			<section id="H614873745D664EAF9200C5244823B6D3"><enum>101.</enum><header>Calculation of
			 separation tolled during litigation</header><text display-inline="no-display-inline">Section 233 of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2293">19 U.S.C. 2293</external-xref>) is
			 amended by adding at the end the following:</text>
				<quoted-block act-name="Trade" id="H18D1B9852929430793AC1CBA914D1C68">
					<subsection id="H134AE8905C8F476FB4159C30580700E7"><enum>(h)</enum><header>Special rule for
				calculating separation</header><text>Notwithstanding any other provision of
				this chapter, any period during which a judicial or administrative appeal is
				pending with respect to the denial by the Secretary of a petition under section
				223 shall not be counted for purposes of calculating the period of separation
				under subsection (a)(2), and an adversely affected worker that would otherwise
				be entitled to a trade readjustment allowance shall not be denied such
				allowance because of such
				appeal.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H7405F45133F9471CB9F7009B8688E3B7"><enum>102.</enum><header>Revision of
			 eligibility criteria</header>
				<subsection id="HA5C0333E633A4584979CBE61E7690076"><enum>(a)</enum><header>Downstream
			 workers</header><text>Section 222(c)(3) of the <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 (U.S.C. 2272(c)(3)) is
			 amended by striking <quote>, if the certification of eligibility</quote> and
			 all that follows through the end and inserting a period.</text>
				</subsection><subsection id="H0466A91DBD3C420B8F30C3EC6F00ABAB"><enum>(b)</enum><header>Shifts in
			 production</header><text>Section 222(a)(2)(B) of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 (U.S.C.
			 2272(a)(2)(B)) is amended to read as follows:</text>
					<quoted-block act-name="Trade" id="H5D4FBCF1AE2F4A16B15E84D3371E0292">
						<subparagraph id="H8EF62BFE53B440FABCF327539F004789" indent="up1"><enum>(B)</enum><text>there has been a shift in production
				by such workers’ firm or subdivision to a foreign country of articles like or
				directly competitive with articles which are produced by such firm or
				subdivision.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HD6EAAF41606B4F6992ADE6F6A35D53B0"><enum>103.</enum><header>Health care tax
			 credit</header>
				<subsection commented="no" id="H2EBD96C42D4A4C6A964759E639DD3812"><enum>(a)</enum><header>Removal of
			 training requirement</header><text>Section 35(c)(2) of the Internal Revenue Act
			 of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/35">26 U.S.C. 35(c)(2)</external-xref>) is amended by striking <quote>subsection
			 (a)(3)(B)</quote> and inserting <quote>subsections (a)(3)(B) and
			 (a)(5)</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H78B275135D7B45FBB5A1179141BD7DF1"><enum>(b)</enum><header>Presumptive
			 eligibility for petitioners for trade adjustment assistance</header>
					<paragraph commented="no" id="H9C5DC1E7EED74662A857AB9CF3562236"><enum>(1)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/35">Section 35(c)</external-xref> of the Internal Revenue Code of 1986 is
			 amended by adding at the end the following new paragraph:</text>
						<quoted-block display-inline="no-display-inline" id="HB56CFB5AF20E484A892051A57200BF34" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="HDFE101521AFB41A8BFF3AC15B5D606FE"><enum>(5)</enum><header>Presumptive
				status as a TAA recipient</header><text display-inline="yes-display-inline">The
				term <term>eligible individual</term> shall include any individual who is
				covered by a petition filed with the Secretary of Labor under section 221 of
				the <act-name parsable-cite="TA74">Trade Act of 1974</act-name>. This paragraph
				shall apply to any individual only with respect to months which—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H1C3585BD1F0B4732B4C7936F88B469C5"><enum>(A)</enum><text display-inline="yes-display-inline">end after the date that such petition is so
				filed, and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H59C0031E30C64717A719235B92C1B700"><enum>(B)</enum><text display-inline="yes-display-inline">begin before the earlier of—</text>
