		<section display-inline="no-display-inline" id="HC8CECA34388F413F955DF799F59395D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Math and Science Incentive Act of
			 2007</short-title></quote>.</text>
		</section><section id="H4AEAFA3A81EF4F20A6711354814B7000"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text>
			<paragraph id="H1C86773CEEBC4B8E8BFDBC8B99F54DA2"><enum>(1)</enum><text display-inline="yes-display-inline">The United States can have a secure and
			 prosperous future only by having a robust and inventive scientific and
			 technical enterprise.</text>
			</paragraph><paragraph id="H9D1162AD80704188BE36EFBEE774809"><enum>(2)</enum><text>Such an enterprise
			 will require the United States to produce more scientists and engineers.</text>
			</paragraph><paragraph id="H022F383FC9BE4E219C9E7B0021AE5FC2"><enum>(3)</enum><text>The United States
			 education system must do more to encourage students at every level to study
			 science and mathematics and to pursue careers related to those fields.</text>
			</paragraph><paragraph id="HBDE2C2784237409C9FAF423DBEFBC100"><enum>(4)</enum><text>The current
			 performance of United States students in science and math lags behind their
			 international peers, and not enough students are pursuing science and
			 mathematics.</text>
			</paragraph><paragraph id="HE2153EACD0FE416FAE9CB2AC2E842AD"><enum>(5)</enum><text>The United States
			 is still reaping the benefits of past investments in research and development
			 and education, but we are drawing down that capital.</text>
			</paragraph><paragraph id="HC59C3963093E4EE2ADC3402EC8217157"><enum>(6)</enum><text>The United States
			 needs to recommit itself to leadership in science, mathematics and engineering,
			 especially as advances are being made in such areas as nanotechnology.</text>
			</paragraph><paragraph id="H9C65C29EAF5D4A67939D8EC89D94171E"><enum>(7)</enum><text>A
			 program of loan forgiveness designed to attract students to careers in science,
			 mathematics, engineering and technology, including teaching careers, can help
			 the United States maintain its technological leadership.</text>
			</paragraph></section><section display-inline="no-display-inline" id="HF2035B50F2E84B3CB8C9526349D5CD6F" section-type="subsequent-section"><enum>3.</enum><header>Establishment of
			 program</header>
			<subsection id="HB062415CEEB84FE8AD71DC36661F36E0"><enum>(a)</enum><header>Program</header>
				<paragraph id="H9C255AE6581444B2ADD9C61B08669B1B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 carry out a program of assuming the obligation to pay, pursuant to the
			 provisions of this Act, the interest on a loan made, insured, or guaranteed
			 under part B or D of title IV of the Higher Education Act of 1965.</text>
				</paragraph><paragraph id="HEBFD1BA9D18940C79C74BA3100B5F66B"><enum>(2)</enum><header>Eligibility</header><text>The
			 Secretary may assume interest payments under paragraph (1) only for a borrower
			 who—</text>
					<subparagraph id="H878B2D28FE5245B6AFFADC31F48801B9"><enum>(A)</enum><text>has submitted an
			 application in compliance with subsection (d);</text>
					</subparagraph><subparagraph id="HBF4E87737C184148B36D3CE46B9C1501"><enum>(B)</enum><text>obtained one or
			 more loans described in
			 <internal-xref idref="H9C255AE6581444B2ADD9C61B08669B1B" legis-path="3.(a)(1)">paragraph (1)</internal-xref> as an undergraduate
			 student;</text>
					</subparagraph><subparagraph id="HBE0A6F0C745748F4B239E77363BB74CA"><enum>(C)</enum><text>is a new borrower
			 (within the meaning of section 103(7) of the Higher Education Act of 1965 (20
			 U.S.C 1003(7)) on or after the date of enactment of this Act;</text>
					</subparagraph><subparagraph id="H4EE5C0A88DF14B7ABEF30041245C177B"><enum>(D)</enum><text>is a teacher of
			 science, technology, engineering or mathematics at an elementary or secondary
			 school, or is a mathematics, science or engineering professional; and</text>
					</subparagraph><subparagraph id="H2C7B46E402634FA6989513B276B00544"><enum>(E)</enum><text>enters into an
			 agreement with the Secretary to complete 5 consecutive years of service in a
			 position described in
			 <internal-xref idref="H4EE5C0A88DF14B7ABEF30041245C177B" legis-path="3.(a)(2)(D)">subparagraph (D)</internal-xref>, starting on the date
			 of the agreement.</text>
					</subparagraph></paragraph><paragraph id="H4CE4B73801DF44D483CC4F36D489A312"><enum>(3)</enum><header>Prior interest
			 limitations</header><text display-inline="yes-display-inline">The Secretary
			 shall not make any payments for interest that—</text>
					<subparagraph id="H4DACD460CCA2435995BA8E5F00A865D2"><enum>(A)</enum><text display-inline="yes-display-inline">accrues prior to the beginning of the
