		<section id="H3C0739F997824EE7A199B8E7D93003C" section-type="section-one"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Protection Against Wrongful Voter Purges Act</quote>.</text>
		</section><section id="HBD75AB7A5A2B48BFB9F25B2110323E9D"><enum>2.</enum><header>Notice and Review
			 Requirements for Removal of Individuals From Official List of Eligible Voters
			 by Reason Other Than Change of Residence</header>
			<subsection id="HD71FF632DD1343779736D4D44E3F2900"><enum>(a)</enum><header>In
			 General</header><text>Section 8 of the National Voter Registration Act of 1993
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6</external-xref>) is amended—</text>
				<paragraph id="H2A80F7E6A34A4848A1AAEF19A9ED63E7"><enum>(1)</enum><text>by redesignating
			 subsection (j) as subsection (k); and</text>
				</paragraph><paragraph id="H3980495BE0B64D5CB663D5BC8EC73DFB"><enum>(2)</enum><text>by inserting after
			 subsection (i) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H927A3B8B6EFA4EF9827FD753A670519B" style="OLC">
						<subsection id="HAF65AE42CB194AE4B1A98DFA00E54119"><enum>(j)</enum><header>Notice and
				Review Requirements For Removal of Individuals From List of Eligible Voters by
				Reason Other Than Change of Residence</header>
							<paragraph id="H550F8F30D59544B696AEF5B5A77E5910"><enum>(1)</enum><header>Minimum notice
				prior to removal</header>
								<subparagraph id="H48C8CAE2F7FE4897807757F97600DB27"><enum>(A)</enum><header>In
				general</header><text>In addition to any other requirements applicable under
				this section, a State may not remove a registrant from the official list of
				eligible voters for an election for Federal office by reason other than death
				or a change of residence unless the State provides the registrant with a notice
				of removal meeting the requirements of subparagraph (B) not later than 30 days
				before the date of the election.</text>
								</subparagraph><subparagraph id="HA5380B905D27455BBFF59D21FE22DDF7"><enum>(B)</enum><header>Requirements for
				notice</header><text>The notice required under this subparagraph shall be sent
				by forwardable mail, and shall include the following:</text>
									<clause id="HD5DC535FDF9147B58B7D61927F781721"><enum>(i)</enum><text>A
				statement that the State intends to remove the registrant from the official
				list of eligible voters for elections for Federal office.</text>
									</clause><clause id="H844F45DD5ED04D8698AB109C978177DB"><enum>(ii)</enum><text>A
				description of the reasons for removal, including (in the case of an individual
				proposed to be removed by reason of criminal conviction) sufficient identifying
				information on the criminal conviction alleged to be the basis for removal to
				enable the registrant to determine whether the registrant was convicted of the
				offense cited in the notice.</text>
									</clause><clause id="H2B34EDCC6938471793A6F542B61D4247"><enum>(iii)</enum><text>A statement that
				the registrant may obtain a review of the removal from an appropriate State
				election official in accordance with paragraph (2).</text>
									</clause><clause id="H18E6B4F6047344E698509E60F51D60F1"><enum>(iv)</enum><text>A
				postage pre-paid and pre-addressed envelope and a clear list of contact
				information for the appropriate State election official that includes a mailing
				address, telephone number, and fax number.</text>
									</clause></subparagraph></paragraph><paragraph id="H326C7B81E5E24BD49D087F7F26B2A2D"><enum>(2)</enum><header>Review of
				decision to remove</header>
								<subparagraph id="H21195AEB05874405842EB561A4C672B5"><enum>(A)</enum><header>In
				general</header><text>A registrant who receives a notice of removal under
				paragraph (1) may submit a written request to a designated State election
				official to withdraw the notice and retain the registrant on the official list
				of eligible voters, and may include in the request such information and
				evidence as the registrant considers appropriate to show that the registrant is
				not subject to removal from the list under State law, including information and
				evidence showing that the registrant was not convicted of the criminal offense
				cited in the notice or that the period of ineligibility imposed as the result
				of a conviction of a criminal offense has expired (in the case of an individual
				proposed to be removed by reason of criminal conviction).</text>
								</subparagraph><subparagraph id="HB3048AC5275D4E28A3A71679D183BDA"><enum>(B)</enum><header>Response by
