<official-title>To authorize a land exchange to acquire lands for the Blue Ridge Parkway from the Town of Blowing Rock, North Carolina, and for other purposes.</official-title>

<section id="H16623202C1CF42F693001D4BDF3162B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blue Ridge Parkway and Town of Blowing Rock Land Exchange Act of 2008</short-title></quote>.</text></section> 
<section id="HEA09A4452209470D909E00ABC5171303"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H7D2DFA9D54CA41B6B8369E2FE6B46FB1"><enum>(1)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HACD2AB76FB2D43F4B297268251F7361E"><enum>(2)</enum><header>Town</header><text>The term <quote>Town</quote> means the Town of Blowing Rock in the State of North Carolina.</text></paragraph> 
<paragraph id="H4E911FDA0A6C4C5CA2339CEB06DB04DB"><enum>(3)</enum><header>Map</header><text>The term <quote>map</quote> means the National Park Service map entitled <quote>____</quote>, numbered <quote>___</quote>, and dated <quote>____</quote>.</text></paragraph> 
<paragraph id="H9C20B46D033F46C0A0BDA97F79E7501"><enum>(4)</enum><header>Exchange</header><text>The term <quote>exchange</quote> means the exchange of land authorized by section 3(a).</text></paragraph></section> 
<section id="HF2E7D3CACF7F46C5B41159FEDBB1DAF5"><enum>3.</enum><header>Land exchange</header> 
<subsection id="H65EF75D9FD43440AB654AE955DE4E012"><enum>(a)</enum><header>In general</header><text>Subject to subsection (d), the Secretary may exchange approximately 20 acres of land within the boundary of the Blue Ridge Parkway that are generally depicted on the map as <quote>Blowing Rock Reservoir</quote>, for approximately 192 acres of land owned by the Town that are generally depicted on the map as <quote>Town of Blowing Rock Exchange Lands</quote>.</text></subsection> 
<subsection id="H73842DA0D7EF4E0B8E0077D7235CD686"><enum>(b)</enum><header>Map availability</header><text>The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></subsection> 
<subsection id="H6092661259DA4700BBEF12F454D5808"><enum>(c)</enum><header>Timing</header><text>The Secretary shall seek to complete the land exchange not later than two years after the date of enactment of this Act.</text></subsection> 
<subsection id="H34178BDD5A324216B959D58D7983AAA"><enum>(d)</enum><header>Applicable laws; terms and conditions</header><text>The exchange shall be subject to—</text> 
<paragraph id="H8F353BFDD9AC435D8EA0040150EACA29"><enum>(1)</enum><text>laws, regulations, and policies applicable to exchanges of land administered by the National Park Service, including those concerning land appraisals, equalization of values, and environmental compliance; and</text></paragraph> 
<paragraph id="H974274F2CDEA4610BF2EFF00F6DF573C"><enum>(2)</enum><text>such terms and conditions as the Secretary considers appropriate.</text></paragraph></subsection> 
<subsection id="HD0A30AFD0E8E4E03B7371B93C4E8A6DF"><enum>(e)</enum><header>Boundary adjustment</header><text>Upon completion of the exchange, the Secretary shall adjust the boundary of the Blue Ridge Parkway to reflect the exchanged lands.</text></subsection> 
<subsection id="H15CC34ED5D0D4DF5AA338EBDD7C2F156"><enum>(f)</enum><header>Administration</header><text>Lands acquired by the Secretary through the exchange shall be administered as part of the Blue Ridge Parkway in accordance with all applicable laws and regulations.</text></subsection> 
<subsection id="H5C077628EA69427396B700BD1690C781"><enum>(g)</enum><header>Future disposition of property</header><text>If the Town desires to dispose of the reservoir property that is the subject of the exchange, the Secretary shall have the right of first refusal to acquire the property for the Blue Ridge Parkway.</text></subsection></section>