									<clause commented="no" display-inline="no-display-inline" id="HBB0CCAD4743941C6BD904B5E2C43C218"><enum>(i)</enum><text display-inline="yes-display-inline">the 90th day after the date of filing of
				such petition, or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="HC795A81D47F74C6CB1002238FA73F496"><enum>(ii)</enum><text display-inline="yes-display-inline">the date on which the Secretary of Labor
				makes a final determination with respect to such
				petition.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HACCFB575662943DBAF43D9EE34DE41D6"><enum>(2)</enum><header>Conforming
			 amendments</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="HC2784A46E3724B759564A9CC9542A02"><enum>(A)</enum><text display-inline="yes-display-inline">Paragraph (1) of section 7527(d) of such
			 Code is amended by striking <quote>or an eligible alternative TAA recipient (as
			 defined in section 35(c)(3))</quote> and inserting <quote>, an eligible
			 alternative TAA recipient (as defined in section 35(c)(3)), or an individual
			 who is an eligible individual by reason of section 35(c)(5)</quote>.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA955EB6EEE7344D5976FA5AF76F1C35D"><enum>(B)</enum><text display-inline="yes-display-inline">Section 173(f)(4) of the Workforce
			 Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2918">29 U.S.C. 2918(f)(4)</external-xref>) is amended—</text>
							<clause commented="no" display-inline="no-display-inline" id="HA86CEEE164B14100BAEA78B8EDCF32CD"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>and</quote> at the end;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3E7C87A9FEAB49B4A8870040C9C1F41B"><enum>(ii)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period
			 and inserting <quote>, and</quote> ; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="H3C4D077E4C264110B105F35BB1F75713"><enum>(iii)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (C), the
			 following new subparagraph:</text>
								<quoted-block display-inline="no-display-inline" id="H5DC0FBAFDD9B44C3966D24BBF1FEA8ED" style="OLC">
									<subparagraph commented="no" display-inline="no-display-inline" id="H0368115053C24DE897339866B7FEF64F"><enum>(D)</enum><text display-inline="yes-display-inline">an individual who is an eligible individual
				by reason of section 35(c)(5) of the Internal Revenue Code of
				1986.</text>
									</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" id="HB90D9A4658A449BCAB64A997579F2004"><enum>(c)</enum><header>Clarification of
			 3-month creditable coverage requirement</header>
					<paragraph commented="no" id="HD2F6E4713D2344F8A044B23DDBA151E1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Clause (i) of section
			 35(e)(2)(B) of the Internal Revenue Code of 1986 is amended by inserting
			 <quote>(prior to the employment separation necessary to attain the status of an
			 eligible individual)</quote> after <quote>9801(c)</quote>.</text>
					</paragraph><paragraph commented="no" id="HCDE1AB91405D49528CB8D05EAF2432BD"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 173(f)(2)(B)(ii)(I) of the Workforce Investment
			 Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2918">29 U.S.C. 2918(f)(2)(B)(ii)(I)</external-xref>) is amended by inserting
			 <quote>(prior to the employment separation necessary to attain the status of an
			 eligible individual)</quote> after <quote>1986</quote>.</text>
					</paragraph></subsection><subsection commented="no" id="HBB448AAB11F449D8BD1CDC7FE668AC83"><enum>(d)</enum><header>Increase in tax
			 credit</header><text display-inline="yes-display-inline">Section 35(a) of the
			 Internal Revenue Code of 1986 is amended by striking <quote>65 percent</quote>
			 and inserting <quote>75 percent</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HC87A9C921546491F9EFF7CBF05EC2731"><enum>(e)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to months beginning after the date of the enactment of
			 this Act in taxable years ending after that date.</text>
				</subsection></section><section id="HEDB9CFBFDEA440CAA97E6CA8FE71154"><enum>104.</enum><header>Alternative
			 trade adjustment assistance</header>
				<subsection id="H7F207DF537634CEFB1ADE9FD1800004F"><enum>(a)</enum><header>Eligibility of
			 all workers; lower age requirement</header><text>Section 246(a)(3) of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C.
