		<official-title>To provide for the establishment of a commission to
		  engage in an informed, national, and public dialogue about how to ensure that
		  each student in the United States receives an equitable education that enables
		  the student to achieve his or her maximum academic potential.</official-title>

		<section id="H68F57377368543E3829438E5DF3C553D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>The Citizens’ Commission on
			 Educational Equity Act of 2008</short-title></quote>.</text>
		</section><section id="H126BB3A88C724BA6AAFB9456504BDE6"><enum>2.</enum><header>Findings; sense of
			 the Congress</header>
			<subsection id="H35ABA5942201414EA9EE5C357760D500"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">The Congress finds the following:</text>
				<paragraph id="H52EA7F9BE5714CB8B52F1B9E3E9EB959"><enum>(1)</enum><text>There are vast
			 disparities in the educations provided by schools throughout the United
			 States.</text>
				</paragraph><paragraph id="HA355437C57AC47458DF166AF3C4E7B03"><enum>(2)</enum><text display-inline="yes-display-inline">The educational disparities are reinforced
			 by funding disparities, such as the following:</text>
					<subparagraph id="HC1333582758C4FDABD95B357086DF4C3"><enum>(A)</enum><text display-inline="yes-display-inline">The school district in the United States
			 with the greatest spending per student spends 9.12 times more per student
			 annually than the district with the least spending per student.</text>
					</subparagraph><subparagraph id="HB6EFF0D912A84FD5B212B651AC654159"><enum>(B)</enum><text display-inline="yes-display-inline">The school district in California with the
			 greatest spending per student spends 4.24 times more per student annually than
			 the district with the least spending per student.</text>
					</subparagraph></paragraph><paragraph id="H20E813D369F0404100E5B349DAA9CCD9"><enum>(3)</enum><text>The schools of the
			 United States do not meet the educational needs of all students, despite the
			 wealth of the Nation.</text>
				</paragraph></subsection><subsection id="H18499BF651604E739BCAACD3536D037"><enum>(b)</enum><header>Sense of the
			 Congress</header><text display-inline="yes-display-inline">It is the sense of
			 the Congress that the people of the United States should engage in an informed,
			 national, and public dialogue on how to ensure that each student in the United
			 States receives an equitable education that enables the student to achieve his
			 or her maximum educational potential.</text>
			</subsection></section><section id="HDF2E90FBF4374DA7889D65E4307675F"><enum>3.</enum><header>Establishment of
			 Commission</header><text display-inline="no-display-inline">There shall be
			 established a commission to be known as the <quote>Citizens’ Commission on
			 Educational Equity</quote> (in this Act referred to as the
			 <quote>Commission</quote>).</text>
		</section><section id="HB5DFAB34102E448B89C2863168EB11"><enum>4.</enum><header>Duties of
			 Commission</header><text display-inline="no-display-inline">The Commission
			 shall study ways to enable each student attending a school in the United States
			 to achieve his or her maximum academic potential, with particular emphasis on
			 the following:</text>
			<paragraph id="H3DA712274BE1486C92E9A0A7EFF1FAA"><enum>(1)</enum><text display-inline="yes-display-inline">Ensuring that a school receives adequate
			 resources to meet the educational needs of each student in the school.</text>
			</paragraph><paragraph id="H2800EA89E88941EBBFA467A19112D59D"><enum>(2)</enum><text display-inline="yes-display-inline">The methods available, or that need to be
			 developed, to determine the educational needs of a student.</text>
			</paragraph><paragraph id="HA7CDE7AB3EC44FF4AB4E4329B5370099"><enum>(3)</enum><text>Identifying and
			 devising innovative strategies for State and local educational agencies
			 to—</text>
				<subparagraph id="H399B050BE21F4CFAB7961C236B7731B3"><enum>(A)</enum><text>enable each
			 student to achieve his or her maximum academic potential; and</text>
				</subparagraph><subparagraph id="H6FC2B651F067437BABD13D9100AB7250"><enum>(B)</enum><text>participate in
