		  improve compensation benefits for veterans in certain cases of impairment of
		  vision involving both eyes, and for other purposes.</official-title>

		<section display-inline="no-display-inline" id="H87E5A4B664CC426A9D4E29001B451D16" section-type="section-one"><enum>1.</enum><header>Enhanced compensation
			 benefits for veterans in certain cases of impairment of vision involving both
			 eyes</header>
			<subsection id="HEDD28800B7864CB9B0A22F32933DF5F7"><enum>(a)</enum><header>Short
			 title</header><text>This section may be cited as the <quote>Dr. James Allen
			 Veteran Vision Equity Act</quote>.</text>
			</subsection><subsection id="H4B74D04D26004548BA7400BC6398E157"><enum>(b)</enum><header>Enhanced
			 compensation</header><text display-inline="yes-display-inline">Section
			 1160(a)(1) of title 38, United States Code, is amended—</text>
				<paragraph id="H1C4DD3494DC14119B1B6E33BD3D493C6"><enum>(1)</enum><text>by striking
			 <quote>blindness</quote> both places it appears and inserting <quote>impairment
			 of vision</quote>; and</text>
				</paragraph><paragraph id="HB3C2771F7964438EB875BEAD343BE126"><enum>(2)</enum><text>by inserting before the
			 semicolon at the end the following: <quote>, where the impairment in each eye
			 is to a visual acuity of 20/200 or less or of a peripheral field of 20 degrees
			 or less</quote>.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HA202C9AA865D45BA88F7572C59F333CF" section-type="subsequent-section"><enum>2.</enum><header>Use of National
			 Directory of New Hires for income verification purposes for certain veterans
			 benefits</header>
			<subsection display-inline="no-display-inline" id="H108B9762E128458099057794ADD5636C"><enum>(a)</enum><header>Use of information in
			 national directory of new hires</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/53">Chapter 53</external-xref> of title 38, United
			 States Code, is amended by adding at the end the following new section:</text>
				<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H63841537A1CB43E4BC98914DED4E92BF" reported-display-style="italic" style="USC">
					<section id="H4A6278BA6DA348DA900073D0C7E1010"><enum>5320.</enum><header>Use of National
				Directory of New Hires for income verification purposes</header>
						<subsection id="HB022B67D03AB455E894C78708BE7DEB"><enum>(a)</enum><header>Information from
				national directory of new hires</header><paragraph commented="no" display-inline="yes-display-inline" id="H0B933FE14FAC4A10009C790234AC0010"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall furnish to the
				Secretary of Health and Human Services, on a quarterly basis or at such
				intervals as may be determined by the Secretary, information in the custody of
				the Secretary for comparison with information in the National Directory of New
				Hires maintained by the Secretary of Health and Human Services pursuant to
				section 453 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/653">42 U.S.C. 653</external-xref>), in order to obtain the
				information in such directory with respect to individuals under the age of 65
				who are applicants for or recipients of benefits or services specified in
				subsection (d).</text>
							</paragraph><paragraph changed="added" committee-id="HVR00" id="H1C0163B3D72D4D0CB14602E36DEF7C28" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall seek information
				pursuant to this subsection only to the extent essential to determining
				eligibility for benefits and services specified in subsection (d) and the
				amount of benefits specified in paragraphs (1) and (2) of that subsection for
				individuals under the age of 65.</text>
							</paragraph><paragraph changed="added" committee-id="HVR00" id="H407D387CB9D749BD9D60CA6B83A71BDF" indent="up1" reported-display-style="italic"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H558769A91F45456C8B009F515D8BC2EB"><enum>(A)</enum><text>The Secretary of Health
				and Human Services, in cooperation with the Secretary, shall compare
				information in the National Directory of New Hires with information in the
				custody of the Secretary furnished pursuant to paragraph (1), and disclose
				information in that Directory to the Secretary, in accordance with this
				subsection, for the purposes specified in this subsection.</text>
								</subparagraph><subparagraph changed="added" committee-id="HVR00" id="H77055AE65F1548639E7E00AE8D069BAA" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary of Health and Human Services
				may make a disclosure in accordance with subparagraph (A) only to the extent
				that the Secretary determines that such disclosure does not interfere with the
				effective operation of the program under part D of title IV of the Social
				Security Act.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="HVR00" id="H29A985C369E240AFB951D641957BEE23" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary may use information resulting
				from a data match pursuant to this subsection only for the purpose of
				determining eligibility for benefits and services specified in subsection (d)
				and the amount of benefits specified in paragraphs (1) and (2) of that
				subsection.</text>
							</paragraph><paragraph changed="added" committee-id="HVR00" id="H14A5A96EE8D24FDBBFC345A60116A9A9" indent="up1" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary shall reimburse the Secretary
				of Health and Human Services for the additional costs incurred by that
				Secretary in furnishing information under this subsection. Such reimbursement
				shall be at rates that the Secretary of Health and Human Services determines to
				be reasonable (which rates shall include payment for the costs of obtaining,
				verifying, maintaining, and comparing the information).</text>
							</paragraph></subsection><subsection display-inline="no-display-inline" id="HCC34BE652B0546BF8F9906AC71C52B80"><enum>(b)</enum><header>Notification to
				beneficiaries</header><text>The Secretary shall notify each applicant for, or
				recipient of, a benefit or service specified in subsection (d) that income
				information furnished by the applicant to the Secretary may be compared with
				information obtained by the Secretary from the Secretary of Health and Human
				Services under subsection (a). The Secretary shall periodically transmit to
				recipients of such benefits additional notifications of such matters.</text>