			 2318(a)(3)) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H09AA5BA389A949A0A1248D3F463BE3DD" style="OLC">
						<paragraph id="H333B9817767344C8B047A8DA9FA3DE57"><enum>(3)</enum><header>Eligibility</header><text>A
				worker in a group that the Secretary has certified as eligible to apply for
				adjustment assistance under section 223 may elect to receive benefits under the
				alternative trade adjustment assistance program if the worker—</text>
							<subparagraph id="HF3F39B5938BD4BB59285628990677200"><enum>(A)</enum><text>obtains
				reemployment not more than 26 weeks after the date of separation from the
				adversely affected employment;</text>
							</subparagraph><subparagraph id="H2112107E8DE543C7B189C8D075CD166"><enum>(B)</enum><text>is at least 40
				years of age;</text>
							</subparagraph><subparagraph id="H7BC6746EE84B45F4B53E656767D572E4"><enum>(C)</enum><text>earns not more
				than $50,000 a year in wages from reemployment;</text>
							</subparagraph><subparagraph id="H3C700D9B54AE4862BF6FEC136FBFDE0"><enum>(D)</enum><text>is employed on a
				full-time basis as defined by State law in the State in which the worker is
				employed; and</text>
							</subparagraph><subparagraph id="H850B8129C05940949CA38C13A68316D5"><enum>(E)</enum><text>does not return to
				the employment from which the worker was
				separated.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H3F4E7FA24C7A4B84B8920044747BCFD4"><enum>(b)</enum><header>Conforming
			 amendments</header>
					<paragraph id="H67B61F8D98D5455C986E17FCD171F131"><enum>(1)</enum><text>Subparagraphs (A)
			 and (B) of section 246(a)(2) of the <act-name parsable-cite="TA74">Trade Act of
			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/19/2318">19 U.S.C. 2318(a)(2)</external-xref>) are amended by striking <quote>paragraph
			 (3)(B)</quote> and inserting <quote>paragraph (3)</quote> each place it
			 appears.</text>
					</paragraph><paragraph id="H601B1D2B770E49D493974DD2F1A6B5C6"><enum>(2)</enum><text>Section 246(b)(2)
			 of that Act is amended by striking <quote>subsection (a)(3)(B)</quote> and
			 inserting <quote>subsection (a)(3)</quote>.</text>
					</paragraph><paragraph id="H931BC43DC85645C4AF9602DC68B06245"><enum>(3)</enum><text>Section
			 35(c)(3)(A) of the Internal Revenue Code of 1986 is amended by striking
			 <quote>246(a)(3)(B)</quote> and inserting <quote>246(a)(3)</quote>.</text>
					</paragraph></subsection></section><section id="H123C7B4980B843459CD24C009D629C8F"><enum>105.</enum><header>Training
			 funds</header>
				<subsection id="H718D02D38DA74AD2A1E33FDCF2D4C950"><enum>(a)</enum><header>Funding for
			 training</header><text>Section 236(a) of the Trade Act of 1974 (19 U.S.C.
			 2296(a)) is amended—</text>
					<paragraph id="H0BB1D4A35BCB40F6B9E7D07BC1277E78"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>Upon such approval</quote> and all that follows to the end;
			 and</text>
					</paragraph><paragraph id="HBA722D2AE80040E898A99F650110A9EC"><enum>(2)</enum><text>by amending
			 paragraph (2) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="HFB815BF7D1C2475493596CFA37009980" style="OLC">
							<paragraph id="H0A7E7E29CAB44246A462BF44F91DE669"><enum>(2)(A)</enum><text>Upon approval
				of a training program under paragraph (l), and subject to the limitations
				imposed by this section, an adversely affected worker covered by a
				certification issued under section 223 shall be eligible to have payment of the
				costs of that training, including any costs of an approved training program
				incurred by a worker before a certification was issued under section 223, made
				on behalf of the worker by the Secretary directly or through a voucher
				system.</text>
								<subparagraph id="H925C532FD42D4E0DAB642153ACA9126D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than 6 months after the date of
				enactment of the American Competitiveness and Adjustment Act, the Secretary
				shall develop and submit to Congress for approval a formula that provides
				workers with an individual entitlement for training costs to be administered
				pursuant to sections 239 and 240. The formula shall take into account—</text>
									<clause id="HC5A5D4A6E94F431284744D00275C8DE9"><enum>(i)</enum><text>the number of workers enrolled in
				trade adjustment assistance;</text>
