72E1249314D95BF26EDB3AC5B2892"><enum>(2)</enum><header>Adherence and
		  participation by members</header><text>To the extent permitted under law, and
		  to the extent not inconsistent with standards established by the Comptroller
		  General of the United States for audits of Federal establishments,
		  organizations, programs, activities, and functions, each member of the Council,
		  as appropriate, shall—</text>
										<subparagraph id="idCD3ACBC3E75A406EBD5E7489B590972B"><enum>(A)</enum><text>adhere to
		  professional standards developed by the Council; and</text>
										</subparagraph><subparagraph id="id0FB46A5570954EEFAC9F27B54A1260EF"><enum>(B)</enum><text>participate in
		  the plans, programs, and projects of the Council, except that in the case of a
		  member described under subsection (b)(1)(I) , the member shall participate only
		  to the extent requested by the member and approved by the Executive Chairperson
		  and Chairperson.</text>
										</subparagraph></paragraph><paragraph commented="no" id="ID2de3029c598e4048a4c406324d4e2557"><enum>(3)</enum><header>Additional
		  administrative authorities</header>
										<subparagraph commented="no" id="idB26DC56BABD24377A9B9DCAF779A1EC2"><enum>(A)</enum><header>Interagency
		  funding</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1532">section 1532</external-xref> of title 31, United States
		  Code, or any other provision of law prohibiting the interagency funding of
		  activities described under subclause (I), (II), or (III) of clause (i), in the
		  performance of the responsibilities, authorities, and duties of the
		  Council—</text>
											<clause commented="no" id="idBE7747E8FB894C6795134B7E5F92E6F3"><enum>(i)</enum><text>the Executive
		  Chairperson may authorize the use of interagency funding for—</text>
												<subclause commented="no" id="id2402EDD3B7914378AA6E52655D5E534E"><enum>(I)</enum><text>Governmentwide
		  training of employees of the Offices of the Inspectors General;</text>
												</subclause><subclause commented="no" id="idC71B4A50AFF946A3A32BDAA9750E393E"><enum>(II)</enum><text>the functions of
		  the Integrity Committee of the Council; and</text>
												</subclause><subclause commented="no" id="id03353CFD4A174A28A0CB5C7DF7594D2C"><enum>(III)</enum><text>any other
		  authorized purpose determined by the Council; and</text>
												</subclause></clause><clause commented="no" id="idF7111D05367F4B658178020F2FFEB0AE"><enum>(ii)</enum><text>upon the
		  authorization of the Executive Chairperson, any department, agency, or entity
		  of the executive branch which has a member on the Council shall fund or
		  participate in the funding of such activities.</text>
											</clause></subparagraph><subparagraph commented="no" id="IDa1250546805340079d4551052bd773a3"><enum>(B)</enum><header>Revolving
		  fund</header>
											<clause commented="no" id="idA8712669A3B44C0B8539C2144F39BBAE"><enum>(i)</enum><header>In
		  general</header><text>The Council may—</text>
												<subclause commented="no" id="id230FDF57024E4823B0167AAE9AA278C4"><enum>(I)</enum><text>establish in the
		  Treasury of the United States a revolving fund to be called the Inspectors
		  General Council Fund; or</text>
												</subclause><subclause commented="no" id="id8B4FDA7FA8144350834066BD706CFD02"><enum>(II)</enum><text>enter into an
		  arrangement with a department or agency to use an existing revolving
		  fund.</text>
												</subclause></clause><clause commented="no" id="id452D91FDB964440181D43AFBA341FBCA"><enum>(ii)</enum><header>Amounts in
		  revolving fund</header>
												<subclause commented="no" id="idC6220F1E47F84D319A097B33190F98A2"><enum>(I)</enum><header>In
		  general</header><text>Amounts transferred to the Council under this subsection
		  shall be deposited in the revolving fund described under clause (i)(I) or
		  (II).</text>
												</subclause><subclause commented="no" id="id02D87F2530A04FDCAB3837E21A0EDC2D"><enum>(II)</enum><header>Training</header><text>Any
		  remaining unexpended balances appropriated for or otherwise available to the
		  Inspectors General Criminal Investigator Academy and the Inspectors General
		  Auditor Training Institute shall be transferred to the revolving fund described
		  under clause (i)(I) or (II).</text>
												</subclause></clause><clause commented="no" id="id1EB467F134984E7ABD06E9E00EF04C85"><enum>(iii)</enum><header>Use of
		  revolving fund</header>
												<subclause commented="no" id="idBB90A3D8A86349DF8A598B44883AD579"><enum>(I)</enum><header>In
		  general</header><text>Except as provided under subclause (II), amounts in the
		  revolving fund described under clause (i)(I) or (II) may be used to carry out
		  the functions and duties of the Council under this subsection.</text>
												</subclause><subclause commented="no" id="id84BD678745544180902BDCF43D87A26B"><enum>(II)</enum><header>Training</header><text>Amounts
		  transferred into the revolving fund described under clause (i)(I) or (II) may
		  be used for the purpose of maintaining any training academy as determined by
