			 provision, the reference shall be considered to be made to a section or other
			 provision of the <act-name parsable-cite="FWPCA">Federal Water Pollution
			 Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>).</text>
		</section><title id="H27AFE195E0B546A4A0CDFC28DECD4C80"><enum>I</enum><header>TECHNICAL AND
			 MANAGEMENT ASSISTANCE</header>
			<section id="HE413881BAC584AB3B5B82F8874B9B2A1"><enum>101.</enum><header>Technical
			 assistance</header>
				<subsection id="H825CDD4E249C40388B537BB21E003891"><enum>(a)</enum><header>Technical
			 Assistance for Rural and Small Treatment Works</header><text>Section 104(b) (33
			 U.S.C. 1254(b)) is amended—</text>
					<paragraph id="H8760772CC1C54E7AB9CC161C0200B185"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
					</paragraph><paragraph id="H18D389F9428C406FAD17D4C3D2FE412"><enum>(2)</enum><text>by
			 striking the period at the end of paragraph (7) and inserting <quote>;
			 and</quote>; and</text>

				and small municipalities for the purpose of assisting, in consultation with the
				State in which the assistance is provided, such municipalities in the planning,
				developing, and acquisition of financing for eligible projects described in
				section 603(c);</text>
								</subparagraph><subparagraph id="H383EB70C5AAA498984C71C6239E73B3"><enum>(B)</enum><text>to provide
				technical assistance and training for rural and small publicly owned treatment
				works and decentralized wastewater treatment systems to enable such treatment
				works and systems to protect water quality and achieve and maintain compliance
				with the requirements of this Act; and</text>
								</subparagraph><subparagraph id="HEDFE62A4FEA64EEEBE53AD754F64BAE3"><enum>(C)</enum><text>to disseminate
				information to rural and small municipalities and municipalities that meet the
				affordability criteria established under section 603(i)(2) by the State in
				which the municipality is located with respect to planning, design,
				construction, and operation of publicly owned treatment works and decentralized
				wastewater treatment
				systems.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H32ED1FEA4F4F41DC8944EE688694E27C"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>Section 104(u) (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(u)</external-xref>) is
			 amended—</text>
					<paragraph id="H041F8A9FAB51475780F87490D348571D"><enum>(1)</enum><text>by striking
			 <quote>and (6)</quote> and inserting <quote>(6)</quote>; and</text>
					</paragraph><paragraph id="H13E0617CD2C5422D93F0A219AA1DC7E9"><enum>(2)</enum><text>by inserting
			 before the period at the end the following: <quote>; and (7) not to exceed
			 $75,000,000 for each of fiscal years 2008 through 2012 for carrying out
			 subsections (b)(3) and (b)(8), except that not less than 20 percent of the
			 amounts appropriated pursuant to this paragraph in a fiscal year shall be used
			 for carrying out subsection (b)(8)</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA6EC939DBF1946F392D8EB32EDDC9017"><enum>(c)</enum><header>Small flows
			 clearinghouse</header><text>Section 104(q)(4) (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(q)(4)</external-xref>) is
			 amended—</text>
					<paragraph commented="no" id="HDE95473FFE0D4566BD853DE730CD24DA"><enum>(1)</enum><text>in the first
			 sentence by striking <quote>$1,000,000</quote> and inserting
			 <quote>$3,000,000</quote>; and</text>
					</paragraph><paragraph commented="no" id="H8361A54233934C6F9382D250BDDFD72"><enum>(2)</enum><text>in the second
			 sentence by striking <quote>1986</quote> and inserting
			 <quote>2009</quote>.</text>
					</paragraph></subsection><subsection id="H201EEE3EE48F423591AE1888BD4999D"><enum>(d)</enum><header>Competitive
			 Procedures for Awarding Grants</header><text>Section 104 (<external-xref legal-doc="usc" parsable-cite="usc/33/1254">33 U.S.C. 1254(b)</external-xref>)
			 is amended by adding at the end the following:</text>

						<subsection id="H71910B29F9C94E2393AA5F3D2BC27FD4"><enum>(w)</enum><header>Competitive
				Procedures for Awarding Grants</header><text>The Administrator shall establish
				procedures that, to the maximum extent practicable, promote competition and
				openness in the award of grants to nonprofit private agencies, institutions,
				and organizations under this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="H220B1E63C7B14C049F44A538A0AEEB1"><enum>102.</enum><header>State management
			 assistance</header><text display-inline="no-display-inline">Section 106(a) (33
			 U.S.C. 1256(a)) is amended—</text>
				<paragraph id="H6CD18EF7874E424891788E9525E9E951"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (1);</text>
				</paragraph><paragraph id="H048BB1243FB54E4FABD37508F1E7C223"><enum>(2)</enum><text>by striking the
			 semicolon at the end of paragraph (2) and inserting <quote>; and</quote>;
			 and</text>

			 projects</header>

			 Projects</header><text>Section 122 (<external-xref legal-doc="usc" parsable-cite="usc/33/1274">33 U.S.C. 1274</external-xref>) is amended—</text>
					<paragraph id="H6FF533BA92BF4CD3AD866C7E60DEC022"><enum>(1)</enum><text>in the section
			 heading by striking <quote><header-in-text level="section" style="OLC">Wet
			 weather</header-in-text></quote>; and</text>
					</paragraph><paragraph id="H32E43B63E4A846C4A067B414ECB1BBD"><enum>(2)</enum><text>in
			 subsection (a)—</text>
						<subparagraph id="HE4C8D25AF2E34DC79387A72F90F477BA"><enum>(A)</enum><text>in the matter

								</paragraph><paragraph id="H3C296E8B573D456CA01FD800B0DE681F"><enum>(4)</enum><header>Integrated water
				resource plan</header><text display-inline="yes-display-inline">The development