									</clause><clause id="H036E7C6C90E84BD999254FEAA0FAAB48"><enum>(ii)</enum><text>the duration of the
				assistance;</text>
									</clause><clause id="HFA775708A0D84F93B4A75748170BE00"><enum>(iii)</enum><text>the anticipated training costs
				for workers; and</text>
									</clause><clause id="H382044131B0F4E1881FF55758800F506"><enum>(iv)</enum><text>any other factors the Secretary
				deems appropriate.</text>
									</clause></subparagraph><subparagraph id="HC3FC7DEBB8A84CA784B7D41861949233" indent="up1"><enum>(C)</enum><text>Until such time as Congress approves
				the formula, the total amount of payments that may be made under subparagraph
				(A) for any fiscal year shall not exceed 50 percent of the amount of trade
				readjustment allowances paid to workers during that fiscal
				year.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection display-inline="no-display-inline" id="HCFA5319541F1472700568121E4D53FA6"><enum>(b)</enum><header>Modification of
			 enrollment deadlines</header><text>Section 231(a)(5)(A)(ii) of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C.
			 2291(a)(5)(A)(ii)) is amended—</text>
					<paragraph id="H5DA33D1ACFF04D80B13155D5DDC8F60"><enum>(1)</enum><text>in
			 subclause (I), by striking <quote>16th week</quote> and inserting <quote>32nd

			 evaluations</header><text>Subchapter C of chapter 2 of title II of the
			 <act-name parsable-cite="TA74">Trade Act of 1974</act-name> is amended by
			 inserting after section 249 the following new section:</text>

				evaluations</header><text>The Secretary shall establish an effective
				performance measuring system to evaluate the following:</text>

				performance</header><text>A comparison of the trade adjustment assistance
				program before and after the effective date of the Trade Adjustment Assistance
				Reform Act of 2002 with respect to—</text>

				workers certified and the number of workers actually participating in the trade
				adjustment assistance program;</text>
									</subparagraph><subparagraph id="HEEBD71BEB7474501BA2311AF658C3B77"><enum>(B)</enum><text>the time for
				processing petitions;</text>
									</subparagraph><subparagraph id="HD4058FD70EDF49EFBC852EF97B5117FF"><enum>(C)</enum><text>the number of
				training waivers granted;</text>
									</subparagraph><subparagraph id="HCEAC1039823E4572BE956C4CFB569BE3"><enum>(D)</enum><text>the coordination
				of programs under this chapter with programs under the Workforce Investment Act
				of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801 et seq.</external-xref>);</text>
									</subparagraph><subparagraph id="H342F071006CD47C5B071286DC0B5FC12"><enum>(E)</enum><text>the effectiveness
				of individual training providers in providing appropriate information and
				training;</text>
									</subparagraph><subparagraph id="H9E01F53D21BB48DDAAF75766DA78AD7C"><enum>(F)</enum><text>the extent to
				which States have designed and implemented health care coverage options under
				title II of the Trade Act of 2002, including any difficulties States have
				encountered in carrying out the provisions of title II;</text>
									</subparagraph><subparagraph id="H387F113224074B29BD4CC91F6666B7F8"><enum>(G)</enum><text>how Federal,
				State, and local officials are implementing the trade adjustment assistance
				program to ensure that all eligible individuals receive benefits, including
				providing outreach, rapid response, and other activities; and</text>
									</subparagraph><subparagraph id="H3AFA8EB8D37C4B47871F52158468C5A6"><enum>(H)</enum><text>any other data
				necessary to evaluate how individual States are implementing the requirements
				of this chapter.</text>
									</subparagraph></paragraph><paragraph id="H67913CDA010A47088F6CAF8EBC6B5E20"><enum>(2)</enum><header>Program
				participation</header><text>The effectiveness of the program relating
				to—</text>
									<subparagraph id="HC36F6C0F16AF4136AE32E9D3DCF1052D"><enum>(A)</enum><text>the number of
				workers receiving benefits and the type of benefits being received both before
				and after the effective date of the Trade Adjustment Assistance Reform Act of
				2002;</text>
									</subparagraph><subparagraph id="H4E8B8AA5639642ACBEAEC9182337008F"><enum>(B)</enum><text>the number of
				workers enrolled in, and the duration of, training by major types of training