			 reforming the methods by which schools are funded, to achieve educational
			 equity.</text>
				</subparagraph></paragraph></section><section id="H7E17CAF1FC1B454FA037289935DD96DC"><enum>5.</enum><header>Membership of
			 Commission</header>
			<subsection id="H0D8CF14DBACA451C93A7F526E4456BA2"><enum>(a)</enum><header>Number and
			 appointment</header><text display-inline="yes-display-inline">The Commission
			 shall be composed of 15 members, as follows:</text>
				<paragraph id="H8DAA86CF08984FB0B2575D7ED480E4CE"><enum>(1)</enum><text>The Secretary of
			 Education.</text>
				</paragraph><paragraph id="H975E06F9DCE1490F0086E0ED9591C516"><enum>(2)</enum><text>14 individuals
			 appointed by the Comptroller General, in collaboration with the President of
			 the National Academy of Sciences, in accordance with subsection (b).</text>
				</paragraph></subsection><subsection id="HE777252773AE4F77998413AC66BC1E5"><enum>(b)</enum><header>Criteria for
			 selection</header>
				<paragraph id="H62F9D0F9E06C44E3AF5FED1B984F703D"><enum>(1)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Within 90 days after funds are first
			 appropriated to carry out this Act, the Comptroller General shall make the
			 appointments provided for in subsection (a)(2) from among individuals—</text>
					<subparagraph id="HA2E34B2016B34276B95EE7AEE7E468D"><enum>(A)</enum><text>who submit an
			 application as the Comptroller General shall require; and</text>
					</subparagraph><subparagraph id="HDE4BF8548B5E42C79383E57C91CBB8CE"><enum>(B)</enum><text>who are any of the
			 following:</text>
						<clause id="H3B69466051274FF3AE41EC861B79E5FE"><enum>(i)</enum><text>A
			 student.</text>
						</clause><clause id="H148E8E692D8248F9878EF00FF5864C0"><enum>(ii)</enum><text>A
			 parent or guardian of a student.</text>
						</clause><clause id="H508D8F713F534CDCA498BE28AF17F4D6"><enum>(iii)</enum><text>An
			 individual familiar with special education.</text>
						</clause><clause id="HDAF342961FCD4FCCA34B5872C473651E"><enum>(iv)</enum><text>An
			 officer of a State educational agency.</text>
						</clause><clause id="HC1F5A6C2F31D45B78E4EAF174DD1C53"><enum>(v)</enum><text>A
			 teacher.</text>
						</clause><clause id="H8A8753224A7748DA81771EB81343EDD"><enum>(vi)</enum><text>A
			 principal or school administrator.</text>
						</clause><clause id="H3889954F4DD84CA6A7555100D0FF6100"><enum>(vii)</enum><text>A
			 school board member</text>
						</clause><clause id="HD99BB551DE37478886022BA3FF3219AA"><enum>(viii)</enum><text>A
			 businessperson.</text>
						</clause><clause id="HD61CAAFA847546CAAB90B900565C1276"><enum>(ix)</enum><text>A
			 college or university professor of education.</text>
						</clause></subparagraph></paragraph><paragraph id="H0E2E2C0AED87469AA8CC7917C6A9E4EF"><enum>(2)</enum><header>Diversity</header><text>In
			 making the appointments, the Comptroller General shall ensure that the
			 Commission represents the geographical, economic, and cultural diversity of the
			 United States.</text>
				</paragraph><paragraph id="HF1B08FF9299948A780C605EDD74691B"><enum>(3)</enum><header>Prohibited
			 appointments</header><text>The Comptroller General may not appoint to the
			 Commission an individual who is any of the following:</text>
					<subparagraph id="H6D16DA0F1B4047509D5F6C5B83EE8577"><enum>(A)</enum><text>A Member of
			 Congress.</text>
					</subparagraph><subparagraph id="H904D4AC443F741C99C73EECB9FC8C1A6"><enum>(B)</enum><text>An officer or
			 employee of the Federal Government.</text>
					</subparagraph><subparagraph id="HA832CB4F1DBD4B1EA9A6201DAC960000"><enum>(C)</enum><text>An individual who
			 is—</text>
						<clause id="HB9BED1582B764125BACE263146370422"><enum>(i)</enum><text>registered as a
			 lobbyist under section 3 of the Lobbying Disclosure Act of 1995; or</text>
						</clause><clause id="H977FC2B908CE46ED800073E7451928B"><enum>(ii)</enum><text>registered as a
			 lobbyist under the law of any State.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H3B1EDCE129DE47AB9760FDC2BAD8FE4"><enum>(c)</enum><header>Terms of
			 appointed Commission members</header><text display-inline="yes-display-inline">A Commission member appointed under