				of an integrated water resource plan for the coordinated management and
				protection of surface water, ground water, and stormwater resources on a
				watershed or subwatershed basis to meet the objectives, goals, and policies of
				this
				Act.</text>
								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="H674361BD3112479C91F6823232E9E529"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>Section 122(c)(1) is amended by striking
			 <quote>for fiscal year 2004</quote> and inserting <quote>for each of fiscal
			 years 2004 through 2012</quote>.</text>
				</subsection><subsection id="H8C73840070444C798DA35D0856F3F027"><enum>(c)</enum><header>Report to
			 Congress</header><text>Section 122(d) is amended by striking <quote>5

				under this title if the project otherwise meets the requirements of subsection
				(a)(1) and meets the requirement of paragraph (3).</text>
							</paragraph><paragraph id="H6B8A8619E3874600823F8F57C2AD39E3"><enum>(2)</enum><header>New
				systems</header><text>Notwithstanding the requirement of subsection (a)(2)
				concerning the existence of a community as a condition of eligibility, a
				project for a new collection system to serve a community existing on January 1,
				2007, shall be eligible for a grant under this title if the project otherwise
				meets the requirements of subsection (a)(2) and meets the requirement of
				paragraph (3).</text>
							</paragraph><paragraph id="H6ED3F10878064A4698230753AD1276F8"><enum>(3)</enum><header>Requirement</header><text>A
				project meets the requirement of this paragraph if the purpose of the project
				is to accomplish the objectives, goals, and policies of this Act by addressing
				an adverse environmental condition existing on the date of enactment of this
				paragraph.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="H2953FEB7C9DC4AF095507D01CBB08EE"><enum>202.</enum><header>Treatment works
			 defined</header><text display-inline="no-display-inline">Section 212(2)(A) (33
			 U.S.C. 1292(2)(A)) is amended—</text>
				<paragraph id="H8E2607802EEA45529EBEEAD42B01BA12"><enum>(1)</enum><text>by striking
			 <quote>any works, including site</quote>;</text>
				</paragraph><paragraph id="H9805FBCF6A404C4A8349C5102FB7D46E"><enum>(2)</enum><text>by striking
			 <quote>is used for ultimate</quote> and inserting <quote>will be used for
			 ultimate</quote>; and</text>
				</paragraph><paragraph id="H22778ADFB72040AE86C8D514A0F133E5"><enum>(3)</enum><text>by inserting
			 before the period at the end the following: <quote>and acquisition of other
			 lands, and interests in lands, which are necessary for
			 construction</quote>.</text>
				</paragraph></section><section id="HD6ACED252232432EBAA4081EEF100DA"><enum>203.</enum><header>Policy on cost
			 effectiveness</header><text display-inline="no-display-inline">Section 218(a)
			 (<external-xref legal-doc="usc" parsable-cite="usc/33/1298">33 U.S.C. 1298(a)</external-xref>) is amended by striking <quote>combination of devices and
			 systems</quote> and all that follows through the period at the end and
			 inserting <quote>treatment works that meets the requirements of this Act. The
			 system may include water efficiency measures and devices.</quote>.</text>

			 POLLUTION CONTROL REVOLVING FUNDS</header>
			<section id="H9C7B7F582409461EA219C02FB4487300"><enum>301.</enum><header>General
			 authority for capitalization grants</header><text display-inline="no-display-inline">Section 601(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1381">33 U.S.C. 1381(a)</external-xref>)
			 is amended by striking <quote>for providing assistance</quote> and all that
			 follows through the period at the end and inserting the following: <quote>to
			 accomplish the objectives, goals, and policies of this Act by providing
			 assistance for projects and activities identified in section
			 603(c).</quote>.</text>
			</section><section id="H819BA2DB6DEB4A57904E920541D55E1F"><enum>302.</enum><header>Capitalization
			 grant agreements</header>
				<subsection id="H878588CE8A154D7C9D54DFDB029FBD60"><enum>(a)</enum><header>Reporting
			 Infrastructure Assets</header><text>Section 602(b)(9) (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)(9)</external-xref>) is amended by
			 striking <quote>standards</quote> and inserting <quote>standards, including
			 standards relating to the reporting of infrastructure assets</quote>.</text>
				</subsection><subsection id="HEF204F7C93E14D38987783C7291FD050"><enum>(b)</enum><header>Additional
			 Requirements</header><text>Section 602(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1382">33 U.S.C. 1382(b)</external-xref>) is
			 amended—</text>

			 <quote>and</quote> at the end of paragraph (9);</text>

				in accordance with this title;</text>
							</paragraph><paragraph id="H517BDAFD2A8043FBBB3184BD6E1981CD"><enum>(12)</enum><text>any fees charged
				by the State to recipients of assistance will be used for the purpose of
				financing the cost of administering the fund or financing projects or
				activities eligible for assistance from the fund;</text>
							</paragraph><paragraph id="H19FC5166D3124A6CBBDFD46004F69F12"><enum>(13)</enum><text>beginning in
				fiscal year 2009, the State will include as a condition of providing assistance
				to a municipality or intermunicipal, interstate, or State agency that the
				recipient of such assistance certify, in a manner determined by the Governor of
				the State, that the recipient—</text>
								<subparagraph commented="no" id="H08EBC977D0D6407C9B3115836227AA2F"><enum>(A)</enum><text>has studied and
				evaluated the cost and effectiveness of innovative and alternative processes,
				materials, techniques, and technologies for carrying out the proposed project
