		<official-title>To amend title 49, United States Code, to direct the
		  Secretary of Transportation to establish sanctions and penalties applicable to
		  an employer whenever an employee of the employer is convicted of driving an
		  over-the-road bus under the influence of alcohol or a controlled substance
		  while acting within the scope of the employee’s employment.</official-title>

		<section id="HEB8C3FEA1D304CDBA464ED449CE6D375" section-type="section-one"><enum>1.</enum><header>Sanctions applicable to
			 employers of over-the-road bus drivers convicted of driving under the
			 influence</header><text display-inline="no-display-inline">Section 31310 of
			 title 49, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H4B87CE6E83EA4DE2A184988E0018BFF1" style="OLC">
				<subsection id="HB2D318EB358A46419846009DD76B9461"><enum>(j)</enum><header>Sanctions
				applicable to employers of over-the-road bus drivers convicted of driving under
				the influence</header>
					<paragraph id="HDA7C9C577F6F4735A97CB5ECB053E4C"><enum>(1)</enum><header>Sanctions</header><text>The
				Secretary shall issue regulations establishing sanctions and penalties
				applicable to an employer whenever an employee of the employer is convicted of
				driving an over-the-road bus under the influence of alcohol or a controlled
				substance while acting within the scope of the employee’s employment.</text>
					</paragraph><paragraph id="H1857D59485AB4A5E8892E9EEB9C8D850"><enum>(2)</enum><header>Minimum
				requirements</header><text display-inline="yes-display-inline">The regulations
				issued under paragraph (1) shall require, at a minimum, that an employer
				described in paragraph (1) be subject for each offense, upon conviction, to
				imprisonment for a term not to exceed one year or a fine under title 18, or
				both.</text>
					</paragraph><paragraph id="HBD3F375A15A54E8AB1198778C1ED179"><enum>(3)</enum><header>Over-the-road bus
				defined</header><text display-inline="yes-display-inline">In this subsection,
				the term <quote>over-the-road bus</quote> means a commercial motor vehicle
				providing intercity, fixed-route over-the-road service or other over-the-road
				service, as such terms are defined in section 3038(a) of the Transportation
				Equity Act for the 21st Century (<external-xref legal-doc="usc" parsable-cite="usc/49/5310">49 U.S.C. 5310</external-xref> note; 112 Stat. 392).</text>
