			 <quote><short-title>Preventing Harassment through Outbound
			 Number Enforcement (PHONE) Act of 2007</short-title></quote>.</text>

			 spoofing</header>
			<subsection id="HB6B956B808C541B8B0F50784B5F0E4AD"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following:</text>

					<section id="H9961A007643A4B888571D1978635493F"><enum>1040.</enum><header>Caller ID
				spoofing</header>
						<subsection id="H8C6100C04BE34C37A6E4F221AE7C0708"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever, in or affecting interstate or
				foreign commerce, knowingly uses or provides to another—</text>
							<paragraph id="HE1D84086ED7F4FF7A5C8E42C569BB6F3"><enum>(1)</enum><text display-inline="yes-display-inline">false caller ID information with intent to
				defraud; or</text>
							</paragraph><paragraph id="H8085DFFBEDD94BE300FBF7B7955C5E9F"><enum>(2)</enum><text display-inline="yes-display-inline">caller ID information pertaining to an
				actual person without that person’s consent and with intent to deceive the
				recipient of a call about the identity of the caller;</text>
							</paragraph><continuation-text continuation-text-level="subsection">or attempts or conspires to do so,
				shall be punished as provided in subsection (b).</continuation-text></subsection><subsection id="HD1CF57958415402DBE640076008450D2"><enum>(b)</enum><header>Punishment</header><text>Whoever
				violates subsection (a) shall—</text>
							<paragraph id="H4D3B6451039549D6B439AFE7A22D87A5"><enum>(1)</enum><text display-inline="yes-display-inline">if the offense is committed for commercial
				gain, be fined under this title or imprisoned not more than 5 years, or both;
				and</text>
							</paragraph><paragraph id="H34C4036C67DA4413B7768CFD88D1687D"><enum>(2)</enum><text display-inline="yes-display-inline">be fined under this title or imprisoned not
				more than one year, or both, in any other case.</text>
							</paragraph></subsection><subsection id="HCDE1F23D25AA41ACB3F765C63E07FFF"><enum>(c)</enum><header>Law enforcement
				exception</header><text display-inline="yes-display-inline">It is a defense to
				a prosecution for an offense under this section that the conduct involved was
				lawfully authorized investigative, protective, or intelligence activity of a
				law enforcement agency of the United States, a State, or a political
				subdivision of a State, or of an intelligence agency of the United States, or
				any activity authorized under chapter 224 of this title.</text>
						</subsection><subsection display-inline="no-display-inline" id="H9C347D6E85614199839142083933C0C4"><enum>(d)</enum><header>Forfeiture</header>
							<paragraph id="H3759CC0F9AC04C31AFB3770073EB7C24"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The court, in
				imposing sentence on a person who is convicted of an offense under this
				section, shall order that the defendant forfeit to the United States—</text>
								<subparagraph id="H340AAA6302444150A2CE731600A6DFCC"><enum>(A)</enum><text>any property, real
				or personal, constituting or traceable to gross proceeds obtained from such
				offense; and</text>
								</subparagraph><subparagraph id="H6FB2727408AF48DFA7004582D8559164"><enum>(B)</enum><text>any equipment,
				software or other technology used or intended to be used to commit or to
				facilitate the commission of such offense.</text>
								</subparagraph></paragraph><paragraph id="H357A2FCE72394780B7D4B5AF00168B50"><enum>(2)</enum><header>Procedures</header><text>The
				procedures set forth in section 413 of the Controlled Substances Act (21 U.S.C.
				853), other than subsection (d) of that section, and in Rule 32.2 of the
				Federal Rules of Criminal Procedure, shall apply to all stages of a criminal
				forfeiture proceeding under this section.</text>
							</paragraph></subsection><subsection id="HD17592FF7F3A424C9FD7E935DDAD17D6"><enum>(e)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="HB4A96F56C50A4B00003BD67CB776D9B7"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>caller ID
				information</quote> means information regarding the origination of the
				telephone call, such as the name or the telephone number of the caller;</text>
							</paragraph><paragraph id="H1794F230B50140B8A4BBA3CCDF83CBD"><enum>(2)</enum><text>the term
				<quote>telephone call</quote> means a call made using or received on a
				telecommunications service or VOIP service;</text>
							</paragraph><paragraph id="H0CD6EBFD24594F6F8901E8F5704CC6D1"><enum>(3)</enum><text>the term
				<quote>VOIP service</quote> means a service that—</text>
								<subparagraph id="HE6D74C12426F4EBEB04D00309BFCF61C"><enum>(A)</enum><text>provides real-time
				2-way voice communications transmitted using Internet Protocol, or a successor
				protocol;</text>
								</subparagraph><subparagraph id="H34883172F85D406EBCBAA575B395B8E"><enum>(B)</enum><text>is offered to the
				public, or such classes of users as to be effectively available to the public
				(whether part of a bundle of services or separately); and</text>
								</subparagraph><subparagraph id="H1321B37F98464217A53FE6005F507E42"><enum>(C)</enum><text>has the capability
				to originate traffic to, or terminate traffic from, the public switched
				telephone network or a successor network;</text>
								</subparagraph></paragraph><paragraph id="HB9DD50914B46416FB3DDFFE19200042"><enum>(4)</enum><text>the term
				<quote>State</quote> includes a State of the United States, the District of
				Columbia, and any commonwealth, territory, or possession of the United States;
				and</text>
							</paragraph><paragraph id="H10AA001C9B5849318C391EC7FCAFEC5D"><enum>(5)</enum><text>a term used in a
				definition in this subsection has the meaning given that term in section 3 of
				the Communications Act of 1934 (47 U.S.C.
				153).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H6053E65B6F1E408EA34D7E572345BB6D"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18,
			 United States Code, is amended by adding at the end the following new
			 item:</text>