		  the Council.</text>
												</subclause></clause><clause commented="no" id="idE8DC055CBCD6417E8A5333887D3F5DCE"><enum>(iv)</enum><header>Availability
		  of funds</header><text>Amounts in the revolving fund described under clause
		  (i)(I) or (II) shall remain available to the Council without fiscal year
		  limitation.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id842B9430E7F54D2A84B0E5421B449A18"><enum>(C)</enum><header>Superseding
		  provisions</header><text>No provision of law enacted after the date of
		  enactment of this subsection shall be construed to limit or supersede any
		  authority under subparagraph (A) or (B), unless such provision makes specific
		  reference to the authority in that paragraph.</text>
										</subparagraph></paragraph><paragraph id="H1D55DC0D722B45839CD7D0AEECB710DD"><enum>(4)</enum><header>Existing
		  authorities and responsibilities</header><text>The establishment and operation
		  of the Council shall not affect—</text>
										<subparagraph id="H60920BDB454847A6B137CCCAE71517B8"><enum>(A)</enum><text>the role of the
		  Department of Justice in law enforcement and litigation;</text>
										</subparagraph><subparagraph id="HD18B86325EDB47BDAAD942ECA1DA6DCD"><enum>(B)</enum><text>the authority or
		  responsibilities of any Government agency or entity; and</text>
										</subparagraph><subparagraph id="HB5171138715F4552B2D7BE7174407FCF"><enum>(C)</enum><text>the authority or
		  responsibilities of individual members of the Council.</text>
										</subparagraph></paragraph></subsection><subsection id="HBC381E4B6B324F28BC01486E209DF82B"><enum>(d)</enum><header>Integrity
		  Committee</header>
									<paragraph id="H1E58904F6DFD47B5AD9ED3CC9168F46D"><enum>(1)</enum><header>Establishment</header><text>The
		  Council shall have an Integrity Committee, which shall receive, review, and
		  refer for investigation allegations of wrongdoing that are made against
		  Inspectors General and staff members of the various Offices of Inspector
		  General described under paragraph (4)(C).</text>
									</paragraph><paragraph id="H70749050CFEF4D7C996F98D6249C03AE"><enum>(2)</enum><header>Membership</header><text>The
		  Integrity Committee shall consist of the following members:</text>
										<subparagraph id="H6D0268FC3EC546CBA6D76F1DAACD3706"><enum>(A)</enum><text>The official of
		  the Federal Bureau of Investigation serving on the Council, who shall serve as
		  Chairperson of the Integrity Committee, and maintain the records of the
		  Committee.</text>
										</subparagraph><subparagraph id="H08427A3951594A008288B57CE3888AD"><enum>(B)</enum><text>Four Inspectors
		  General described in subparagraph (A) or (B) of subsection (b)(1) appointed by
		  the Chairperson of the Council, representing both establishments and designated
		  Federal entities (as that term is defined in section 8G(a)).</text>
										</subparagraph><subparagraph id="H58535D5347C74E5AA42CA7A018F44C95"><enum>(C)</enum><text>The Special
		  Counsel of the Office of Special Counsel.</text>
										</subparagraph><subparagraph id="HF25336BCC29B4A8598E0A2E387B8619F"><enum>(D)</enum><text>The Director of
		  the Office of Government Ethics.</text>
										</subparagraph></paragraph><paragraph id="H8980E51255F5442B941D647D2016B565"><enum>(3)</enum><header>Legal
		  advisor</header><text>The Chief of the Public Integrity Section of the Criminal
		  Division of the Department of Justice, or his designee, shall serve as a legal
		  advisor to the Integrity Committee.</text>
									</paragraph><paragraph id="HB6A123FAE155444BA14198000074A7C"><enum>(4)</enum><header>Referral of
		  allegations</header>
										<subparagraph id="HE4CBE5D70B484CF086B8CC1F7FC7AA07"><enum>(A)</enum><header>Requirement</header><text>An
		  Inspector General shall refer to the Integrity Committee any allegation of
		  wrongdoing against a staff member of the office of that Inspector General,
		  if—</text>
											<clause id="HF81053920AEC4445B6D472124427DEAA"><enum>(i)</enum><text>review
		  of the substance of the allegation cannot be assigned to an agency of the
		  executive branch with appropriate jurisdiction over the matter; and</text>
											</clause><clause id="H32F8618AC0B34B06B63EB5DF06181153"><enum>(ii)</enum><text>the
		  Inspector General determines that—</text>
												<subclause id="H61B62ED2B3134D9A9101A7CB262841C"><enum>(I)</enum><text>an
		  objective internal investigation of the allegation is not feasible; or</text>
												</subclause><subclause id="H5356F0556E8C4F13A0FF85707BCFB7FC"><enum>(II)</enum><text>an
		  internal investigation of the allegation may appear not to be objective.</text>
												</subclause></clause></subparagraph><subparagraph id="H19643135A2B54CFD92B2D4BE7F00C59E"><enum>(B)</enum><header>Definition</header><text>In
		  this paragraph the term <term>staff member</term> means any employee of an
		  Office of Inspector General who—</text>
											<clause id="H11CFDC8550454D1DBFAD266416286F63"><enum>(i)</enum><text>reports directly
