		  Ships to implement MARPOL Annex VI.</official-title>

		<section display-inline="no-display-inline" id="HF395BDD0D3BE403A9979E11DBCF2E03B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Maritime Pollution Prevention Act of
			 2007</short-title></quote>.</text>
		</section><section id="HE6FC37C4974E4BAB9D12858C3D17B59B"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Wherever in this Act an amendment or repeal
			 is expressed in terms of an amendment to or a repeal of a section or other
			 provision, the reference shall be considered to be made to a section or other
			 provision of the Act to Prevent Pollution from Ships (33 U.S.C. 1901 et
			 seq.).</text>
		</section><section id="HB8D469350A604D64003DC1B400DF0880"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1901">33 U.S.C. 1901(a)</external-xref>) is
			 amended—</text>
			<paragraph id="H99CD80255AA647028CE94ED9D7E4895D"><enum>(1)</enum><text>by redesignating
			 the paragraphs (1) through (12) as paragraphs (2) through (13),
			 respectively;</text>
			</paragraph><paragraph id="HF6D62C8400FF49A4BBCBAA99C9EF5861"><enum>(2)</enum><text>by inserting
			 before paragraph (2) (as so redesignated) the following:</text>
				<quoted-block id="H231C8D490AD54781BD68761100E65078" style="OLC">
					<paragraph id="H166AB69B361145079B82A323257D69FB"><enum>(1)</enum><text><quote>Administrator</quote>
				means the Administrator of the Environmental Protection
				Agency.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H2025D54E2A2D4CA1AC64ACDDCDB4EB77"><enum>(3)</enum><text>in paragraph (5)
			 (as so redesignated) by striking <quote>and V</quote> and inserting <quote>V,
			 and VI</quote>;</text>
			</paragraph><paragraph id="HD0B6AF7720DB47EBAE6FE62D29B7AC33"><enum>(4)</enum><text>in paragraph (6)
			 (as so redesignated) by striking <quote><quote>discharge</quote> and
			 <quote>garbage</quote> and <quote>harmful substance</quote> and
			 <quote>incident</quote></quote> and inserting <quote><quote>discharge</quote>,
			 <quote>emission</quote>, <quote>garbage</quote>, <quote>harmful
			 substance</quote>, and <quote>incident</quote></quote>; and</text>
			</paragraph><paragraph id="H6DD7CBB139E74997995177F8D61069CA"><enum>(5)</enum><text>by redesignating
			 paragraphs (7) through (13) (as redesignated) as paragraphs (8) through (14),
			 respectively, and inserting after paragraph (6) (as redesignated) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H91F5301C7DBA4D27B7FFAE2FAECF632" style="OLC">
					<paragraph id="H4ED4F5DD84E841A588889D238FD0E855"><enum>(7)</enum><text><quote>navigable
				waters</quote> includes the territorial sea of the United States (as defined in
				Presidential Proclamation 5928 of December 27, 1988) and the internal waters of
				the United
				States;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HB380873334FE4847A2EA54B0D9B9D2E5"><enum>4.</enum><header>Applicability</header><text display-inline="no-display-inline">Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/33/1902">33 U.S.C. 1902</external-xref>) is amended—</text>
			<paragraph id="H380819145C184EF2A200CCE0698DFD9"><enum>(1)</enum><text>in
			 subsection (a)—</text>
				<subparagraph id="H1C743F1C571F456F9ECF24F4AF26001F"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (3);</text>
				</subparagraph><subparagraph id="H759CCE0D115B46A493F511C5DF8042B2"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (4) and inserting <quote>; and</quote>;
			 and</text>
				</subparagraph><subparagraph id="H7E360B65B8BB40FF9BFF1FCA1E007B56"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HCB44569B4DE44AD2AEE9E922C60727D" style="OLC">
						<paragraph id="H8EAFA8D996724488AA4B3EC35FABC7B0"><enum>(5)</enum><text>with respect to
				Annex VI to the Convention, and other than with respect to a ship referred to
				in paragraph (1)—</text>
							<subparagraph id="H12CA60CA5E0F4556BF5E3CC5575043E8"><enum>(A)</enum><text>to a ship that is
				in a port, shipyard, offshore terminal, or the internal waters of the United
				States;</text>
							</subparagraph><subparagraph id="HF9E11168E8094B1391B0D6B3343EA11"><enum>(B)</enum><text>to a ship that is
				bound for, or departing from, a port, shipyard, offshore terminal, or the
