<official-title>To modernize and expand the reporting requirements relating to child pornography, to expand cooperation in combating child pornography, and for other purposes.</official-title>

<section id="HE938D6BC894C4D138BE42C7DA43DCC13" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Adolescents From Exploitation-Online Act of 2007</short-title></quote> or the <quote><short-title>SAFE Act of 2007</short-title></quote>.</text></section> 
<section id="H556A9B16D5C74B6F9BB7A4A7D1EABE2D"><enum>2.</enum><header>Reporting requirements of electronic communication service providers and remote computing service providers</header> 
<subsection id="H920C9EBA6AFC4747BC246DF2B3D3CECB"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/18/2258">section 2258</external-xref> the following:</text>

<section id="HEBCEC7FC3E8347C388A510DFCCFD0025"><enum>2258A.</enum><header>Reporting requirements of electronic communication service providers and remote computing service providers</header> 
<subsection id="H5BF0EE6DB96343BEACE7F3E1C885D19"><enum>(a)</enum><header>Duty To report</header> 
<paragraph id="H46BDEAB013464C30A4E77FF8C31C4200"><enum>(1)</enum><header>In general</header><text>Whoever, while engaged in providing an electronic communication service or a remote computing service to the public through a facility or means of interstate or foreign commerce, obtains actual knowledge of any facts or circumstances described in paragraph (2) shall, as soon as reasonably possible, make a report of such facts or circumstances to the CyberTipline of the National Center for Missing and Exploited Children, or any successor to the CyberTipline operated by such center.</text></paragraph> 
<paragraph id="H17975908529E40F5BDDAE3217F46CF01"><enum>(2)</enum><header>Facts or circumstances</header><text>The facts or circumstances described in this paragraph are any facts or circumstances that appear to indicate a violation of—</text> 
<subparagraph id="H5EF4AF76519143F2B2CB21F21B93B910"><enum>(A)</enum><text>section 2251, 2251A, 2252, 2252A, 2252B, or 2260 that involves child pornography or;</text></subparagraph> 
<subparagraph id="H37322FDEDB61491F952B54E6C71F696D"><enum>(B)</enum><text>section 1466A.</text></subparagraph></paragraph></subsection> 
<subsection id="H963C8DD7295F4352944354FE5563F924"><enum>(b)</enum><header>Contents of report</header><text>To the extent available to an electronic communication service provider or a remote computing service provider, each report under subsection (a)(1) shall include the following information:</text> 
<paragraph id="H71A93225A8F64BEF9338525BC555DBE"><enum>(1)</enum><header>Information about the involved individual</header><text>Information relating to the Internet identity of any individual who appears to have violated a Federal law in the manner described in subsection (a)(2), including the electronic mail address, website address, uniform resource locator, or any other identifying information.</text></paragraph> 
<paragraph id="H46DCF13C4D774DC991CB092DC39FB3F4"><enum>(2)</enum><header>Historical reference</header><text>Information relating to when any apparent child pornography was uploaded, transmitted, reported to, or discovered by the electronic communication service provider or remote computing service provider, as the case may be, including a date and time stamp and time zone.</text></paragraph> 
<paragraph id="H1A183484035F4E55B02F610083E68FF"><enum>(3)</enum><header>Geographic location information</header><text>Information relating to the geographic location of the involved individual, hosting website, or uniform resource locator, including the street address, telephone number, area code, zip code, or any Internet Protocol address.</text></paragraph> 
<paragraph id="HEE4AED32DDAE45ADB27DC4DAA37BED03"><enum>(4)</enum><header>Images of apparent child pornography</header><text>Any image of any apparent child pornography relating to the incident such report is regarding.</text></paragraph> 
<paragraph id="H78A240B8FBE64BA1BED4E6A045F0D06"><enum>(5)</enum><header>Company contact information</header><text>Accurate contact information for the electronic communication service provider or remote computing service provider making the report, including the address, telephone number, facsimile number, electronic mail address of, and individual point of contact for, such electronic communication service provider or remote computing service provider.</text></paragraph></subsection> 
<subsection id="HFB9AD5C792784753A3612F37018E1BBB"><enum>(c)</enum><header>Forwarding of report to law enforcement</header> 
