		  reduce human exposure to mercury through vaccines.</official-title>

		<section display-inline="no-display-inline" id="H6A4C73C17D5C405BB20067B42BA4E08" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mercury-Free Vaccines Act of
			 2007</short-title></quote>.</text>
		</section><section id="HE3C18F40B9A84ED7961875BD9396F3C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="HB5075F7CD4B04933973089234D1D2E00"><enum>(1)</enum><text>In July 1999, the
			 Public Health Service and the American Academy of Pediatrics issued a joint
			 statement, which was later endorsed by the American Academy of Family
			 Physicians, proclaiming: <quote>[The] Public Health Service, the American
			 Academy of Pediatrics, and vaccine manufacturers agree that
			 thimerosal-containing vaccines should be removed as soon as possible. Similar
			 conclusions were reached this year in a meeting attended by European regulatory
			 agencies, the European vaccine manufacturers, and the US FDA which examined the
			 use of thimerosal-containing vaccines produced or sold in European
			 countries.</quote>.</text>
			</paragraph><paragraph id="H832110506357446BB3E7B1949664CE4"><enum>(2)</enum><text>In
			 July 2000, the Public Health Service, the Advisory Commission on Immunization
			 Practices, the American Academy of Pediatrics, and the American Academy of
			 Family Physicians issued a joint statement, providing: <quote>The AAFP, [the]
			 AAP, and the PHS in consultation with the ACIP reaffirm the goal set in July
			 1999 to remove or greatly reduce thimerosal from vaccines as soon as possible
			 for the following reasons: (1) the removal or substantial reduction of
			 thimerosal from vaccines is feasible, (2) the progress in removal which has
			 been made to date is substantial, (3) the discussions between the Food and Drug
			 Administration and the vaccine manufacturers in removing thimerosal are
			 ongoing, and (4) the public concern about the use of mercury of any sort
			 remains high. Based on information from the FDA and manufacturers, the PHS
			 projects that the United States will complete its transition to a secure
			 routine pediatric vaccine supply free of thimerosal as a preservative (i.e., at
			 least two vaccine products each for Hep B, Hib, and DTaP) by the first quarter
			 of 2001.</quote>.</text>
			</paragraph><paragraph id="H7A03E3BE856247F9A2820001CA7F16F"><enum>(3)</enum><text>The Institute of
			 Medicine’s Immunization Review Committee concluded that significant reasons
			 existed for continued public health attention to concerns about thimerosal
			 exposure and neurodevelopmental disorders and recommended the removal of
			 thimerosal from vaccines administered to children and pregnant women.</text>
			</paragraph><paragraph id="H39B9FB04B41846DBA77EB5107641B305"><enum>(4)</enum><text>Federal regulatory
			 agencies and manufacturers have taken positive steps to remove thimerosal from
			 some medical products, most notably routinely administered childhood
			 vaccines.</text>
			</paragraph><paragraph id="H917444E4B5D944098BD9B08CDF35ED6"><enum>(5)</enum><text>Considerable
			 progress has been made in reducing mercury exposures from childhood vaccines,
			 yet 8 years after the July 1999 statement, thimerosal remains in several
			 nonroutinely administered childhood vaccines and many pediatric and adult
			 influenza vaccines.</text>
			</paragraph><paragraph id="HF4F42529085A42C2002E8D768BB19B06"><enum>(6)</enum><text>There is no law or
			 regulation to prohibit the reintroduction of thimerosal into any products from
			 which it has been removed, leaving open the possibility that it may be
			 reintroduced at some point in the future in new vaccines or vaccines from which
			 it has already been removed.</text>
			</paragraph><paragraph id="H97BCB90E06484FE29EC242DC98F21322"><enum>(7)</enum><text>The Environmental
			 Protection Agency has estimated that as many as 1 in 6 infants are born with a
			 blood mercury level that exceeds the Agency’s safety threshold.</text>
			</paragraph><paragraph id="HF368AAE3B6814631957ECCFA544F00"><enum>(8)</enum><text>Cumulative exposures
			 to mercury, a neurotoxin, are known to cause harm, particularly in young
			 children and pregnant women.</text>
			</paragraph><paragraph id="H8530F6610BFD46E0951696D614477322"><enum>(9)</enum><text>Taking steps to
			 reduce mercury exposures through vaccines is an important way to reduce direct
			 exposures to mercury and mercury compounds.</text>
			</paragraph></section><section id="H1395043F621A4BF993269DA7C52BE400"><enum>3.</enum><header>Banned
			 mercury-containing vaccines</header>
			<subsection id="HD83D0AD8AD8E4156BCFC3821CD617C85"><enum>(a)</enum><header>Prohibition</header><text>Section
			 501 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/351">21 U.S.C. 351</external-xref>) is amended by adding at the end the
			 following:</text>
				<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H75B7AAA893634F7FBC2299BA7ED1B982">