				both before and after the effective date of the Trade Adjustment Assistance
				Reform Act of 2002;</text>
									</subparagraph><subparagraph id="HECDAD89F63C14F6E803675728317E02"><enum>(C)</enum><text>earnings history of
				workers that reflects wages before separation and wages in any job obtained
				after receiving benefits under this Act;</text>
									</subparagraph><subparagraph id="H4EA86E6801C74C0B84C6275D586750CD"><enum>(D)</enum><text>reemployment rates
				and sectors in which dislocated workers have been employed;</text>
									</subparagraph><subparagraph id="H0873F88E81E643AE9DE376AD9D6FF00"><enum>(E)</enum><text>the cause of
				dislocation identified in each petition that resulted in a certification under
				this chapter; and</text>
									</subparagraph><subparagraph id="HC38F40F93A0E4FCA82C1E6F693D728C9"><enum>(F)</enum><text>the number of
				petitions filed and workers certified in each congressional district of the
				United States.</text>
									</subparagraph></paragraph></subsection><subsection id="HF523ED8BDFDA494485E600ED746424D5"><enum>(c)</enum><header>State
				participation</header><text>The Secretary shall ensure, to the extent
				practicable, through oversight and effective internal control measures the
				following:</text>
								<paragraph id="H2294DCDEE34C420AA11521FA3DE54C"><enum>(1)</enum><header>State
				participation</header><text>Participation by each State in the performance
				measurement system established under subsection (b) and shall provide
				incentives for States to supplement employment and wage data obtained through
				the use of unemployment insurance wage records.</text>
								</paragraph><paragraph id="H1D74DF39F36C4469A583ECD5B6AD335E"><enum>(2)</enum><header>Monitoring</header><text>Monitoring
				by each State of internal control measures with respect to performance
				measurement data collected by each State.</text>
								</paragraph><paragraph id="HAF30B6F0884B4377B043017DDB9E8C42"><enum>(3)</enum><header>Response</header><text>The
				quality and speed of the rapid response provided by each State under section
				134(a)(2)(A) of the Workforce Investment Act of 1998 (29 U.S.C.
				2864(a)(2)(A)).</text>
								</paragraph></subsection><subsection id="H6D3046C3158C47C9B1EBB5AE9EEEE689"><enum>(d)</enum><header>Reports</header>
								<paragraph id="H52FDA634B53E4E5EBB479E6F2F95C916"><enum>(1)</enum><header>Reports by the
				Secretary</header>
									<subparagraph id="H4F6604D708D2425EB0ADAF41D2CD08AC"><enum>(A)</enum><header>Initial
				report</header><text display-inline="yes-display-inline">Not later than 6
				months after the date of enactment of the American Competitiveness and
				Adjustment Act, the Secretary shall submit to the Committee on Finance of the
				Senate and the Committee on Ways and Means of the House of Representatives a
				report that—</text>
										<clause id="H9CFF8A1702DA408A8330AE9F1F470073"><enum>(i)</enum><text>describes the
				performance measurement system established under subsection (b);</text>
										</clause><clause id="HE90206C411204A729D00AD9819933115"><enum>(ii)</enum><text>includes analysis
				of data collected through the system established under subsection (b);
				and</text>
										</clause><clause id="H4A47C060D08B432EA64D50DBFB47907D"><enum>(iii)</enum><text>provides
				recommendations for program improvements.</text>
										</clause></subparagraph><subparagraph id="H661985192F0C440CA156A85FFBC5D234"><enum>(B)</enum><header>Annual
				report</header><text>Not later than 1 year after the date the report is
				submitted under subparagraph (A), and annually thereafter, the Secretary shall
				submit to the Committee on Finance of the Senate and the Committee on Ways and
				Means of the House of Representatives and release to the public a report that
				includes the information collected under clause (ii) of subparagraph
				(A).</text>
									</subparagraph></paragraph><paragraph id="H25097B1F846D47089959872E79E2BF4"><enum>(2)</enum><header>State
				reports</header><text>Pursuant to regulations prescribed by the Secretary, each
				State shall submit to the Secretary a report that details its participation in
				the programs established under this chapter, and that contains the data
				necessary to allow the Secretary to submit the report required under paragraph
				(1).</text>
