<section id="H280EB824B6E24764B0C8719944368293" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <short-title><quote>Limitation on Nuclear Cooperation with the United Arab Emirates Act of 2008</quote></short-title>.</text></section> 
<section id="H0052D66DADD8407D92ECDAF71BE70100"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HA40C82856BFD4D5487BFC5E5F1CE8C4B"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> 
<subparagraph id="H1D22C396C54143BF8D6D167074BC9DF1"><enum>(A)</enum><text>the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph> 
<subparagraph id="HCC8702A20EE34D76B06F9D70A7B87394"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H79A65B1C10674B6C9400C1E0AE7F7EF1"><enum>(2)</enum><header>Government of the United Arab Emirates</header> 
<subparagraph id="HDDF058B4AE3D4465B9DC026C4800FA33"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>Government of the United Arab Emirates</term> includes the government of any subdivision of the United Arab Emirates, and any agency or instrumentality of the Government of the United Arab Emirates.</text></subparagraph> 
<subparagraph id="H01FAD566A2374C12B9B29603B7294D86"><enum>(B)</enum><header>Agency or instrumentality</header><text>For purposes of subparagraph (A), the term <term>agency or instrumentality of the Government of the United Arab Emirates</term> means an agency or instrumentality of a foreign state as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/1603">section 1603(b)</external-xref> of title 28, United States Code, with each reference in such section to <quote>a foreign state</quote> deemed to be a reference to <quote>the United Arab Emirates</quote>.</text></subparagraph></paragraph> 
<paragraph id="HA20BB3AEFDA34B9AAFB55F0DFBE5BFC"><enum>(3)</enum><header>Government of Iran</header> 
<subparagraph id="HA236C8C6B26E4AFAB993BC90094F731"><enum>(A)</enum><header>In general</header><text>The term <term>Government of Iran</term> includes the government of any subdivision of Iran, and any agency or instrumentality of the Government of Iran.</text></subparagraph> 
<subparagraph id="HFB54996927254E619C22C6479002E00"><enum>(B)</enum><header>Agency or instrumentality</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term <term>agency or instrumentality of the Government of Iran</term> means an agency or instrumentality of a foreign state as defined in <external-xref legal-doc="usc" parsable-cite="usc/28/1603">section 1603(b)</external-xref> of title 28, United States Code, with each reference in such section to <quote>a foreign state</quote> deemed to be a reference to <quote>Iran</quote>.</text></subparagraph></paragraph> 
<paragraph id="H345FAAA384FC49C3B8C3BBC1F716902F"><enum>(4)</enum><header>National of the United Arab Emirates</header><text>The term <term>national of the United Arab Emirates</term> means—</text> 
<subparagraph id="H18CB322C1B224CB3B3BDD20680EB577C"><enum>(A)</enum><text display-inline="yes-display-inline">any citizen of the United Arab Emirates; or</text></subparagraph> 
<subparagraph id="H189C5280857D4E4BB7A3CA51DFC3F00"><enum>(B)</enum><text display-inline="yes-display-inline">any other legal entity that is organized under the laws of the United Arab Emirates.</text></subparagraph></paragraph> 
<paragraph id="H58CF001E4608434B9538FAC44E76C872"><enum>(5)</enum><header>National of Iran</header><text>The term <term>national of Iran</term> means—</text> 
<subparagraph id="H937F36F0363443B6BE8CCE6F1307A3BC"><enum>(A)</enum><text>any citizen of Iran; or</text></subparagraph> 
<subparagraph id="H52FF5C4A16004932B77F2996098C3200"><enum>(B)</enum><text>any other legal entity that is organized under the laws of Iran.</text></subparagraph></paragraph></section> 
<section id="H183A0EDA00A04D3FB392F600D6B85E95"><enum>3.</enum><header>Restriction on nuclear cooperation with the United Arab Emirates</header> 