				or activity for which assistance is sought under this title, and has selected,
				to the extent practicable, a project or activity that may result in greater
				environmental benefits or equivalent environmental benefits when compared to
				standard processes, materials, techniques, and technologies and more
				efficiently uses energy and natural and financial resources; and</text>
								</subparagraph><subparagraph commented="no" id="H0CEA67EBCF274DC8BC1DF500BF48C4CC"><enum>(B)</enum><text display-inline="yes-display-inline">has considered, to the maximum extent
				practical and as determined appropriate by the recipient, the costs and
				effectiveness of other design, management, and financing approaches for
				carrying out a project or activity for which assistance is sought under this
				title, taking into account the cost of operating and maintaining the project or
				activity over its life, as well as the cost of constructing the project or
				activity;</text>
								</subparagraph></paragraph><paragraph id="HA4C47A85BDEF4B608B49194939EA91EF"><enum>(14)</enum><text>the State will
				use at least 15 percent of the amount of each capitalization grant received by
				the State under this title after September 30, 2007, to provide assistance to
				municipalities of fewer than 10,000 individuals that meet the affordability
				criteria established by the State under section 603(i)(2) for activities
				included on the State’s priority list established under section 603(g), to the
				extent that there are sufficient applications for such assistance;</text>
							</paragraph><paragraph id="HD6FF51B132704099A207E4A58D00ED2C"><enum>(15)</enum><text display-inline="yes-display-inline">treatment works eligible under section
				603(c)(1) which will be constructed in whole or in part with funds made
				available under section 205(m) or by a State water pollution control revolving
				fund under this title, or both, will meet the requirements of, or otherwise be
				treated (as determined by the Governor of the State) under sections 204(a)(6),
				204(b)(1), 211, 218, and 511(c)(1) in the same manner as treatment works
				constructed with assistance under title II of this Act;</text>
							</paragraph><paragraph commented="no" id="H3CA9FDBC3155463782B1AE2EB832AC00"><enum>(16)</enum><text>a contract to be
				carried out using funds directly made available by a capitalization grant under
				this title for program management, construction management, feasibility
				studies, preliminary engineering, design, engineering, surveying, mapping, or
				architectural related services shall be negotiated in the same manner as a
				contract for architectural and engineering services is negotiated under
				<external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/11">chapter 11</external-xref> of title 40,
				United States Code, or an equivalent State qualifications-based requirement (as
				determined by the Governor of the State); and</text>
							</paragraph><paragraph id="H6405EDDC6A7B45D19EE8D13FC40EC61"><enum>(17)</enum><text display-inline="yes-display-inline">the requirements of section 513 will apply
				to the construction of treatment works carried out in whole or in part with
				assistance made available by a State water pollution control revolving fund as
				authorized under this title, or with assistance made available under section
				205(m), or both, in the same manner as treatment works for which grants are
				made under this
				Act.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection></section><section id="H46BDA801254A4610A04D80A1A0BFA49"><enum>303.</enum><header>Water pollution
			 control revolving loan funds</header>
				<subsection id="HD23DD1AB370A466500183B32E75D19A8"><enum>(a)</enum><header>Projects and
			 Activities Eligible for Assistance</header><text>Section 603(c) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(c)</external-xref>)
			 is amended to read as follows:</text>
					<quoted-block id="HF77D11A05B254C67BE6DF4A882A4AE4F" style="OLC">
						<subsection id="HE7B7A28899BA4FDCADEEDD08D51B0685"><enum>(c)</enum><header>Projects and
				Activities Eligible for Assistance</header><text>The amounts of funds available
				to each State water pollution control revolving fund shall be used only for
				providing financial assistance—</text>
							<paragraph id="H3FAD4777228E4F01B63E649B1879B320"><enum>(1)</enum><text>to any
				municipality or intermunicipal, interstate, or State agency for construction of
				publicly owned treatment works;</text>
							</paragraph><paragraph id="HD6D383153DD643CD81F05333AF5B0737"><enum>(2)</enum><text>for the
				implementation of a management program established under section 319;</text>
							</paragraph><paragraph id="H5A926673FFFE44ABBD6BBD6580750000"><enum>(3)</enum><text>for development
				and implementation of a conservation and management plan under section
				320;</text>
							</paragraph><paragraph id="H49EC0FA72B2D4E8CA064F1C638408577"><enum>(4)</enum><text>for the
				implementation of lake protection programs and projects under section
				314;</text>
							</paragraph><paragraph id="H36AC4B538BCA4E709ED9B6FE1EDBAB1B"><enum>(5)</enum><text>for repair or
				replacement of decentralized wastewater treatment systems that treat domestic
				sewage;</text>
							</paragraph><paragraph id="H610308901A5B435A8D23EAE2F16594F6"><enum>(6)</enum><text display-inline="yes-display-inline">for measures to manage, reduce, treat, or
				reuse municipal stormwater;</text>
							</paragraph><paragraph id="HC38DB76A132D4CBAB061D41083AEBD4"><enum>(7)</enum><text>to any municipality
				or intermunicipal, interstate, or State agency for measures to reduce the
