<official-title>To amend the Internal Revenue Code of 1986 to improve and expand education savings accounts.</official-title>

<section commented="no" display-inline="no-display-inline" id="HE661D0D1078E4E61950060C7A80534A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>401Kids Family Savings Act of 2007</short-title></quote>.</text></section> 
<section id="H084654DC1888414D852ECCA2E46BEFA4"><enum>2.</enum><header>Extension of date for sunset of certain education savings incentives</header><text display-inline="no-display-inline">In the case of the provisions of, and amendments made by, subtitle A of title IV of the Economic Growth and Tax Relief Reconciliation Act of 2001 (relating to education savings incentives), section 901 of such Act (relating to sunset of provisions of Act) shall be applied by substituting <quote>December 31, 2015</quote> for <quote>December 31, 2010</quote> in subsection (a)(1) thereof.</text></section> 
<section id="H54AAB0DF714D44619BD9DEE82D98D2E5"><enum>3.</enum><header>Distributions from education savings accounts for first home purchases treated as qualified distributions</header> 
<subsection id="HBD86E2F07A144927002929A7D7214FBA"><enum>(a)</enum><header>In general</header><text>Subsections (b)(1), (d)(2)(A), (d)(2)(B), (d)(2)(C)(ii)(II), and (d)(2)(D) of <external-xref legal-doc="usc" parsable-cite="usc/26/530">section 530</external-xref> of the Internal Revenue Code of 1986 are each amended by striking <quote>qualified education expenses</quote> and inserting <quote>qualified expenses</quote>.</text></subsection> 
<subsection id="H0CC126A37B50489D986B8E110921D1A7"><enum>(b)</enum><header>Qualified expenses</header><text>Subsection (b) of section 530 of such Code is amended—</text> 
<paragraph id="H502C56AB2FA743FB9D012013732C56A7"><enum>(1)</enum><text>by redesignating paragraphs (2) through (4) as paragraphs (3) through (5), respectively, and by inserting after paragraph (1) the following new paragraph:</text>

<paragraph id="HCD3D4AE5829A4FDC83F868B3D5D3F023"><enum>(2)</enum><header>Qualified expenses</header><text>The term <quote>qualified expenses</quote> means—</text> 
<subparagraph id="HC766A4A4905E4819BA32BC130575E96C"><enum>(A)</enum><text>qualified education expenses (as defined in paragraph (3)), and</text></subparagraph> 
<subparagraph id="H9CB5089B4CDE4793BAA1B5F1D2C6D284"><enum>(B)</enum><text>qualified first-time homebuyer expenses (as defined in paragraph (4)).</text></subparagraph></paragraph><after-quoted-block>, and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD8FBDFCA4EA7408BA632F869AB9600D9"><enum>(2)</enum><text>by redesignating paragraphs (4) and (5) (as redesignated by paragraph (1)) as paragraphs (5) and (6), respectively, and by inserting after paragraph (3) the following new paragraph:</text>

<paragraph id="HF4389307D9A9404AA142BFE8D17BFED8"><enum>(4)</enum><header>Qualified first-time homebuyer expenses</header><text>The term <quote>qualified first-time homebuyer expenses</quote> means, in the case of a designated beneficiary who is a first-time homebuyer, the qualified acquisition costs with respect to a principal residence of such beneficiary. Terms used in this paragraph shall have the same meaning as when used in section 72(t)(8).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1F74CC72B0744A9CA4E768F42CF6F2D"><enum>(c)</enum><header>Conforming amendment</header><text>The heading for paragraph (2) of section 530(d) of such Code is amended by striking <quote><header-in-text level="paragraph" style="OLC">qualified education expenses</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">qualified expenses</header-in-text></quote>.</text></subsection> 
<subsection id="H38AF16E06720454FA8063C972FA6BA97"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section> 
<section id="H10DF6A4EDFC043F094FEB66DD154AC41"><enum>4.</enum><header>Rollovers from education savings accounts to Roth IRAs</header> 
<subsection id="H81D6779F56E34387AC8556F0A00009AA"><enum>(a)</enum><header>In general</header><text>Paragraph (5) of <external-xref legal-doc="usc" parsable-cite="usc/26/530">section 530(d)</external-xref> of the Internal Revenue Code of 1986, as amended by section 5, is amended by inserting <quote>or a Roth IRA</quote> after <quote>another 401Kids savings account</quote>.</text></subsection> 
<subsection id="H640B9291AC894E49A5FE255D4CE6D7EF"><enum>(b)</enum><header>Conforming amendment</header><text>Subsection (e) of section 408A of such Code is amended by inserting the following after the second sentence: <quote>Such term includes a rollover contribution to a Roth IRA from a 401Kids savings account described in section 530(d)(5).</quote>.</text></subsection> 
<subsection id="H3D8CED25C8B84A0A8BE30035BD8E21E9"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section>

<subsection id="HFF62419ABDD14DD186B82073FC20535D"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/530">Section 530</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>Coverdell education savings account</quote> each place it appears and inserting <quote>401Kids savings account</quote>.</text></subsection>