				State</header><text>Not later than 10 days after receiving a request from a
				registrant under subparagraph (A), the State shall review the information and
				evidence included and accept or reject the request, and shall notify the
				registrant in writing of its decision.</text>
								</subparagraph></paragraph><paragraph id="H78FE1A7A76764FD1A6A0D6E1108D9D77"><enum>(3)</enum><header>Special rules
				for removal by reason of death of registrant</header><text>In the case of an
				individual proposed to be removed by reason of death—</text>
								<subparagraph id="H073B7871EA8E4F1786B2115509C53F91"><enum>(A)</enum><text>the notice of
				removal under paragraph (1) shall be addressed to the occupant of the most
				recent address of the registrant in the records of the appropriate State
				election official;</text>
								</subparagraph><subparagraph id="HA8526D4C5638419E8B471F52B4A36105"><enum>(B)</enum><text>the notice shall
				include a statement that the occupant should notify the appropriate State
				election official immediately if the notice of the registrant’s death is in
				error;</text>
								</subparagraph><subparagraph id="HD8F73DFC4DED49128D9200E8948304F8"><enum>(C)</enum><text>if the notice of
				removal was issued in error, the registrant may submit a written request under
				paragraph (2) to withdraw the notice and retain the registrant on the official
				list of eligible voters; and</text>
								</subparagraph><subparagraph id="H6D9C08A8F87843F58B499E33FE944FF8"><enum>(D)</enum><text>if the registrant
				submits such a written request, the State shall notify the registrant of the
				decision made under paragraph (2)(B) with respect to the request.</text>
								</subparagraph></paragraph><paragraph id="H95EBAB9AA0C7468C997984B691064B09"><enum>(4)</enum><header>Opportunity to
				cast provisional ballot</header><text>Any registrant who receives a notice of
				removal under paragraph (1) and believes that the removal decision was made in
				error shall be permitted to cast a provisional ballot in an election for
				Federal office in accordance with section 302(a) of the Help America Vote Act
				of 2002, and the vote cast by such a ballot shall be counted in the election
				(in accordance with the standards and procedures of such section) if it is
				determined that the removal decision was made in error.</text>
							</paragraph><paragraph id="HF0D3272DE5234566B8552EEC4DC009C"><enum>(5)</enum><header>No expansion of
				grounds for removal</header><text display-inline="yes-display-inline">Nothing
				in this subsection may be construed to require or authorize the establishment
				of any grounds for the removal of a registrant from the official list of
				eligible voters for an election for Federal office which were not in effect
				prior to the enactment of this
				subsection.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H0193210E89CE4A279F815800E819D808"><enum>(b)</enum><header>Adoption of
			 Voluntary Guidance Regarding Audits of Computerized List</header><text>Section
			 311 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15501">42 U.S.C. 15501</external-xref>) is amended by adding
			 at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H37A22BF4DCD9413080B0B533AB771EA3" style="OLC">
					<subsection id="H9EDDD320F3EF48FAB94530F826244FD"><enum>(d)</enum><header>Voluntary
				Guidance Regarding Audits of Computerized List</header><text display-inline="yes-display-inline">Not later than October 1, 2008, the
				Commission shall adopt voluntary guidance with respect to audits of the
				Statewide computerized voter registration list required to be maintained under
				section 303 so that each State will be able to ensure that the list reflects an
				accurate and complete count of all individuals who are validly registered to
				vote in elections for Federal office in the State and is secure against
				unauthorized
				uses.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection display-inline="no-display-inline" id="HE542B6B4D91647718E8D1530806C5FF0"><enum>(c)</enum><header>Conforming
			 Amendments</header>
				<paragraph id="H12D3C2A3AF7E4117828E0585CC89DA4B"><enum>(1)</enum><header>National Voter
			 Registration Act of 1993</header><text>Section 8 of the National Voter
			 Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6</external-xref>) is amended—</text>
					<subparagraph id="H3A1D1932A42640DEA300F9CE2ADA6BE"><enum>(A)</enum><text>in subsection