			 subsection (a)(2) shall be appointed for the life of the Commission.</text>
			</subsection><subsection id="H4159C23C2BE94F69B6F63637102B8F20"><enum>(d)</enum><header>Vacancies</header>
				<paragraph id="H744F2D43DE4C4505BB63C77DB5335E5B"><enum>(1)</enum><header>How
			 filled</header><text>A vacancy in the Commission shall be filled in the manner
			 in which the original appointment was made.</text>
				</paragraph><paragraph id="HEAB7D0A691444E739E11A704ECE0BF67"><enum>(2)</enum><header>Length of
			 service</header><text display-inline="yes-display-inline">A Commission member
			 appointed to fill a vacancy in the Commission occurring before the end of the
			 term for which the predecessor of the member was appointed, shall be appointed
			 only for the remainder of the term.</text>
				</paragraph></subsection><subsection id="HAF7634DD36854936BEFAB7A142F2C2B8"><enum>(e)</enum><header>Compensation</header>
				<paragraph id="H77B7F63A35044DFEAF47167BE68B28C2"><enum>(1)</enum><header>Basic
			 pay</header><text display-inline="yes-display-inline">For each day, including
			 travel time, a Commission member is engaged in the performance of Commission
			 duties, the member shall be entitled to the daily equivalent of the annual rate
			 of basic pay for level IV of the Executive Schedule, subject to section
			 11(b)(1).</text>
				</paragraph><paragraph id="HCC16E33EC04544249837B4BE771700ED"><enum>(2)</enum><header>Prohibition of
			 compensation of Federal employees</header><text>The Secretary of Education may
			 not receive additional pay, allowances, or benefits by reason of service on the
			 Commission.</text>
				</paragraph></subsection><subsection id="HBB7F8105622A4772ACE708AC5F558867"><enum>(f)</enum><header>Travel
			 expenses</header><text>A Commission member may receive travel expenses,
			 including per diem in lieu of subsistence, in accordance with applicable
			 provisions under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States
			 Code.</text>
			</subsection><subsection id="HEE6D23BF27F24D5A8650F0FC49FFD655"><enum>(g)</enum><header>Chairperson</header><text>Within
			 15 days after all initial appointments to the Commission have been made, the
			 Comptroller General shall designate 1 Commission member as the chairperson (in
			 this Act referred to as the <quote>chairperson</quote>) of the
			 Commission.</text>
			</subsection><subsection id="H2CF7F9FE8D114A61AB7538B5F31846C9"><enum>(h)</enum><header>Taking
			 action</header><text display-inline="yes-display-inline">The Commission may
			 take action at a meeting only by a majority vote of the Commission members
			 present at the meeting.</text>
			</subsection><subsection id="HA6B0A145678E4B9A99D429B6A1BBD118"><enum>(i)</enum><header>Rules of
			 procedure</header><text display-inline="yes-display-inline">Within 15 days
			 after the designation of the chairperson, the Commission shall adopt rules of
			 procedure.</text>
			</subsection></section><section id="H720F983C03EC4C26948567849575F3A2"><enum>6.</enum><header>Commission
			 operations</header>
			<subsection id="HC2FA26D54D8448C3004D0013B7000904"><enum>(a)</enum><header>Executive
			 Director; staff</header>
				<paragraph id="HA9C06C99D6784337AD7DFC909412DC05"><enum>(1)</enum><header>Appointment of
			 Executive Director</header><text>The chairperson shall appoint an Executive
			 Director of the Commission.</text>
				</paragraph><paragraph id="H204C3473CDF84370A333EB722620114"><enum>(2)</enum><header>Hiring of
			 staff</header><text display-inline="yes-display-inline">The Commission may hire
			 additional personnel as the Commission considers appropriate.</text>
				</paragraph></subsection><subsection id="H44C2F5C64B0F48589143FCD121076EF2"><enum>(b)</enum><header>Compensation of
			 Executive Director and staff</header><text display-inline="yes-display-inline">Subject to section 11(b)(1), the Commission
			 shall pay—</text>
				<paragraph id="HFD4EE00854C647049F8333FB62ACD41C"><enum>(1)</enum><text>the Executive
			 Director at the rate of basic pay for level III of the Executive Schedule;
			 and</text>
				</paragraph><paragraph id="H4259BD600C3A4CD6A5CFCCD52431CA0"><enum>(2)</enum><text>an
