<section display-inline="no-display-inline" id="HA2373DF7F0D64C2AB2ADF46BD4D5B79F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>John R. Justice Prosecutors and Defenders Incentive Act of 2007</short-title></quote>.</text></section> 
<section id="HE26A11F6781B4AEABB3ECE948B06F79D" section-type="subsequent-section"><enum>2.</enum><header>Loan repayment for prosecutors and defenders</header><text display-inline="no-display-inline">Title I of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3711">42 U.S.C. 3711 et seq.</external-xref>) is amended by adding at the end the following:</text>

<part id="H5F536FF119284345A0A1032632B6EE32"><enum>JJ</enum><header>Loan repayment for prosecutors and public defenders</header> 
<section id="HC0C3FC29014943900091520711B609EF"><enum>3111.</enum><header>Grant authorization</header> 
<subsection id="HEFE88386173644ADB0E992ADC2BD43A1"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to encourage qualified individuals to enter and continue employment as prosecutors and public defenders.</text></subsection> 
<subsection id="H7F391F41472C444AB146DCC5FE623EA"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H802152F1D78E4F1CA0B47EFEC100CDE6"><enum>(1)</enum><header>Prosecutor</header><text>The term <term>prosecutor</term> means a full-time employee of a State or local agency who—</text> 
<subparagraph id="HA1F3A81B30E8459396B7EABB2CC5C4D2"><enum>(A)</enum><text>is continually licensed to practice law; and</text></subparagraph> 
<subparagraph id="HEA367ACE223B4852BE38E30000B202D6"><enum>(B)</enum><text>prosecutes criminal or juvenile delinquency cases (or both) at the State or local level, including an employee who supervises, educates, or trains other persons prosecuting such cases.</text></subparagraph></paragraph> 
<paragraph id="H6648FC80CE0D40A496DED4F2BD9CA3B"><enum>(2)</enum><header>Public defender</header><text>The term <term>public defender</term> means an attorney who—</text> 
<subparagraph id="H0EFAD1C7C1FE4B609225704B6F7996CA"><enum>(A)</enum><text>is continually licensed to practice law; and</text></subparagraph> 
<subparagraph id="H986695E8103646F29CE8998B311F1FFD"><enum>(B)</enum><text>is—</text> 
<clause id="HEE33CDD4D71B4A90945067F76FBAE98E"><enum>(i)</enum><text display-inline="yes-display-inline">a full-time employee of a State or local agency who provides legal representation to indigent persons in criminal or juvenile delinquency cases (or both), including an attorney who supervises, educates, or trains other persons providing such representation;</text></clause> 
<clause id="HCCA8EEA34AC447B98FE382C6046C30C3"><enum>(ii)</enum><text display-inline="yes-display-inline">a full-time employee of a nonprofit organization operating under a contract with a State or unit of local government, who devotes substantially all of such full-time employment to providing legal representation to indigent persons in criminal or juvenile delinquency cases (or both), including an attorney who supervises, educates, or trains other persons providing such representation; or</text></clause> 
<clause id="H24D6C517486745EC8B16C9ABB18D72E8"><enum>(iii)</enum><text display-inline="yes-display-inline">employed as a full-time Federal defender attorney in a defender organization established pursuant to subsection (g) of <external-xref legal-doc="usc" parsable-cite="usc/18/3006A">section 3006A</external-xref> of title 18, United States Code, that provides legal representation to indigent persons in criminal or juvenile delinquency cases (or both).</text></clause></subparagraph></paragraph> 
<paragraph id="HD2D6E6F9FD484845B071C311CCB59B7"><enum>(3)</enum><header>Student loan</header><text>The term <term>student loan</term> means—</text> 
<subparagraph id="H90E6040324EE4223BAD3017F565BB8A3"><enum>(A)</enum><text>a loan made, insured, or guaranteed under part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HB96E80FC0F094926934518F8A71E4A6"><enum>(B)</enum><text>a loan made under part D or E of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1087a">20 U.S.C. 1087a et seq.</external-xref> and 1087aa et seq.); and</text></subparagraph> 
<subparagraph id="H2E35A993B4B2493FA18E002E59348100"><enum>(C)</enum><text>a loan made under section 428C or 455(g) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20 U.S.C. 1078–3 and 1087e(g)) to the extent that such loan was used to repay a Federal Direct Stafford Loan, a Federal Direct Unsubsidized Stafford Loan, or a loan made under section 428 or 428H of such Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H5F8EC338776740F9BB50859123B6CD2B"><enum>(c)</enum><header>Program authorized</header><text>The Attorney General shall, subject to the availability of appropriations, establish a program by which the Department of Justice shall assume the obligation to repay a student loan, by direct payments on behalf of a borrower to the holder of such loan, in accordance with subsection (d), for any borrower who—</text> 