				internal waters of the United States, and is in—</text>
								<clause id="HFAC6B1413CCA45BA81D1C3BD3E839CD1"><enum>(i)</enum><text>the navigable
				waters of the United States;</text>
								</clause><clause id="H67B493D89A824629AF5D83EC160566A4"><enum>(ii)</enum><text>an emission
				control area designated pursuant to section 4; or</text>
								</clause><clause id="HB512B8885259469BBC071623AD8461CD"><enum>(iii)</enum><text>any other area
				that the Administrator, in consultation with the Secretary and each State in
				which any part of the area is located, has designated by order as being an area
				from which emissions from ships are of concern with respect to protection of
				public health, welfare, or the environment;</text>
								</clause></subparagraph><subparagraph id="H0FEA388CE83F4636A717EAE5436F84CF"><enum>(C)</enum><text>to a ship that is
				entitled to fly the flag of, or operating under the authority of, a party to
				Annex VI, and is in—</text>
								<clause id="HAB2AD962DAF046A885A0B800EBD26013"><enum>(i)</enum><text>the navigable
				waters of the United States;</text>
								</clause><clause id="H8DC3B7E5FD66434787AC96A7F657B958"><enum>(ii)</enum><text>an emission
				control area designated under section 4; or</text>
								</clause><clause id="HFDC109BC50BA4FE0BF98F508C624F53B"><enum>(iii)</enum><text>any other area
				that the Administrator, in consultation with the Secretary and each State in
				which any part of the area is located, has designated by order as being an area
				from which emissions from ships are of concern with respect to protection of
				public health, welfare, or the environment; and</text>
								</clause></subparagraph><subparagraph id="H138AE766B3554D4286A3C9E146ABE0D3"><enum>(D)</enum><text>to the extent
				consistent with international law, to any other ship that is in—</text>
								<clause id="H2ACD0866F15F44A88297921DBB005597"><enum>(i)</enum><text>the exclusive
				economic zone of the United States;</text>
								</clause><clause id="HD5071DDCB4AC40B5A08DB7E14C008131"><enum>(ii)</enum><text>the navigable
				waters of the United States;</text>
								</clause><clause id="H1BC2FB510D0D47768EE4807AF1C205D"><enum>(iii)</enum><text>an emission
				control area designated under section 4; or</text>
								</clause><clause id="H0A56FA1A637244F9B97D98B4B110404E"><enum>(iv)</enum><text>any other area
				that the Administrator, in consultation with the Secretary and each State in
				which any part of the area is located, has designated by order as being an area
				from which emissions from ships are of concern with respect to protection of
				public health, welfare, or the
				environment.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HF1E49399B1354D8790B4F1DAAFEAE000"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H4AE3A17F4C9244A2A3AC817CE86673CF"><enum>(A)</enum><text>in paragraph (1)
			 by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2)
			 and (3)</quote>; and</text>
				</subparagraph><subparagraph id="H1FA89B1FFF3F4FB7B78C04A1A9197203"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HADE38DAA51DA4EE2B542E62D2B64828B" style="OLC">
						<paragraph id="H50EFE3A83CC849AA9FC3E2BF16D6C744" indent="up1"><enum>(3)</enum><text>With respect to Annex VI the
				Administrator, or the Secretary, as relevant to their authorities pursuant to
				this Act, may determine that some or all of the requirements under this Act
				shall apply to one or more classes of public vessels, except that such a
				determination by the Administrator shall have no effect unless the head of the
				Department or agency under which the vessels operate concurs in the
				determination. This paragraph does not apply during time of war or during a
				declared national emergency.</text>
						</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H4BA96D3228D842C6A3FDCD644778B7B3"><enum>(3)</enum><text>by redesignating
			 subsections (c) through (g) as subsections (d) through (h), respectively, and
			 inserting after subsection (b) the following:</text>
				<quoted-block display-inline="no-display-inline" id="HD61094BCE8FD44D78123AF6E29853498" style="OLC">
					<subsection id="HF0F4BAF954DF4DEDB2DA7E2E2DC1FA1F"><enum>(c)</enum><header>Application to