			 individual hired under subsection (a)(2) at a rate that may not exceed the
			 daily equivalent of the annual rate of basic pay for grade GS–14 of the General
			 Schedule.</text>
				</paragraph></subsection><subsection id="HB534A24646404004A08FC300866BA7C4"><enum>(c)</enum><header>Experts and
			 consultants</header><text>Subject to rules prescribed by the Commission, the
			 Executive Director may procure temporary and intermittent services in the same
			 manner as an agency under <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109(b)</external-xref> of title 5, United States
			 Code.</text>
			</subsection><subsection id="H822F70EB764D46B9944C1E544F4681EA"><enum>(d)</enum><header>Staff of Federal
			 agencies</header><text display-inline="yes-display-inline">On request of the
			 Commission, to assist the Commission in carrying out the duties of the
			 Commission—</text>
				<paragraph id="H4492E31DC278486A891F08326C2B98A2"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary of Education may detail to
			 the Commission not more than 10 personnel of the Department of
			 Education;</text>
				</paragraph><paragraph id="HB007397FBF194D47A8A8C9F794030066"><enum>(2)</enum><text>the head of any
			 other Federal department or agency may detail personnel, services, or
			 facilities of the department or agency to the Commission, subject to paragraph
			 (3); and</text>
				</paragraph><paragraph id="HA10A06B6D3484DA800729026C6579685"><enum>(3)</enum><text>a
			 total of not more than 10 personnel may be detailed to the Commission under
			 paragraph (2).</text>
				</paragraph></subsection></section><section id="HC2BEFC205EAA42B7B365B03B87742265"><enum>7.</enum><header>Powers of
			 Commission</header>
			<subsection id="HD51260142904482400CEEA81F5388021"><enum>(a)</enum><header>Hearings and
			 sessions</header><text display-inline="yes-display-inline">To carry out the
			 duties of the Commission—</text>
				<paragraph id="HCA535F0649BA4550A9001BB7007F2016"><enum>(1)</enum><text display-inline="yes-display-inline">the Commission shall conduct public
			 hearings in which testimony is received from experts in—</text>
					<subparagraph id="HDE8A989B1A00412495502D2EE12B831B"><enum>(A)</enum><text>educational
			 equity;</text>
					</subparagraph><subparagraph id="H66583273832C428FBD78673932061D28"><enum>(B)</enum><text>civil rights
			 law;</text>
					</subparagraph><subparagraph id="H9BBF29C1BB16446FB465B5EAE725FA05"><enum>(C)</enum><text>constitutional
			 law;</text>
					</subparagraph><subparagraph id="HC459B7EBF0C64EFCB3B1A03E3E005D14"><enum>(D)</enum><text>educational
			 policy;</text>
					</subparagraph><subparagraph id="H566C98596AB24E24A0FDBD900120B0D3"><enum>(E)</enum><text>school
			 finance;</text>
					</subparagraph><subparagraph id="H5A06C699C84243A9BAA90978A86B91CD"><enum>(F)</enum><text>economics;</text>
					</subparagraph><subparagraph id="H022D31FA153346658B5C85AFAA855E8E"><enum>(G)</enum><text>taxation;</text>
					</subparagraph><subparagraph id="HB013737D88254039AB3C44E200C1E827"><enum>(H)</enum><text>land use or zoning
			 law; and</text>
					</subparagraph><subparagraph id="H6B07B0AEF3BA4051B1D02C03F113C0AB"><enum>(I)</enum><text>any other field
			 the Commission considers relevant; and</text>
					</subparagraph></paragraph><paragraph id="H09282262A3364FA994B1B53CE84B8588"><enum>(2)</enum><text display-inline="yes-display-inline">the Commission may, as the Commission
			 considers appropriate, sit and act, take testimony, and receive
			 evidence.</text>
				</paragraph></subsection><subsection id="HAB50D66562484EB9B0C05B00D12248CE"><enum>(b)</enum><header>Powers of
			 Commission members and agents</header><text>The Commission may authorize any
			 Commission member or agent of the Commission to take any action which the
			 Commission is authorized to take by this Act.</text>
			</subsection><subsection id="HA7AD105CF47D427283AC8208562F4D5B"><enum>(c)</enum><header>Obtaining
			 official data</header><text>The Commission may secure, directly from any
			 department or agency of the United States, information necessary to enable the
