<section id="H3855465274BB4F5F94CC8BFB2F9243B3" section-type="section-one"><enum>1.</enum><header>Exclusion of gain from sale or exchange of certain mortgages and mortgage-related securities</header> 
<subsection id="H36A97E6AE715492DBF0807F899AF00D7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part I of subchapter P of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to treatment of capital gains) is amended by adding at the end:</text>

<section id="H60A61552B0424BBE8B4000FD44A7CAAE"><enum>1203.</enum><header>Exclusion of gain from sale or exchange of certain mortgages and mortgage-related securities</header> 
<subsection id="H9C806F50477A484ABCECEE10005C43"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be excluded from gross income gain from the sale or exchange of a qualified mortgage or mortgage-related security held for more than 1 year.</text></subsection> 
<subsection id="HD44E8396849148EB86BE18DDDD234499"><enum>(b)</enum><header>Qualified mortgage or mortgage-related security</header><text>For purposes of this section, the term <term>qualified mortgage or mortgage-related security</term> means any residential or commercial mortgage (or any security, obligation, or other instrument which is based on or related to such a mortgage) which in each case—</text> 
<paragraph id="HBA543B7D161E490EA869AAFBD9E484EC"><enum>(1)</enum><text>was originated or issued on or before March 14, 2008, and</text></paragraph> 
<paragraph id="H61A718AACC674528B300D98D54BF1210"><enum>(2)</enum><text>was acquired by the taxpayer after the date of the enactment of this section and before January 1, 2009.</text></paragraph></subsection> 
<subsection id="H207669B10B8941AAA57580BB3468D1A8"><enum>(c)</enum><header>Related parties</header><text>Subsection (a) shall not apply to any sale to, or exchange with, any person who bears a relationship to the taxpayer which is described in section 267(b) or 707(b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H21C0267BB4934F3F8D500652D359CF95"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for part I of subchapter P of chapter 1 of such Code is amended by adding at the end the following new item:</text>

<subsection id="HB1C4463BC72E43F1BCA4A006ABBA4655"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to sales and exchanges after the date of the enactment of this Act.</text></subsection></section>