		  to an Inspector General; or</text>
											</clause><clause id="H1C3E4605A6CA4D348881F32015DD5260"><enum>(ii)</enum><text>is
		  designated by an Inspector General under subparagraph (C).</text>
											</clause></subparagraph><subparagraph id="HB71460D73CD24751BF44C982D675C18F"><enum>(C)</enum><header>Designation of
		  staff members</header><text>Each Inspector General shall annually submit to the
		  Chairperson of the Integrity Committee a designation of positions whose holders
		  are staff members for purposes of subparagraph (B).</text>
										</subparagraph></paragraph><paragraph id="H34AA171CC10B4248A4F7DBE8FFA6852D"><enum>(5)</enum><header>Review of
		  allegations</header><text>The Integrity Committee shall—</text>
										<subparagraph id="H12E7F793E9624571BB481D104E3B87AF"><enum>(A)</enum><text>review all
		  allegations of wrongdoing the Integrity Committee receives against an Inspector
		  General, or against a staff member of an Office of Inspector General described
		  under paragraph (4)(C);</text>
										</subparagraph><subparagraph id="idA684955B34074C22B465968A3F678BFD"><enum>(B)</enum><text>refer any
		  allegation of wrongdoing to the agency of the executive branch with appropriate
		  jurisdiction over the matter; and</text>
										</subparagraph><subparagraph id="HDF177BCF418B4048AEDFBED2EA17D27D"><enum>(C)</enum><text>refer to the
		  Chairperson of the Integrity Committee any allegation of wrongdoing determined
		  by the Integrity Committee under subparagraph (A) to be potentially meritorious
		  that cannot be referred to an agency under subparagraph (B).</text>
										</subparagraph></paragraph><paragraph id="HDD8559D2841949CA92AC3C004135F603"><enum>(6)</enum><header>Authority to
		  investigate allegations</header>
										<subparagraph id="HD75FAC86A19B4BD486DBE422B923B766"><enum>(A)</enum><header>Requirement</header><text>The
		  Chairperson of the Integrity Committee shall cause a thorough and timely
		  investigation of each allegation referred under paragraph (5)(C) to be
		  conducted in accordance with this paragraph.</text>
										</subparagraph><subparagraph id="H7F31BBB1F64947B9BE8CE5E85000FB5C"><enum>(B)</enum><header>Resources</header><text>At
		  the request of the Chairperson of the Integrity Committee, the head of each
		  agency or entity represented on the Council—</text>
											<clause id="HD01F22386BA84523A4C265F19C718E0"><enum>(i)</enum><text>may
		  provide resources necessary to the Integrity Committee; and</text>
											</clause><clause id="H7ED945DDA6E6448085CAA62400DBC400"><enum>(ii)</enum><text>may
		  detail employees from that agency or entity to the Integrity Committee, subject
		  to the control and direction of the Chairperson, to conduct an investigation
		  under this subsection.</text>
											</clause></subparagraph></paragraph><paragraph id="H394BA455A6DB4C78AE697C1764F30676"><enum>(7)</enum><header>Procedures for
		  investigations</header>
										<subparagraph id="H6542D77457DA4C1D00EC17EBC6C633DD"><enum>(A)</enum><header>Standards
		  applicable</header><text>Investigations initiated under this subsection shall
		  be conducted in accordance with the most current Quality Standards for
		  Investigations issued by the Council or by its predecessors (the President’s
		  Council on Integrity and Efficiency and the Executive Council on Integrity and
		  Efficiency).</text>
										</subparagraph><subparagraph id="HB57FC9582EFE42C08D90F1DA307FADE9"><enum>(B)</enum><header>Additional
		  policies and procedures</header>
											<clause id="idD72890AF71E945139B7D0C7F89365318"><enum>(i)</enum><header>Establishment</header><text>The
		  Integrity Committee, in conjunction with the Chairperson of the Council, shall
		  establish additional policies and procedures necessary to ensure fairness and
		  consistency in—</text>
												<subclause id="H6FF479D50E85490A804E76A2180084A6"><enum>(I)</enum><text>determining
		  whether to initiate an investigation;</text>
												</subclause><subclause id="H801D7D7319364E639FC800F18F946965"><enum>(II)</enum><text>conducting
		  investigations;</text>
												</subclause><subclause id="H7346AD4273A949248F482F14C58F4C10"><enum>(III)</enum><text>reporting the
		  results of an investigation; and</text>
												</subclause><subclause id="H9A3FD089659C41028EABBBA1E17F600"><enum>(IV)</enum><text>providing the
		  person who is the subject of an investigation with an opportunity to respond to
		  any Integrity Committee report.</text>
												</subclause></clause><clause id="id40582914B5A543508390AAD9D0AC2EF9"><enum>(ii)</enum><header>Submission to
		  Congress</header><text>The Council shall submit a copy of the policies and
		  procedures established under clause (i) to the congressional committees of
		  jurisdiction.</text>
											</clause></subparagraph><subparagraph id="H5B7B13A4AF234A9BA10087E8D1FA24C"><enum>(C)</enum><header>Reports</header>
											<clause id="idEF89E4175FB5456EBC2E6E322F13D7AE"><enum>(i)</enum><header>Potentially
		  meritorious allegations</header><text>For allegations described under paragraph
