		<section id="H1C96E72E66FA417CA0A352DF758DDB2" section-type="section-one"><enum>1.</enum><header>Selective Service
			 registration</header>
			<subsection id="HF076F4696DAC466495B7BE9CE182A700"><enum>(a)</enum><header>In
			 general</header><text>Section 3328 of title 5, United States Code, is amended
			 by striking subsection (b) and inserting the following:</text>
				<quoted-block id="H9036EDA44FB14CC9AE9F307FFE2B34DD" style="OLC">
					<subsection id="HD4C34A224E3C449BA1AFC123F28FE9F1"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H2D4C7A2657F4425CBC51D0D95B6FF1FB"><enum>(1)</enum><text>Except as provided in
				subsection (c), the Director of the Office of Personnel Management, in
				consultation with the Director of the Selective Service System, shall prescribe
				regulations to carry out this section.</text>
						</paragraph><paragraph id="H97BC607724DF49FFBA8B7BE2E3DEC6C0" indent="up1"><enum>(2)</enum><text>Such regulations—</text>
							<subparagraph id="H693F1D2E1DF54FEBB0E095099DBAA700"><enum>(A)</enum><text>shall provide for exceptions to
				determinations of ineligibility under this section to allow for the appointment
				of an individual who was discharged or released from active duty in the armed
				forces under honorable conditions; and</text>
							</subparagraph><subparagraph id="H1A173DC32B3540E287E4EDCAFD4EAC1"><enum>(B)</enum><text>may provide that determinations of
				eligibility under the requirements of this section shall be adjudicated by the
				Executive agency making the appointment for which the eligibility is
				determined.</text>
							</subparagraph></paragraph></subsection><subsection id="HBA47568C2C5344A9BD03F7C5EA5F54"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H4E232331161A4510A161ECFB6D352F74"><enum>(1)</enum><text>The Director of the
				Selective Service System, in consultation with the Director of the Office of
				Personnel Management, shall prescribe procedures—</text>
							<subparagraph id="H54EE9F74E0284AD08F9B326FC53F3981" indent="up1"><enum>(A)</enum><text>for the adjudication of determinations
				of whether a failure to register was knowing and willful; and</text>
							</subparagraph><subparagraph id="H1D2D296DED2B47958321922936158EAC" indent="up1"><enum>(B)</enum><text>under which such a determination may
				not be made if the individual concerned shows by a preponderance of the
				evidence that the failure to register was neither knowing nor willful.</text>
							</subparagraph></paragraph><paragraph id="HC9BDF072CBC14E29A446B487589BC48F" indent="up1"><enum>(2)</enum><text>The procedures under paragraph (1)
				may provide that determinations referred to in paragraph (1)(A) shall be
				adjudicated by the Executive agency making the appointment for which the
				eligibility is
				determined.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H511720125B9244E0BB004F47327D84C3"><enum>(b)</enum><header>Regulations</header><text>Not
			 later than 60 days after the date of enactment of this Act, the Director of the
			 Selective Service System, in consultation with the Director of the Office of
			 Personnel Management, shall prescribe regulations under section 3328(c) of
			 title 5, United States Code, as added by subsection (a) of this section.</text>
			</subsection><subsection id="H3BDB143C607A41A1AA004CDB4C8364C3"><enum>(c)</enum><header>Readjudication
			 of determinations</header><text>Any individual whose case was or is adjudicated
			 under section 3328(b) of title 5, United States Code, during the period
			 beginning on February 21, 2007, through the date on which the regu1ations are
			 prescribed or amended under subsection (b) of this section are in effect, and
			 whose case involve a determination of whether a failure to register was knowing
			 and willful, may have his or her case readju-<pagebreak></pagebreak>dicated in accordance
			 with such regulations as so prescribed.</text>