<subsection id="HB84CBBA7BC66427FAE9E148F15B55624" display-inline="no-display-inline"><enum>(a)</enum><header>Restriction on nuclear cooperation agreement</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law or any international agreement, no agreement for cooperation between the United States of America and the United Arab Emirates pursuant to section 123 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2153">42 U.S.C. 2153</external-xref>) may enter into force on or after the date of the enactment of this Act unless not less than 30 legislative days prior to such entry into force the President certifies to the appropriate congressional committees that the requirements of subsection (c) have been met.</text></subsection> 
<subsection id="H7DC9BFB6BCF74227B7EE022EBB93E944"><enum>(b)</enum><header>Restriction on exports of nuclear material, equipment, or technology</header><text display-inline="yes-display-inline">No license may be issued for the export of nuclear material, equipment, or technology to the United Arab Emirates pursuant to an agreement for cooperation between the United States of America and the United Arab Emirates pursuant to section 123 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2153">42 U.S.C. 2153</external-xref>) for any fiscal year beginning after the date of the enactment of this Act unless not less than 30 legislative days prior to the issuance of such license the President certifies to the appropriate congressional committees for such fiscal year that the requirements of subsection (c) have been met.</text></subsection> 
<subsection id="H8EA2D764F05444D7A0061BD1002DB88D"><enum>(c)</enum><header>Requirements</header><text>The requirements referred to in this subsection are the following:</text> 
<paragraph id="HA67A45D100F94990903900C9F5DDBC2"><enum>(1)</enum><text display-inline="yes-display-inline">The Government of the United Arab Emirates has taken, and is continuing to take, effective actions to prohibit, terminate, and prevent the transfer of goods, services, or technology to the Government of Iran, including fully implementing United Nations Security Council sanctions against Iran.</text></paragraph> 
<paragraph id="HA7A50B386057415D8222353E9C3E99C4"><enum>(2)</enum><text>For the preceding 12-month period—</text> 
<subparagraph id="H182C42FDF8344234916ED6E9C335100"><enum>(A)</enum><text display-inline="yes-display-inline">there has been no cooperation with respect to any activity described in paragraph (1) between the Government of the United Arab Emirates and the Government of Iran, any national of Iran, or any Iranian-controlled entity based on all credible information available to the United States at the time of the certification; </text></subparagraph> 
<subparagraph id="H1C389F3311D845D8979D1BEA530200E6"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H67C26F21E1484D8CB89DB8443534BAFB"><enum>(i)</enum><text display-inline="yes-display-inline">there has been no cooperation with respect to any activity described in paragraph (1) between any national of the United Arab Emirates and the Government of Iran, any national of Iran, or any Iranian-controlled entity based on all credible information available to the United States at the time of the certification; or</text></clause> 
<clause id="HEC20C8F3F8304DD6BE1B8F817CF0C22E" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">the Government of the United Arab Emirates has—</text> 
<subclause id="HEA7A07B7C4A74D4586B4000023058EB0"><enum>(I)</enum><text display-inline="yes-display-inline">terminated all cooperation between any such United Arab Emirates national and the Government of Iran, any such Iranian national, or any such Iranian-controlled entity;</text></subclause> 
<subclause id="H544030DFECA64C3400ACBB636C435CE2"><enum>(II)</enum><text>instituted effective measures to prevent a reoccurrence of any such cooperation; and </text></subclause> 
<subclause id="H7A26CE1DDC85452D9409D218E93EA8D4"><enum>(III)</enum><text display-inline="yes-display-inline">prosecuted any such United Arab Emirates national; and</text></subclause></clause></subparagraph> 
<subparagraph id="HD106D62E44BF4BCAA4E03DD42E977E11"><enum>(C)</enum><text>the Government of the United Arab Emirates has not engaged in or condoned activities that violate—</text> 