		  (5)(C), the Chairperson of the Integrity Committee shall make a report
		  containing the results of the investigation of the Chairperson and shall
		  provide such report to members of the Integrity Committee.</text>
											</clause><clause id="ID00d8ce2bc1c540fa9c9ce12ed1b4286d"><enum>(ii)</enum><header>Allegations of
		  wrongdoing</header><text>For allegations referred to an agency under paragraph
		  (5)(B), the head of that agency shall make a report containing the results of
		  the investigation and shall provide such report to members of the Integrity
		  Committee.</text>
											</clause></subparagraph></paragraph><paragraph id="IDe3c24f2be5e8483d9289ee53eece0044"><enum>(8)</enum><header>Assessment and
		  final disposition</header>
										<subparagraph id="IDaa7c53e319894e80903bb290754fb17f"><enum>(A)</enum><header>In
		  general</header><text>With respect to any report received under paragraph
		  (7)(C), the Integrity Committee shall—</text>
											<clause id="IDf4c31aa35e914efdb749ab7df6a21bbe"><enum>(i)</enum><text>assess the
		  report;</text>
											</clause><clause id="IDfb999ae574fe487f8d046be8d62f9e41"><enum>(ii)</enum><text>forward the
		  report, with the recommendations of the Integrity Committee, including those on
		  disciplinary action, within 30 days (to the maximum extent practicable) after
		  the completion of the investigation, to the Executive Chairperson of the
		  Council and to the President (in the case of a report relating to an Inspector
		  General of an establishment or any employee of that Inspector General) or the
		  head of a designated Federal entity (in the case of a report relating to an
		  Inspector General of such an entity or any employee of that Inspector General)
		  for resolution; and</text>
											</clause><clause id="IDfda389aeae7e40e4b94d245bd75502d0"><enum>(iii)</enum><text>submit to the
		  Committee on Government Oversight and Reform of the House of Representatives,
		  the Committee on Homeland Security and Governmental Affairs of the Senate, and
		  other congressional committees of jurisdiction an executive summary of such
		  report and recommendations within 30 days after the submission of such report
		  to the Executive Chairperson under clause (ii).</text>
											</clause></subparagraph><subparagraph id="IDf62227e8855d44aba2336cf956aa1621"><enum>(B)</enum><header>Disposition</header><text>The
		  Executive Chairperson of the Council shall report to the Integrity Committee
		  the final disposition of the matter, including what action was taken by the
		  President or agency head.</text>
										</subparagraph></paragraph><paragraph id="IDf6543fa1cd25454c8871b99d203309f1"><enum>(9)</enum><header>Annual
		  report</header><text>The Council shall submit to Congress and the President by
		  December 31 of each year a report on the activities of the Integrity Committee
		  during the preceding fiscal year, which shall include the following:</text>
										<subparagraph id="IDe3779d2f4aeb4ec9bdef560e338bd905"><enum>(A)</enum><text>The number of
		  allegations received.</text>
										</subparagraph><subparagraph id="ID1677c05184754f9c86ee599122dbe374"><enum>(B)</enum><text>The number of
		  allegations referred to other agencies, including the number of allegations
		  referred for criminal investigation.</text>
										</subparagraph><subparagraph id="ID001bcb41f08e4b4f9739a0a19076dc68"><enum>(C)</enum><text>The number of
		  allegations referred to the Chairperson of the Integrity Committee for
		  investigation.</text>
										</subparagraph><subparagraph id="ID1af6fe0801eb45da82e2e173e0ed6a81"><enum>(D)</enum><text>The number of
		  allegations closed without referral.</text>
										</subparagraph><subparagraph id="ID96039be5f09d4306bd99e6cbd9114586"><enum>(E)</enum><text>The date each
		  allegation was received and the date each allegation was finally disposed
		  of.</text>
										</subparagraph><subparagraph id="ID6daa86d49ad44e469dd7692155f3b47f"><enum>(F)</enum><text>In the case of
		  allegations referred to the Chairperson of the Integrity Committee, a summary
		  of the status of the investigation of the allegations and, in the case of
		  investigations completed during the preceding fiscal year, a summary of the
		  findings of the investigations.</text>
										</subparagraph><subparagraph id="ID8da7d871688c4c9aab5cf773a2143a67"><enum>(G)</enum><text>Other matters
		  that the Council considers appropriate.</text>
										</subparagraph></paragraph><paragraph id="ID6c2c9f44ac934863929bd067a591d384"><enum>(10)</enum><header>Requests for
		  more information</header><text>With respect to paragraphs (8) and (9), the
		  Council shall provide more detailed information about specific allegations upon
		  request from any of the following:</text>
										<subparagraph id="ID07eec83b20224121b8cc3ad153c7948f"><enum>(A)</enum><text>The chairperson
		  or ranking member of the Committee on Homeland Security and Governmental
		  Affairs of the Senate.</text>
