		<official-title>To amend the Robert T. Stafford Disaster Relief and
		  Emergency Assistance Act to authorize funding for emergency management
		  performance grants to provide for domestic preparedness and collective response
		  to the catastrophic incidents, and for other purposes.</official-title>

		<section id="HCCD35AB45650431899E349FEA34340AF" section-type="section-one"><enum>1.</enum><header>Emergency management
			 performance grants</header><text display-inline="no-display-inline">Subtitle B
			 of title VI of the Robert T. Stafford Disaster Relief and Emergency Assistance
			 Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5197">42 U.S.C. 5197 et seq.</external-xref>) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H69DA9253A265430E99BFA30330562FAF" style="OLC">
				<section id="HF887D9A8554D40719D778500C5ED8520"><enum>630.</enum><header>Emergency
				management performance grants</header>
					<subsection id="H76AC231395004585A6EC6925E0585B8C"><enum>(a)</enum><header>In
				General</header><text display-inline="yes-display-inline">The Administrator of
				the Federal Emergency Management Agency, shall establish an emergency
				management performance grants program (in this section referred to as the
				<quote>program</quote>) to carry out the provisions of this title and section
				201 to address domestic preparedness and collective response to a catastrophic
				incident.</text>
					</subsection><subsection id="H02E5AE1F087C4B6891726956887DD2CC"><enum>(b)</enum><header>Federal
				share</header><text>Except as otherwise specifically provided by this Act, the
				Federal share of the cost of an activity carried out using funds made available
				under the program shall not exceed 50 percent.</text>
					</subsection><subsection id="H68D20CA552AB4C38BAFF09B9EE646E4"><enum>(c)</enum><header>Apportionment</header><text>For
				fiscal year 2009, and each fiscal year thereafter, the Administrator shall
				apportion the amounts appropriated to carry out the program among the States as
				follows:</text>
						<paragraph id="HE7F63F3F7534431499D61C3900FB0180"><enum>(1)</enum><header>Baseline
				amount</header><text>The Administrator shall first apportion 0.25 percent of
				such amounts to each of American Samoa, the Commonwealth of the Northern
				Mariana Islands, Guam, and the Virgin Islands and 0.75 of such amount to each
				of the remaining States.</text>
						</paragraph><paragraph id="HDF3ED3C524E64ED491A09DEB1C20400"><enum>(2)</enum><header>Remainder</header><text>The
				Administrator shall apportion the remainder of such amounts in the ratio
				that—</text>
							<subparagraph id="H0624FFD46EFE4B3583C4F41FA4264265"><enum>(A)</enum><text>the population of
				each State; bears to</text>
							</subparagraph><subparagraph id="H23625C6FBEE7446B90C155CADFE24FAA"><enum>(B)</enum><text>the population of
				all States.</text>
							</subparagraph></paragraph></subsection><subsection id="H5B6D52E41E52494692E4ADFA57E3B7F3"><enum>(d)</enum><header>Authorization of
				Appropriations</header><text>There is authorized to be appropriated to carry
				out the program $535,000,000 for fiscal year 2009, $680,000,000 for fiscal year
				2010, and $815,000,000 for fiscal year 2011. Such sums shall remain available
				until expended.</text>
					</subsection><subsection id="H696DC3B9D64D4053AC46C16859C476C0"><enum>(e)</enum><header>Catastrophic
				Incident Defined</header><text>In this section the term <term>catastrophic
				incident</term> has the meaning given such term in section 501(3) of the
				Homeland Security Act of 2002 (6 U.S.C.
				311(3)).</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H3F12EBD29152434800DE2B44355C52C9"><enum>2.</enum><header>Construction of
			 emergency operations centers</header><text display-inline="no-display-inline">Section 614 of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5196c">42 U.S.C. 5196c</external-xref>) is amended to
			 read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="HFD1E7A26133245C2BFE26D1C61145015" style="OLC">
				<section id="H955AFF96779D47CAA24BC63F17011F69"><enum>614.</enum><header>Construction of
				emergency operations centers</header>
					<subsection id="HF82AD52688284A57A857BF588B00EFF3"><enum>(a)</enum><header>Grants</header><text display-inline="yes-display-inline">The Administrator of the Federal Emergency
				Management Agency, may make grants to States under this title for equipping,
				upgrading, and constructing emergency operations centers for domestic
				preparedness and collective response to a catastrophic incident.</text>
					</subsection><subsection id="H7B89E60D54DB45E9B82C4557F7213863"><enum>(b)</enum><header>Federal
				share</header><text>Notwithstanding any other provision of this title, the
				Federal share of the cost of an activity carried out using amounts from grants
				made under this section shall not exceed 75 percent.</text>
					</subsection><subsection id="H67208CD2A30747C3BFACDE673F1A8FE"><enum>(c)</enum><header>Catastrophic
				incident defined</header><text>In this section the term <term>catastrophic
				incident</term> has the meaning given such term in section 501(3) of the
				Homeland Security Act of 2002 (6 U.S.C.
				311(3)).</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
