<legis-type>AN ACT</legis-type> 
<official-title display="yes">To provide for the investigation of certain unsolved civil rights crimes, and for other purposes.</official-title> 
</form> 
<legis-body display-enacting-clause="yes-display-enacting-clause" id="H23EAC8452A534FF3B026DC84555B344D" style="OLC"> 
<section display-inline="no-display-inline" id="H01E02CE580AB425EA3E129593FA481C7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Emmett Till Unsolved Civil Rights Crime Act of 2007</short-title></quote>.</text> </section>
<section id="H4E604D3A995A4E34BBD075D93716F8CB"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that all authorities with jurisdiction, including the Federal Bureau of Investigation and other entities within the Department of Justice, should—</text> 
<paragraph id="H96C00C01F0AA43219F76CDF38F2E9635"><enum>(1)</enum><text>expeditiously investigate unsolved civil rights murders, due to the amount of time that has passed since the murders and the age of potential witnesses; and</text> </paragraph>
<paragraph id="HA6360682428C46F3A68653B9FB1EF82"><enum>(2)</enum><text>provide all the resources necessary to ensure timely and thorough investigations in the cases involved.</text> </paragraph></section>
<section commented="no" id="HA8CCBF69F6964E5A8764059F5034AF12"><enum>3.</enum><header>Deputy Chief of the Criminal Section of the Civil Rights Division</header> 
<subsection commented="no" id="HEB7304233D114537B7122374A100A886"><enum>(a)</enum><header>In General</header><text>The Attorney General shall designate a Deputy Chief in the Criminal Section of the Civil Rights Division of the Department of Justice.</text> </subsection>
<subsection commented="no" id="H4709AC830854438FB69BE3AB95F4B3B4"><enum>(b)</enum><header>Responsibility</header> 
<paragraph commented="no" id="HD7CBF4CF3800493285D2A430B445001E"><enum>(1)</enum><header>In general</header><text>The Deputy Chief shall be responsible for coordinating the investigation and prosecution of violations of criminal civil rights statutes that occurred not later than December 31, 1969, and resulted in a death.</text> </paragraph>
<paragraph commented="no" id="H7D267F20053D40F900F82F19188B9BD8"><enum>(2)</enum><header>Coordination</header><text>In investigating a complaint under paragraph (1), the Deputy Chief may coordinate investigative activities with State and local law enforcement officials.</text> </paragraph></subsection>
<subsection commented="no" id="H4287979A51E04AA3836657A599CC8AD"><enum>(c)</enum><header>Study and Report</header> 
<paragraph commented="no" id="HBEEF8787B97F4B3F9F30871121CCA000"><enum>(1)</enum><header>Study</header><text>The Attorney General shall annually conduct a study of the cases under the jurisdiction of the Deputy Chief or under the jurisdiction of the Supervisory Special Agent and, in conducting the study, shall determine—</text> 
<subparagraph id="H7E7DA525FB6C49B19000EB9600317124"><enum>(A)</enum><text>the number of open investigations within the Department for violations of criminal civil rights statutes that occurred not later than December 31, 1969;</text> </subparagraph>
<subparagraph id="HB17ADAD1DBED4FB5B3A57DD5F0FC91C6"><enum>(B)</enum><text>the number of new cases opened pursuant to this Act since the previous year’s study;</text> </subparagraph>
<subparagraph id="H09334DDA7A7E4205A65683DBE0AB3054"><enum>(C)</enum><text>the number of unsealed Federal cases charged within the study period, including the case names, the jurisdiction in which the charges were brought, and the date the charges were filed;</text> </subparagraph>
<subparagraph id="H0FF98B11628B47E4B62FDD6C1F17A2D6"><enum>(D)</enum><text>the number of cases referred by the Department to a State or local law enforcement agency or prosecutor within the study period, the number of such cases that resulted in State charges being filed, the jurisdiction in which such charges were filed, the date the charges were filed, and if a jurisdiction declines to prosecute or participate in an investigation of a case so referred, the fact it did so;</text> </subparagraph>
<subparagraph id="HC8768E215CE0475DB77012B0D98DF523"><enum>(E)</enum><text>the number of cases within the study period that were closed without Federal prosecution, the case names of unsealed Federal cases, the dates the cases were closed, and the relevant federal statutes;</text> </subparagraph>