			 Commission to carry out this Act. On request of the chairperson, the head of
			 the department or agency shall furnish the information to the Commission,
			 subject to any applicable limitations of Federal law.</text>
			</subsection><subsection id="HFC3F6DD7F8E94CE2A2A920B6C449988C"><enum>(d)</enum><header>Administrative
			 support services</header><text display-inline="yes-display-inline">On request
			 of the chairperson, the Administrator of General Services shall provide to the
			 Commission, on a reimbursable basis, human resources management, budget,
			 leasing, accounting, payroll services, and other services necessary for the
			 Commission to carry out the duties of the Commission.</text>
			</subsection><subsection id="H21C3FDE1B7B646678715EF94B58F692C"><enum>(e)</enum><header>Contract
			 authority</header>
				<paragraph id="H677FAABF67A24DB9AAB45C93B3EF7F35"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subject to paragraph
			 (2) of this subsection and section 11(b)(2), the Commission may enter into
			 contracts with and compensate a government or private agency or person for the
			 conduct of activities necessary for the Commission to carry out the duties of
			 the Commission.</text>
				</paragraph><paragraph id="H28419E7C6ACE487B9C807E08FF07A824"><enum>(2)</enum><header>Duration</header><text>The
			 Commission may not enter into a contract if the terms of the contract extend
			 beyond the date the Commission terminates.</text>
				</paragraph></subsection><subsection id="HB69E004AF8D74FF09E80D5FC87F7D151"><enum>(f)</enum><header>Authority To
			 accept voluntary services</header>
				<paragraph id="H96238291202C4A588BC4EC9D77C80D9"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding <external-xref legal-doc="usc" parsable-cite="usc/31/1342">section 1342</external-xref> of title 31, United States
			 Code, the Commission may accept the service of a volunteer.</text>
				</paragraph><paragraph id="HF2868F309D8745BD00B71FC07A1ECD3"><enum>(2)</enum><header>Reimbursement of
			 volunteer</header><text>In accordance with applicable provisions under
			 subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, the Commission may
			 reimburse a volunteer for expenses for office supplies and local travel, and
			 for travel expenses, including per diem in lieu of subsistence, incurred in
			 performing services for the Commission.</text>
				</paragraph><paragraph id="H28C590451CC54CB1ADE466BBF3DCC026"><enum>(3)</enum><header>Volunteer deemed
			 a Federal employee</header><text>While performing services for the Commission,
			 a volunteer is deemed an employee of the Federal Government for the purposes of
			 the following:</text>
					<subparagraph id="H512DF43981F94198AF27B9E53DA700CF"><enum>(A)</enum><text>Chapter 81 of
			 title 5, United States Code, relating to compensation for work-related
			 injuries.</text>
					</subparagraph><subparagraph id="H00018E7D0D5F438493484800644E1BDE"><enum>(B)</enum><text>Chapter 11 of
			 title 18, United States Code, relating to conflicts of interest.</text>
					</subparagraph><subparagraph id="H6F5571DA9C544C1A84C76D40B58719A9"><enum>(C)</enum><text>Chapter 171 of
			 title 28, United States Code, relating to tort claims.</text>
					</subparagraph></paragraph></subsection><subsection id="H9D0F45ADFC874C739744BEC5BE9C7815"><enum>(g)</enum><header>Mails</header><text display-inline="yes-display-inline">The Commission may use the United States
			 mails in the same manner and under the same conditions as other departments and
			 agencies of the United States.</text>
			</subsection></section><section id="HCE592CADC7C446988EF07E57C0C5067D"><enum>8.</enum><header>Community
			 outreach programs</header>
			<subsection id="HBDEC1D26D21D4BD98FF6EE4FDF1DDF9C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Within 180 days after
			 the appointment of the chairperson, the Commission shall commence outreach
			 programs with communities throughout the United States, to engage the
			 communities in a public dialogue on how to ensure that the schools in the
			 communities enable each student in the United States to achieve his or her
			 maximum academic potential.</text>