			 related activity in connection with electronic mail</header><text>Section
			 1956(c)(7)(D) of title 18, United States Code, is amended by inserting
			 <quote>section 1037 (Fraud and related activity in connection with electronic
			 mail),</quote> after <quote>1032</quote>.</text>
			</subsection><subsection id="H43BBC9A9794048C5ADFBDA97F940F2C"><enum>(b)</enum><header>Caller ID
			 spoofing</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/1956">Section 1956(c)(7)(D)</external-xref> of title 18,
			 United States Code, is amended by inserting <quote>section 1040 (Caller ID
			 spoofing),</quote> before <quote>section 1111</quote>.</text>

			 spoofing</header>
			<subsection id="H737EBAEF77A244F8A6AC00436112C347"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by
			 adding at the end the following:</text>

					<section id="H8EC245FCDDC0449788C5E301912C6E5"><enum>1040.</enum><header>Caller ID
				spoofing</header>
						<subsection id="H1C6239B3E10E462AB2EDC8981BB2EBFE"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever, in or affecting interstate or
				foreign commerce, knowingly uses or provides to another—</text>
							<paragraph id="H02487F915C834429BD3540D6887E71F"><enum>(1)</enum><text display-inline="yes-display-inline">false caller ID information with intent
				wrongfully to obtain anything of value; or</text>
							</paragraph><paragraph id="H5A607BAA05BC4617B668536F0060DB89"><enum>(2)</enum><text display-inline="yes-display-inline">caller ID information pertaining to an
				actual person or other entity without that person’s or entity’s consent and
				with intent to deceive any person or other entity about the identity of the
				caller;</text>
							</paragraph><continuation-text continuation-text-level="subsection">or
				attempts or conspires to do so, shall be punished as provided in subsection
				(b).</continuation-text></subsection><subsection id="H3DDB3ED0B3A1462693C7002D599E00E4"><enum>(b)</enum><header>Punishment</header><text>Whoever
				violates subsection (a) shall—</text>
							<paragraph id="H7C9B55EDAECC4B459007B6E4B00F981"><enum>(1)</enum><text display-inline="yes-display-inline">if the offense is a violation of subsection
				(a)(1), be fined under this title or imprisoned not more than 5 years, or both;
				and</text>
							</paragraph><paragraph id="H69933FF21B5A4ACEB8071500A6FD3350"><enum>(2)</enum><text display-inline="yes-display-inline">if the offense is a violation of subsection
				(a)(2), be fined under this title or imprisoned not more than one year, or
				both.</text>
							</paragraph></subsection><subsection id="H6BCF3BE28D414114B5612B07D2DF944"><enum>(c)</enum><header>Law enforcement
				exception</header><text display-inline="yes-display-inline">This section does
				not prohibit lawfully authorized investigative, protective, or intelligence
				activity of a law enforcement agency of the United States, a State, or a
				political subdivision of a State, or of an intelligence agency of the United
				States, or any activity authorized under chapter 224 of this title.</text>
						</subsection><subsection display-inline="no-display-inline" id="HA03A0838E8DD46918458F74416EED0B5"><enum>(d)</enum><header>Forfeiture</header>
							<paragraph id="H384C5A38CA724B3AA47E7EF4B816A3AC"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The court, in