<paragraph id="H1C16306E01754432A35285D4B7F4007B"><enum>(1)</enum><text>is employed as a prosecutor or public defender; and</text></paragraph> 
<paragraph id="H62D30C60641A468D9BA0F6D3F2A537F"><enum>(2)</enum><text>is not in default on a loan for which the borrower seeks forgiveness.</text></paragraph></subsection> 
<subsection id="HF28E3C9FF9AE42F6A6170388BBADD217"><enum>(d)</enum><header>Terms of loan repayment</header> 
<paragraph id="H97C10A91B5754EA78F443DC7B487B606"><enum>(1)</enum><header>Borrower agreement</header><text>To be eligible to receive repayment benefits under <internal-xref idref="H5F8EC338776740F9BB50859123B6CD2B" legis-path="3111.(c)">subsection (c)</internal-xref>, a borrower shall enter into a written agreement with the Attorney General that specifies that—</text> 
<subparagraph id="HE0142F4918A84CD78CA268C2C2A6F7F6"><enum>(A)</enum><text>the borrower will remain employed as a prosecutor or public defender for a required period of service of not less than 3 years, unless involuntarily separated from that employment;</text></subparagraph> 
<subparagraph id="H66B013A9306B4C6E86A515CEE7F4108F"><enum>(B)</enum><text>if the borrower is involuntarily separated from employment on account of misconduct, or voluntarily separates from employment, before the end of the period specified in the agreement, the borrower will repay the Attorney General the amount of any benefits received by such employee under this section; and</text></subparagraph> 
<subparagraph id="H25F6BC6651064771A0E5BDA949623C9"><enum>(C)</enum><text>if the borrower is required to repay an amount to the Attorney General under <internal-xref idref="H66B013A9306B4C6E86A515CEE7F4108F" legis-path="3111.(d)(1)(B)">subparagraph (B)</internal-xref> and fails to repay such amount, a sum equal to that amount shall be recoverable by the Federal Government from the employee (or such employee’s estate, if applicable) by such methods as are provided by law for the recovery of amounts owed to the Federal Government.</text></subparagraph></paragraph> 
<paragraph id="H4C3F7758360F4B1BA9819BAA4170FEC5"><enum>(2)</enum><header>Repayment by borrower</header> 
<subparagraph id="H053C5D250A8148CD80098C10974FB0B9"><enum>(A)</enum><header>In general</header><text>Any amount repaid by, or recovered from, an individual or the estate of an individual under this subsection shall be credited to the appropriation account from which the amount involved was originally paid.</text></subparagraph> 
<subparagraph id="HE06238E9F61A4A91A4FEF3F6C3DD3F"><enum>(B)</enum><header>Merger</header><text>Any amount credited under <internal-xref idref="H053C5D250A8148CD80098C10974FB0B9" legis-path="3111.(d)(2)(A)">subparagraph (A)</internal-xref> shall be merged with other sums in such account and shall be available for the same purposes and period, and subject to the same limitations, if any, as the sums with which the amount was merged.</text></subparagraph> 
<subparagraph id="H63045B3593714C3688C4AC72902D78BC"><enum>(C)</enum><header>Waiver</header><text>The Attorney General may waive, in whole or in part, a right of recovery under this subsection if it is shown that recovery would be against equity and good conscience or against the public interest.</text></subparagraph></paragraph> 
<paragraph id="HF17B04466A62437BB056246477A8DD77"><enum>(3)</enum><header>Limitations</header> 
<subparagraph id="H081E5AFB3CFD431FBA4528059675D134"><enum>(A)</enum><header>Student loan payment amount</header><text display-inline="yes-display-inline">Student loan repayments made by the Attorney General under this section shall be made subject to the availability of appropriations, and subject to such terms, limitations, or conditions as may be mutually agreed upon by the borrower and the Attorney General in an agreement under <internal-xref idref="H97C10A91B5754EA78F443DC7B487B606" legis-path="3111.(d)(1)">paragraph (1)</internal-xref>, except that the amount paid by the Attorney General under this section shall not exceed—</text> 
<clause id="H4CDFD10CFC144455B94D73C8A38CEC06"><enum>(i)</enum><text>$10,000 for any borrower in any calendar year; or</text></clause> 
<clause id="H31A34D0FDE124D90A95C95DE808F90C2"><enum>(ii)</enum><text>an aggregate total of $60,000 in the case of any borrower.</text></clause></subparagraph> 
<subparagraph id="HB32AC6BECB854EE38872104CC4277EDF"><enum>(B)</enum><header>Beginning of payments</header><text>Nothing in this section shall authorize the Attorney General to pay any amount to reimburse a borrower for any repayments made by such borrower prior to the date on which the Attorney General entered into an agreement with the borrower under this subsection.</text></subparagraph></paragraph></subsection> 