										</subparagraph><subparagraph id="ID4dfb5bacd73045f191bda4efe2170600"><enum>(B)</enum><text>The chairperson
		  or ranking member of the Committee on Oversight and Government Reform of the
		  House of Representatives.</text>
										</subparagraph><subparagraph id="ID5fd73e00155541d6a5339166aeb39bbb"><enum>(C)</enum><text>The chairperson
		  or ranking member of the congressional committees of jurisdiction.</text>
										</subparagraph></paragraph><paragraph id="HB6FB78D0A1A741F3A3FAB60927B9F18"><enum>(11)</enum><header>No right or
		  benefit</header><text>This subsection is not intended to create any right or
		  benefit, substantive or procedural, enforceable at law by a person against the
		  United States, its agencies, its officers, or any
		  person.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="idA3BEAB85321140E8B28545327A763AB5"><enum>(b)</enum><header>Allegations of
		wrongdoing against special counsel or deputy special counsel</header>
						<paragraph id="ID89a8829aed3d45f591c8cffe87f36b19"><enum>(1)</enum><header>Definitions</header><text>In
		this section—</text>
							<subparagraph id="idD35F6BE722454767A666EF51E42E54D0"><enum>(A)</enum><text>the term
		<term>Integrity Committee</term> means the Integrity Committee established
		under <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /11">section 11(d)</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App), as
		amended by this Act; and</text>
							</subparagraph><subparagraph id="id8696FA4CF6514EBF8BFCC947ECC52CAC"><enum>(B)</enum><text>the term
		<term>Special Counsel</term> refers to the Special Counsel appointed under
		<external-xref legal-doc="usc" parsable-cite="usc/5/1211">section 1211(b)</external-xref> of title 5, United States Code.</text>
							</subparagraph></paragraph><paragraph id="ID05edfa27c09b41d38fd24c52d29dbc4c"><enum>(2)</enum><header>Authority of
		integrity committee</header>
							<subparagraph id="ID7300d05bff25449aa0af342d2519e318"><enum>(A)</enum><header>In
		general</header><text>An allegation of wrongdoing against the Special Counsel
		or the Deputy Special Counsel may be received, reviewed, and referred for
		investigation by the Integrity Committee to the same extent and in the same
		manner as in the case of an allegation against an Inspector General (or a
		member of the staff of an Office of Inspector General), subject to the
		requirement that the Special Counsel recuse himself or herself from the
		consideration of any allegation brought under this paragraph.</text>
							</subparagraph><subparagraph id="ID7300478f4fff40669c01f10786eb507c"><enum>(B)</enum><header>Coordination
		with existing provisions of law</header><text>This subsection does not
		eliminate access to the Merit Systems Protection Board for review under section
		7701 of title 5, United States Code. To the extent that an allegation brought
		under this subsection involves section 2302(b)(8) of that title, a failure to
		obtain corrective action within 120 days after the date on which that
		allegation is received by the Integrity Committee shall, for purposes of
		section 1221 of such title, be considered to satisfy section 1214(a)(3)(B) of
		that title.</text>
							</subparagraph></paragraph><paragraph id="IDb7c390fd6c224d2eb7cf9c16e631d5ed"><enum>(3)</enum><header>Regulations</header><text>The
		Integrity Committee may prescribe any rules or regulations necessary to carry
		out this subsection, subject to such consultation or other requirements as
		might otherwise apply.</text>
						</paragraph></subsection><subsection id="id4D5003349D96470C84D6416342F0F332"><enum>(c)</enum><header>Effective date
		and existing executive orders</header>
						<paragraph id="idE78A6F41192F4109A3BB1762BEC6E8A6"><enum>(1)</enum><header>Council</header><text>Not
		later than 180 days after the date of the enactment of this Act, the Council of
		the Inspectors General on Integrity and Efficiency established under this
		section shall become effective and operational.</text>
						</paragraph><paragraph id="id172C540EC40041F39ED0BB9EFF26EDE9"><enum>(2)</enum><header>Executive
		orders</header><text>Executive Order No. 12805, dated May 11, 1992, and
		Executive Order No. 12933, dated March 21, 1996 (as in effect before the date
		of the enactment of this Act) shall have no force or effect on and after the
		earlier of—</text>
							<subparagraph id="idDF24486136984488B7838F89B52D9135"><enum>(A)</enum><text>the date on which
		the Council of the Inspectors General on Integrity and Efficiency becomes
		effective and operational as determined by the Executive Chairperson of the
		Council; or</text>
							</subparagraph><subparagraph id="id1A901AAD122849558A790D52BC781107"><enum>(B)</enum><text>the last day of
		the 180-day period beginning on the date of enactment of this Act.</text>
							</subparagraph></paragraph></subsection><subsection id="H2220D5012FBC4369A880E7ABACCE9805"><enum>(d)</enum><header>Technical and
		conforming amendments</header>
						<paragraph id="HA7D546D3D07C45CAAB20DE6EEEDC4959"><enum>(1)</enum><header>Inspector
		General Act of 1978</header><text>The Inspector General Act of 1978 (5 U.S.C.