			</subsection><subsection id="HB3F3AE38137640518824169E9C6FC3CD"><enum>(b)</enum><header>Methods</header><text>The
			 outreach programs shall, to the maximum extent possible, include the
			 following:</text>
				<paragraph id="H2077D7D173234BC9A54B67DF06D2A607"><enum>(1)</enum><text>Meetings.</text>
				</paragraph><paragraph id="H943EBC0A763C46D8A9972EAB2DC7E6FB"><enum>(2)</enum><text>Surveys.</text>
				</paragraph><paragraph id="H4AB7158BA48E4A0BBB1F3B533BC1B483"><enum>(3)</enum><text>Telephone
			 polls.</text>
				</paragraph><paragraph id="H5931365846A84272B0464F4D3CC68157"><enum>(4)</enum><text>Conference
			 calls.</text>
				</paragraph><paragraph id="H13CD9C9B4EB74E4D8CA8B3716443956"><enum>(5)</enum><text>Internet messaging
			 and forums.</text>
				</paragraph><paragraph id="H26B5225FD02E48C5B7B64B1E459DFEAF"><enum>(6)</enum><text>E-mail.</text>
				</paragraph></subsection><subsection id="H2997B7AC0F574E65B71FA87834576131"><enum>(c)</enum><header>Requirements</header>
				<paragraph id="HF999169985774E42BBDA06EE3300D764"><enum>(1)</enum><header>Selection of
			 communities</header><text>In selecting communities in which to conduct an
			 outreach program, the Commission shall ensure that the outreach programs
			 represent, to the maximum extent possible, the geographic diversity of the
			 United States and the economic and cultural diversity of the populations of the
			 communities.</text>
				</paragraph><paragraph id="H721A50F499F24D73995E4DC9AF91AC9D"><enum>(2)</enum><header>Public
			 events</header><text>Any event the Commission conducts as part of an outreach
			 program shall be open to the public.</text>
				</paragraph><paragraph id="H916078D5F36E418199F9CEA97E629E7"><enum>(3)</enum><header>Conduct of
			 outreach programs</header><text display-inline="yes-display-inline">In
			 conducting an outreach program:</text>
					<subparagraph id="H426D3864C43E49448EB37338C2FE7393"><enum>(A)</enum><header>Chair</header><text display-inline="yes-display-inline">The chairperson shall designate 1
			 Commission member to serve as the chair of an event that is part of the
			 program.</text>
					</subparagraph><subparagraph id="HC0ADA3EF609E4C078F66862186CEA4DA"><enum>(B)</enum><header>Issues</header><text>The
			 chair shall endeavour to have the attendees address the following
			 issues:</text>
						<clause id="H1FF54D9D96A44784A02F81BE934F51DB"><enum>(i)</enum><text>The
			 benefits to the United States of investing in enabling each student to achieve
			 his or her maximum academic potential.</text>
						</clause><clause id="HB3D411CD94774B9FA5BD67C1178C009B"><enum>(ii)</enum><text>How
			 to ensure that each student achieves his or her maximum academic
			 potential.</text>
						</clause><clause id="H93A593985F7544F5BCA7D9BE991609B9"><enum>(iii)</enum><text>How to establish
			 educational equity for all students.</text>
						</clause><clause id="HAF4A37DDA88E4A7C9F00C67155C00788"><enum>(iv)</enum><text>How
			 to determine the educational needs of a student.</text>
						</clause><clause id="HDAC386804A2F4F3782C8C8119734213B"><enum>(v)</enum><text>How
			 to evaluate the effectiveness of a school in meeting the educational needs of a
			 student at the school.</text>
						</clause><clause id="HF0D79F64AB424CE386AA863206CE25C"><enum>(vi)</enum><text>The
			 methods by which schools should be funded.</text>
						</clause></subparagraph><subparagraph id="HF364D30795014054834D75772DE06E00"><enum>(C)</enum><header>Participation</header><text>The
			 Commission shall encourage broad participation in the program by any reasonable
			 means the Commission considers appropriate.</text>
					</subparagraph></paragraph></subsection></section><section id="H8C3F6E185A774B609888867B5F8573ED"><enum>9.</enum><header>Reports and other
			 publications of Commission</header>
			<subsection id="HA37F16D46F634E508F976E2ED4DD41F1"><enum>(a)</enum><header>Quarterly
			 reports</header>
				<paragraph id="H12E5929CBC85427B9C7EA0EDD675B1AC"><enum>(1)</enum><header>In
			 general</header><text>Every 90 days after the designation of the chairperson,
			 the Commission shall prepare a report detailing the expenditures and activities
			 of the Commission.</text>
