		<official-title display="yes">To provide for the establishment of centers
		  to encourage demonstration and commercial application of advanced energy
		  methods and technologies.</official-title>

		<section display-inline="no-display-inline" id="H931EADF62EE84DD88594B7CC6D38800" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Energy Technology Transfer
			 Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HF0F4E596B0344A5BBB9C70EAEAF5006B" section-type="subsequent-section"><enum>2.</enum><header>Energy technology
			 transfer</header><text display-inline="no-display-inline">Section 917 of the
			 Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16197">42 U.S.C. 16197</external-xref>) is amended to
			 read as follows:</text>

				<section id="H1AD664D5F3B34366A3CF9450DA252E4D"><enum>917.</enum><header>Advanced Energy
				Technology Transfer Centers</header>
					<subsection id="HAE1E7BEA9E2F4E3F817F1DA0FDD85BBD"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of the Energy Technology Transfer Act, the Secretary shall make
				grants to nonprofit institutions, State and local governments, cooperative
				extension services, or institutions of higher education (or consortia thereof),
				to establish a geographically dispersed network of Advanced Energy Technology
				Transfer Centers, to be located in areas the Secretary determines have the
				greatest need of the services of such Centers. In making awards under this
				section, the Secretary shall—</text>
						<paragraph id="H597584E69B20439A8D05A67DE742C96"><enum>(1)</enum><text>give priority to
				applicants already operating or partnered with an outreach program capable of
				transferring knowledge and information about advanced energy efficiency methods
				and technologies;</text>
						</paragraph><paragraph id="H3E44B8B72F254757941968C1C84FC641"><enum>(2)</enum><text>ensure that, to
				the extent practicable, the program enables the transfer of knowledge and
				information—</text>
							<subparagraph id="H8E23DBE35E444F6CBF31184D980078C7"><enum>(A)</enum><text>about a variety of
				technologies; and</text>
							</subparagraph><subparagraph id="HF95D3228F6AD48B79B003BE1DC034201"><enum>(B)</enum><text>in a variety of
				geographic areas;</text>
							</subparagraph></paragraph><paragraph id="HCC86E5958E2D43678C9CE71977567D4"><enum>(3)</enum><text>give preference to
				applicants that would significantly expand on or fill a gap in existing
				programs in a geographical region; and</text>
						</paragraph><paragraph id="H87E227610A96435C97BE4E6C9F41FB7B"><enum>(4)</enum><text display-inline="yes-display-inline">consider the special needs and
				opportunities for increased energy efficiency for manufactured and site-built
				housing, including construction, renovation, and retrofit.</text>
						</paragraph></subsection><subsection id="H3BFC9BD308EC4FDBA879E25732324FDD"><enum>(b)</enum><header>Activities</header><text>Each
				Center shall operate a program to encourage demonstration and commercial
				application of advanced energy methods and technologies through education and
				outreach to building and industrial professionals, and to other individuals and
				organizations with an interest in efficient energy use. Funds awarded under
				this section may be used for the following activities:</text>
						<paragraph id="H985AF4680C5D45B19D039D0831DA7BE8"><enum>(1)</enum><text>Developing and
				distributing informational materials on technologies that could use energy more
				efficiently.</text>
						</paragraph><paragraph id="HE7E8981AA650420C9C9C444E59EA5EF7"><enum>(2)</enum><text>Carrying out
				demonstrations of advanced energy methods and technologies.</text>
						</paragraph><paragraph id="HE28DC7666EA54D47BEAFE4B1FF43FE2"><enum>(3)</enum><text>Developing and
				conducting seminars, workshops, long-distance learning sessions, and other
				activities to aid in the dissemination of knowledge and information on
				technologies that could use energy more efficiently.</text>
						</paragraph><paragraph id="HE365D6E89A35449190A332B1656D2AE"><enum>(4)</enum><text>Providing or
				coordinating onsite energy evaluations, including instruction on the
				commissioning of building heating and cooling systems, for a wide range of
				energy end-users.</text>
						</paragraph><paragraph id="HACCEA85DABE34D379F0098CAE484B682"><enum>(5)</enum><text>Examining the
				energy efficiency needs of energy end-users to develop recommended research
				projects for the Department.</text>
						</paragraph><paragraph id="H866A98D162A6493EBD00FDF162D34D74"><enum>(6)</enum><text>Hiring experts in
				energy efficient technologies to carry out activities described in paragraphs
				(1) through (5).</text>
						</paragraph></subsection><subsection id="H406A18DEBCFF44749B5FDFCDAE75C0A"><enum>(c)</enum><header>Application</header><text>A
				person seeking a grant under this section shall submit to the Secretary an
				application in such form and containing such information as the Secretary may
				require. The Secretary may award a grant under this section to an entity
				already in existence if the entity is otherwise eligible under this section.
