		<section id="H2E8A011B95D54D91807915E201D0E3B" section-type="section-one"><enum>1.</enum><header>Criminal misue of registered
			 mark</header>
			<subsection id="HBE61202DB428403F95F75300B188E916"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 113 of title
			 18, United States Code, is amended by inserting after section 2320 the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H5753E7D33B3846D788688C29FFD319BD" style="USC">
					<section id="HCEF4F50EBD9D49C3A7E9E1B791328FF3"><enum>2320A.</enum><header>Criminal
				misuse of registered mark</header>
						<subsection id="HDD6EE9DCC4F04E58A8DFCC265D9C3599"><enum>(a)</enum><header>Offense</header>
							<paragraph id="H154C271C2E984E8A96B25667304C42DE"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Whoever, in
				communications that may be regulated by Congress, uses a trademark, service
				mark, collective mark, or certification mark registered on the principal
				register in the United States Patent and Trademark Office, with the intent to
				deceive the public to believe that such use is authorized by the owner of the
				mark shall—</text>
								<subparagraph id="H329E607318FD4674BED4FF1E62EBFE7"><enum>(A)</enum><text>if an individual,
				be fined not more than $2,000,000 or imprisoned not more than 10 years, or
				both; and</text>
								</subparagraph><subparagraph id="H54F822BC42694D98B7B75C691B0291B2"><enum>(B)</enum><text>if a person other
				than an individual, be fined not more than $5,000,000.</text>
								</subparagraph></paragraph><paragraph id="HB0EA01EAE009482CA170C66133DC5DEC"><enum>(2)</enum><header>Subsequent
				offenses</header><text>In the case of an offense by a person under paragraph
				(1) that occurs after that person is convicted of another offense under
				paragraph (1), the person convicted shall—</text>
								<subparagraph id="HB3D704D839464D1DBCE5C775FDB2745D"><enum>(A)</enum><text>if an individual,
				be fined not more than $5,000,000 or imprisoned not more than 20 years, or
				both; and</text>
								</subparagraph><subparagraph id="HF10661367D6A442E8881451988BBD5AD"><enum>(B)</enum><text>if other than an
				individual, be fined not more than $15,000,000.</text>
								</subparagraph></paragraph></subsection><subsection id="H37A365B0370C444FA7DE9FC46F939CA9"><enum>(b)</enum><header>Defenses and
				limitations on remedies</header><text>All defenses, affirmative defenses, and
				limitations on remedies that would apply in an action under the Lanham Act
				shall apply in a prosecution under this section. In a prosecution under this
				section, the defendant shall have the burden of proof, by a preponderance of
				the evidence, of any such affirmative defense.</text>
						</subsection><subsection id="H06CF3C8FCC7E4D44A29949022C31C800"><enum>(c)</enum><header>Pre-sentence
				report</header><text>During preparation of the pre-sentence report pursuant to
				Rule 32(c) of the Federal Rules of Criminal Procedure, victims of the offense
				under subsection (a) shall be permitted to submit, and the probation officer
				shall receive, a victim impact statement that identifies the victim of the
				offense and the extent and scope of the injury and loss suffered by the victim,
				including the estimated economic impact of the offense on that victim.</text>
						</subsection><subsection id="HA2391C1FDDDB45698FCEA17DF84200"><enum>(d)</enum><header>Definition</header><text>For
				purposes of this section, the term <quote>Lanham Act</quote> means the Act
				entitled <quote>An Act to provide for the registration and protection of
				trademarks used in commerce, to carry out the provisions of certain
				international conventions, and for other purposes</quote>, approved July 5,
				1946.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H624C069DB15F4B7FAC608CD0C22C7B6"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of sections and the begining of chapter 113
			 of title 18, United States Code, is amended by inserting adter the item
			 relating to section 2320 the following new item</text>