				other persons</header><text>This Act shall apply to all persons to the extent
				necessary to ensure compliance with Annex VI to the
				Convention.</text>
					</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HBE36A351E61F4D4694419BF90634C2C"><enum>(4)</enum><text>in
			 subsection (e), as redesignated—</text>
				<subparagraph id="H652F104FED0D4BB290D2111800B500BC"><enum>(A)</enum><text>by inserting
			 <quote>or the Administrator, consistent with section 4 of this Act,</quote>
			 after <quote>Secretary</quote>;</text>
				</subparagraph><subparagraph id="H553024660DFE4E1F8E4DD4FE2226A7BB"><enum>(B)</enum><text>by striking
			 <quote>of section (3)</quote> and inserting <quote>of this section</quote>; and</text>
				</subparagraph><subparagraph id="H628EF4A785B5448DB5D1702F5269EBCB"><enum>(C)</enum><text>by striking
			 <quote>Protocol, including regulations conforming to and giving effect to the
			 requirements of Annex V</quote> and inserting <quote>Protocol (or the
			 applicable Annex), including regulations conforming to and giving effect to the
			 requirements of Annex V and Annex VI</quote>.</text>
				</subparagraph></paragraph></section><section id="H3718FF82BDFA49ADABEC2930186885D2"><enum>5.</enum><header>Administration
			 and enforcement</header><text display-inline="no-display-inline">Section 4
			 (33 U.S.C.
			 1903) is amended—</text>
			<paragraph id="HDB2324FDA4BE46159DA4C67284A6CB3F"><enum>(1)</enum><text>by redesignating
			 subsections (b) and (c) as subsections (c) and (d), respectively, and inserting
			 after subsection (a) the following:</text>
				<quoted-block display-inline="no-display-inline" id="H829C35B6B09E4298981000D0F9E35F37" style="OLC">
					<subsection id="H36EFF1B6C74B4A8C89CBFCA9D1D75CF0"><enum>(b)</enum><header>Duty of the
				Administrator</header><text>In addition to other duties specified in this Act,
				the Administrator and the Secretary, respectively, shall have the following
				duties and authorities:</text>
						<paragraph id="H8B854E6E91DE41E4BA1B3F363502F09F"><enum>(1)</enum><text>The Administrator
				shall, and no other person may, issue Engine International Air Pollution
				Prevention certificates in accordance with Annex VI and the International
				Maritime Organization’s Technical Code on Control of Emissions of Nitrogen
				Oxides from Marine Diesel Engines, on behalf of the United States for a vessel
				of the United States as that term is defined in
				section
				116 of title 46, United States Code. The issuance of Engine
				International Air Pollution Prevention certificates shall be consistent with
				any applicable requirements of the Clean Air Act or regulations prescribed
				under that Act.</text>
						</paragraph><paragraph id="H4A10F57E5B45456F96949D16A800CED7"><enum>(2)</enum><text>The Administrator
				shall have authority to administer regulations 12, 13, 14, 15, 16, 17, 18, and
				19 of Annex VI to the Convention.</text>
						</paragraph><paragraph id="H25A29581970E4D40BD9557CBB9B1042C"><enum>(3)</enum><text>The Administrator
				shall, only as specified in section 8(f), have authority to enforce Annex VI of
				the
				Convention.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HA1736B0C4C794A39B5D8009FE78BA900"><enum>(2)</enum><text>in subsection (c),
			 as redesignated, by redesignating paragraph (2) as paragraph (4), and inserting
			 after paragraph (1) the following:</text>
				<quoted-block id="HAF6A96058EB04BE5986C584FE30946CF" style="OLC">
					<paragraph id="H8F56924E85224372BA1C14CAE543C5B9" indent="up1"><enum>(2)</enum><text>In addition to the authority the
				Secretary has to prescribe regulations under this Act, the Administrator shall
				also prescribe any necessary or desired regulations to carry out the provisions
				of regulations 12, 13, 14, 15, 16, 17, 18, and 19 of Annex VI to the
				Convention.</text>
					</paragraph><paragraph id="H02D7C8351959489087DA88F03F271776" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In prescribing any regulations under this
				section, the Secretary and the Administrator shall consult with each other, and
				with respect to regulation 19, with the Secretary of the
				Interior.</text>
