		  Election Assistance Commission to develop and adopt guidelines for electronic
		  poll books in the same manner as the Commission develops and adopts voluntary
		  voting system guidelines under the Act, and for other

		<section id="HAAB59F48CCDB4D04837E3EE375DC62FD" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>E-Poll
			 Book Improvement Act of 2007</quote>.</text>
		</section><section id="H0F643A0F5F1B456EAB28CDC17BB7FAF5" section-type="subsequent-section"><enum>2.</enum><header>Development and
			 Adoption of Guidelines For Electronic Poll Books</header>
			<subsection id="H0F32B94964C74E999DBB5BB3D254E1F"><enum>(a)</enum><header>Requiring
			 Election Assistance Commission to Develop and Adopt
			 Guidelines</header><text>Part 3 of subtitle A of the Help America Vote Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15361">42 U.S.C. 15361 et seq.</external-xref>) is amended by adding at the end the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="HDA72D79FC8BC4409B42ED7000060F286" style="OLC">
					<section id="HDEEDD03D1B0C4EF29EF635A23874B913"><enum>223.</enum><header>Development and
				Adoption of Guidelines For Electronic Poll Books</header>
						<subsection id="HBD9059C887F54BD9BAF7259F499F7335"><enum>(a)</enum><header>In
				General</header><text>Not later than 1 year after the date of the enactment of
				this section, the Commission shall develop and adopt voluntary guidelines for
				electronic poll books, in the same manner and in accordance with the same
				procedures under which the Commission develops and adopts voluntary voting
				system guidelines under this part.</text>
						</subsection><subsection id="HDB14D7F3D1A247BCA3412500055F92C5"><enum>(b)</enum><header>Electronic Poll
				Book Defined</header><text>In this section, an <quote>electronic poll
				book</quote> is an electronic mechanism (including stand-alone software) by
				which an election official at a polling place, at the time an individual seeks
				to vote, may obtain information on the individual’s eligibility to vote
				(including whether the individual is registered to vote in an election for
				Federal office, the polling place to which the individual is assigned, and
				whether the individual has already voted in the election), whether the
				mechanism is operated by integration with a voting system or independently.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H0DA531E3633248508907D7845DB5BC75"><enum>(b)</enum><header>Role of
			 Technical Guidelines Development Committee</header><text>Section 221 of such
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15361">42 U.S.C. 15361</external-xref>) is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HB660660FB4AD449697A083CA108C65A7" style="OLC">
					<subsection id="HD8A89ADD5485445680B6B608E0C0295F"><enum>(g)</enum><header>Application to
				Guidelines For Electronic Poll Books</header><text>This section shall apply
				with respect to the voluntary guidelines for electronic poll books developed
				and adopted under section 223 in the same manner as it applies to the
				development and adoption of the voluntary voting system
				guidelines.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HFA817374930A443C801DE755D32519DA"><enum>(c)</enum><header>Clerical
			 Amendment</header><text>The table of contents of such Act is amended by adding
			 at the end of the items relating to part 3 of subtitle A the following:</text>

			</subsection></section><section id="H1E18025DA4E4414E9E08D661C0FF962F"><enum>3.</enum><header>Certification and
			 Testing of Electronic Poll Books by Accredited Laboratories</header><text display-inline="no-display-inline">Section 231(a) of the Help America Vote Act
			 of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15371">42 U.S.C. 15371(a)</external-xref>) is amended by adding at the end the following new
			 paragraph:</text>
			<quoted-block display-inline="no-display-inline" id="H0131C965B576405AB48127B9E944B8B" style="OLC">
				<paragraph id="H4533D1C6E5C44CB1AC51B318CC1ED59C"><enum>(3)</enum><header>Coverage of
				electronic poll books under certification and testing of voting system hardware
				and software</header><text display-inline="yes-display-inline">For purposes of
				this section, an electronic poll book (as defined in section 223(b)) shall be
				treated as part of the hardware and software of a voting system, without regard
				to whether or not the electronic poll book operates by integration with a
				voting system or
				independently.</text>
