		<official-title>To allow flood insurance coverage under the national
		  flood insurance program for new structures designed to protect public safety
		  that are located in special flood hazard zones, and for other
		  purposes.</official-title>

		<section id="H9B4E4DC33C524B76A646D5C939A92557" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Safety Enhancement Act of
			 2008</short-title></quote>.</text>
		</section><section id="HF745B0E9A7A2441F9CD46F827F76A8B7"><enum>2.</enum><header>Exception to
			 prohibition of insurance for properties in violation of State and local laws
			 regarding development in flood-prone areas</header><text display-inline="no-display-inline">Section 1316 of the National Flood Insurance
			 Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/4023">42 U.S.C. 4023</external-xref>) is amended by inserting <quote>, other than a
			 qualified public safety structure (as such term is defined in section
			 1370(a)),</quote> after <quote>for any property</quote>.</text>
		</section><section id="H7A035450CEA348E400F4532F53D59475"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Subsection (a) of section 1370 of the
			 National Flood Insurance Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/40121">42 U.S.C. 40121</external-xref>) is amended—</text>
			<paragraph id="H1D97E05BAE7C4779A991A3A299B31590"><enum>(1)</enum><text>in paragraph (14),
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="H224F9DC8335F466190230089A0141135"><enum>(2)</enum><text>in paragraph (15),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
			</paragraph><paragraph id="HA3B900DE3300412FAD95B459222FEE00"><enum>(3)</enum><text>by adding at the
			 end the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HAAC081AB82EA409684D5D823A500D5EC" style="OLC">
					<paragraph id="HCE8AAFF9058348C8AB0997383317D16F"><enum>(16)</enum><text display-inline="yes-display-inline">The term <quote>qualified public safety
				structure</quote> means any of the following structures:</text>
						<subparagraph id="H3F672B7B74F74188AC0030371FE503AB"><enum>(A)</enum><text>A structure that
				is used in providing a public safety service, which shall include police and
				firefighting services.</text>
						</subparagraph><subparagraph id="H68E42E4356DE43298C8EE7283CD0000"><enum>(B)</enum><text>A structure
				that—</text>
							<clause id="H435BAA10F7B448088035AE45EABCF81"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="HF854DE4448784CE4BBAF77FFCD8D425F"><enum>(I)</enum><text>is newly constructed on
				the same site of a structure that was destroyed or damaged, at no fault of the
				owner, during any period during which the site of such structure is located
				within an area designated as having special flood hazards; and</text>
								</subclause><subclause id="HC6A891DD870C4D8990FB3D292C25F348" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">does
				not exceed the size, by square footage, of the destroyed or damaged structure;
				or</text>
								</subclause></clause><clause id="HCB25DC59235E4D018EE1A853DCE5E06F"><enum>(ii)</enum><text display-inline="yes-display-inline">is substantially improved pursuant to
				destruction or damage that occurred, at no fault of the owner, during any
				period during which the site of such structure is located within an area
				designated as having special flood hazards.</text>
							</clause></subparagraph><subparagraph id="H0D6A6F05283247FCAF2038926D8063F4"><enum>(C)</enum><text display-inline="yes-display-inline">A newly constructed structure that—</text>
							<clause id="HC1CCE0D5F08041C888CA29642CA79D40"><enum>(i)</enum><text>is
				located on the same property as a structure that was removed through use of
				eminent domain by the Federal Government or any State or local government;
				and</text>
							</clause><clause id="H66DAA0F7B46A45248C1B787370980070"><enum>(ii)</enum><text>does not exceed
				the size, by square footage, of the structure so
				removed.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
