		<section id="H543B54F21B094294A8E40060BEDE030" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Energy Efficient Buildings Act of
			 2007</short-title></quote>.</text>
		</section><section id="HE12FF10A973B4F9F9E36BBA100CEA98"><enum>2.</enum><header>Energy efficient
			 building grant program</header>
			<subsection id="H22426B92636B4A09007EEB0753CE00"><enum>(a)</enum><header>Energy Efficient
			 Building Pilot Grant Program</header>
				<paragraph id="H869843C683234FC4B174BAEE8EF5428D"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 6
			 months after the date of enactment of this Act, the Secretary of Energy (in
			 this Act referred to as the <quote>Secretary</quote>) shall establish a pilot
			 program to award grants to businesses and organizations for new construction of
			 energy efficient buildings, or major renovations of buildings that will result
			 in energy efficient buildings, to demonstrate innovative energy efficiency
			 technologies, especially those sponsored by the Department of Energy.</text>
				</paragraph><paragraph id="H6B24E89DB7794E68AF861590777B0020"><enum>(2)</enum><header>Awards</header><text>The
			 Secretary shall award grants under this subsection competitively to those
			 applicants whose proposals—</text>
					<subparagraph id="HC79B6EDD8CF14CC5BC02627BDCBCE62"><enum>(A)</enum><text>best
			 demonstrate—</text>
						<clause id="HBC74EA3BDAD646FCAA639DB45E2B9296"><enum>(i)</enum><text>likelihood to meet
			 or exceed the standards referred to in subsection (b)(2);</text>
						</clause><clause id="HB62D83EB05F641AE9DDBBD283D2BC5F"><enum>(ii)</enum><text>likelihood to
			 maximize cost-effective energy efficiency opportunities; and</text>
						</clause><clause id="H7947747FBCFD4BA1AADF8E1090FF6D08"><enum>(iii)</enum><text>advanced energy
			 efficiency technologies; and</text>
						</clause></subparagraph><subparagraph id="H609F1E26FD434C9CB2AAFC637FCF68D2"><enum>(B)</enum><text>maximize the
			 leverage of private investment for costs related to increasing the energy
			 efficiency of the building.</text>
					</subparagraph></paragraph><paragraph id="H2E04F788B6BD453696E380E7B2713F"><enum>(3)</enum><header>Consideration</header><text>The
			 Secretary shall give due consideration to proposals for buildings that are
			 likely to serve low and moderate income populations.</text>
				</paragraph><paragraph id="H6D7AD72CBE8B42D7A773ABFBD34FBD1D"><enum>(4)</enum><header>Amount of
			 grants</header><text>Grants under this subsection shall be for up to 50 percent
			 of design and energy modeling costs, not to exceed $50,000 per building. No
			 single grantee may be eligible for more than 3 grants per year under this
			 program.</text>
				</paragraph><paragraph id="HD15809C3DCEF4D46A1834BF3BA22E17"><enum>(5)</enum><header>Grant
			 payments</header>
					<subparagraph id="HB8B9FD3B3007441589908BC40A9EEB7"><enum>(A)</enum><header>Initial
			 payment</header><text>The Secretary shall pay 50 percent of the total amount of
			 the grant to grant recipients upon selection.</text>
					</subparagraph><subparagraph id="H4F76D72A665C41B5AE844466DD0535F1"><enum>(B)</enum><header>Remainder of
			 payment</header><text>The Secretary shall pay the remaining 50 percent of the
			 grant only after independent certification, by a professional engineer or other
			 qualified professional, that operational buildings are energy efficient
			 buildings as defined in subsection (b).</text>
					</subparagraph><subparagraph id="H4B3BF05C4F224AFFA702E4571536F15E"><enum>(C)</enum><header>Failure to
			 comply</header><text>The Secretary shall not provide the remainder of the
			 payment unless the building is certified within 6 months after operation of the
			 completed building to meet the requirements described in subparagraph (B), or
			 in the case of major renovations the building is certified within 6 months of
			 the completion of the renovations.</text>
					</subparagraph></paragraph><paragraph id="HF2A767F896F84CF5AA7301F5D4EA6D9C"><enum>(6)</enum><header>Report to
			 congress</header><text>Not later than 3 years after awarding the first grant
			 under this subsection, the Secretary shall transmit to Congress a report
			 containing—</text>
					<subparagraph id="HD3F72809F1484A17BB78E50035B55170"><enum>(A)</enum><text>the total number
			 and dollar amount of grants awarded under this subsection; and</text>
					</subparagraph><subparagraph id="HB5437545EF044D1B8B405C26B8A2C7EF"><enum>(B)</enum><text>an estimate of
			 aggregate cost and energy savings enabled by the pilot program under this
			 subsection.</text>
					</subparagraph></paragraph><paragraph id="H07DA83BF0E17414085DDBFE7E8AD4F55"><enum>(7)</enum><header>Administrative
			 expenses</header><text>Administrative expenses for the program under this
			 subsection shall not exceed 10 percent of appropriated funds.</text>
				</paragraph></subsection><subsection id="H85643F3E30E343A0AF1E5795C83F7732"><enum>(b)</enum><header>Definition of
			 Energy Efficient Building</header><text>For purposes of this section the term
			 <quote>energy efficient building</quote> means a building that—</text>
				<paragraph id="H4EF6E3C65CE6468AAAF01F544DA838A7"><enum>(1)</enum><text>achieves a
			 reduction in energy consumption of—</text>
					<subparagraph id="H3477BDA64F86408CBE4182B99D4FB32D"><enum>(A)</enum><text>at least 30
			 percent for new construction, compared to the energy standards set by the 2004
			 International Energy Conservation Code (in the case of residential buildings)
			 or ASHRAE Standard 90.1–2004; or</text>
					</subparagraph><subparagraph id="HBF8CA09922964A55AF00CDC0CBE2A0B6"><enum>(B)</enum><text>at least 20
			 percent for major renovations, compared to energy consumption before
			 renovations are begun;</text>
					</subparagraph></paragraph><paragraph id="HEAD8A33AC51545C19CDC85865FDE60A7"><enum>(2)</enum><text>is constructed or
			 renovated in accordance with the most current, appropriate, and applicable
			 voluntary consensus standards, as determined by the Secretary, such as those
			 listed in the assessment under section 914(b), or revised or developed under
			 section 914(c), of the Energy Policy Act of 2005; and</text>
				</paragraph><paragraph id="H88D02024B8514A81A23E194559C47759"><enum>(3)</enum><text>after construction
			 or renovation—</text>
					<subparagraph id="H1DC2D76033814796B214E9B8E4BBB36E"><enum>(A)</enum><text>uses heating,
			 ventilating, and air conditioning systems that perform at no less than Energy
			 Star standards; or</text>
					</subparagraph><subparagraph id="H6C498B70184B46ACABED4B86CB9954C6"><enum>(B)</enum><text>if Energy Star
			 standards are not applicable, uses Federal Energy Management Program
			 recommended heating, ventilating, and air conditioning products.</text>
					</subparagraph></paragraph></subsection><subsection id="HB5169E19F59948F59E095063BBE7409"><enum>(c)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Secretary for carrying out this section $10,000,000 for each of the fiscal
			 years 2008 through 2012.</text>