				</paragraph><paragraph id="HFA9641DAC9A94D169D2DF66762607935"><enum>(2)</enum><header>Submission to
			 Congress</header><text>The Commission shall submit each report prepared under
			 paragraph (1) to Congress and make the report widely available.</text>
				</paragraph></subsection><subsection id="H84702F1ACBA34302A32D4FE7A2F7772F"><enum>(b)</enum><header>Final
			 report</header>
				<paragraph id="HF01671898CBD4A8884FAA5FCA33900E4"><enum>(1)</enum><header>Content</header><text display-inline="yes-display-inline">The final report of the Commission shall
			 include the following:</text>
					<subparagraph id="H2BF5A01FACCC41B3835EDFA36C7043E7"><enum>(A)</enum><header>Discharge duties
			 of Commission</header><text display-inline="yes-display-inline">The findings
			 and conclusions of the Commission on the matters described in section 4.</text>
					</subparagraph><subparagraph id="H1BD0B0B0BEE94B378690768726226CDC"><enum>(B)</enum><header>Basis of
			 conclusions</header><text display-inline="yes-display-inline">The basis of the
			 findings and conclusions, including the results of hearings conducted under
			 section 7(a) and the outreach programs conducted under section 8.</text>
					</subparagraph><subparagraph id="H4EBF17EBF6E9432581B1824BDE2F72F6"><enum>(C)</enum><header>Other topics to
			 be addressed</header><text>A summary of the following:</text>
						<clause id="HE0D8B416B97B4ED4A099EB2825A2797"><enum>(i)</enum><text display-inline="yes-display-inline">The role of the Federal, State, and local
			 governments in establishing sufficient funding to ensure that each student
			 receives an equitable education that enables the student to achieve his or her
			 maximum academic potential.</text>
						</clause><clause id="H3F9D6CF263394598901D5E79DFC08FF1"><enum>(ii)</enum><text>The
			 unmet educational needs of students, and the benefits of providing the
			 necessary support to enable schools meet their needs.</text>
						</clause><clause id="H1C5392D2677F4353833D9F576300232E"><enum>(iii)</enum><text>Recommendations
			 on how to assess the educational needs of a student, the types of assessments
			 available, and how to develop additional assessments to enable educators to
			 better understand the educational needs of a student.</text>
						</clause><clause id="HFA452838630D445ABC07C896A4EB4B60"><enum>(iv)</enum><text display-inline="yes-display-inline">Information concerning the cost of
			 education in different settings, with consideration of variations in geography,
			 needs of student populations, and concentrations of student populations.</text>
						</clause><clause id="HF55D108065D542D194FD082FB1225B4D"><enum>(v)</enum><text>The
			 methods by which schools are and should be funded.</text>
						</clause></subparagraph></paragraph><paragraph id="H910782BFF1E1471C9D9B111146183787"><enum>(2)</enum><header>Publication of
			 draft report</header><text display-inline="yes-display-inline">Within 480 days
			 after the designation of the chairperson, the Commission shall publish a draft
			 of the final report.</text>
				</paragraph><paragraph id="HB2666E966FE0406CB4AD00C78515C465"><enum>(3)</enum><header>Public comment
			 period</header><text>During the 45-day period beginning with the date the draft
			 report is published, the Commission shall solicit and receive comments from the
			 public on the draft report.</text>
				</paragraph><paragraph id="HE692FB4493D245E98C18801867422028"><enum>(4)</enum><header>Issuance of
			 final report</header>
					<subparagraph id="HB155C2F63B194CCCAD081CB9A4EA1273"><enum>(A)</enum><header>In
			 general</header><text>Within 165 days after publishing the draft report, and
			 after taking into account any comments received under paragraph (4), the
			 Commission shall submit the final report to—</text>
						<clause id="H5F61932D8DC94B368BD2AD16D646F8DC"><enum>(i)</enum><text display-inline="yes-display-inline">the Committees on Finance, on Health,
			 Education, Labor, and Pensions, and on Appropriations of the Senate;</text>
						</clause><clause id="H09D0A820A1124697B575243ED97415DB"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committees on Ways and Means, on