<subsection id="HF8B5C016D6E14D21AA29E57EA424CB21"><enum>(e)</enum><header>Additional agreements</header> 
<paragraph id="H2E211290CCAA4F7FB3BFCC3083E51100"><enum>(1)</enum><header>In general</header><text>On completion of the required period of service under an agreement under <internal-xref idref="HF28E3C9FF9AE42F6A6170388BBADD217" legis-path="3111.(d)">subsection (d)</internal-xref>, the borrower and the Attorney General may, subject to <internal-xref idref="H91840B814E6E455DBBD4B6C9D606759B" legis-path="3111.(e)(2)">paragraph (2)</internal-xref>, enter into an additional agreement in accordance with <internal-xref idref="HF28E3C9FF9AE42F6A6170388BBADD217" legis-path="3111.(d)">subsection (d)</internal-xref>.</text></paragraph> 
<paragraph id="H91840B814E6E455DBBD4B6C9D606759B"><enum>(2)</enum><header>Term</header><text>An agreement entered into under <internal-xref idref="H2E211290CCAA4F7FB3BFCC3083E51100" legis-path="3111.(e)(1)">paragraph (1)</internal-xref> may require the borrower to remain employed as a prosecutor or public defender for less than 3 years.</text></paragraph></subsection> 
<subsection id="H6E126B71155C4E86A26B48F666C502AC"><enum>(f)</enum><header>Award basis; priority</header> 
<paragraph id="H37C8EA1B11B548BD87143B004146005F"><enum>(1)</enum><header>Award basis</header><text>The Attorney General shall provide repayment benefits under this section—</text> 
<subparagraph id="H1C72625128054E5191883D45CED020B0"><enum>(A)</enum><text>subject to the availability of appropriations; and</text></subparagraph> 
<subparagraph id="H7353BBA9B601458383247344BE48F781"><enum>(B)</enum><text>in accordance with <internal-xref idref="H4089EA6A4E2B459CBC73006D5B8C36FC" legis-path="3111.(f)(2)">paragraph (2)</internal-xref>, except that the Attorney General shall determine a fair allocation of repayment benefits among prosecutors and defenders, and among employing entities nationwide. </text></subparagraph></paragraph> 
<paragraph id="H4089EA6A4E2B459CBC73006D5B8C36FC"><enum>(2)</enum><header>Priority</header><text>In providing repayment benefits under this section in any fiscal year, the Attorney General shall give priority to borrowers—</text> 
<subparagraph id="H3FAE05BD18164C89AEBCF409CF24F6D"><enum>(A)</enum><text>who, when compared to other eligible borrowers, have the least ability to repay their student loans (considering whether the borrower is the beneficiary of any other student loan repayment program), as determined by the Attorney General; or</text></subparagraph> 
<subparagraph id="HEE93A868DD7341938389254F8FEF125E"><enum>(B)</enum><text>who—</text> 
<clause id="H99FD5C474678427E97E1C3BAF8748C9B"><enum>(i)</enum><text>received repayment benefits under this section during the preceding fiscal year; and</text></clause> 
<clause id="H0E3FA83BC5874A29AEA423698853DAA"><enum>(ii)</enum><text>have completed less than 3 years of the first required period of service specified for the borrower in an agreement entered into under <internal-xref idref="HF28E3C9FF9AE42F6A6170388BBADD217" legis-path="3111.(d)">subsection (d)</internal-xref>.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HB095D0E54F084DAB847D8B1D3C296BD0"><enum>(g)</enum><header>Regulations</header><text>The Attorney General is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</text></subsection> 
<subsection id="H7A37C753E6474E62B700F68813BC14F0" display-inline="no-display-inline"><enum>(h)</enum><header>Report by Inspector General</header><text display-inline="yes-display-inline">Not later than 3 years after the date of the enactment of this section, the Inspector General of the Department of Justice shall submit to Congress a report on—</text> 
<paragraph id="HDE2F6750D1694D819BB126973E5834DD"><enum>(1)</enum><text>the cost of the program authorized under this section; and</text></paragraph> 
<paragraph id="H39B65B9686C941BBBD84389C88461D64"><enum>(2)</enum><text>the impact of such program on the hiring and retention of prosecutors and public defenders.</text></paragraph></subsection> 
<subsection id="H8938A040F4AD4DDAB86D4FF9F2DFD9D5"><enum>(i)</enum><header>GAO Study</header><text>Not later than one year after the date of the enactment of this section, the Comptroller General shall conduct a study of, and report to Congress on, the impact that law school accreditation requirements and other factors have on the costs of law school and student access to law school, including the impact of such requirements on racial and ethnic minorities.</text></subsection> 
<subsection id="HBB098C20A62146C8A94F18EECC006CC7"><enum>(j)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for each of the fiscal years 2008 through 2013.</text></subsection></section></part> <after-quoted-block>.</after-quoted-block></quoted-block></section>