					<subsection id="HC3064A8144C34F788853EFB760F447A"><enum>(j)</enum><text>If it is a banned
				mercury-containing vaccine under section 351B of the
				<act-name parsable-cite="PHSA">Public Health Service
				Act</act-name>.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H17D8914129B146D18B4D980543097C7F"><enum>(b)</enum><header>Amendment to
			 PHSA</header><text>Title III of the <act-name parsable-cite="PHSA">Public
			 Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/241">42 U.S.C. 241 et seq.</external-xref>) is amended by inserting
			 after section 351A the following:</text>
				<quoted-block act-name="Public Health Service Act" id="HC23FCA5287AA4E3181DD78DC41EAD92C">
					<section id="H0E076BA883024E9788FEB981C4BF86B9"><enum>351B.</enum><header>Banned
				mercury-containing vaccines</header>
						<subsection id="H5B0F7008629A41A5802CD1F503D1689C"><enum>(a)</enum><header>In
				general</header><text>For purposes of section 501(j) of the
				<act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic
				Act</act-name>, and subject to subsection (b), a vaccine is a banned
				mercury-containing vaccine under this section if 1 dose of the vaccine contains
				1 or more micrograms of mercury in any form.</text>
						</subsection><subsection id="H80F8A4DF4AB348599860E01F006E5F32"><enum>(b)</enum><header>Public health
				emergency exception</header>
							<paragraph id="H6EC8C3E9278D4C17ADEEBE8B4114DD"><enum>(1)</enum><header>Exception</header><text>Subsection
				(j) of section 501 of the <act-name parsable-cite="FFDCA">Federal Food, Drug,
				and Cosmetic Act</act-name> shall not apply to a vaccine during the effective
				period of a declaration issued by the Secretary for such vaccine under this
				subsection.</text>
							</paragraph><paragraph id="H7AFA5C707A2C48FA91D8C88D1768F088"><enum>(2)</enum><header>Declaration</header><text>The
				Secretary may issue a declaration concluding that an actual or potential
				bioterrorist incident or other actual or potential public health emergency
				makes advisable the administration of a vaccine described in subsection (a)
				notwithstanding the mercury content of such vaccine.</text>
							</paragraph><paragraph id="H4368FA42C26C41E48FCD014D98B2D041"><enum>(3)</enum><header>Limitation</header><text>The
				Secretary—</text>
								<subparagraph id="H96B190B7ABF841B9B78EC3CE00D77627"><enum>(A)</enum><text>shall specify in
				any declaration under this section the beginning and ending dates of the
				effective period of the declaration; and</text>
								</subparagraph><subparagraph id="H109B37A684114488BB2ECB378DC8D7E9"><enum>(B)</enum><text>may not specify
				any such effective period that exceeds 12 months.</text>
								</subparagraph></paragraph><paragraph id="H16F40506DBFC4B53B4CB6000CD5DDC13"><enum>(4)</enum><header>Renewals</header><text>At
				the end of the effective period of any declaration under this section, the
				Secretary, subject to paragraph (3), may issue another declaration for the same
				incident or public health emergency.</text>
							</paragraph><paragraph id="H7536FF0F8CC4443285BD383B14A950"><enum>(5)</enum><header>Publication</header><text>The
				Secretary shall promptly publish each declaration under this section in the
				Federal Register.</text>
							</paragraph></subsection><subsection id="H1998229E941E4CDB8C96CEE1111F6CB9"><enum>(c)</enum><header>Effective
				dates</header><text display-inline="yes-display-inline">This section applies
				only to the introduction, or delivery for introduction, of a banned
				mercury-containing vaccine into interstate commerce on or after the earlier of
				the following:</text>
							<paragraph id="HB7FC7F6383DA452FBA78AFEB21DBE407"><enum>(1)</enum><text>January 1, 2008,
				if the vaccine is listed in the January 2007 version of the recommended
				childhood and adolescent immunization schedule of the Centers for Disease
				Control and Prevention (other than an influenza vaccine).</text>
							</paragraph><paragraph id="H65923B3D88C747B4AAF20000A214CC43"><enum>(2)</enum><text>January 1,
				2009.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="HA179EE8242BC4FB4B29B08B5F8AEEC2F"><enum>4.</enum><header>Restrictions on
			 administration of mercury-containing influenza vaccines to children and
			 pregnant women</header>
			<subsection id="HD5381B0B7ABD4BB7A41611DBFDA33BE1"><enum>(a)</enum><header>Application</header><text>This
			 section applies only to a vaccine that—</text>
				<paragraph id="HFFA2380DDEC44B40BB4FDBF5C6749B2C"><enum>(1)</enum><text>is a banned
			 mercury-containing vaccine (as that term is defined in section 351B(a) of the
			 Public Health Service Act (as amended by section 3));</text>
				</paragraph><paragraph id="H2A266F879DFB4BC18EC4AB7645D3AC19"><enum>(2)</enum><text>is an influenza
			 vaccine; and</text>
				</paragraph><paragraph id="HAACCDD3F160E4C68B16E5177FF5CAE66"><enum>(3)</enum><text>is manufactured
			 for use in the 2007–2008 influenza season or any subsequent period.</text>