		App.) is amended—</text>
							<subparagraph id="H655387ADCF1A4C0EB54FD2AC6261D3EE"><enum>(A)</enum><text>in
		sections 2(1), 4(b)(2), and 8G(a)(1)(A) by striking <quote>section
		11(2)</quote> each place it appears and inserting <quote>section 12(2)</quote>;
		and</text>
							</subparagraph><subparagraph id="HD45CBFCAE2E7407B9F72B203BB78059"><enum>(B)</enum><text>in
		section 8G(a), in the matter preceding paragraph (1), by striking
		<quote>section 11</quote> and inserting <quote>section 12</quote>.</text>
							</subparagraph></paragraph><paragraph id="H5BB4A36F107448D0A05B0053991B97BC"><enum>(2)</enum><header>Separate
		appropriations account</header><text><external-xref legal-doc="usc" parsable-cite="usc/31/1105">Section 1105(a)</external-xref> of title 31, United
		States Code, is amended by striking the first paragraph (33) and inserting the
		following:</text>
							<quoted-block display-inline="no-display-inline" id="H6CF8C63C01984113B5FC4F07D1FDF189" style="OLC">
								<paragraph id="HC83B81B27E4C400EAEA58880F8CDA11F"><enum>(33)</enum><text>a
		  separate appropriation account for appropriations for the Council of the
		  Inspectors General on Integrity and Efficiency, and, included in that account,
		  a separate statement of the aggregate amount of appropriations requested for
		  each academy maintained by the Council of the Inspectors General on Integrity
		  and
		  Efficiency.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection></section><section id="id109B932DB3344C97846F599E45136FDE"><enum>8.</enum><header>Submission of
		budget requests to Congress</header><text display-inline="no-display-inline">Section 6 of the Inspector General Act of
		1978 (5 U.S.C. App.) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idCB21F886AE4C46E2810A77EAB20C4FA9" style="OLC">
						<subsection id="ID2d003a20db62490296a39c128efc7e96"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id20B4D987D6D8477C9151A0ABFB9AE9FC"><enum>(1)</enum><text>For each fiscal year,
		  an Inspector General shall transmit a budget estimate and request to the head
		  of the establishment or designated Federal entity to which the Inspector
		  General reports. The budget request shall specify the aggregate amount of funds
		  requested for such fiscal year for the operations of that Inspector General and
		  shall specify the amount requested for all training needs, including a
		  certification from the Inspector General that the amount requested satisfies
		  all training requirements for the Inspector General’s office for that fiscal
		  year, and any resources necessary to support the Council of the Inspectors
		  General on Integrity and Efficiency. Resources necessary to support the Council
		  of the Inspectors General on Integrity and Efficiency shall be specifically
		  identified and justified in the budget request.</text>
							</paragraph><paragraph id="IDe86feaec86e64b338ea672b921e1ec48" indent="up1"><enum>(2)</enum><text>In transmitting a proposed budget to
		  the President for approval, the head of each establishment or designated
		  Federal entity shall include—</text>
								<subparagraph id="ID5d680440ceb04671b2ad82dee44cdf81"><enum>(A)</enum><text>an aggregate request for the Inspector
		  General;</text>
								</subparagraph><subparagraph id="ID51835e03f8184b7092de612fa9d8a125"><enum>(B)</enum><text>amounts for Inspector General
		  training;</text>
								</subparagraph><subparagraph id="ID7e1681f6f19b41d6bb21c7ae3d185c1a"><enum>(C)</enum><text>amounts for support of the Council of
		  the Inspectors General on Integrity and Efficiency; and</text>
								</subparagraph><subparagraph id="ID57fe14c748204fdea5d6b7438a5434a6"><enum>(D)</enum><text>any comments of the affected Inspector
		  General with respect to the proposal.</text>
								</subparagraph></paragraph><paragraph id="ID811581373e3d49d185f3b7423fb684d1" indent="up1"><enum>(3)</enum><text>The President shall include in each
		  budget of the United States Government submitted to Congress—</text>
								<subparagraph id="IDd43cf7cce60847b88d6ee69988000a71"><enum>(A)</enum><text>a separate statement of the budget
		  estimate prepared in accordance with paragraph (1);</text>
								</subparagraph><subparagraph id="id1F27D3127B55481FB2BDBACF4E53BE09"><enum>(B)</enum><text>the amount requested by the President
		  for each Inspector General;</text>
								</subparagraph><subparagraph id="IDc58b8cf5fc2349b491881242587a57c2"><enum>(C)</enum><text><added-phrase reported-display-style="italic"></added-phrase>the amount requested by the
		  President for<added-phrase reported-display-style="italic"></added-phrase>
		  training of Inspectors General;</text>
								</subparagraph><subparagraph id="ID1fa6ee06ff5a4b2590004dfaa42276aa"><enum>(D)</enum><text><added-phrase reported-display-style="italic"></added-phrase>the amount requested by the
		  President for<added-phrase reported-display-style="italic"></added-phrase>
		  support for the Council of the Inspectors General on Integrity and Efficiency;
		  and</text>
								</subparagraph><subparagraph id="idDADE515F44E34565A22814C53A6B8011"><enum>(E)</enum><text>any comments of the affected Inspector