			 repayment period on a loan in the case of a loan made under section 428H of the
			 Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-8">20 U.S.C. 1078–8</external-xref>) or a Federal Direct
			 Unsubsidized Stafford Loan; or</text>
					</subparagraph><subparagraph id="HA395634A39D347A4A135C2F2348FC69"><enum>(B)</enum><text>has accrued prior
			 to the signing of an agreement under
			 <internal-xref idref="H2C7B46E402634FA6989513B276B00544" legis-path="3.(a)(2)(E)">paragraph (2)(E)</internal-xref>.</text>
					</subparagraph></paragraph><paragraph id="H0B6558F892124B47A5008EB7DD57BF85"><enum>(4)</enum><header>Initial
			 selection</header><text display-inline="yes-display-inline">In selecting
			 participants for the program under this Act, the Secretary—</text>
					<subparagraph id="H85B2636B2C0C4A99ADE4DE422849FE81"><enum>(A)</enum><text>shall choose among
			 eligible applicants on the basis of—</text>
						<clause id="H540676424154416BB323805311165557"><enum>(i)</enum><text display-inline="yes-display-inline">the national security, homeland security
			 and economic security needs of the United States, as determined by the
			 Secretary, in consultation with other Federal agencies, including the
			 Departments of Labor, Defense, Homeland Security, Commerce, and Energy, the
			 Central Intelligence Agency and the National Science Foundation; and</text>
						</clause><clause id="HF86DAD0E4D864729BB65036CFE7479FA"><enum>(ii)</enum><text>the
			 academic record or job performance of the applicant; and</text>
						</clause></subparagraph><subparagraph id="H6B2B263F039E40398F08CFD1CED3C800"><enum>(B)</enum><text display-inline="yes-display-inline">may choose among eligible applicants on the
			 basis of—</text>
						<clause id="H3B1A997FEF734239A3F8CD958054D206"><enum>(i)</enum><text>the
			 likelihood of the applicant to complete the five-year service
			 obligation;</text>
						</clause><clause id="HDCF087CFA42B422D82B2FCA843EE5822"><enum>(ii)</enum><text>the
			 likelihood of the applicant to remain in science, mathematics or engineering
			 after the completion of the service requirement; or</text>
						</clause><clause id="H8C7D36C84691488697BE71685CD259DC"><enum>(iii)</enum><text>other relevant
			 criteria determined by the Secretary.</text>
						</clause></subparagraph></paragraph><paragraph id="H4784E6EC14E64FD7AC7272D5BC75F6EF"><enum>(5)</enum><header>Availability
			 subject to appropriations</header><text display-inline="yes-display-inline">Loan interest payments under this Act shall
			 be subject to the availability of appropriations. If the amount appropriated
			 for any fiscal year is not sufficient to provide interest payments on behalf of
			 all qualified applicants, the Secretary shall give priority to those
			 individuals on whose behalf interest payments were made during the preceding
			 fiscal year.</text>
				</paragraph><paragraph id="HF3C3919FEDCD406682C657956CC4132E"><enum>(6)</enum><header>Regulations</header><text>The
			 Secretary is authorized to prescribe such regulations as may be necessary to
			 carry out the provisions of this section.</text>
				</paragraph></subsection><subsection id="H82A83710F20C4C249EC7CC056B38CC55"><enum>(b)</enum><header>Duration and
			 amount of interest payments</header><text>The period during which the Secretary
			 shall pay interest on behalf of a student borrower who is selected under
			 <internal-xref idref="HB062415CEEB84FE8AD71DC36661F36E0" legis-path="3.(a)">subsection (a)</internal-xref> is the period that begins on
			 the effective date of the agreement under
			 <internal-xref idref="H2C7B46E402634FA6989513B276B00544" legis-path="3.(a)(2)(E)">subsection (a)(2)(E)</internal-xref>, continues after
			 successful completion of the service obligation, and ends on the earlier
			 of—</text>
				<paragraph id="H0549DDA3FE0D495783E46327BB6841A0"><enum>(1)</enum><text display-inline="yes-display-inline">the completion of the repayment period of
			 the loan;</text>
				</paragraph><paragraph id="HCF0E5713139B46F3AB298E1E633015DE"><enum>(2)</enum><text>payment by the
			 Secretary of a total of $10,000 on behalf of the borrower;</text>
				</paragraph><paragraph id="H85A520E070F147FE005B1EA687BCCCF5"><enum>(3)</enum><text>if the borrower
			 ceases to fulfill the service obligation under such agreement prior to the end
			 of the 5-year period, as soon as the borrower is determined to have ceased to
			 fulfill such obligation in accordance with regulations of the Secretary;
			 or</text>
				</paragraph><paragraph id="H8E881F43D3A04801A300BB40254989D4"><enum>(4)</enum><text>6
			 months after the end of any calendar year in which the borrower’s gross income
			 equals or exceeds 4 times the national per capita disposable personal income
