		<official-title>To amend the Federal Food, Drug, and Cosmetic Act to
		  prohibit the marketing of authorized generic drugs.</official-title>

		<section display-inline="no-display-inline" id="H88404835944445E296210429F1FC9B5E" section-type="section-one"><enum>1.</enum><header>Prohibition of authorized
			 generics</header><text display-inline="no-display-inline">Section 505 of the
			 Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/355">21 U.S.C. 355</external-xref>) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HEBC03FBECEEE49A784D5C39EC8CE5BD3" style="OLC">
				<subsection id="HC398007188F644BA9252502C57ABB8B9"><enum>(o)</enum><header>Prohibition of
				authorized generic drugs</header>
					<paragraph id="H606E82D3CDDD4E9F91ED002726A6A100"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding any other provision of this Act, no
				holder of a new drug application approved under subsection (c) shall
				manufacture, market, sell, or distribute an authorized generic drug, direct or
				indirectly, or authorize any other person to manufacture, market, sell, or
				distribute an authorized generic drug.</text>
					</paragraph><paragraph id="HBDDEED14EE4B45A38D0354941C2B28DF"><enum>(2)</enum><header>Authorized
				generic drug</header><text>For purposes of this subsection, the term
				<term>authorized generic drug</term>—</text>
						<subparagraph id="H72D39F26BD2143EF8338D2A7E900E7BB"><enum>(A)</enum><text>means any version
				of a listed drug (as such term is used in subsection (j)) that the holder of
				the new drug application approved under subsection (c) for that listed drug
				seeks to commence marketing, selling, or distributing, directly or indirectly,
				after receipt of a notice sent pursuant to subsection (j)(2)(B) with respect to
				that listed drug; and</text>
						</subparagraph><subparagraph id="H56D3ECF22CD7448A9101F5503079A962"><enum>(B)</enum><text>does not include
				any drug to be marketed, sold, or distributed—</text>
							<clause id="HFC61810607884CF5979B60DBAA60B877"><enum>(i)</enum><text>by
				an entity eligible for exclusivity with respect to such drug under subsection
				(j)(5)(B)(iv); or</text>
							</clause><clause id="H650D6642DE0F4818B2E8B916DC087F72"><enum>(ii)</enum><text>after expiration
				or forfeiture of any exclusivity with respect to such drug under such
				subsection
				(j)(5)(B)(iv).</text>