				demand for publicly owned treatment works capacity through water conservation,
				efficiency, or reuse;</text>
							</paragraph><paragraph id="H22B33116A40D4849A265380032352155"><enum>(8)</enum><text>for measures to
				increase the security of publicly owned treatment works; and</text>
							</paragraph><paragraph id="HFF185080A4AD4CE08FB99F68257966CA"><enum>(9)</enum><text>for the
				development and implementation of watershed projects meeting the criteria set
				forth in section
				122.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HB17EAE5D03C04C4A00776134F2583825"><enum>(b)</enum><header>Extended
			 Repayment Period</header><text>Section 603(d)(1) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(1)</external-xref>) is
			 amended—</text>
					<paragraph id="HF69000578FC24DFEB1C3123D2FD64F39"><enum>(1)</enum><text>in subparagraph
			 (A) by striking <quote>20 years</quote> and inserting <quote>the lesser of 30
			 years or the design life of the project to be financed with the proceeds of the
			 loan</quote>; and</text>
					</paragraph><paragraph id="H8E457FE788F2451C8BD54E35FCC663E"><enum>(2)</enum><text>in
			 subparagraph (B) by striking <quote>not later than 20 years after project
			 completion</quote> and inserting <quote>upon the expiration of the term of the
			 loan</quote>.</text>
					</paragraph></subsection><subsection id="H84B6007338E34C4298A5D29BB094DA13"><enum>(c)</enum><header>Fiscal
			 Sustainability Plan</header><text>Section 603(d)(1) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(1)</external-xref>) is
			 further amended—</text>
					<paragraph id="HE2C9A598FBE34D3D900018D4A8642385"><enum>(1)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (C);</text>
					</paragraph><paragraph id="H79AA5C27607C423FB9194653B2244F34"><enum>(2)</enum><text>by inserting
			 <quote>and</quote> at the end of subparagraph (D); and</text>
					</paragraph><paragraph id="H99BFF5F638724753A396002854DAE4EA"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="HEE4C432AC87E42B2B61347A0D831BE6" style="OLC">
							<subparagraph id="HEF6316DE867F42468F2926C977BA7FDF"><enum>(E)</enum><text>for any portion of
				a treatment works proposed for repair, replacement, or expansion, and eligible
				for assistance under section 603(c)(1), the recipient of a loan will develop
				and implement a fiscal sustainability plan that includes—</text>
								<clause id="HE5609D4A95DE4FC5BB4EFEEF82DE93E"><enum>(i)</enum><text>an
				inventory of critical assets that are a part of that portion of the treatment
				works;</text>
								</clause><clause id="H959F0683F18C49DDB7F07800F2F396B3"><enum>(ii)</enum><text>an evaluation of
				the condition and performance of inventoried assets or asset groupings;
				and</text>
								</clause><clause id="HF0504C28358E421F818B906837D38FBE"><enum>(iii)</enum><text>a plan for
				maintaining, repairing, and, as necessary, replacing that portion of the
				treatment works and a plan for funding such
				activities;</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H9378A766795E4AF78E568FAD1533B73F"><enum>(d)</enum><header>Administrative
			 Expenses</header><text>Section 603(d)(7) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(d)(7)</external-xref>) is amended by
			 inserting before the period at the end the following: <quote>, $400,000 per
			 year, or <fraction>1/5</fraction> percent per year of the current valuation of
			 the fund, whichever amount is greatest, plus the amount of any fees collected
			 by the State for such purpose regardless of the source</quote>.</text>
				</subsection><subsection id="H3C3B9AC8E2CF42D29281A4B5495B708C"><enum>(e)</enum><header>Technical and
			 Planning Assistance for Small Systems</header><text>Section 603(d) (33 U.S.C.
			 1383(d)) is amended—</text>
					<paragraph id="HF557D332653441E7AAAE4C1037CF4AD"><enum>(1)</enum><text>by
			 striking <quote>and</quote> at the end of paragraph (6);</text>
					</paragraph><paragraph id="H7FE0A38B224D4B05B7164E9CD363B841"><enum>(2)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>
					</paragraph><paragraph id="H0AB0BDE10FF24A19AF83A70264D12797"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block id="H57AF6E5581804590A283757802B7F1F4" style="OLC">
							<paragraph id="H6FEBEE5BA84143468B73F75D2EA8AAB3"><enum>(8)</enum><text>to provide owners
				and operators of treatment works that serve a population of 10,000 or fewer
				with technical and planning assistance and assistance in financial management,
				user fee analysis, budgeting, capital improvement planning, facility operation
				and maintenance, equipment replacement, repair schedules, and other activities
				to improve wastewater treatment plant management and operations; except that
				such amounts shall not exceed 2 percent of grant awards to such fund under this
				title.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H00709E6490A344C28BF16D7D007FDE10"><enum>(f)</enum><header>Additional
			 Subsidization</header><text>Section 603 (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383</external-xref>) is amended by
			 adding at the end the following:</text>
					<quoted-block id="H8E7B047A9E9A493CA7F32CA697DEDC00" style="OLC">
						<subsection id="HDBB4BF926D3E4B8C8B858BD8848D967"><enum>(i)</enum><header>Additional
				Subsidization</header>
							<paragraph id="H157B8B7637FF46C8A000956E248F8BDE"><enum>(1)</enum><header>In
				general</header><text>In any case in which a State provides assistance to a
				municipality or intermunicipal, interstate, or State agency under subsection
				(d), the State may provide additional subsidization, including forgiveness of
				principal and negative interest loans—</text>