			 (a)(3)(B), by striking <quote>State law,</quote> and inserting <quote>State law
			 and consistent with the requirements of subsection (j),</quote>;</text>
					</subparagraph><subparagraph id="H243E07DB6F694F4D8D2EDCCB9906D666"><enum>(B)</enum><text>in subsection
			 (a)(4)(A), by striking the semicolon at the end and inserting and <quote>,
			 consistent with the requirements of subsection (j);</quote>;</text>
					</subparagraph><subparagraph id="HB7CC282BB57B4BBCA619C8BF9785E973"><enum>(C)</enum><text>in the heading for
			 subsection (d), by inserting after <quote><header-in-text level="subsection" style="OLC">Rolls</header-in-text></quote> the following:
			 <quote><header-in-text level="subsection" style="OLC">by Reason of Change of
			 Residence</header-in-text></quote>; and</text>
					</subparagraph><subparagraph id="HD1A2E6C4CCF048DBA2752B651DDF183F"><enum>(D)</enum><text>in subsection
			 (i)(2), by inserting after <quote>subsection (d)(2)</quote> the following:
			 <quote>and all persons to whom notices described in subsection
			 (j)</quote>.</text>
					</subparagraph></paragraph><paragraph id="HC4ED6A1EE286427BAABE9353F3A028FC"><enum>(2)</enum><header>Help America
			 Vote Act of 2002</header><text>Section 303(a) of the Help America Vote Act of
			 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(a)</external-xref>) is amended—</text>
					<subparagraph id="H385C86079F1445CE9CA0D7F5BCA6511B"><enum>(A)</enum><text>in paragraph
			 (2)(A)(i), by striking <quote>and (e)</quote> and inserting <quote>(e), and
			 (j)</quote>; and</text>
					</subparagraph><subparagraph id="H46AD5E2A9256401FBD25FEBEF6E5F6C6"><enum>(B)</enum><text>in paragraph
			 (4)(B), by striking <quote>Safeguards</quote> and inserting <quote>In addition
			 to meeting the applicable notice and review requirements of section 8 of the
			 National Voter Registration Act of 1993, safeguards</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H513984B0D62747D38C2CF489D9FDB037"><enum>(d)</enum><header>Rule of
			 Construction</header><text>Nothing in this section or any amendment made by
			 this section may be construed—</text>
				<paragraph display-inline="no-display-inline" id="H4A990179DED0489BBC006209A8B0B91B"><enum>(1)</enum><text>to affect the
			 right of any individual to cast a provisional ballot under section 302(a) of
			 the Help America Vote Act of 2002; or</text>
				</paragraph><paragraph id="H485D8519867A4DAD994B2270386E0614"><enum>(2)</enum><text>to prohibit any
			 State from providing individuals threatened with removal from the official list
			 of eligible voters in the State with greater protections than those required
			 under section 8(j) of the National Voter Registration Act of 1993 (as added by
			 subsection (a)).</text>
				</paragraph></subsection><subsection id="HD73A9E566546431EB658344CFCF47800"><enum>(e)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply with respect
			 to the regularly scheduled general election for Federal office in November 2008
			 and each succeeding election for Federal office.</text>
			</subsection></section><section display-inline="no-display-inline" id="H93E11EFBC01B4F79866831D5C3EC3120" section-type="subsequent-section"><enum>3.</enum><header>Contents and Treatment
			 of Voter Registration Forms</header>
			<subsection id="H8CC4F1144C704728800514CBD44B319B"><enum>(a)</enum><header>Opportunity To
			 Correct Incomplete Forms</header><text>Section 303(b)(4)(B) of the Help America
			 Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)(4)(B)</external-xref>) is amended by striking <quote>to
			 answer the question included on the mail voter registration form pursuant to
			 subparagraph (A)(i)</quote> and inserting <quote>to provide any information
			 required on any voter registration form used by the State under section 6 of
			 the National Voter Registration Act of 1993</quote>.</text>
			</subsection><subsection id="H48567AF01FC54212897732659FE8E3F7"><enum>(b)</enum><header>Completed
			 National Form Deemed Complete For All States</header><text>Section 303(b) of
			 such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)</external-xref>) is amended—</text>
				<paragraph id="H9A53333E2F304C1284D294EA4C4FB200"><enum>(1)</enum><text>by redesignating
			 paragraph (5) as paragraph (6); and</text>
				</paragraph><paragraph id="H9B50F819F0FB4E1D8600A9FEFF060113"><enum>(2)</enum><text>by inserting after
			 paragraph (4) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="H9C57CE15E7F74EBDAF1D28B07CF490BB" style="OLC">