<paragraph id="H81DF8F2969DB42E292CBF06862D9C2D2"><enum>(1)</enum><header>In general</header><text>The National Center for Missing and Exploited Children shall forward each report made under subsection (a)(1) to any appropriate law enforcement agency designated by the Attorney General under subsection (d)(2).</text></paragraph> 
<paragraph id="H3D70B802611A4C4DA6ED2B2897CB54F6"><enum>(2)</enum><header>State and local law enforcement</header><text>The National Center for Missing and Exploited Children may forward any report made under subsection (a)(1) to an appropriate official of a State or political subdivision of a State for the purpose of enforcing State criminal law.</text></paragraph> 
<paragraph id="HF71185DF433D4C37A78B1679CA34CE00"><enum>(3)</enum><header>Foreign law enforcement</header><text>The National Center for Missing and Exploited Children may forward any report made under subsection (a)(1) to any appropriate foreign law enforcement agency designated by the Attorney General under subsection (d)(3), subject to the conditions established by the Attorney General under subsection (d)(3).</text></paragraph></subsection> 
<subsection id="H86A894F22E704940BFCC3825746CA84C"><enum>(d)</enum><header>Attorney general responsibilities</header> 
<paragraph id="H9A533A8F67BB43028412D1EAED69E41"><enum>(1)</enum><header>In general</header><text>The Attorney General shall enforce this section.</text></paragraph> 
<paragraph id="HDAF1BC5E1B784207914B05AC27464534"><enum>(2)</enum><header>Designation of Federal agencies</header><text>The Attorney General shall designate promptly the Federal law enforcement agency or agencies to which a report shall be forwarded under subsection (c)(1).</text></paragraph> 
<paragraph id="HA21D7DEE0CF04D64903F663EEA00CBC5"><enum>(3)</enum><header>Designation of foreign agencies</header><text>The Attorney General shall promptly—</text> 
<subparagraph id="HDD001F9292304CE687493FF3F8FA4872"><enum>(A)</enum><text>designate the foreign law enforcement agencies to which a report may be forwarded under subsection (c)(3); and</text></subparagraph> 
<subparagraph id="HD8CCED4C710142268F1230A3194EEB40"><enum>(B)</enum><text>establish the conditions under which such a report may be forwarded to such agencies.</text></subparagraph></paragraph></subsection> 
<subsection id="HD57541CFF7164F8D96FBD2B1527F505C"><enum>(e)</enum><header>Failure to report</header><text>An electronic communication service provider or remote computing service provider that knowingly and willfully fails to make a report required under subsection (a)(1) shall be fined—</text> 
<paragraph id="H76EABCA26E894DC20040DA3B553E032F"><enum>(1)</enum><text>in the case of an initial knowing and willful failure to make a report, not more than $150,000; and</text></paragraph> 
<paragraph id="HC52DE2BC94A2477EBB5F01D700893B8F"><enum>(2)</enum><text>in the case of any second or subsequent knowing and willful failure to make a report, not more than $300,000.</text></paragraph></subsection> 
<subsection id="HDA0DD2B5B56540FCA500B177D26EE8"><enum>(f)</enum><header>Protection of privacy</header><text>Nothing in this section shall be construed to require an electronic communication service provider or a remote computing service provider to—</text> 
<paragraph id="H0FD220341867402898C14EBE8212C02C"><enum>(1)</enum><text>monitor any user, subscriber, or customer of that provider;</text></paragraph> 
<paragraph id="HB55E40C992644A3B8DAC6C442F90CCAB"><enum>(2)</enum><text>monitor the content of any communication of any person described in paragraph (1); or</text></paragraph> 
<paragraph id="H37930BEFD5E34EEB008F76C7726675EA"><enum>(3)</enum><text>affirmatively seek facts or circumstances described in subsection (a)(2).</text></paragraph></subsection> 
<subsection id="H2FB95100C49D47038BB11B88B9F89F2"><enum>(g)</enum><header>Conditions of disclosure of information contained within report</header> 
<paragraph id="HF60F36D5A13847278500FAADDD094D7D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a law enforcement agency that receives a report under subsection (c) shall not disclose any information contained in that report.</text></paragraph> 
<paragraph id="H38768C17320343C9A94B1B56983CD7BE"><enum>(2)</enum><header>Permitted disclosures</header><text>A law enforcement agency may disclose information in a report received under subsection (c)—</text> 
<subparagraph id="H543E1B083F6E468B91F2E815180602C"><enum>(A)</enum><text>to an attorney for the government for use in the performance of the official duties of that attorney;</text></subparagraph> 
<subparagraph id="H5160FB8F00FE486F9D2F313E9CAEDD9C"><enum>(B)</enum><text>to such officers and employees of that law enforcement agency, as may be necessary in the performance of their investigative and recordkeeping functions;</text></subparagraph> 