								<subparagraph id="H5E48FA3B5D2D4B3FADFE10BC7906F25E"><enum>(A)</enum><text>to benefit a
				municipality that—</text>
									<clause id="HB385D58EC92A4A94AE668C83F57BA57C"><enum>(i)</enum><text>meets the State’s
				affordability criteria established under paragraph (2); or</text>
									</clause><clause id="H5C8B91E7DEAE4587A25BA8633FD4E237"><enum>(ii)</enum><text>does not meet the
				State’s affordability criteria if the recipient—</text>
										<subclause id="HD34AA031ED464452A28B9D613142AE41"><enum>(I)</enum><text>seeks additional
				subsidization to benefit individual ratepayers in the residential user rate
				class;</text>
										</subclause><subclause id="HF1CAF84D68BB4E519911128CFF9557C6"><enum>(II)</enum><text>demonstrates to
				the State that such ratepayers will experience a significant hardship from the
				increase in rates necessary to finance the project or activity for which
				assistance is sought; and</text>
										</subclause><subclause id="H8AFCCA51FB39489EB99C562D88019041"><enum>(III)</enum><text>ensures, as part
				of an assistance agreement between the State and the recipient, that the
				additional subsidization provided under this paragraph is directed through a
				user charge rate system (or other appropriate method) to such ratepayers;
				or</text>
										</subclause></clause></subparagraph><subparagraph id="HC95F79B9ADAE441300EE86CCEEED419"><enum>(B)</enum><text display-inline="yes-display-inline">to implement an innovative or alternative
				process, material, technique, or technology (including low-impact technologies,
				nonstructural protection of surface waters, a new or improved method of waste
				treatment, and nutrient pollutant trading) that may result in greater
				environmental benefits, or equivalent environmental benefits at reduced cost,
				when compared to a standard process, material, technique, or technology.</text>
								</subparagraph></paragraph><paragraph id="H45A90658660541EB823E522C16E54F00"><enum>(2)</enum><header>Affordability
				criteria</header>
								<subparagraph id="H8A6DC47AB3E945318C3F00CE0779AAB"><enum>(A)</enum><header>Establishment</header><text>On
				or before September 30, 2008, and after providing notice and an opportunity for
				public comment, a State shall establish affordability criteria to assist in
				identifying municipalities that would experience a significant hardship raising
				the revenue necessary to finance a project or activity eligible for assistance
				under section 603(c)(1) if additional subsidization is not provided. Such
				criteria shall be based on income data, population trends, and other data
				determined relevant by the State.</text>
								</subparagraph><subparagraph id="HC42F41AA79654162A879B1EABCD0DED2"><enum>(B)</enum><header>Existing
				criteria</header><text>If a State has previously established, after providing
				notice and an opportunity for public comment, affordability criteria that meet
				the requirements of subparagraph (A), the State may use the criteria for the
				purposes of this subsection. For purposes of this Act, any such criteria shall
				be treated as affordability criteria established under this paragraph.</text>
								</subparagraph><subparagraph id="HF423F7E43F244021B5E3B9E2026B90E1"><enum>(C)</enum><header>Information to
				assist states</header><text>The Administrator may publish information to assist
				States in establishing affordability criteria under subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="H87A6EC861AEE4F1888CC282B9BC98BFA"><enum>(3)</enum><header>Priority</header><text>A
				State may give priority to a recipient for a project or activity eligible for
				funding under section 603(c)(1) if the recipient meets the State’s
				affordability criteria.</text>
							</paragraph><paragraph id="HBC842C1D9BA94CA19E408FF60086EF87"><enum>(4)</enum><header>Set-aside</header>
								<subparagraph id="HB3C1D1612D15483885BF52C838D07DA9"><enum>(A)</enum><header>In
				general</header><text>In any fiscal year in which the Administrator has
				available for obligation more than $1,000,000,000 for the purposes of this
				title, a State shall provide additional subsidization under this subsection in
				the amount specified in subparagraph (B) to eligible entities described in
				paragraph (1) for projects and activities identified in the State’s intended
				use plan prepared under section 606(c) to the extent that there are sufficient
				applications for such assistance.</text>
								</subparagraph><subparagraph id="H3F4B76E962D4400F83A636FD827C8363"><enum>(B)</enum><header>Amount</header><text>In
				a fiscal year described in subparagraph (A), a State shall set aside for
				purposes of subparagraph (A) an amount not less than 25 percent of the
				difference between—</text>
									<clause id="HDFF2B0F27DA747AC9EFD6130C3FD9BDF"><enum>(i)</enum><text>the total amount
				that would have been allotted to the State under section 604 for such fiscal
				year if the amount available to the Administrator for obligation under this
				title for such fiscal year had been equal to $1,000,000,000; and</text>
									</clause><clause id="H8382538385A345E992EB0000D810D897"><enum>(ii)</enum><text>the total amount
				allotted to the State under section 604 for such fiscal year.</text>
									</clause></subparagraph></paragraph><paragraph id="H14A7DACD11A0441FA1F3C82010262E87"><enum>(5)</enum><header>Limitation</header><text>The
				total amount of additional subsidization provided under this subsection by a
				State may not exceed 30 percent of the total amount of capitalization grants
				received by the State under this title in fiscal years beginning after
				September 30,