				The application shall include, at a minimum—</text>
						<paragraph id="HCF281B9759DB44B0B4E54BA57BB3765"><enum>(1)</enum><text>a description of
				the applicant’s outreach program, and the geographic region it would serve, and
				of why the program would be capable of transferring knowledge and information
				about advanced energy technologies that increase efficiency of energy
				use;</text>
						</paragraph><paragraph id="H5FF52C2989904F54AAA2B8C5AA90EEFF"><enum>(2)</enum><text>a description of
				the activities the applicant would carry out, of the technologies that would be
				transferred, and of any other organizations that will help facilitate a
				regional approach to carrying out those activities;</text>
						</paragraph><paragraph id="H345D964661134E86B58126A2093CC5BC"><enum>(3)</enum><text>a description of
				how the proposed activities would be appropriate to the specific energy needs
				of the geographic region to be served;</text>
						</paragraph><paragraph id="H6749C04A4E1F4249A030F690D4482A6"><enum>(4)</enum><text>an estimate of the
				number and types of energy end-users expected to be reached through such
				activities; and</text>
						</paragraph><paragraph id="H1B3046393467418C9358EBD69C44B3AC"><enum>(5)</enum><text>a description of
				how the applicant will assess the success of the program.</text>
						</paragraph></subsection><subsection id="HFF228A343ECD4A6088F464C13518D284"><enum>(d)</enum><header>Selection
				criteria</header><text>The Secretary shall award grants under this section on
				the basis of the following criteria, at a minimum:</text>
						<paragraph id="H64C3F036E62B48E8962FC8E764D96064"><enum>(1)</enum><text>The ability of the
				applicant to carry out the proposed activities.</text>
						</paragraph><paragraph id="H8DF468E85C8C4D08B9F0B57537814F7B"><enum>(2)</enum><text>The extent to
				which the applicant will coordinate the activities of the Center with other
				entities as appropriate, such as State and local governments, utilities,
				institutions of higher education, and National Laboratories.</text>
						</paragraph><paragraph id="HDFF248BEA5D345F29400FEA7063513D3"><enum>(3)</enum><text>The
				appropriateness of the applicant’s outreach program for carrying out the
				program described in this section.</text>
						</paragraph><paragraph id="H83A2EA9CE46D43389F935FB78DC02FD6"><enum>(4)</enum><text>The likelihood
				that proposed activities could be expanded or used as a model for other
				areas.</text>
						</paragraph></subsection><subsection id="H8AA0392BB4CD4F7DB3B8458C84DE7765"><enum>(e)</enum><header>Cost-sharing</header><text>In
				carrying out this section, the Secretary shall require cost-sharing in
				accordance with the requirements of section 988 for commercial application
				activities.</text>
					</subsection><subsection id="HDFE1F6A1BB5E4F2D841929C9FEDF5847"><enum>(f)</enum><header>Duration</header>
						<paragraph id="HEED8BEE4AB2A4A4EB30050004CC052E0"><enum>(1)</enum><header>Initial grant
				period</header><text>A grant awarded under this section shall be for a period
				of 5 years.</text>
						</paragraph><paragraph id="HA2C69667248E4F13A225DE35FAC41C81"><enum>(2)</enum><header>Initial
				evaluation</header><text>Each grantee under this section shall be evaluated
				during its third year of operation under procedures established by the
				Secretary to determine if the grantee is accomplishing the purposes of this
				section described in subsection (a). The Secretary shall terminate any grant
				that does not receive a positive evaluation. If an evaluation is positive, the
				Secretary may extend the grant for 3 additional years beyond the original term
				of the grant.</text>
						</paragraph><paragraph id="HEE0FF99BF1DE4FC1AA40008B88428D6D"><enum>(3)</enum><header>Additional
				extension</header><text>If a grantee receives an extension under paragraph (2),
				the grantee shall be evaluated again during the second year of the extension.