		  General with respect to the proposal if the Inspector General concludes that
		  the budget submitted by the President would substantially inhibit the Inspector
		  General from performing the duties of the
		  office.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="id2B946085EB0845038A614458DB3A1004"><enum>9.</enum><header>Subpoena
		power</header><text display-inline="no-display-inline">Section 6(a)(4) of the
		Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text>
					<paragraph id="H10B8B256E2AA4166A44EB43FF9BDC857"><enum>(1)</enum><text>by
		inserting <quote>in any medium (including electronically stored information, as
		well as any tangible thing)</quote> after <quote>other data</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE72C7E6B860648F6940135499F2536A6"><enum>(2)</enum><text>by striking
		<quote>subpena</quote> and inserting <quote>subpoena</quote>.</text>
					</paragraph></section><section id="H9F8F3A8C344C480B9F983E24FBE4BE06"><enum>10.</enum><header>Program Fraud
		Civil Remedies Act</header><text display-inline="no-display-inline">Section
		3801(a)(1) of title 31, United States Code, is amended—</text>
					<paragraph id="id7C3DA83FF82D48358862FB7CD1043FD9"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
		<quote>and</quote> after the semicolon;</text>
					</paragraph><paragraph id="idF264BA2E51DB48898616F49959E191BA"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (E), by striking the period
		and inserting <quote>; and</quote>; and</text>
					</paragraph><paragraph id="idA79FE2D38656425E9F2EC048CE7B9A74"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H06CA8DAB0AAF4D8488DA9C607E1DE5BC" style="OLC">
							<subparagraph id="H14F199F25295477496D640B6885ADF2"><enum>(F)</enum><text>a
		  designated Federal entity (as such term is defined under section 8G(a)(2) of
		  the Inspector General Act of
		  1978);</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H8B761063EFB44F14B9F6C40438ADE5FD"><enum>11.</enum><header>Law
		enforcement authority for designated Federal entities</header><text display-inline="no-display-inline">Section 6(e) of the Inspector General Act of
		1978 (5 U.S.C. App.) is amended—</text>
					<paragraph id="HD46C375B1C2C4E71A84584F7F0EB644D"><enum>(1)</enum><text>in
		paragraph (1) by striking <quote>appointed under section 3</quote>; and</text>
					</paragraph><paragraph id="H2A4379257AE44AAA8DCD85E13648AAC8"><enum>(2)</enum><text>by
		adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H954E190AD8D64A63AA668CD4DCE6F68D" style="OLC">
							<paragraph id="H9D8AD9E4E33344A89D948974AC084B17" indent="up1"><enum>(9)</enum><text>In this subsection, the term
		  <term>Inspector General</term> means an Inspector General appointed under
		  section 3 or an Inspector General appointed under section

		semiannual reporting requirements with respect to inspection reports and
		evaluation reports</header><text display-inline="no-display-inline">Section 5
		of the Inspector General Act of 1978 (5 U.S.C. App.) is amended—</text>
					<paragraph id="HEA9A05A095E247BFA4957367F4AC3427"><enum>(1)</enum><text>in
		each of subsections (a)(6), (a)(8), (a)(9), (b)(2), and (b)(3)—</text>
						<subparagraph id="HB93F66785B99498887F012E6FCDDE5DA"><enum>(A)</enum><text>by
		inserting <quote>, inspection reports, and evaluation reports</quote> after
		<quote>audit reports</quote> the first place it appears; and</text>
						</subparagraph><subparagraph id="H3096F9272ABF4E418797F6ABB8BD69D4"><enum>(B)</enum><text>by
		striking <quote>audit</quote> the second place it appears; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6EA2190618744092B9F2DF87F06EEDC4"><enum>(2)</enum><text>in subsection
		(a)(10) by inserting <quote>, inspection reports, and evaluation
		reports</quote> after <quote>audit reports</quote>.</text>
					</paragraph></section><section id="id3DA28F05675D4337B5CD0E63E33365FE"><enum>13.</enum><header>Information on
		websites of Offices of Inspectors General</header>
					<subsection id="id5CB4B36AE0064208953097FF3931460B"><enum>(a)</enum><header>In
		General</header><text>The Inspector General Act of 1978 (5 U.S.C. App.) is
		amended by inserting after section 8K the following:</text>
						<quoted-block display-inline="no-display-inline" id="id50A6BF24B22F42D6B0387C1BB68D70B3" style="OLC">
							<section id="id3DD4D1174DE74C619D4308141FC1CC48"><enum>8L.</enum><header>Information on
		  websites of Offices of Inspectors General</header>
								<subsection id="idDFF60A1808A04DE19CEFCC1A4530C1C4"><enum>(a)</enum><header>Direct links to
		  Inspectors General Offices</header>
									<paragraph id="idF9CEF5CC5E4847058D52A7BAB5D58F80"><enum>(1)</enum><header>In
		  general</header><text>Each agency shall establish and maintain on the homepage
		  of the website of that agency, a direct link to the website of the Office of
		  the Inspector General of that agency.</text>
									</paragraph><paragraph id="id0FB788C4C04A4DB48653BB07F11834F5"><enum>(2)</enum><header>Accessibility</header><text>The
		  direct link under paragraph (1) shall be obvious and facilitate accessibility
		  to the website of the Office of the Inspector General.</text>