<subparagraph id="H394EFDAEC4764ED5AC93B28B9C009C46"><enum>(F)</enum><text>the number of attorneys who worked, in whole or in part, on any case described in subsection (b)(1); and</text> </subparagraph>
<subparagraph id="H69392A0343A5451FA6EDF822F6EF1179"><enum>(G)</enum><text>the applications submitted for grants under section 5, the award of such grants, and the purposes for which the grant amount were expended.</text> </subparagraph></paragraph>
<paragraph commented="no" id="H349A1BE0E3704A2EB8E1E28B9CD37F7E"><enum>(2)</enum><header>Report</header><text>Not later than 6 months after the date of enactment of this Act, and each year thereafter, the Attorney General shall prepare and submit to Congress a report containing the results of the study conducted under paragraph (1).</text> </paragraph></subsection></section>
<section id="H9D7BA0A6C2BC47A08CBF6A66EA3949D"><enum>4.</enum><header>Supervisory Special Agent in the Civil Rights Unit of the Federal Bureau of Investigation</header> 
<subsection id="H4710488AA0B348E0B89D7868B9008592"><enum>(a)</enum><header>In General</header><text>The Attorney General shall designate a Supervisory Special Agent in the Civil Rights Unit of the Federal Bureau of Investigation of the Department of Justice.</text> </subsection>
<subsection id="HC65E2020B9F94CC1BA413C26452661F"><enum>(b)</enum><header>Responsibility</header> 
<paragraph id="H935EC0B294BC4E3FAA50A011580710E6"><enum>(1)</enum><header>In general</header><text>The Supervisory Special Agent shall be responsible for investigating violations of criminal civil rights statutes that occurred not later than December 31, 1969, and resulted in a death.</text> </paragraph>
<paragraph id="HFDDF88372DBA462B9EEC916DAE721EC1"><enum>(2)</enum><header>Coordination</header><text>In investigating a complaint under paragraph (1), the Supervisory Special Agent may coordinate the investigative activities with State and local law enforcement officials.</text> </paragraph></subsection></section>
<section id="HC94A306E995641979F906BD79953D9A3"><enum>5.</enum><header>Grants to State and local law enforcement</header> 
<subsection id="HBDE1346B7142401D00B34000CD53F706"><enum>(a)</enum><header>In general</header><text>The Attorney General may award grants to State or local law enforcement agencies for expenses associated with the investigation and prosecution by them of criminal offenses, involving civil rights, that occurred not later than December 31, 1969, and resulted in a death.</text> </subsection>
<subsection id="H31098D881572410C8B8205D9BC45CC4"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $2,000,000 for each of the fiscal years 2008 through 2017 to carry out this section.</text> </subsection></section>
<section commented="no" display-inline="no-display-inline" id="H62ABB2D3C5C647ADB27C1D47A0F4D04E"><enum>6.</enum><header>Authorization of appropriations</header> 
<subsection id="HAD9B8A3AD578449D8D560368EFE05D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated, in addition to any other amounts otherwise authorized to be appropriated for this purpose, to the Attorney General $10,000,000 for each of the fiscal years 2008 through 2017 for the purpose of investigating and prosecuting violations of criminal civil rights statutes that occurred not later than December 31, 1969, and resulted in a death. These funds shall be allocated by the Attorney General to the Deputy Chief of the Criminal Section of the Civil Rights Division and the Supervisory Special Agent of the Civil Rights Unit of the Federal Bureau of Investigation in order to advance the purposes set forth in this Act.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HA3D6D14FA8734722BB9B1F58A1FFB3B"><enum>(b)</enum><header>Community Relations Service of the Department of Justice</header><text display-inline="yes-display-inline">In addition to any amounts authorized to be appropriated under title XI of the <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2000h">42 U.S.C. 2000h et seq.</external-xref>), there are authorized to be appropriated to the Community Relations Service of the Department of Justice $1,500,000 for fiscal year 2008 and each subsequent fiscal year, to enable the Service (in carrying out the functions described in title X of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2000g">42 U.S.C. 2000g et seq.</external-xref>)) to provide technical assistance by bringing together law enforcement agencies and communities in the investigation of violations of criminal civil rights statutes, in cases described in section 4(b).</text> </subsection></section>