<clause id="H677A07ABDEE941E9B5B2E976F769BABC"><enum>(i)</enum><text display-inline="yes-display-inline">the Iran Sanctions Act of 1996, including Executive Orders 12957, 12959, 13059 and other executive orders issued pursuant to such Act;</text></clause> 
<clause id="HE602178795224EABA8BECFF75BE5B666"><enum>(ii)</enum><text>the Iran, North Korea, and Syria Nonproliferation Act; and</text></clause> 
<clause id="H7B45B6047A524A15A5757F9998AFC977" commented="no"><enum>(iii)</enum><text>other provisions of applicable United States law.</text></clause></subparagraph></paragraph> 
<paragraph id="H35DFA5C1B033483D8C51E6483508C76D"><enum>(3)</enum><text>The Government of the United Arab Emirates—</text> 
<subparagraph id="HA3EDADF2D9604412A9D9FB3904116C48"><enum>(A)</enum><text>has developed and fully implemented an export control regime in accordance with international standards; and</text></subparagraph> 
<subparagraph id="H72C4CD95C9AD46248851DA34EC294EC0"><enum>(B)</enum><text>has developed and implemented the appropriate or necessary legislative and functional actions to target the logistical and financial networks that support terrorist organizations.</text></subparagraph></paragraph></subsection> 
<subsection id="H53CE59CC168B410EA7D4744D054544F2"><enum>(d)</enum><header>Goods, services, or technology defined</header> 
<paragraph id="H460383C30E8D416D8C04FAA55C9C5E8C"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), in this section, the term <term>goods, services, or technology</term> means—</text> 
<subparagraph id="HE7670BDFA59144CD9EB256BA5E9C6600"><enum>(A)</enum><text>goods, services, or technology listed on—</text> 
<clause id="HECF492910ABD45A4BAEE99657EE58213"><enum>(i)</enum> 
<subclause id="HEFE683B52C6F460EAA15AAB7ABE5BC6D" commented="no" display-inline="yes-display-inline"><enum>(I)</enum><text>the Nuclear Suppliers Group Guidelines for the Export of Nuclear Material, Equipment and Technology (published by the International Atomic Energy Agency as Information Circular INFCIRC/254/Rev. 8/Part 1, and subsequent revisions) and Guidelines for Transfers of Nuclear-Related Dual-Use Equipment, Material, and Related Technology (published by the International Atomic Energy Agency as Information Circular INFCIRC/254/Rev. 7/Part 2, and subsequent revisions);</text></subclause> 
<subclause id="H0F3ED261B4F54CE8AF4007216DB14CCB" indent="up1"><enum>(II)</enum><text>the Missile Technology Control Regime Equipment and Technology Annex of June 11, 1996, and subsequent revisions;</text></subclause> 
<subclause id="HE480EF8EED8A4576BBB4765957BC7B6F" indent="up1"><enum>(III)</enum><text>the lists of items and substances relating to biological and chemical weapons the export of which is controlled by the Australia Group;</text></subclause> 
<subclause id="H0F5B4E0894574B2A8BBAB600BF58002E" indent="up1"><enum>(IV)</enum><text>the Schedule One or Schedule Two list of toxic chemicals and precursors the export of which is controlled pursuant to the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction; </text></subclause> 
<subclause id="HDDEAD63AF4ED4C62AFAA681DDC31A389" indent="up1"><enum>(V)</enum><text>the Wassenaar Arrangement list of Dual Use Goods and Technologies and Munitions list of July 12, 1996, and subsequent revisions; </text></subclause> 
<subclause id="HC4A2709007244D4A80F9E433C8F4081F" indent="up1" commented="no"><enum>(VI)</enum><text>the United States Munitions List under section 38 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2778">22 U.S.C. 2778</external-xref>) for which special export controls are warranted under such Act (22 U.S.C. 2751 3 et seq.); or</text></subclause> 
<subclause id="H60812E92088543C2BB77BE4E3ED9E09E" indent="up1" commented="no"><enum>(VII)</enum><text display-inline="yes-display-inline">the Commerce Control List maintained under part 774 of title 15, Code of Federal Regulations; or</text></subclause></clause></subparagraph> 