				2007.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HAC1A13B97D764282B7D3036117F5C52"><enum>304.</enum><header>Allotment of
			 funds</header>
				<subsection id="H677353ADEC154EB58E5386286E260004"><enum>(a)</enum><header>In
			 General</header><text>Section 604(a) (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384(a)</external-xref>) is amended to
			 read as follows:</text>
					<quoted-block id="HD13ADED1CF8243018D36919E5610C894" style="OLC">
						<subsection id="H8C4E68E1025847258C88EB5031C452AA"><enum>(a)</enum><header>Allotments</header>
							<paragraph id="H46AED772EC3D4A61B8E78EE9684402D1"><enum>(1)</enum><header>Fiscal years
				2008 and 2009</header><text>Sums appropriated to carry out this title for each
				of fiscal years 2008 and 2009 shall be allotted by the Administrator in
				accordance with the formula used to allot sums appropriated to carry out this
				title for fiscal year 2007.</text>
							</paragraph><paragraph id="H069D25EB1BC141FDAACE9F5F1D1F5CB8"><enum>(2)</enum><header>Fiscal year 2010
				and thereafter</header><text>Sums appropriated to carry out this title for
				fiscal year 2010 and each fiscal year thereafter shall be allotted by the
				Administrator as follows:</text>
								<subparagraph id="H6620BFCF7D5746178769386000B9088E"><enum>(A)</enum><text>Amounts that do
				not exceed $1,350,000,000 shall be allotted in accordance with the formula
				described in paragraph (1).</text>
								</subparagraph><subparagraph id="H24FDC44CCCA64D4FB81491A4B2EB72D"><enum>(B)</enum><text>Amounts that exceed
				$1,350,000,000 shall be allotted in accordance with the formula developed by
				the Administrator under subsection
				(d).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H17BC5462B38F415CB1E981A378D21FD4"><enum>(b)</enum><header>Planning
			 Assistance</header><text>Section 604(b) (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384(b)</external-xref>) is amended by
			 striking <quote>1 percent</quote> and inserting <quote>2
			 percent</quote>.</text>
				</subsection><subsection id="H6C17506A36B84E86A9D3C003594DC123"><enum>(c)</enum><header>Formula</header><text>Section
			 604 (<external-xref legal-doc="usc" parsable-cite="usc/33/1384">33 U.S.C. 1384</external-xref>) is amended by adding at the end the following:</text>
					<quoted-block id="H9E6269CAC6A04CBFABF385C8D931F9F1" style="OLC">
						<subsection id="HF393D7CBA4434A2A914366215751408D"><enum>(d)</enum><header>Formula Based on
				Water Quality Needs</header><text>Not later than September 30, 2009, and after
				providing notice and an opportunity for public comment, the Administrator shall
				publish an allotment formula based on water quality needs in accordance with
				the most recent survey of needs developed by the Administrator under section
				516(b).</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="HC187F14B98574EB49EF129FC422DA5C"><enum>305.</enum><header>Intended use
			 plan</header>
				<subsection id="HFACCE4507A564A2EA6390900E432AD13"><enum>(a)</enum><header>Integrated
			 Priority List</header><text>Section 603(g) (<external-xref legal-doc="usc" parsable-cite="usc/33/1383">33 U.S.C. 1383(g)</external-xref>) is amended to
			 read as follows:</text>
					<quoted-block id="H8E912D9FC8C34409A1BA68FBE69CAE" style="OLC">
						<subsection id="H83358453590145F796335B80E2003235"><enum>(g)</enum><header>Priority
				List</header>
							<paragraph id="H010E0596E79946D39C45613C07048E2F"><enum>(1)</enum><header>In
				general</header><text>For fiscal year 2009 and each fiscal year thereafter, a
				State shall establish or update a list of projects and activities for which
				assistance is sought from the State’s water pollution control revolving fund.
				Such projects and activities shall be listed in priority order based on the
				methodology established under paragraph (2). The State may provide financial
				assistance from the State’s water pollution control revolving fund only with
				respect to a project or activity included on such list. In the case of projects
				and activities eligible for assistance under section 603(c)(2), the State may
				include a category or subcategory of nonpoint sources of pollution on such list
				in lieu of a specific project or activity.</text>
							</paragraph><paragraph id="H8D22EC21EB734E4988B6C7C11DD5297B"><enum>(2)</enum><header>Methodology</header>
								<subparagraph id="H28DABF158DA94976914683539D95B831"><enum>(A)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of this
				paragraph, and after providing notice and opportunity for public comment, each
				State (acting through the State’s water quality management agency and other
				appropriate agencies of the State) shall establish a methodology for developing
				a priority list under paragraph (1).</text>
								</subparagraph><subparagraph id="H9C86B461F91643F194808EAB511048F1"><enum>(B)</enum><header>Priority for
				projects and activities that achieve greatest water quality
				improvement</header><text display-inline="yes-display-inline">In developing the
				methodology, the State shall seek to achieve the greatest degree of water
				quality improvement, taking into consideration the requirements of section
				602(b)(5) and section 603(i)(3), whether such water quality improvements would
				be realized without assistance under this title, and whether the proposed
				projects and activities would address water quality impairments associated with
				existing treatment works.</text>
								</subparagraph><subparagraph id="HB62FF7D57CCF43649BD6EA0635504FF"><enum>(C)</enum><header>Considerations in
				selecting projects and activities</header><text>In determining which projects