<subparagraph id="HE847D9C8A80D47D3AF8FB26D82E256E6"><enum>(C)</enum><text>to such other government personnel (including personnel of a State or subdivision of a State) as are determined to be necessary by an attorney for the government to assist the attorney in the performance of the official duties of the attorney in enforcing Federal criminal law;</text></subparagraph> 
<subparagraph id="H6B747CB9AD624C2282003289F3EA09B4"><enum>(D)</enum><text>if the report discloses a violation of State criminal law, to an appropriate official of a State or subdivision of a State for the purpose of enforcing such State law; or</text></subparagraph> 
<subparagraph id="H42CDB2CFD6F94A758F6E2DD97881E291"><enum>(E)</enum><text>to a defendant in a criminal case or the attorney for that defendant, to the extent the information relates to a criminal charge pending against that defendant.</text></subparagraph></paragraph></subsection> 
<subsection id="H3694EDCB66464F81855D7F0070A2A572"><enum>(h)</enum><header>Evidence preservation</header> 
<paragraph id="HF87847968ED74CC18721727268B8509E"><enum>(1)</enum><header>In general</header><text>An electronic communication service provider or a remote computing service provider shall store any image and other information relating to the facts or circumstances of any incident reported under subsection (a)(1) for not less than 180 days after the date that the report is transmitted to the National Center for Missing and Exploited Children through the CyberTipline, or for such longer period of time as may be requested by a law enforcement agency.</text></paragraph> 
<paragraph id="HBAD76109FC0F48D6AB36902EEAB1D800"><enum>(2)</enum><header>Destruction of evidence</header><text>An electronic communication service provider or a remote computing service provider shall not destroy any data that, to the knowledge of that electronic communication service provider or remote computing service provider, relates to an incident reported under subsection (a)(1) during the 180-day period beginning on the date that report is transmitted to the National Center for Missing and Exploited Children through the CyberTipline, or for such longer period of time as may be requested by a law enforcement agency.</text></paragraph></subsection></section> 
<section id="H2FC9E6D4D13B4237A31C49CB5347A8EC"><enum>2258B.</enum><header>Limited liability for electronic communication service providers and remote computing service providers</header> 
<subsection id="H1A63AB9F1F00409DAB0018D33C651BBE"><enum>(a)</enum><header>In general</header><text>Except as provided in subsections (b) and (c), a civil claim or criminal charge against an electronic communication service provider or a remote computing service provider, including any director, officer, employee, or agent of such electronic communication service provider or remote computing service provider, arising from the performance of the reporting responsibilities of such electronic communication service provider or remote computing service provider under this section, section 2258A, or section 2258C may not be brought in any Federal or State court.</text></subsection> 
<subsection id="H20F5B0EC19A241818E209C30E6DFB988"><enum>(b)</enum><header>Intentional, reckless, or other misconduct</header><text>Subsection (a) shall not apply to a claim if the electronic communication service provider or remote computing service provider, or a director, officer, employee, or agent of that electronic communication service provider or remote computing service provider—</text> 
<paragraph id="H649EEA9205D343A98132FB3997A57809"><enum>(1)</enum><text>engaged in intentional misconduct; or</text></paragraph> 
<paragraph id="H1C7C0FA84F9843D6BD00D4D455DF6898"><enum>(2)</enum><text>acted, or failed to act—</text> 
<subparagraph id="H500C6C168FC948CB91C1B5EC7E74B92"><enum>(A)</enum><text>with actual malice;</text></subparagraph> 
<subparagraph id="H963F316F3DB846A79406DDE2FB07675"><enum>(B)</enum><text>with reckless disregard to a substantial risk of causing injury without legal justification; or</text></subparagraph> 
<subparagraph id="H08732495755C498CA86942902E3FB4F4"><enum>(C)</enum><text>for a purpose unrelated to the performance of any responsibility or function under this section, section 2258A, or section 2258C.</text></subparagraph></paragraph></subsection> 
<subsection id="HE5D45F979EFA49E0AD00041D00D24230"><enum>(c)</enum><header>Ordinary business activities</header><text>Subsection (a) shall not apply to an act or omission relating to an ordinary business activity of an electronic communication service provider or a remote computing service provider, including general administration or operations, the use of motor vehicles, or personnel management.</text></subsection> 