				The Secretary shall terminate any grant that does not receive a positive
				evaluation. If an evaluation is positive, the Secretary may extend the grant
				for a final additional period of 3 additional years beyond the original
				extension.</text>
						</paragraph><paragraph id="H8C46F7DBD00744C98B427255DF071424"><enum>(4)</enum><header>Limitation</header><text>No
				grantee may receive more than 11 years of support under this section without
				reapplying for support and competing against all other applicants seeking a
				grant at that time.</text>
						</paragraph></subsection><subsection id="H2A21E02A36C244ECBBC8A174E900986B"><enum>(g)</enum><header>Prohibition</header><text>None
				of the funds awarded under this section may be used for the construction of
				facilities.</text>
					</subsection><subsection id="HAC42780C9EDD4AADA53FD33E053FEC42"><enum>(h)</enum><header>Definitions</header><text>For
				purposes of this section:</text>
						<paragraph id="H9042534253004886AF86BA26584F3D5E"><enum>(1)</enum><header>Advanced energy
				methods and technologies</header><text>The term <term>advanced energy methods
				and technologies</term> means all methods and technologies that promote energy
				efficiency and conservation, including distributed generation technologies, and
				life-cycle analysis of energy use.</text>
						</paragraph><paragraph id="H1FBE53D5F9BE4E448D013582BE29B1DA"><enum>(2)</enum><header>Center</header><text>The
				term <term>Center</term> means an Advanced Energy Technology Transfer Center
				established pursuant to this section.</text>
						</paragraph><paragraph id="HFA6DF86410C54AEC997712BFB420F2FE"><enum>(3)</enum><header>Distributed
				generation</header><text>The term <term>distributed generation</term> means an
				electric power generation technology, including photovoltaic, small wind, and
				micro-combined heat and power, that serves electric consumers at or near the
				site of production.</text>
						</paragraph><paragraph id="HD160516FF1794662BCCA2CA9D54B9977"><enum>(4)</enum><header>Cooperative
				extension</header><text>The term <term>Cooperative Extension</term> means the
				extension services established at the land-grant colleges and universities
				under the Smith-Lever Act of May 8, 1914.</text>
						</paragraph><paragraph id="HC23218D571A14CA1821B239E2EC7DC7F"><enum>(5)</enum><header>Land-grant
				colleges and universities</header><text>The term <term>land-grant colleges and
				universities</term> means—</text>
							<subparagraph id="HE5191B65CB5C4AE2B3837BF1B1463E11"><enum>(A)</enum><text>1862 Institutions
				(as defined in section 2 of the Agricultural Research, Extension, and Education
				Reform Act of 1998 (7
				U.S.C. 7601));</text>
							</subparagraph><subparagraph id="HE08061E261204E29B6794B7DA3244D85"><enum>(B)</enum><text>1890 Institutions
				(as defined in section 2 of that Act); and</text>
							</subparagraph><subparagraph id="HFD8EFDBF90DE4E9EBD8CB0ED46EFD66"><enum>(C)</enum><text>1994 Institutions
				(as defined in section 2 of that Act).</text>
							</subparagraph></paragraph></subsection><subsection id="H1CDDD48E76204A1C9487000068C34049"><enum>(i)</enum><header>Authorization of
				appropriations</header><text display-inline="yes-display-inline">In addition to
				amounts otherwise authorized to be appropriated in section 911, there are
				authorized to be appropriated for the program under this section such sums as
				may be
				appropriated.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