								</paragraph><paragraph id="H7F76CF1CD55249F59C2C8E841500D19E"><enum>(3)</enum><header>Publication</header><text>The
				Secretary shall make available to each State, to Congress, and to the public,
				the data gathered and evaluated through the performance measurement system

				after, the date on which the Commission made its report to the President under

				totally or partially separated, not more than 1 year before or not more than 1

				term <term>applicable date</term> means—</text>

			 producer had no positive net farm income for the 2 most recent consecutive
			 years in which no adjustment assistance was received by the producer under this
			 chapter</quote>.</text>
				</subsection></section><section id="HA1EEA6DE83584229863775486392F6DE"><enum>503.</enum><header>Petition
			 process</header><text display-inline="no-display-inline">Section 293 of the
			 Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401c">19 U.S.C. 2401c</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HDF0165A2E12D4E0E8CA5AADA2F20600" style="OLC">
					<subsection id="HABA09DA8347C471A96A5972DA213773"><enum>(d)</enum><header>Addition of
				commodity producers to petition</header><text>At any time after a petition is
				filed under section 292 by a group of agricultural commodity producers,
				including after the Secretary issues a certification of eligibility under
				subsection (a) to a group of agricultural producers, any other producer of that
				agricultural commodity may elect to join the group of producers who filed the
				petition. Any producer who makes an election under the preceding sentence is
				eligible for assistance under this chapter to the same extent as the producers
				who filed the petition.</text>
					</subsection><subsection id="H50F2C2DE86764C3D802EF93E1927D8F9"><enum>(e)</enum><header>Amendment of
				petition</header><text display-inline="yes-display-inline">In any case in which
				the Secretary issues a certification of eligibility under subsection (a)
				pursuant to a petition filed under section 292, the group of producers of an
				agricultural commodity to whom the certification applies may thereafter amend
				the petition to modify the countries described in section 292(c)(2) or to
				modify the heading or subheading under which the agricultural commodity is
				classified under the Harmonized Tariff Schedule of the United
				States.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H2014AA5850314BADB379D500AC00CE6B"><enum>504.</enum><header>Amount of cash
			 benefits</header><text display-inline="no-display-inline">Section 296(b)(1) of
			 the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2401e">19 U.S.C. 2401e(b)(1)</external-xref>) is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="HC5F29748E85448279F3465925EEDF700" style="OLC">
					<paragraph id="H6989E619A2D64E58B01E2DD231B6129E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to the
				provisions of section 298, an adversely affected agricultural commodity
				producer described in subsection (a) shall be entitled to adjustment assistance
				under this chapter as follows:</text>
						<subparagraph id="H78B578C27992412D8E56640938A81D5D"><enum>(A)</enum><header>Commodities
				receiving assistance</header>
							<clause id="H668116A7DC5D4485AF715C6600F9A217"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">If the agricultural
				commodity with respect to which the certification under this chapter applies is
				described in clause (ii), the adversely affected agricultural commodity
				producer shall be entitled to adjustment assistance under this chapter in an
				amount equal to the product of—</text>
								<subclause id="H23470EAFB61E4B3DAEED7D5BF44186E2"><enum>(I)</enum><text>one-half of the
				difference between—</text>
									<item id="H9997EBFC9F5D4F09005F1FDC76F06CE9"><enum>(aa)</enum><text>an
				amount equal to 80 percent of the average of the national average price of the
				agricultural commodity covered by the application described in subsection (a)
				for the 5 marketing years preceding the most recent marketing year, and</text>
									</item><item id="H686BA651C95A4ADB901144DC4C295743"><enum>(bb)</enum><text>the
				national average price of the agricultural commodity for the most recent
				marketing year, and</text>
									</item></subclause><subclause id="HCCD461AAF9BA4C5085F236344466CFB2"><enum>(II)</enum><text>the amount of the
