		<official-title>To direct the Election Assistance Commission to make
		  grants to States to carry out election administration improvement
		  plans.</official-title>

		<section id="H9C720968459D4AFBB85D309869FA7829" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Critical Election Infrastructure Act of
			 2008</short-title></quote>.</text>
		</section><section id="HCBCE6721F82D4CCEAC0594DAC1D911C3"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H4761791E3F9649D98190214F40007C82"><enum>(1)</enum><text display-inline="yes-display-inline">Roughly 130 million votes were cast in the
			 United States in the November 2008 general election, representing over 61% of
			 the Nation’s population.</text>
			</paragraph><paragraph id="HA581F0ED3C04409D8888F84240E18976"><enum>(2)</enum><text>Hundreds of
			 thousands of individuals were forced to wait in lines for 5 hours or longer in
			 order to cast their votes, both during early voting periods and on Election
			 Day.</text>
			</paragraph><paragraph id="H80AAFDE5ED1C43BF9E5090A2F378B73C"><enum>(3)</enum><text>Hundreds of
			 jurisdictions lacked the necessary equipment and personnel to speedily and
			 efficiently meet the needs of such large turnout.</text>
			</paragraph></section><section id="HA598DF22FB7748B2BEBB91A0486C21DD"><enum>3.</enum><header>Grants to States
			 for Election Administration Improvements</header>
			<subsection id="H0EF0CCCC44F049379812CE6800BCEE0"><enum>(a)</enum><header>Grants
			 Authorized</header><text display-inline="yes-display-inline">The Election
			 Assistance Commission (hereafter referred to as the <quote>Commission</quote>)
			 shall make grants to eligible States to carry out election administration
			 improvement plans.</text>
			</subsection><subsection id="H189FBECA15F54C69AC5E2277896634D9"><enum>(b)</enum><header>Plans
			 Described</header><text display-inline="yes-display-inline">For purposes of
			 this Act, an election administration improvement plan is a plan established by
			 a State to promote efficiency and fairness in the operation of polling places
			 at which individuals cast ballots in elections for Federal office held in the
			 State (including early voting sites), which may include the acquisition of
			 additional voting systems and equipment, improved training of election
			 administration officials, and the allocation of additional election
			 administration officials to polling places serving greater numbers of
			 voters.</text>
			</subsection><subsection id="HB4ECFC02D37244578E17D5CECF5D26B6"><enum>(c)</enum><header>Eligibility</header><text>A
			 State is eligible to receive a grant under this Act if it submits to the
			 Commission (at such time and in such form as the Commission may require) an
			 application containing—</text>
				<paragraph id="H05AA025426A647F2995E31F0445CD59"><enum>(1)</enum><text>the State’s
			 election administration improvement plan;</text>
				</paragraph><paragraph id="H6DBF9D7719284A05AAEA40A4DB0D1DD"><enum>(2)</enum><text>a
			 description of how the State will use the funds provided under the grant to
			 carry out the plan; and</text>
				</paragraph><paragraph id="H46232E83EEA44FF2BAC571E8E67C2F7B"><enum>(3)</enum><text>such other
			 information and certifications as the Commission may require.</text>
				</paragraph></subsection><subsection id="H102DCB32C3A34E96B025D6E170802C51"><enum>(d)</enum><header>Amount of
			 Grant</header><text>The amount of the grant made to an eligible State under
			 this Act shall be determined by the Commission, taking into account the
			 contents of application submitted by the State under subsection (c), the amount
			 of funds available for grants to all States, and such other factors as the
			 Commission considers appropriate.</text>
			</subsection><subsection id="H7A4B019DC78E495A90B5D183EB3C55C2"><enum>(e)</enum><header>State
			 Defined</header><text display-inline="yes-display-inline">In this Act, the term
			 <term>State</term> includes the District of Columbia, the Commonwealth of
			 Puerto Rico, Guam, American Samoa, and the United States Virgin Islands.</text>
			</subsection></section><section id="H9B838925F383420D9D78209191A14859"><enum>4.</enum><header>Authorization of
			 Appropriations</header>
			<subsection id="HD2FFD4D9BCA04D0C9F01E3AD3FE6FDBD"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">There are authorized
			 to be appropriated for grants under this Act $250,000,000 for each of the
			 fiscal years 2009 through 2012.</text>
			</subsection><subsection id="HACB0742ACDEF4055965FC9A193EE7291"><enum>(b)</enum><header>Continuing
			 Availability of Funds</header><text>Any amounts appropriated pursuant to the
			 authorization under this section shall remain available until expended.</text>