<subparagraph id="HC57564CF71BA4F2BAEEF6FE856602394"><enum>(B)</enum><text>goods, services, or technology not listed on any list identified in subparagraph (A) but which nevertheless would be, if they were United States goods, services, or technology, prohibited for export to Iran because of their potential to make a material contribution to the development of nuclear, biological, or chemical weapons, or of ballistic or cruise missile systems.</text></subparagraph></paragraph> 
<paragraph id="H88F2F3413D4346D7BABA74C4C57D246D"><enum>(2)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>goods, services, or technology</term> does not include goods, services, or technology that are directly related to the operation of the Bushehr nuclear power reactor.</text></paragraph></subsection></section> 
<section id="H55DFADB46A6044189188CAAE698E003F"><enum>4.</enum><header>Requirement for congressional approval of agreements for peaceful nuclear cooperation</header> 
<subsection id="H5DA1BE31D0B945738EB1F6F8F2C8FC00"><enum>(a)</enum><header>Cooperation with other nations</header><text display-inline="yes-display-inline">Section 123 d. of the Atomic Energy Act of 1954 (42 U.S.C. 2153 d.) is amended in the first sentence—</text> 
<paragraph id="H92B9DB79F323461ABD003855005B8C9B"><enum>(1)</enum><text>by striking <quote>not</quote> the first and second place it appears;</text> </paragraph> 
<paragraph id="H365178C304E3409AB5570004E344CBF2"><enum>(2)</enum><text>by inserting <quote>only</quote> after <quote>effective</quote>; and</text> </paragraph> 
<paragraph id="H1348364B268340E4B4C321CC8F06BA1"><enum>(3)</enum><text>by striking <quote><italic>Provided further</italic>,</quote> and all that follows through the period at the end.</text> </paragraph></subsection> 
<subsection id="H9535FF53D4E44992A544D7DDD97CB277"><enum>(b)</enum><header>Subsequent arrangements</header><text>Section 131 a.(1) of such Act is amended—</text> 
<paragraph id="H3C6146C6455B4A6D00423F81BB42CD49"><enum>(1)</enum><text>in the second sentence, by striking <quote>, security</quote> and all that follows through the period at the end; and</text> </paragraph> 
<paragraph id="H3028A9B86DB244B0B73E459728008D74"><enum>(2)</enum><text>by inserting after the second sentence the following: <quote>Such subsequent arrangement shall not take effect unless the Congress enacts a joint resolution of approval, according to the procedures of sections 123 d. and 130 i. of this Act. Any such nuclear proliferation assessment statement shall be submitted to the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate no later than the 31st day of continuous session after submission of the subsequent arrangement.</quote>.</text> </paragraph></subsection></section> 
<section id="HAF91D3C33B844BEBB7F4FB1C2D8300A8"><enum>5.</enum><header>Initiatives and negotiations relating to agreements for peaceful nuclear cooperation</header><text display-inline="no-display-inline">Section 123 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2153">42 U.S.C. 2153</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H52E5119FC85E490EA93B48558EA28952" other-style="archaic" style="other"> 
<subsection id="H9B83C4C2CC8D457B98D6C675E5CE5584"><enum>e.</enum><text display-inline="yes-display-inline">The President shall keep the Committee on Foreign Affairs of the House of Representatives and the Committee on Foreign Relations of the Senate fully and currently informed of any initiative or negotiations relating to a new or amended agreement for peaceful nuclear cooperation pursuant to this section prior to the President’s announcement of such initiative or negotiations. The President shall consult with the appropriate congressional committees concerning such initiative or negotiations beginning not less than 15 calendar days after the initiation of any such negotiations, or the receipt or transmission of a draft agreement, whichever occurs first, and monthly thereafter until such time as the negotiations are concluded.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