				agricultural commodity produced by the agricultural commodity producer in the
				most recent marketing year.</text>
								</subclause></clause><clause id="HC4F381D6008242519F452F949031A854"><enum>(ii)</enum><header>Agricultural
				commodities described</header><text>An agricultural commodity is described in
				this clause if it is—</text>
								<subclause id="HEBC9F71C62D74527914CAE863B76DCD"><enum>(I)</enum><text>a covered commodity
				for purposes of section 1103 or 1104 of the Farm Security and Rural Investment
				Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7913">7 U.S.C. 7913</external-xref>, 7914);</text>
								</subclause><subclause id="HAAF81AB0A6584571A5EB106107102700"><enum>(II)</enum><text>a loan commodity
				for purposes of section 1202 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7932">7 U.S.C. 7932</external-xref>); or</text>
								</subclause><subclause id="H46F92CD5C23A40208D1838AF45B57409"><enum>(III)</enum><text>a product
				eligible for assistance under subtitle C, D, or E of title I of that Act, or
				the amendments made by any such subtitle.</text>
								</subclause></clause></subparagraph><subparagraph display-inline="no-display-inline" id="H2A75B19EFDFA40708D417DCD005ECE27"><enum>(B)</enum><header>Other
				commodities</header><text>If the agricultural commodity with respect to which
				the certification under this chapter applies is not covered under subparagraph
				(A), the adversely affected agricultural commodity producer shall be entitled
				to adjustment assistance under this chapter in an amount equal to the product
				of—</text>
							<clause id="HF638D63B288B411C8C02FEE7A4546C49"><enum>(i)</enum><text>the difference
				between—</text>
								<subclause id="HCCC07516EA37499E8B5FFF646733734B"><enum>(I)</enum><text>an amount equal to
				80 percent of the average of the national average price of the agricultural
				commodity covered by the application described in subsection (a) for the 5
				marketing years preceding the most recent marketing year, and</text>
								</subclause><subclause id="H9DB848DC077F433597BC8666F0D85FA7"><enum>(II)</enum><text>the national
				average price of the agricultural commodity for the most recent marketing year,
				and</text>
								</subclause></clause><clause id="H39C02E59FCCF4273893F198534E18DA4"><enum>(ii)</enum><text>the amount of the
				agricultural commodity produced by the agricultural commodity producer in the
				most recent marketing
				year.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H03254D8168AD4861B91F2FA437EF5EC0"><enum>505.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by

			 the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2341">19 U.S.C. 2341(c)</external-xref>) is amended—</text>
				<paragraph id="HF7D0AF293AD94D538E69F33DFA681010"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(B)(ii) by striking
			 <quote>sales or production, or both, of an article that accounted for not less
			 than 25 percent of the total production or sales of the firm during the
			 12-month period preceding the most recent 12-month period for which data are
			 available have decreased absolutely</quote> and inserting <quote>average
			 monthly sales or production, or both, during the 60-month period preceding the
			 most recent 12-month period for which data are available, of an article that
			 accounted, during such 60-month period, for not less than 25 percent of the
			 total production or sales of the firm, have decreased absolutely</quote>;</text>

			 paragraph (1)(C)—</text>

				months after such date of enactment, the Secretary of Commerce shall, in
				consultation with the Secretary of Labor, conduct a study and report to the
				Congress on ways to improve the timeliness and coverage of data on trade in
				services, including methods to identify increased imports due to the relocation
				of United States firms to foreign countries, and increased imports due to
				United States firms obtaining services from firms in foreign
				countries.</text>

				</paragraph></section><section id="H043B8CA4228E417392CE170022515C7C"><enum>704.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">Except as provided in
			 subsection (b), the amendments made by this title shall take effect on the date
			 that is 60 days after the date of the enactment of this Act.</text>