						<paragraph id="HD4C95FAF70DD44B8BFE8906980F440EE"><enum>(5)</enum><header>Completed
				national form deemed complete for all States</header>
							<subparagraph id="H1FC33311579E4280B8F25D19626C3E9F"><enum>(A)</enum><header>Treatment of
				completed form</header><text display-inline="yes-display-inline">If an
				applicant for voter registration in a State submits a voter registration
				application form which contains all of the information required to be provided
				under the mail voter registration form developed by the Commission under
				section 9(a)(2) of the National Voter Registration Act of 1993 (whether the
				form submitted by the applicant is the form developed by the Commission or
				another form developed and used by the State under section 6(a) of the National
				Voter Registration Act of 1993), the State may not refuse to register the
				applicant as a voter on the ground that the applicant failed to complete the
				form.</text>
							</subparagraph><subparagraph id="H4D2B1FC844144795007379561D3FB136"><enum>(B)</enum><header>Presumption in
				favor of registration</header><text>In determining whether applicants meet the
				requirements for registering to vote in elections for Federal office in a
				State, State election officials shall act under the presumption that applicants
				should be
				registered.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="HABB02D14E95F4086B821F500305B0071" section-type="subsequent-section"><enum>4.</enum><header>Availability of
			 Updated Information for Registered Voters</header>
			<subsection id="H9660E122060349509D6E3770CA92CC42"><enum>(a)</enum><header>Requiring States
			 To Make Updated Information Available to Registered
			 Voters</header><text>Section 303(a)(1) of the Help America Vote Act of 2002 (42
			 U.S.C. 15483(a)(1)) is amended—</text>
				<paragraph id="HA74CBF0DE00A4095A9D4F97EF449AFD7"><enum>(1)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (D); and</text>
				</paragraph><paragraph id="H82DF60B226074D3BBDD5203576284056"><enum>(2)</enum><text>by inserting after
			 subparagraph (A) the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="HA7CEB39EB3AA476D9660C11EFF11FD07" style="OLC">
						<subparagraph id="H20F8223D03DE4062B7C424BC1761A0AC"><enum>(B)</enum><header>Availability of
				updated version of list online and at polling places</header>
							<clause id="H8D1E60E5A6DA4513807053567D3808F8"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">The appropriate State
				or local election official shall ensure that, at each polling place for an
				election for Federal office and on a public website of the election official of
				each registrar’s jurisdiction, a list is available which shows—</text>
								<subclause id="H3029324FBE3046A38DA85056DA2E31F2"><enum>(I)</enum><text display-inline="yes-display-inline">all individuals registered to vote in that
				election at all polling places located in the registrar's jurisdiction, other
				than any individual who requests that the appropriate official exclude the
				individual’s name from the list; and</text>
								</subclause><subclause id="HCE85B26F0642431A8FD8BEE21DDED1B"><enum>(II)</enum><text display-inline="yes-display-inline">for each such individual, the polling place
				at which the individual is registered.</text>
								</subclause></clause><clause id="H2D2806AFE8AB439A8CE9111812F9B757"><enum>(ii)</enum><header>Exclusion of
				addresses</header><text>The list required to be made available under clause (i)
				may not contain the address of any individual.</text>
							</clause><clause id="HF609F147DA7A4336BDC6782CA05818AF"><enum>(iii)</enum><header>Timing</header><text>The
				appropriate election official shall make the list required to be made available
				under clause (i)—</text>
								<subclause id="HA9494040C2374071957298648D1CF161"><enum>(I)</enum><text>available not
				later than 72 hours after the applicable deadline under State law for
				registering to vote in elections for Federal office; or</text>
								</subclause><subclause id="HD3415CAB8FE5416AA78CF15918A500E"><enum>(II)</enum><text>in the case of a
				same-day registration State, available on a weekly basis during the 30-day
				period which ends on the date of the election.</text>
								</subclause></clause><clause id="H55DA4736FCE64B5491249ED27FD348B"><enum>(iv)</enum><header>Permitting
				individuals to opt out of inclusion in publicly-posted list</header><text>If an
				individual requests that the appropriate election official exclude the