					</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H883AF8897A07434482623099827C6500"><enum>(3)</enum><text>by adding at the
			 end of subsection (c), as redesignated, the following:</text>
				<quoted-block id="HD948BC97289942CD8B67ABB6A3A86F6C" style="OLC">
					<paragraph id="HCEAF4C0BE2474723A7AF5385B512ACB2" indent="up1"><enum>(5)</enum><text>No standard issued by any person or
				Federal authority, with respect to emissions from tank vessels subject to
				regulation 15 of Annex VI to the Convention, shall be effective until 6 months
				after the required notification to the International Maritime Organization by
				the Secretary.</text>
					</paragraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</paragraph></section><section id="H030DF0DD8BC8460D806006BE1CF28195"><enum>6.</enum><header>Certificates</header><text display-inline="no-display-inline">Section 5 (<external-xref legal-doc="usc" parsable-cite="usc/33/1904">33 U.S.C. 1904</external-xref>) is amended—</text>
			<paragraph id="HBCB0D21AAD3F48D4906C7F7634FA2256"><enum>(1)</enum><text>in subsection (a)
			 by striking <quote>The Secretary</quote> and inserting <quote>Except as
			 provided in section 4(b)(1), the Secretary</quote>;</text>
			</paragraph><paragraph id="H0CE014DB270B446300953C6FD97BB613"><enum>(2)</enum><text>in subsection (b)
			 by striking <quote>Secretary under the authority of the MARPOL
			 protocol.</quote> and inserting <quote>Secretary or the Administrator under the
			 authority of this Act.</quote>; and</text>
			</paragraph><paragraph id="H551123468231414FB4E58751C11B9139"><enum>(3)</enum><text>in subsection (e)
			 by striking <quote>environment.</quote> and inserting <quote>environment or the
			 public health and welfare.</quote>.</text>
			</paragraph></section><section id="HD2D12FF6C15544759BDBDBB2E30045D"><enum>7.</enum><header>Reception
			 facilities</header><text display-inline="no-display-inline">Section 6
			 (33 U.S.C.
			 1905) is amended—</text>
			<paragraph id="HC15298CE45984FC489CAE0202D838D96"><enum>(1)</enum><text>in subsection (a)
			 by adding at the end the following:</text>
				<quoted-block id="H62B50E3C6C80433FAE87612CD4E0C43E" style="OLC">
					<paragraph id="H094678DCD2B444FE9FF4D03190F8C232" indent="up1"><enum>(3)</enum><text>The Secretary and the Administrator,
				after consulting with appropriate Federal agencies, shall jointly prescribe
				regulations setting criteria for determining the adequacy of reception
				facilities for receiving ozone depleting substances, equipment containing such
				substances, and exhaust gas cleaning residues at a port or terminal, and
				stating any additional measures and requirements as are appropriate to ensure
				such adequacy. Persons in charge of ports and terminals shall provide reception
				facilities, or ensure that reception facilities are available, in accordance
				with those regulations. The Secretary and the Administrator may jointly
				prescribe regulations to certify, and may issue certificates to the effect,
				that a port’s or terminal’s facilities for receiving ozone depleting
				substances, equipment containing such substances, and exhaust gas cleaning
				residues from ships are adequate.</text>
					</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H8B53688410414E53BDD4A832006051DF"><enum>(2)</enum><text>in subsection (b)
			 by inserting <quote>or the Administrator</quote> after
			 <quote>Secretary</quote>;</text>
			</paragraph><paragraph id="H5E35CC173CF7407F9815E6BDCF3DA1CE"><enum>(3)</enum><text>in subsection (e)
			 by striking paragraph (2) and inserting the following:</text>
				<quoted-block id="H3B6A9E9A6F2645D39B00C69478BFE2F3" style="OLC">
					<paragraph id="H1C76FFD313804D5991BDE5CECD92F336" indent="up1"><enum>(2)</enum><text>The Secretary may deny the entry of a
				ship to a port or terminal required by the MARPOL Protocol, this Act, or
				regulations prescribed under this section relating to the provision of adequate
				reception facilities for garbage, ozone depleting substances, equipment
				containing those substances, or exhaust gas cleaning residues, if the port or
				terminal is not in compliance with the MARPOL Protocol, this Act, or those
				regulations.</text>