				and activities will achieve the greatest degree of water quality improvement,
				the State shall consider—</text>
									<clause id="HEB2CDDF3D64A4FD0BA07AE5EB32D4EEE"><enum>(i)</enum><text>information
				developed by the State under sections 303(d) and 305(b);</text>
									</clause><clause id="H8A6A5871D52342CFB38F0087F9FBB7C3"><enum>(ii)</enum><text>the State’s
				continuing planning process developed under section 303(e);</text>
									</clause><clause id="H0145B05023D1479197577462AA719E04"><enum>(iii)</enum><text>the State’s
				management program developed under section 319; and</text>
									</clause><clause id="H5D94A3D535E54E269BEEC670182C005F"><enum>(iv)</enum><text>conservation and
				management plans developed under section 320.</text>
									</clause></subparagraph><subparagraph id="H4453E99684F441FA9744DA5100FE0913"><enum>(D)</enum><header>Nonpoint
				sources</header><text>For categories or subcategories of nonpoint sources of
				pollution that a State may include on its priority list under paragraph (1),
				the State may consider the cumulative water quality improvements associated
				with projects or activities in such categories or subcategories.</text>
								</subparagraph><subparagraph id="H673C06B40F024813B2F0F91559953F6D"><enum>(E)</enum><header>Existing

				</subsection></section><section id="H3F8315220B904C8CB4EAFA3158C0FE00"><enum>306.</enum><header>Annual
			 reports</header><text display-inline="no-display-inline">Section 606(d) (33

							</subsection><subsection id="H3D1EE82D25F44C128B15537D44DB0632"><enum>(c)</enum><header>Compliance
				criteria</header><text>At the request of any State, the Administrator, after
				providing notice and an opportunity for public comment, shall assist in the
				development of criteria for a State to determine compliance with the conditions
				of funding assistance established under sections 602(b)(13) and
				603(d)(1)(E).</text>

			 long-term, sustainable, clean water funding</header>
				<subsection id="H65784330156B4FB28943DD40E0C13CE9"><enum>(a)</enum><header>Study</header><text>Not
			 later than 30 days after the date of enactment of this Act, the Comptroller
			 General shall commence a study of the funding mechanisms and funding sources
			 available to establish a Clean Water Trust Fund.</text>
				</subsection><subsection id="HF852327482AC41C9970057560832FDFF"><enum>(b)</enum><header>Contents</header><text>The
			 study shall include an analysis of potential revenue sources that can be
			 efficiently collected, are broad based, are related to water quality, and that
			 support the annual funding levels authorized by the amendments made by this
			 Act.</text>
				</subsection><subsection id="HB5DD37B8DC9A4407B46F676F8BFDB8DB"><enum>(c)</enum><header>Consultation</header><text>In
			 conducting the study, the Comptroller General, at a minimum, shall consult with
			 Federal, State, and local agencies, representatives of business and industry,
			 representatives of entities operating publicly owned treatment works, and other
			 interested groups.</text>
				</subsection><subsection id="H37C68A1164334859A41E315350327003"><enum>(d)</enum><header>Report</header><text>Not
			 later than January 1, 2008, the Comptroller General shall submit to the
			 Committee on Transportation and Infrastructure of the House of Representatives
			 and the Committee on Environment and Public Works of the Senate a report on the
			 results of the study.</text>
				</subsection></section><section display-inline="no-display-inline" id="HC1F70034F76244CB9874DB665146F1C2" section-type="subsequent-section"><enum>502.</enum><header>Feasibility study of
			 supplemental and alternative clean water funding mechanisms</header>
				<subsection id="HE1E8934E8E164D10964D51EF3B2FBBF7"><enum>(a)</enum><header>Study</header><text>Not
			 later than 30 days after the date of enactment of this Act, the Comptroller
			 General shall commence a study of funding mechanisms and funding sources
			 potentially available for wastewater infrastructure and other water pollution
			 control activities under the Federal Water Pollution Control Act (33 U.S.C.
			 1251 et seq.).</text>
				</subsection><subsection id="H29F5B598B2E44664A000919BE187E7D"><enum>(b)</enum><header>Contents</header><text>The
			 study shall include an analysis of funding and investment mechanisms and
			 revenue sources from other potential supplemental or alternative public or
			 private sources that could be used to fund wastewater infrastructure and other
			 water pollution control activities under the Federal Water Pollution Control
			 Act.</text>
				</subsection><subsection display-inline="no-display-inline" id="H9095B1A3B725440FA3403FA86EE5BF16"><enum>(c)</enum><header>Consultation</header><text>In
			 conducting the study, the Comptroller General, at a minimum, shall consult with
			 Federal, State, and local agencies, representatives of business, industry, and
			 financial investment entities, representatives of entities operating treatment
			 works, and other interested groups.</text>
				</subsection><subsection id="H609922BD2277403089691FFCADD8CD08"><enum>(d)</enum><header>Report</header><text>Not
			 later than January 1, 2008, the Comptroller General shall submit to the
			 Committee on Transportation and Infrastructure of the House of Representatives
			 and the Committee on Environment and Public Works of the Senate a report on the
			 results of the study.</text>
				</subsection></section><section display-inline="no-display-inline" id="HB1194086FF4D49FB9B65FDE2CED920CF" section-type="subsequent-section"><enum>503.</enum><header>Great Lakes water
			 quality</header>
				<subsection id="H9BDA32907505482383A148DFF565CCA7"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Administrator of the Environmental