				</paragraph></subsection><subsection id="HF1F13B788829473C8EBE354C2B6647E6"><enum>(b)</enum><header>Restrictions on
			 administration of vaccine to children</header><text>Any approval by the
			 Secretary of Health and Human Services of a biologics license under section 351
			 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) for any vaccine described in
			 subsection (a) shall provide that such vaccine is being approved as a
			 biological product subject to subpart H of part 314 of title 21, Code of
			 Federal Regulations (or any successor regulations). Under such subpart H, the
			 Secretary shall establish the following restrictions on the distribution of the
			 vaccine:</text>
				<paragraph id="HE153EF8788CD48EBB47853CC551DB237"><enum>(1)</enum><text>Effective July 1,
			 2007, the vaccine shall not be administered to any child under the age of 3
			 years old.</text>
				</paragraph><paragraph id="H25F7D2AABA06478B992D0000B5BF00CF"><enum>(2)</enum><text>Effective July 1,
			 2007, if the vaccine contains thimerosal, the vaccine shall not be administered
			 to any pregnant woman.</text>
				</paragraph><paragraph id="H6A1D2A8146784418B8A55BDAF082CC4E"><enum>(3)</enum><text>Effective July 1,
			 2008, the vaccine shall not be administered to any child under the age of 6
			 years old.</text>
				</paragraph></subsection><subsection id="H8B256AFC550E48F0ABC4A268D095E800"><enum>(c)</enum><header>Transitional
			 provision</header><text>In the case of a biologics license under section 351 of
			 the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/262">42 U.S.C. 262</external-xref>) that was approved before the date
			 of the enactment of this Act for a vaccine described in subsection (a)—</text>
				<paragraph id="H69B7D1F1568345E384DF41203295700"><enum>(1)</enum><text>at
			 the request of the holder of the license, the Secretary shall modify the
			 license to include the restrictions described in subsection (b); or</text>
				</paragraph><paragraph id="H1ADB61FFBE534D1DBAE72EE03C2330A0"><enum>(2)</enum><text>if the holder of
			 the license fails to submit such a request, the Secretary shall revoke the
			 license as applied to vaccines manufactured for use in the 2007–2008 influenza
			 season or any subsequent period.</text>
				</paragraph></subsection><subsection id="HEA5065B05CF14AAC8C00009858EFFB1F"><enum>(d)</enum><header>Public health
			 emergency exception</header><text display-inline="yes-display-inline">This
			 section shall not apply to a vaccine during the effective period of a
			 declaration issued by the Secretary for such vaccine under section 351B(b) of
			 the Public Health Service Act (as amended by section 3).</text>
			</subsection></section><section id="H540BBE04FAA74DCFAB4B543EB8A1B17B"><enum>5.</enum><header>Information on
			 mercury content</header><text display-inline="no-display-inline">Section 2126
			 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42
			 U.S.C. 300aa–26) is amended by adding at the end the following:</text>
			<quoted-block act-name="Public Health Service Act" id="H1466D1FA37144D4CBC66AF359EE29200">
				<subsection id="H351B0FA2D8744A13BB855DA5A7B9FDE9"><enum>(e)</enum><header>Mercury
				content</header><text>Not later than 2 months after the date of the enactment
				of this subsection, the Secretary shall revise the vaccine information
				materials developed and disseminated under this section to ensure that, in the
				case of any vaccine described in subsection (a) that contains mercury, the
				materials include—</text>
					<paragraph id="H9DEA808FC9D14342962ED4A1DF3D461"><enum>(1)</enum><text>a statement
				indicating the presence of mercury in the vaccine;</text>
					</paragraph><paragraph id="H064688E221674F19A364D1DD59F47899"><enum>(2)</enum><text>information on the
				availability of any mercury-free or mercury-reduced alternative vaccine and
				instructions on how to obtain such alternative vaccine; and</text>
					</paragraph><paragraph id="H06F9C2529E1F4FB0AC463FA8B73317B"><enum>(3)</enum><text>a recommendation
				against administration of any mercury-containing vaccine to a pregnant
				woman.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HA8126405CE2344788145BF0085BDB2ED"><enum>6.</enum><header>Sense of
			 Congress</header><text display-inline="no-display-inline">It is the sense of
			 the Congress that the Director of the Centers for Disease Control and
			 Prevention should include, in any information disseminated by the Centers to
			 the public or to health care providers relating to the administration of
			 vaccines, a recommendation against administration of any thimerosal-containing
			 vaccine to a pregnant woman.</text>
		</section><section id="H49C3FE56C7784C3685A02EE528DA9070"><enum>7.</enum><header>Report to
			 Congress</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of the enactment of this Act, and annually thereafter, the
			 Commissioner of Food and Drugs shall submit a report to the Congress annually
			 on the progress of the Commissioner in removing mercury from vaccines.</text>