					</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H918DBCFB43C049298F7FEDD1BBB2C9B3"><enum>(4)</enum><text>in subsection
			 (f)(1) by striking <quote>Secretary is</quote> and inserting <quote>Secretary
			 and the Administrator are</quote>; and</text>
			</paragraph><paragraph id="H87F861F96402444EA73365CF80D8B31"><enum>(5)</enum><text>in
			 subsection (f)(2) by striking <quote>(A)</quote>.</text>
			</paragraph></section><section id="H7015D9A094D74015AA54325676896DD7"><enum>8.</enum><header>Inspections</header><text display-inline="no-display-inline">Section 8(f) (<external-xref legal-doc="usc" parsable-cite="usc/33/1907">33 U.S.C. 1907(f)</external-xref>) is amended to
			 read as follows:</text>
			<quoted-block id="H4D49164762D44D43B82B6225ADD96F93" style="OLC">
				<subsection id="H1569576869A64A8E83C008C06F748F5"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H213861781A744CFEAE41A6E12900A816"><enum>(1)</enum><text>The Secretary may
				inspect a ship to which this Act applies as provided under section 3(a)(5), to
				verify whether the ship is in compliance with Annex VI to the Convention and
				this Act.</text>
					</paragraph><paragraph display-inline="no-display-inline" id="HCF5ACF7800644741A4501409FBE9819C" indent="up1"><enum>(2)</enum><text>If an inspection under this
				subsection or any other information indicates that a violation has occurred,
				the Secretary, or the Administrator in a matter referred by the Secretary, may
				undertake enforcement action under this section.</text>
					</paragraph><paragraph id="H63736F1BFF054A8A888FF06647EA1B6F" indent="up1"><enum>(3)</enum><text>Notwithstanding subsection (b) and
				paragraph (2) of this subsection, the Administrator shall have all of the
				authorities of the Secretary, as specified in subsection (b) of this section,
				for the purposes of enforcing regulations 17 and 18 of Annex VI to the
				Convention to the extent that shoreside violations are the subject of the
				action and in any other matter referred to the Administrator by the
				Secretary.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HBE45290DB40F4107BF9406E93E1811BD"><enum>9.</enum><header>Amendments to the
			 protocol</header><text display-inline="no-display-inline">Section 10(b)
			 (33 U.S.C.
			 1909(b)) is amended by inserting <quote>or the Administrator as
			 provided for in this Act,</quote> after <quote>Secretary,</quote>.</text>
		</section><section display-inline="no-display-inline" id="H838D48FFA6FF4510BF1CB3F6DE4FC556" section-type="subsequent-section"><enum>10.</enum><header>Penalties</header><text display-inline="no-display-inline">Section 9 (<external-xref legal-doc="usc" parsable-cite="usc/33/1908">33 U.S.C. 1908</external-xref>) is amended—</text>
			<paragraph id="H9E1541C1ADE74D4EB9EDD4D924DF6989"><enum>(1)</enum><text>by striking
			 <quote>Protocol,,</quote> each place it appears and inserting
			 <quote>Protocol,</quote>;</text>
			</paragraph><paragraph id="HEFA90BA3E93E49A5BB8F1B8DF305EC06"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H3CE972FA9E124075AC63C3000782948F"><enum>(A)</enum><text>by inserting
			 <quote>, or the Administrator as provided for in this Act</quote> after
			 <quote>Secretary</quote> the first place it appears;</text>
				</subparagraph><subparagraph id="H930DDFBE86E64A699BE788A8EF5F4C40"><enum>(B)</enum><text>in paragraph (2),
			 by inserting <quote>, or the Administrator as provided for in this Act,</quote>
			 after <quote>Secretary</quote>; and</text>
				</subparagraph><subparagraph id="HDE03E538EC11443393F2C20028BE3042"><enum>(C)</enum><text>in the matter
			 after paragraph (2)—</text>
					<clause id="HFB80186666DC44D485A9AD41E229BE00"><enum>(i)</enum><text>by
			 inserting <quote>, or the Administrator as provided for in this Act</quote>
			 after <quote>Secretary</quote> the first place it appears; and</text>
					</clause><clause id="H0466299049834CE394BB72D0BCAB2EE5"><enum>(ii)</enum><text>by

				any other authorities, requirements, or remedies conferred by any other
				provision of law. Nothing in this Act shall limit, deny, amend, modify, or
				repeal any other authority, requirement, or remedy available to the United
				States or any other person, except as expressly provided in this
				Act.</text>