			 Protection Agency, in consultation with the Secretary of State and the
			 Government of Canada, shall conduct a study of the condition of wastewater
			 treatment facilities located in the United States and Canada that discharge
			 into the Great Lakes.</text>
				</subsection><subsection id="H3D447D24A8FB46DF9E724F73253C8C2F"><enum>(b)</enum><header>Contents</header><text>In
			 conducting the study, the Administrator shall—</text>
					<paragraph id="H2BFA15A4C7804CBFB512CAABBA623D31"><enum>(1)</enum><text>determine the
			 effect that such treatment facilities have on Great Lakes water quality;
			 and</text>
					</paragraph><paragraph id="H73E140C7B8094C81A8F334F2B3E69D2"><enum>(2)</enum><text display-inline="yes-display-inline">develop recommendations—</text>
						<subparagraph id="H3545ADDD78A545D4BA46D9CC04A3E1D8"><enum>(A)</enum><text>to improve water
			 quality monitoring by the operators of such treatment facilities;</text>
						</subparagraph><subparagraph id="H12AA3E7BDFF24B01B901CDFFBEC332F"><enum>(B)</enum><text display-inline="yes-display-inline">to establish a protocol for improved
			 notification and information sharing between the United States and Canada;
			 and</text>
						</subparagraph><subparagraph id="H1D567B77C195402CA515EF2B60EEA9C6"><enum>(C)</enum><text>to promote
			 cooperation between the United States and Canada to prevent the discharge of
			 untreated and undertreated waste into the Great Lakes.</text>
						</subparagraph></paragraph></subsection><subsection id="H0726148A8D87491F87FBC700022E26B2"><enum>(c)</enum><header>Consultation</header><text display-inline="yes-display-inline">In conducting the study, the Administrator
			 shall consult with the International Joint Commission and Federal, State, and
			 local governments.</text>
				</subsection><subsection id="H726CF51A05514D1586FE62F8CC1B9C40"><enum>(d)</enum><header>Report</header><text>Not
			 later than one year after the date of enactment of this Act, the Administrator
			 shall submit to Congress a report on the results of the study, together with
			 the recommendations developed under subsection (b)(2).</text>

				vessel of the United States;</text>

			 issuance of transportation security cards to convicted felons</header><text display-inline="no-display-inline">No individual who has been issued a
			 transportation worker identification card may board a maritime vessel if the
			 individual has been convicted, or found not guilty by reason of insanity, in a
			 civilian or military jurisdiction of any of the following felonies:</text>
				<paragraph id="H89344514EBE847B39ED1462701C80015"><enum>(1)</enum><text>Espionage or
			 conspiracy to commit espionage.</text>
				</paragraph><paragraph id="HC1F5D394E5E54250B193CF3715C18C88"><enum>(2)</enum><text>Sedition or
			 conspiracy to commit sedition.</text>
				</paragraph><paragraph id="HB872CC5BA0964523A34E4CD925A7031"><enum>(3)</enum><text>Treason or
			 conspiracy to commit treason.</text>
				</paragraph><paragraph id="HE0DF58D1BA6F4CEA00DACC9F64E2815B"><enum>(4)</enum><text>A
			 crime listed in
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/113B">chapter 113B</external-xref> of title 18,
			 United States Code, a comparable State law, or conspiracy to commit such
			 crime.</text>
				</paragraph><paragraph id="H487930D5AB3B4560877161C168932B5"><enum>(5)</enum><text>A
			 crime involving a transportation security incident. In this paragraph, a
			 transportation security incident—</text>
					<subparagraph id="H311071FE7C3648879DEEC50B7FF5CBB"><enum>(A)</enum><text>is a security
			 incident resulting in a significant loss of life, environmental damage,
			 transportation system disruption, or economic disruption in a particular area
			 (as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/70101">section 70101</external-xref> of title 46, United
			 States Code); and</text>
					</subparagraph><subparagraph id="HADC364F332F241008F78A2EED015FF00"><enum>(B)</enum><text>does not include a
			 work stoppage or other nonviolent employee-related action, resulting from an
			 employer-employee dispute.</text>
					</subparagraph></paragraph><paragraph id="HDECB0C352B3D47EFA2B91997F121ADA8"><enum>(6)</enum><text>Improper
			 transportation of a hazardous material under <external-xref legal-doc="usc" parsable-cite="usc/49/5124">section 5124</external-xref> of title 49, United
			 States Code, or a comparable State law.</text>
				</paragraph><paragraph id="H88A70DE716CF4B6EACB600B2AEEFC4E7"><enum>(7)</enum><text>Unlawful
			 possession, use, sale, distribution, manufacture, purchase, receipt, transfer,
			 shipping, transporting, import, export, storage of, or dealing in an explosive
			 or incendiary device (as defined in <external-xref legal-doc="usc" parsable-cite="usc/18/232">section 232(5)</external-xref> of title 18, United States
			 Code, explosive materials (as defined in section 841(c) of such title 18), or a
			 destructive device (as defined in 921(a)(4) of such title 18).</text>
				</paragraph><paragraph id="H03A447F8B8B54D1D98534156029929A6"><enum>(8)</enum><text>Murder.</text>
				</paragraph><paragraph id="H09922CBB525841CB84CCBC007934661B"><enum>(9)</enum><text>Conspiracy or
			 attempt to commit any of the crimes described in paragraphs (5) through
			 (8).</text>
				</paragraph><paragraph id="H9FC821F3C8A2423E869BE4E800001417"><enum>(10)</enum><text>A violation of
			 the Racketeer Influenced and Corrupt Organizations Act (18 U.S.C. 1961 et
			 seq.), or a comparable State law, if 1 of the predicate acts found by a jury or
			 admitted by the defendant consists of 1 of the offenses listed in paragraphs
			 (4) and (8).</text>