				imposing sentence on a person who is convicted of an offense under this
				section, shall order that the defendant forfeit to the United States—</text>
								<subparagraph id="HC1817730EFA54AAD92B84DFD9100F832"><enum>(A)</enum><text>any property, real or
				personal, constituting or traceable to gross proceeds obtained from such
				offense; and</text>
								</subparagraph><subparagraph id="HE87D14BB273A45BCAFF406029B7CBBB6"><enum>(B)</enum><text>any equipment, software
				or other technology used or intended to be used to commit or to facilitate the
				commission of such offense.</text>
								</subparagraph></paragraph><paragraph id="HD19D4273CAD04F3FB630E307B2013739"><enum>(2)</enum><header>Procedures</header><text>The
				procedures set forth in section 413 of the Controlled Substances Act (21 U.S.C.
				853), other than subsection (d) of that section, and in Rule 32.2 of the
				Federal Rules of Criminal Procedure, shall apply to all stages of a criminal

							</paragraph></subsection><subsection id="H7212E82C41524A99A31596F741122CA9"><enum>(e)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="H66F3592440CF4CC393003E29E13DD951"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>caller ID
				information</quote> means any identifying information regarding the origination
				of a telephone call, including the name or the telephone number of the caller,
				that is transmitted with the telephone call;</text>
							</paragraph><paragraph id="H0AD48DD0AA9C4515B1783DA01D480496"><enum>(2)</enum><text>the term <quote>telephone
				call</quote> means a call made using or received on a telecommunications
				service or VOIP service;</text>
							</paragraph><paragraph id="H0630BC9F0440475C925762864BCC607D"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>telecommunications
				service</quote> means the offering of telecommunications for a fee directly to
				the public, or to such classes of users as to be effectively available directly
				to the public, regardless of the facilities used;</text>
							</paragraph><paragraph id="H9B4F13053A2C41D593F4ED46B3BE4B28"><enum>(4)</enum><text>the term <quote>VOIP
				service</quote> means a service that—</text>
								<subparagraph id="H9877B035F74042809C2E9799C2B4F630"><enum>(A)</enum><text>provides real-time or
				near real-time voice communications transmitted using Internet Protocol, or a
				successor protocol;</text>
								</subparagraph><subparagraph id="H026051D14D4349A1B779A8517800D243"><enum>(B)</enum><text>is offered to the public,
				or such classes of users as to be effectively available to the public (whether
				part of a bundle of services or separately); and</text>
								</subparagraph><subparagraph id="H3901B8D63FD94BC7B10046CD61923D30"><enum>(C)</enum><text>has the capability to
				originate traffic to, or terminate traffic from, the public switched telephone
				network or a successor network; and</text>
								</subparagraph></paragraph><paragraph id="HD3328E66CC3D49139976FD7CA20829C"><enum>(5)</enum><text>the term
				<quote>State</quote> includes a State of the United States, the District of
				Columbia, and any commonwealth, territory, or possession of the United
				States.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