<subsection id="HCF12B34DC87F47C8AEC390A7FDA62DD3"><enum>(d)</enum><header>Minimizing access</header><text>An electronic communication service provider and a remote computing service provider shall—</text> 
<paragraph id="H20F1F0824A8F4018B93B00D1739F913D"><enum>(1)</enum><text>minimize the number of employees that are provided access to any image provided under section 2258A or 2258C; and</text></paragraph> 
<paragraph id="H39AE6C62505D48E5B26E4219ACDD324C"><enum>(2)</enum><text>ensure that any such image is permanently destroyed, upon notification from a law enforcement agency.</text></paragraph></subsection></section> 
<section id="HE08BF3B635C741AF89278F40AA6FC2A4"><enum>2258C.</enum><header>Use of images from the CyberTipline to combat child pornography</header> 
<subsection id="H3419FC0E14E24001ACB940CAA75E5458"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The National Center for Missing and Exploited Children is authorized to provide elements relating to any image reported to its CyberTipline to an electronic communication service provider or a remote computing service provider for the sole and exclusive purpose of permitting that electronic communication service provider or remote computing service provider to stop the further transmission of images. Such elements may include unique identifiers associated with a specific image, Internet location of images, and other technological elements that can be used to identify and stop the transmission of child pornography.</text></subsection> 
<subsection id="H9F7FEFC1AB7240139E1E140039A1DB70"><enum>(b)</enum><header>Use by electronic communication service providers and remote computing service providers</header><text>Any electronic communication service provider or remote computing service provider that receives elements relating to an image from the National Center for Missing and Exploited Children under this section may use such information only for the purposes described in this section, provided that such use shall not relieve that electronic communication service provider or remote computing service provider from its reporting obligations under section 2258A.</text></subsection></section> 
<section id="H169CA32BAC5D43C289B9F9CFF216D48C"><enum>2258D.</enum><header>Limited liability for the National Center for Missing and Exploited Children</header> 
<subsection id="H90BFA1EB339240819334B9DF9E007169"><enum>(a)</enum><header>In general</header><text>Except as provided in subsections (b) and (c), a civil claim or criminal charge against the National Center for Missing and Exploited Children, including any director, officer, employee, or agent of such center, arising from the performance of the CyberTipline responsibilities or functions of such center, as described in this section, section 2258A or 2258C of this title, or section 404 of the Missing Children's Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5773">42 U.S.C. 5773</external-xref>), or from the effort of such center to identify child victims may not be brought in any Federal or State court.</text></subsection> 
<subsection id="H376B5B830C234915A91B30D3D44F36AE"><enum>(b)</enum><header>Intentional, reckless, or other misconduct</header><text>Subsection (a) shall not apply to a claim or charge if the National Center for Missing and Exploited Children, or a director, officer, employee, or agent of such center—</text> 
<paragraph id="H55D9F1D586004BE280521FEAA0091057"><enum>(1)</enum><text>engaged in intentional misconduct; or</text></paragraph> 
<paragraph id="H4F12242212864290BA904C1969231F29"><enum>(2)</enum><text>acted, or failed to act—</text> 
<subparagraph id="H2E29378450A9434AB03868E8F8992331"><enum>(A)</enum><text>with actual malice;</text></subparagraph> 
<subparagraph id="H24F224690D0647D181AF81A691DA045"><enum>(B)</enum><text>with reckless disregard to a substantial risk of causing injury without legal justification; or</text></subparagraph> 
<subparagraph id="HCA6AD530DDA145ECB18C88C01F39F305"><enum>(C)</enum><text>for a purpose unrelated to the performance of any responsibility or function under this section, section 2258A or 2258C of this title, or section 404 of the Missing Children's Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5773">42 U.S.C. 5773</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="H38F9EC060B5C40668267AFE31DD9D94"><enum>(c)</enum><header>Ordinary business activities</header><text>Subsection (a) shall not apply to an act or omission relating to an ordinary business activity, including general administration or operations, the use of motor vehicles, or personnel management.</text></subsection> 
<subsection id="HCF2B0C0160D24C55A1A9FEFD18B2F7A"><enum>(d)</enum><header>Minimizing access</header><text>The National Center for Missing and Exploited Children shall—</text> 