									</paragraph></subsection><subsection id="id378CA39BBAE445458F1D0CDF0CB4EEE5"><enum>(b)</enum><header>Requirements
		  for Inspectors General websites</header>
									<paragraph id="id27CAD1417C0F4F32AB0463BF74D59CD8"><enum>(1)</enum><header>Posting of
		  reports and audits</header><text>The Inspector General of each agency
		  shall—</text>
										<subparagraph id="id032C730A2082471688993F67C6748253"><enum>(A)</enum><text>not later than 3
		  days after any report or audit (or portion of any report or audit) is made
		  publicly available, post that report or audit (or portion of that report or
		  audit) on the website of the Office of Inspector General; and</text>
										</subparagraph><subparagraph id="idE169ADE5CB834A45995957D067E874C8"><enum>(B)</enum><text>ensure that any
		  posted report or audit (or portion of that report or audit) described under
		  subparagraph (A)—</text>
											<clause id="id9489B281961D487CA46975223B8A67CC"><enum>(i)</enum><text>is
		  easily accessible from a direct link on the homepage of the website of the
		  Office of the Inspector General;</text>
											</clause><clause id="id6BA8375394644B70A6CC18FB02012EFD"><enum>(ii)</enum><text>includes a
		  summary of the findings of the Inspector General; and</text>
											</clause><clause id="id9873397A0C784C309927138218F500C3"><enum>(iii)</enum><text>is
		  in a format that—</text>
												<subclause id="id08998F1919A74668A49537F1D036DA59"><enum>(I)</enum><text>is
		  searchable and downloadable; and</text>
												</subclause><subclause id="idFDCD124F39B14C269167EC13BAEC8B2E"><enum>(II)</enum><text>facilitates
		  printing by individuals of the public accessing the website.</text>
												</subclause></clause></subparagraph></paragraph><paragraph id="id625FCE3E609F480D9913230D05CD9D22"><enum>(2)</enum><header>Reporting of
		  fraud, waste, and abuse</header>
										<subparagraph id="id6A2A374362804E4ABCF37E560BD5220B"><enum>(A)</enum><header>In
		  general</header><text>The Inspector General of each agency shall establish and
		  maintain a direct link on the homepage of the website of the Office of the
		  Inspector General for individuals to report fraud, waste, and abuse.
		  Individuals reporting fraud, waste, or abuse using the direct link established
		  under this paragraph shall not be required to provide personally identifying
		  information relating to that individual.</text>
										</subparagraph><subparagraph id="id9DB0B480D5D446639BD66A3B2633DE1C"><enum>(B)</enum><header>Anonymity</header><text>The
		  Inspector General of each agency shall not disclose the identity of any
		  individual making a report under this paragraph without the consent of the
		  individual unless the Inspector General determines that such a disclosure is
		  unavoidable during the course of the
		  investigation.</text>
										</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="IDeede4f6e11ba4ec7a46729b616c4f69a"><enum>(b)</enum><header>Repeal</header><text>Section
		746(b) of the Financial Services and General Government Appropriations Act,
		2008 (5 U.S.C. App. note; 121 Stat. 2034) is repealed.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id4E6005A90EC14A54999D25C136DB138B"><enum>(c)</enum><header>Implementation</header><text>Not
		later than 180 days after the date of enactment of this Act, the head of each
		agency and the Inspector General of each agency shall implement the amendment
		made by this section.</text>
					</subsection></section><section id="ID5327eeacf7f64d1c9f7b7330bd2fd4a4"><enum>14.</enum><header>Other
		administrative authorities</header>
					<subsection id="ID4eed7a45930843959ae689aef8c2a578"><enum>(a)</enum><header>In
		general</header><text>Section 6(d) of the Inspector General Act of 1978 (5
		U.S.C. App.) is amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id94DB1E1926D54EEE861E173B1C15042B" style="OLC">
							<subsection id="ID0bb03ded2721440fbaa14d736bb5ffbc"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id54557F635711419189AD400111E06086"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idBA24934768824D7B8C7AB7ABBCBF51E6"><enum>(A)</enum><text>For purposes of
		  applying the provisions of law identified in subparagraph (B)—</text>
										<clause id="IDc0e74c84352e4111b44ca23b00ecf84a" indent="up2"><enum>(i)</enum><text>each Office of Inspector General shall
		  be considered to be a separate agency; and</text>
										</clause><clause id="IDb6b456c3e60544089f0a7f918440bfcb" indent="up2"><enum>(ii)</enum><text>the Inspector General who is the head
		  of an office referred to in clause (i) shall, with respect to such office, have
		  the functions, powers, and duties of an agency head or appointing authority
		  under such provisions.</text>
										</clause></subparagraph><subparagraph id="IDd68be901701a4043912e1c0c232a9400" indent="up2"><enum>(B)</enum><text>This paragraph applies with respect
		  to the following provisions of title 5, United States Code:</text>

		service employees</header><text>Section 8D(k)(1)(C) of the Inspector General
		Act of 1978 (5 U.S.C. App.) is amended by striking <quote>physical
		security</quote> and inserting <quote>protection to the Commissioner of
		Internal Revenue</quote>.</text>