<section id="HB2474521D4554BF99CE9462C0554159F"><enum>7.</enum><header>Definition of <quote>criminal civil rights statutes</quote></header><text display-inline="no-display-inline">In this Act, the term <term>criminal civil rights statutes</term> means—</text> 
<paragraph id="HC879235C2B004CA193277B15BF4777CD"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/241">section 241</external-xref> of title 18, United States Code (relating to conspiracy against rights);</text> </paragraph>
<paragraph id="H21DE1C13E73F4B50BAF13F0066EB5B3E"><enum>(2)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/242">section 242</external-xref> of title 18, United States Code (relating to deprivation of rights under color of law);</text> </paragraph>
<paragraph id="HA08E78E2B3DC400AA1CC57A68B3B6838"><enum>(3)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/18/245">section 245</external-xref> of title 18, United States Code (relating to federally protected activities);</text> </paragraph>
<paragraph id="H622974A098304220B29BDDD3EB7F83C5"><enum>(4)</enum><text>sections 1581 and 1584 of title 18, United States Code (relating to involuntary servitude and peonage);</text> </paragraph>
<paragraph id="H38F8F327FF874AD5B6B551726845B5A0"><enum>(5)</enum><text>section 901 of the <act-name parsable-cite="FHA">Fair Housing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3631">42 U.S.C. 3631</external-xref>); and</text> </paragraph>
<paragraph id="HE95E09CF92EC48278000C7F43B3BCB2B"><enum>(6)</enum><text>any other Federal law that—</text> 
<subparagraph id="HC0B5B8ED92AC4FFC8C9327FA3D7EA69"><enum>(A)</enum><text>was in effect on or before December 31, 1969; and</text> </subparagraph>
<subparagraph id="HBA9CAB667F6E4A509724ECD5D8573E84"><enum>(B)</enum><text>the Criminal Section of the Civil Rights Division of the Department of Justice enforced, before the date of enactment of this Act.</text> </subparagraph></paragraph></section>
<section commented="no" display-inline="no-display-inline" id="H1363E4E7021E48F2BE9B89F21529B580"><enum>8.</enum><header>Sunset</header><text display-inline="no-display-inline">Sections 2 through 6 of this Act shall cease to have effect at the end of fiscal year 2017.</text> </section>
<section id="HC8EF47EDD08F4567B77D3B782051511C"><enum>9.</enum><header>Authority of Inspectors General</header><text display-inline="no-display-inline">Title XXXVII of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/5779">42 U.S.C. 5779 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HA2D34A9860624AD1A66202781E7DE79E" style="OLC"> 
<section id="H8EFB2997B4224D6F95462392FB44547C"><enum>3703.</enum><header>Authority of Inspectors General</header> 
<subsection id="H92D695DB19434F539E072F6000E439DE"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An Inspector General appointed under section 3 or 8G of the Inspector General Act of 1978 (5 U.S.C. App.) may authorize staff to assist the National Center for Missing and Exploited Children—</text> 
<paragraph id="H3A0F1F0D38B847B5B0BAEE376F7971C4"><enum>(1)</enum><text>by conducting reviews of inactive case files to develop recommendations for further investigations; and</text> </paragraph>
<paragraph id="H27BD7B38F27147448EB778C84FE1DBAB"><enum>(2)</enum><text>by engaging in similar activities.</text> </paragraph></subsection>
<subsection id="HACB685D5791F429285EEF8C795D53D2C"><enum>(b)</enum><header>Limitations</header> 
<paragraph id="HA3BE884D3F4143ECA71E5206002E2589"><enum>(1)</enum><header>Priority</header><text>An Inspector General may not permit staff to engage in activities described in subsection (a) if such activities will interfere with the duties of the Inspector General under the Inspector General Act of 1978 (5 U.S.C. App.).</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HF19042B310E841C5BD99E471B9A7286F"><enum>(2)</enum><header>Funding</header><text>No additional funds are authorized to be appropriated to carry out this section.</text> </paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </section>