			 (current dollars) for such calendar year, as determined on the basis of the
			 National Income and Product Accounts Tables of the Bureau of Economic Analysis
			 of the Department of Commerce, as determined in accordance with regulations
			 prescribed by the Secretary.</text>
				</paragraph></subsection><subsection id="H4C4B81EC2E5D46AAB348E29C001EA214"><enum>(c)</enum><header>Repayment to
			 eligible lenders</header><text display-inline="yes-display-inline">Subject to
			 the regulations prescribed by the Secretary pursuant to
			 <internal-xref idref="HF3C3919FEDCD406682C657956CC4132E" legis-path="3.(a)(6)">subsection (a)(6)</internal-xref>, the Secretary shall
			 pay to each eligible lender or holder for each payment period the amount of the
			 interest that accrues on a loan of a student borrower who is selected under
			 <internal-xref idref="HB062415CEEB84FE8AD71DC36661F36E0" legis-path="3.(a)">subsection (a)</internal-xref>.</text>
			</subsection><subsection id="H8E397CC67A994736853B0024920567AD"><enum>(d)</enum><header>Application for
			 repayment</header>
				<paragraph id="H274CBD862C5347A0862B274EA5E9F70"><enum>(1)</enum><header>In
			 general</header><text>Each eligible individual desiring loan interest payment
			 under this section shall submit a complete and accurate application to the
			 Secretary at such time, in such manner, and containing such information as the
			 Secretary may require.</text>
				</paragraph><paragraph id="H408E8577B9284349A6DDD753E15826D9"><enum>(2)</enum><header>Failure to
			 complete service agreement</header><text>Such application shall contain an
			 agreement by the individual that, if the individual fails to complete the 5
			 consecutive years of service required by
			 <internal-xref idref="H2C7B46E402634FA6989513B276B00544" legis-path="3.(a)(2)(E)">subsection (a)(2)(E)</internal-xref>, the individual
			 agrees to repay the Secretary the amount of any interest paid by the Secretary
			 on behalf of the individual.</text>
				</paragraph></subsection><subsection id="H15C91D90D21F4654A5E0175CAC297700"><enum>(e)</enum><header>Treatment of
			 consolidation loans</header><text>A consolidation loan made under section 428C
			 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>,
			 or a Federal Direct Consolidation Loan made under part D of title IV of such
			 Act, may be a qualified loan for the purpose of this section only to the extent
			 that such loan amount was used by a borrower who otherwise meets the
			 requirements of this section to repay—</text>
				<paragraph id="H04F3DFB2F753482992FB658D50A8FE26"><enum>(1)</enum><text>a
			 loan made under section 428 or 428H of such Act; or</text>
				</paragraph><paragraph id="HDB749231BD59489A9884F2FF033BFC"><enum>(2)</enum><text>a
			 Federal Direct Stafford Loan, or a Federal Direct Unsubsidized Stafford Loan,
			 made under part D of title IV of such Act.</text>
				</paragraph></subsection><subsection id="HE39EC484E46448DEA0B02245F137ABB1"><enum>(f)</enum><header>Prevention of
			 double benefits</header><text>No borrower may, for the same service, receive a
			 benefit under both this section and—</text>
				<paragraph id="H6FCAE599BE7C482DB0CB7DEF8719C4F4"><enum>(1)</enum><text>any loan
			 forgiveness program under title IV of the Higher Education Act of 1965;
			 or</text>
				</paragraph><paragraph id="H08E71D97E0484AAA006BD35FB7E6F7E3"><enum>(2)</enum><text>subtitle D of
			 title I of the National and Community Service Act of 1990 (42 U.S.C. 12571 et
			 seq.).</text>
				</paragraph></subsection></section><section id="HB0F73C01654740CAB85DDCCBEA3C59F4"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
			<paragraph id="H0E14F18DE95B43ACB9289BA3C80030DB"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Secretary</term> means the
			 Secretary of Education; and</text>
			</paragraph><paragraph id="HBAD66E7224734C649CFE49D58D6F3E53"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>mathematics, science, or
			 engineering professional</term> means a person who—</text>
				<subparagraph id="HC4BBE4D5EAF1463792E52F1998614137"><enum>(A)</enum><text>holds a
			 baccalaureate, masters, or doctoral degree (or a combination thereof) in
			 science, mathematics or engineering; and</text>
				</subparagraph><subparagraph id="H0B90687C13EF41A3A47C8717563E203D"><enum>(B)</enum><text>works in a field
			 the Secretary determines is closely related to that degree, which shall include
			 working as a professor at a two- or four-year institution of higher
			 education.</text>
				</subparagraph></paragraph></section><section id="H59C690E001B54565A00693C0C7358257"><enum>5.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as may be
			 necessary for fiscal year 2008 and for each of the 5 succeeding fiscal
			 years.</text>