<paragraph id="HDBB799BD757140DD8860C868F7D22D8"><enum>(1)</enum><text>minimize the number of employees that are provided access to any image provided under section 2258A; and</text></paragraph> 
<paragraph id="H568EBE897E214EAC8993BD00BFA177C2"><enum>(2)</enum><text>ensure that any such image is permanently destroyed upon notification from a law enforcement agency.</text></paragraph></subsection></section> 
<section id="HABB4193DE08E4EBFA88E9D33FC203D"><enum>2258E.</enum><header>Definitions</header><text display-inline="no-display-inline">In sections 2258A through 2258D—</text> 
<paragraph id="HCAE1BB06EC9F4BEB82FB2607779DFC4"><enum>(1)</enum><text>the terms <term>attorney for the government</term> and <term>State</term> have the meanings given those terms in rule 1 of the Federal Rules of Criminal Procedure;</text></paragraph> 
<paragraph id="HC56C7B34CF2440669CE73B77174C62EF"><enum>(2)</enum><text>the term <term>electronic communication service</term> has the meaning given that term in section 2510;</text></paragraph> 
<paragraph id="H5FEE5EC1506D4A95B05612F46F32F7EF"><enum>(3)</enum><text>the term <term>electronic mail address</term> has the meaning given that term in section 3 of the CAN–SPAM Act of 2003 (<external-xref legal-doc="usc" parsable-cite="usc/15/7702">15 U.S.C. 7702</external-xref>);</text></paragraph> 
<paragraph id="H8FD1131CE6A8423EA01E183C39FB23B0"><enum>(4)</enum><text>the term <term>Internet</term> has the meaning given that term in section 1101 of the Internet Tax Freedom Act (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> note);</text></paragraph> 
<paragraph id="HB0246673031C4061A2901CB5CFF28900"><enum>(5)</enum><text>the term <term>remote computing service</term> has the meaning given that term in section 2711; and</text></paragraph> 
<paragraph id="HCFCDD09FEFAA4EADBAEA6671EADBAFF"><enum>(6)</enum><text>the term <term>website</term> means any collection of material placed in a computer server-based file archive so that it is publicly accessible, over the Internet, using hypertext transfer protocol or any successor protocol.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1F5E9329FC4E4AEC8BB0234869EF8D2"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H824A313E4DCB4391BCC22D075747C568"><enum>(1)</enum><header>Repeal of superceded provision</header><text>Section 227 of the Crime Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/13032">42 U.S.C. 13032</external-xref>) is repealed.</text></paragraph> 
<paragraph id="H6A03A5F5ABB8496D895FF9F4A294A1F3"><enum>(2)</enum><header>Table of sections</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">chapter 110</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/2258">section 2258</external-xref> the following:</text>

<section id="HD528ED43310A4BB5AC937E4F2B12D280"><enum>3.</enum><header>Encouraging foreign countries to combat child pornography and child exploitation</header><text display-inline="no-display-inline">The United States Trade Representative, the Attorney General of the United States, and the head of any other relevant Federal agency shall take appropriate action to encourage foreign governments to—</text> 
<paragraph id="HA77DF215E1054BA798B16E19EB93CEE"><enum>(1)</enum><text display-inline="yes-display-inline">stop the production and transmission of child pornography in the country of such government; and</text></paragraph> 
<paragraph id="HEB0E051B74B946BFA0973FD5B200C381"><enum>(2)</enum><text display-inline="yes-display-inline">cooperate with law enforcement agencies in the United States, including Federal agencies and Internet Crimes Against Children Task Forces, to combat the creation and transmission of child pornography.</text></paragraph></section> 
<section id="HC5FB5FABAFAC448B8171A27B3D12C700"><enum>4.</enum><header>Authorization of funds to combat child pornography</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Attorney General $25,000,000 for grants to Internet Crimes Against Children Task Force.</text></section> 
<section id="H9E0E56B6F6D04F23B26543596701619D"><enum>5.</enum><header>Online monitoring of convicted sex offenders</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3583">Section 3583(k)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H39D82B7B8B1B4E119C5E76E7AF3E075F"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote><header-in-text level="subsection" style="USC">Sex offenders.—</header-in-text></quote> before <quote>Notwithstanding</quote>;</text></paragraph> 
<paragraph id="HA38DB088B1434FAD928D1134048F9C58"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>Notwithstanding</quote> and inserting the following:</text>