				individual’s name from the publicly posted list under this subparagraph—</text>
								<subclause id="H4630C41CB65349E69CF85D2C59026889"><enum>(I)</enum><text>the official shall
				exclude information relating to the individual from the publicly-posted list;
				and</text>
								</subclause><subclause id="HA0543A7E525D413800BF9CCED7907A3"><enum>(II)</enum><text>the official shall
				notify the individual in a private and confidential manner of the polling place
				to which the individual is assigned in accordance with the timetable provided
				for making the list available under clause (iii).</text>
								</subclause></clause><clause id="H7DCF257676B74A4E811EBA357808015F"><enum>(v)</enum><header>Definitions</header><text>In
				this subparagraph—</text>
								<subclause id="H32EE607DE27E4CFEB7678BCD15E226D"><enum>(I)</enum><text display-inline="yes-display-inline">the term <term>registrar’s
				jurisdiction</term> has the meaning given such term in section 8(j) of the
				National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-6">42 U.S.C. 1973gg–6(j)</external-xref>); and</text>
								</subclause><subclause id="H6718E5883D1B40129C6715E6CA6B7B8"><enum>(II)</enum><text display-inline="yes-display-inline">the term <term>same-day registration
				State</term> means a State in which, under law that is in effect continuously
				on and after the date of the enactment of the Protection Against Wrongful Voter
				Purges Act, all voters in the State may register to vote at the polling place
				at the time of voting in a general election for Federal office.</text>
								</subclause></clause></subparagraph><subparagraph id="H2E5907D4CA17418B84BD7D53A5EAC1E"><enum>(C)</enum><header>Notification of
				changes in assigned polling place</header><text>If an election official assigns
				an individual to a polling place which is different than the polling place at
				which the individual was registered to vote under the most recently available
				version of the list required to be made available under subparagraph (B)(i),
				the official shall notify the individual of the new polling place immediately
				upon making the
				assignment.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H02CB9AA981A249A5A4D675B1B51E006F"><enum>(b)</enum><header>Conforming
			 Amendment</header><text>Section 303(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15481">42 U.S.C. 15481(a)(1)</external-xref>)
			 is amended—</text>
				<paragraph id="H79141714BB1C4A328FA877CFB3D3099"><enum>(1)</enum><text>in
			 subparagraph (A), by striking <quote>subparagraph (B)</quote> and inserting
			 <quote>subparagraph (C)</quote>; and</text>
				</paragraph><paragraph id="H336B8FEE16864BE7AE2F4F63E41F6D16"><enum>(2)</enum><text>in subparagraph
			 (C), as redesignated by subsection (a), by striking <quote>requirement under
			 subparagraph (A)</quote> and inserting <quote>requirements under subparagraphs
			 (A) and (B)</quote>.</text>
				</paragraph></subsection></section><section display-inline="no-display-inline" id="H6765ADA57B4B4B2D83263E3027E4BBC9" section-type="subsequent-section"><enum>5.</enum><header>Nonapplicability to
			 Certain States</header><text display-inline="no-display-inline">This Act and
			 the amendments made by this Act shall not apply to a State in which, under a
			 State law in effect continuously on and after the date of the enactment of this
			 Act, there is no voter registration requirement for individuals in the State
			 with respect to elections for Federal office.</text>
		</section><section id="H5E30170CA5484107B022ABB1A15B4738"><enum>6.</enum><header>Effective
			 Date</header><text display-inline="no-display-inline">Section 303(d)(2) of the
			 Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(d)(2)</external-xref>) is amended—</text>
			<paragraph id="H758A8F58B5C748ED9EDC08D774315389"><enum>(1)</enum><text>in subparagraph
			 (A), by striking <quote>Each State</quote> and inserting <quote>Except as
			 provided in subparagraph (C), each State</quote>;</text>
			</paragraph><paragraph id="H797D194D01984101AC322803291D1180"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>The provisions</quote> and inserting <quote>Except as
			 provided in subparagraph (C), the provisions</quote>; and</text>
			</paragraph><paragraph id="H3D38D9A5E8794245B886FB0006A50024"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="H980BA4F6566B499D816B9F94AA71095E" style="OLC">
					<subparagraph id="H27AB3260E45C464B9D3D204907EC851D"><enum>(C)</enum><header>Delayed