						</subsection><subsection id="HA60889A96CD148B2AA8FAABA55F04FDB"><enum>(c)</enum><header>Independent
				verification required</header><text>The Secretary may not, by reason of
				information obtained from the Secretary of Health and Human Services under
				subsection (a) , terminate, deny, suspend, or reduce any benefit or service
				described in subsection (d) until the Secretary takes appropriate steps to
				verify independently information relating to employment and employment
				income.</text>
						</subsection><subsection id="H11A0FB9A1A6F4EB49F382C3B2EDAFA4C"><enum>(d)</enum><header>Covered benefits and
				services</header><text>The benefits and services specified in this subsection
				are the following:</text>
							<paragraph id="HDAF31F1ED7564FC5896F70EC611B1D46"><enum>(1)</enum><text>Needs-based pension
				benefits provided under chapter 15 of this title or under any other law
				administered by the Secretary.</text>
							</paragraph><paragraph display-inline="no-display-inline" id="H51BC89A728BA4FD4B4ADB4885CEEE22"><enum>(2)</enum><text>Parents' dependency and
				indemnity compensation provided under section 1315 of this title.</text>
							</paragraph><paragraph id="H99C9F7E44F714F10BC2B4EC78F00319F"><enum>(3)</enum><text>Health-care services
				furnished under subsections (a)(2)(G), (a)(3), and (b) of section 1710 of this
				title.</text>
							</paragraph><paragraph id="HD8EF0CB94DCC449F8E00D0C400D9CCC"><enum>(4)</enum><text>Compensation paid under
				chapter 11 of this title at the 100 percent rate based solely on
				unemployability and without regard to the fact that the disability or
				disabilities are not rated as 100 percent disabling under the rating
				schedule.</text>
							</paragraph></subsection><subsection id="HC268EA10E9964CB19FB5A162E3E353D"><enum>(e)</enum><header>Limitation with respect
				to individual unemployability cases</header><text>In the case of compensation
				described in subsection (d)(4), the Secretary may independently verify or
				otherwise act upon wage or self-employment information referred to in
				subsection (c) of this section only if the Secretary finds that the amount and
				duration of the earnings reported in that information clearly indicate that the
				individual is not qualified for a rating of total disability.</text>
						</subsection><subsection id="HB51758B5A15949859254F562A8CE951B"><enum>(f)</enum><header>Opportunity To contest
				findings</header><text>The Secretary shall inform the individual of the
				findings made by the Secretary on the basis of verified information under
				subsection (c), and shall give the individual an opportunity to contest such
				findings, in the same manner as applies to other information and findings
				relating to eligibility for the benefit or service involved.</text>
						</subsection><subsection commented="no" id="HFB479A4BA0414C4BA78BD1EBBF3100EC"><enum>(g)</enum><header>Source of funds for
				administration of section</header><text>The Secretary shall pay the expenses of
				carrying out this section from amounts available to the Department for the
				payment of compensation and pension.</text>
						</subsection><subsection id="H607C89B7B8324C2EA33E1E85B80CD8E"><enum>(h)</enum><header>Termination of
				authority</header><text display-inline="yes-display-inline">The authority of
				the Secretary to obtain information from the Secretary of Health and Human
				Services under subsection (a) expires on September 30,
				2012.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7392669A63774099003C3E2373B041A4"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by adding at the end the following new item:</text>

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H186BBCBE404743C1A11C7E0514F2FEC9"><enum>(c)</enum><header>Effective
			 date</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/5320">Section 5320</external-xref> of title 38, United States Code, as added by
			 subsection (a), shall take effect 270 days after the date of the enactment of
			 this Act.</text>
			</subsection></section><section display-inline="no-display-inline" id="H317849C04E8A4E11B3E4BE6EEB27222" section-type="subsequent-section"><enum>3.</enum><header>Extension of authority
			 of Secretary of Veterans Affairs to provide an educational assistance allowance
			 to persons performing qualifying work-study activities</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/3485">Section 3485(a)(4)</external-xref> of title 38, United
			 States Code, is amended by striking <quote>June 30, 2007</quote> each place it
			 appears and inserting <quote>June 30, 2009</quote>.</text>
		</section><section display-inline="no-display-inline" id="H13BAD25609CC4257BE3100E9475DB199" section-type="subsequent-section"><enum>4.</enum><header>Provision of bronze
			 representation of the letter <quote>V</quote> for grave of eligible individual
			 buried in private cemetery in lieu of Government-provided headstone or
			 marker</header><text display-inline="no-display-inline">Section 2306(d) of
			 title 38, United States Code, is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block changed="added" committee-id="HVR00" display-inline="no-display-inline" id="H3B71C758FC324413A0AB8B35593BF07" reported-display-style="italic" style="USC">
				<paragraph id="HB03F93D60AE84B4B94BDAA8700D3CB15" indent="up1"><enum>(5)</enum><text>In lieu of furnishing a
				headstone or marker under this subsection, the Secretary may furnish, if
				requested, a bronze representation of the letter <quote>V</quote> to be
				attached to a headstone or marker furnished at private expense. The Secretary
				shall make such representation available in two sizes for such
				purpose.</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section></legis-body><official-title-amendment>Amend the title so as to read:
	 <quote>A bill to amend title 38, United States Code, to improve compensation
	 benefits for veterans in certain cases of impairment of vision involving both
	 eyes, to provide for the use of the National Directory of New Hires for income
	 verification purposes, to extend the authority of the Secretary of Veterans
	 Affairs to provide an educational assistance allowance for qualifying work
	 study activities, and to authorize the provision of bronze representations of
	 the letter <quote>V</quote> for the graves of eligible individuals buried in
	 private cemeteries in lieu of Government-provided headstones or