<subparagraph id="H7A6FA0E6E17B414696482CF2105267E2"><enum>(A)</enum><header>In general</header><text>The court may order, as an explicit condition of supervised release for any person convicted of a sex offense—</text> 
<clause id="HDD52966B9A1D4210008210FC0197A265"><enum>(i)</enum><text>the use of electronic monitoring technology to monitor the use of the Internet by that defendant; and</text></clause> 
<clause id="H2438A45F394944659334F0F6D55759DA"><enum>(ii)</enum><text>that the defendant pay a fee, not to exceed $50 per month, for such monitoring.</text></clause></subparagraph> 
<subparagraph id="HFE257E5131B240DB8D0168E93E8295CF"><enum>(B)</enum><header>Definitions</header><text>In this paragraph—</text> 
<clause id="H8845B3F5024E4C4188BAEE00B06CD2C3"><enum>(i)</enum><text>the term <term>Internet</term> has the meaning given that term in section 1101 of the Internet Tax Freedom Act (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151</external-xref> note); and</text></clause> 
<clause id="H8D513AA011664A41BC04D8C481F32D90"><enum>(ii)</enum><text>the term <term>sex offense</term> means any offense—</text> 
<subclause id="HDD04AA740C984EFFB86E5D890095E7BE"><enum>(I)</enum><text>under chapter 109A, chapter 110 (excluding offenses relating to recordkeeping), or chapter 117 (excluding offenses relating to transmitting information about a minor or filing a factual statement about an alien individual); and</text></subclause> 
<subclause id="H7DCFA8B5E9E545ED885600198B589CD0"><enum>(II)</enum><text>that involves a minor.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section commented="no" id="HFB02F63285714476AB0048A6001BD3C1"><enum>6.</enum><header>Use of the Internet as an aggravating factor</header> 
<subsection commented="no" id="H8EA1DA79516D4A8185CADC5F4034ACE"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/110">Chapter 110</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<subsection commented="no" id="HE69814986D764B62891F3E860439AD2C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person to—</text> 
<paragraph commented="no" id="H3FA4C79B5D2C4738A9D71188D389BAB7"><enum>(1)</enum><text display-inline="yes-display-inline">commit a violation of section 1466A, 1470, 2251, 2251A, 2252, 2252A, 2252B, or 2260 that does not require, as an element of such violation, the use of the Internet; and</text></paragraph> 
<paragraph commented="no" id="HE1009E4F4C164D5785E4807B2185FDFB"><enum>(2)</enum><text>use the Internet to commit the violation described in paragraph (1).</text></paragraph></subsection> 
<subsection commented="no" id="HE810865B9CDC48AC9B5B42007266D00"><enum>(b)</enum><header>Penalty</header><text>Any person who violates subsection (a) shall be sentenced to a term of imprisonment of 10 years in addition to the imprisonment imposed for the underlying offense.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<section id="H6DE286FB01EE49FAB68E9C7DDF2438FB"><enum>7.</enum><header>Aiding law enforcement in ascertaining web site ownership</header><text display-inline="no-display-inline">It is the sense of Congress that all domain registrars should investigate and correct inaccurate data regarding registered domain names, including any contact information.</text></section> 
<section id="H84464EF91073477288586CAEFAADE1C6"><enum>8.</enum><header>Report regarding prosecutions</header> 
<subsection id="H6D578054881D44BF9E9F84DDAE90819E"><enum>(a)</enum><header>In general</header><text>The Attorney General of the United States shall submit to Congress and make publicly available on the website of the Department of Justice an annual report regarding—</text> 
<paragraph id="H4F383C6E56A24FF8846C04CE55387909"><enum>(1)</enum><text>the number of—</text> 
<subparagraph id="H7772305D10FD4F4100BA9F76872B1DA8"><enum>(A)</enum><text>investigations by local, State, or Federal law enforcement agencies of crimes of sexual exploitation against children;</text></subparagraph> 
<subparagraph id="HE1FAEE51680B46F5ABF6285F8E3C863F"><enum>(B)</enum><text>prosecutions resulting from investigations by local, State, or Federal law enforcement agencies of crimes of sexual exploitation against children;</text></subparagraph> 
<subparagraph id="H9DF8FA4F09B24151A8DAB324DFF6BE7C"><enum>(C)</enum><text>convictions resulting from prosecutions by local, State, or Federal authorities of crimes of sexual exploitation against children;</text></subparagraph> 
<subparagraph id="H1C572B5E8BE642CDB0C6950053BFFF90"><enum>(D)</enum><text>convictions of repeat offenders; and</text></subparagraph></paragraph> 
<paragraph id="H1058867103F3410397ABA5E7D0472E9B"><enum>(2)</enum><text>descriptions of sentences given to persons convicted as a result of investigations described in paragraph (1)(A).</text></paragraph></subsection></section>
