		<official-title>To amend part D of title IV of the Social Security Act to
		  prohibit States from charging child support recipients for the collection of
		  child support.</official-title>

		<section display-inline="no-display-inline" id="HFEA01EC3A0614DA288819CC0E1A336FD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Elimination of Single Parent Tax Act
			 of 2008</short-title></quote>.</text>
		</section><section id="H0410A1DE3B0F4FFFBFF410DCDA013B52"><enum>2.</enum><header>Prohibition on
			 States from charging child support recipients for the collection of child
			 support</header><text display-inline="no-display-inline">Section 454(6)(B)(ii)
			 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/654">42 U.S.C. 654(6)(B)(ii)</external-xref>) is amended—</text>
			<paragraph id="HCC89312B477C4BE8ABEDB59864E17C7"><enum>(1)</enum><text>by
			 striking <quote>retained by the State from support collected on behalf of the
			 individual (but not from the first $500 so collected), paid by the individual
			 applying for the services,</quote>; and</text>
			</paragraph><paragraph id="H1543401639BF47DEA3823B85BD009318"><enum>(2)</enum><text>by striking the
			 comma after <quote>absent parent</quote>.</text>
			</paragraph></section><section id="H7D570179DCDC4244845B458B6EE2B9F2"><enum>3.</enum><header>Conforming
			 amendments</header><text display-inline="no-display-inline">Section 457(a)(4)
			 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/657">42 U.S.C. 657(a)(4)</external-xref>), as amended by section 7301 of
			 the Deficit Reduction of 2005, is amended—</text>
			<paragraph id="HCDB74DB9BD8243A0ABB0CB0047962E87"><enum>(1)</enum><text>by striking
			 <quote>the portion of </quote>; and</text>
			</paragraph><paragraph id="HC047E7B4F71E46D0BEC4A2B22642DF25"><enum>(2)</enum><text>by striking
			 <quote>that remains after withholding any fee pursuant to section
			 454(6)(B)(ii)</quote>.</text>
			</paragraph></section><section id="HDCB36EC4F4ED4333864D199527FC241B"><enum>4.</enum><header>Effective
			 date</header>
			<subsection id="H8FDEA1BE8DDB44B99DDC858834708BE7"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as otherwise
			 provided in subsection (b), each amendment made by this Act to part D of title
			 IV of the Social Security Act shall take effect on October 1, 2009, and shall
			 apply to payments under such part for quarters beginning on or after such
			 date.</text>
			</subsection><subsection id="H7E2843AB5D8A45F8B7120309DAB6EE68"><enum>(b)</enum><header>Delay permitted
			 if state legislation required</header>
				<paragraph id="H169CF0CDF091475CAB8FEF25F17FE30"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Until the date
			 described in paragraph (2), a qualified State plan shall not be regarded as
			 failing to comply with part D of title IV of the Social Security Act, solely by
			 reason of the plan failing to comply with the additional requirements imposed
			 by reason of this Act.</text>
				</paragraph><paragraph id="H9FBFEA6942C74F4B9C003EAB38967E3C"><enum>(2)</enum><header>Date
			 described</header>
					<subparagraph id="H580527F3F67D4D2682FFFBCC52947DCC"><enum>(A)</enum><header>In
			 general</header><text>The date described in this paragraph is the first day of
			 the first calendar quarter that begins after the close of the first regular
			 session of the State legislature that ends after the effective date of this
			 Act.</text>
					</subparagraph><subparagraph id="H6BF62EF1CD9B4C44AD23583E183C55F9"><enum>(B)</enum><header>Special
			 rule</header><text>For purposes of subparagraph (A), in the case of a State
			 that has a 2-year legislative session, each year of the session is deemed to be
			 a separate regular session of the State legislature.</text>
					</subparagraph></paragraph><paragraph id="H88EC4C74CC994104951927E4438FF743"><enum>(3)</enum><header>Qualified state
			 plan</header><text>In paragraph (1), the term <term>qualified State plan</term>
			 means a State plan, approved under part D of title IV of the Social Security
			 Act, which the Secretary of Health and Human Services determines will require
			 State legislation (other than legislation appropriating funds) in order for the
			 plan to meet the additional requirements imposed by reason of this Act.</text>