			 Education and Labor, and on Appropriations of the House of Representatives;
			 and</text>
						</clause><clause id="H36EEA63594A54175A1903B0049007E76"><enum>(iii)</enum><text display-inline="yes-display-inline">the President.</text>
						</clause></subparagraph><subparagraph id="HCE0E0AAA41D34A45BB9C001599C9BFD9"><enum>(B)</enum><header>Approvals
			 required; inclusion of minority view</header>
						<clause id="H911C0F561A7B467785B9158258E146A6"><enum>(i)</enum><header>Approvals
			 required</header><text>The Commission may not issue the final report without
			 the approval of at least 10 Commission members.</text>
						</clause><clause id="H52C6E13A11054090BF884779318DAD93"><enum>(ii)</enum><header>Inclusion of
			 minority view</header><text>The Commission may include a minority view in the
			 final report.</text>
						</clause></subparagraph></paragraph><paragraph id="H3F85FDDFEBE44DE4B685CFE006DE4300"><enum>(5)</enum><header>Congressional
			 hearings</header><text>It is the sense of the Congress that the Committees
			 specified in paragraph (4)(A) should hold hearings on the information in the
			 final report.</text>
				</paragraph></subsection><subsection id="H1C8F0B8896A44963985B1392424E5E42"><enum>(c)</enum><header>Format of
			 publications; timing; accessibility</header>
				<paragraph id="H867388EF9D1D4954A7CCC66B175DFE1F"><enum>(1)</enum><header>Format of
			 publications</header><text display-inline="yes-display-inline">The Commission
			 shall publish all reports prepared under this section, minutes of all
			 Commission meetings, and transcripts of all Commission hearings, in a format
			 that is understandable to the public.</text>
				</paragraph><paragraph id="HD77592D78F814D9FBEFB3C07BEA6F540"><enum>(2)</enum><header>Timing</header><text>The
			 Commission shall publish the information described in paragraph (1)—</text>
					<subparagraph id="HE8C3582B5EE447ACA6E4292CFDE8EDD7"><enum>(A)</enum><text display-inline="yes-display-inline">on the Internet website of the Department
			 of Education, within 15 days after preparation of the information; and</text>
					</subparagraph><subparagraph id="HBAB263E29DB244198BC1E2B44BBBDE1F"><enum>(B)</enum><text display-inline="yes-display-inline">in print, within 60 days after preparation
			 of the information.</text>
					</subparagraph></paragraph><paragraph id="H03EACE9AE956492F973C722312280004"><enum>(3)</enum><header>Accessibility</header><text display-inline="yes-display-inline">The Secretary of Education shall maintain,
			 on the Internet website of the Department of Education, the information
			 published under paragraph (1), which shall be accessible to the public.</text>
				</paragraph></subsection></section><section id="HAEAECECE432848E4854EDA90FAD6F9D4"><enum>10.</enum><header>Termination of
			 Commission</header><text display-inline="no-display-inline">The Commission
			 shall terminate 45 days after issuing the final report under section
			 9(b)(4).</text>
		</section><section id="HEE339A439A6F41178110329D5E00BD73"><enum>11.</enum><header>Limitations on
			 authorization of appropriations</header>
			<subsection id="HFD35330999EA48ECB750A35B8434DCAF"><enum>(a)</enum><header>Limitations on
			 authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
			 carry out this Act, other than section 9(b), not more than $10,000,000, to
			 remain available until expended.</text>
			</subsection><subsection id="H49C33A63F6FA48059DAB66F100A0D49B"><enum>(b)</enum><header>Limitations on
			 use of funds</header><text display-inline="yes-display-inline">To the extent or
			 in the amounts provided in advance in appropriation Acts, the Commission may do
			 the following:</text>
				<paragraph id="HD71B628E28314883A838106801D89B03"><enum>(1)</enum><text display-inline="yes-display-inline">Pay compensation under sections 5(e)(1) and
			 6(b).</text>
				</paragraph><paragraph id="HAFDC708A94FE41A7851F8CEC1F732CEA"><enum>(2)</enum><text display-inline="yes-display-inline">Enter into contracts with and compensate a
			 government or private agency or person for the conduct of activities, under
			 section 7(e).</text>
				</paragraph></subsection></section><section id="HC31D17D3059F4427B21B5BA0C7DAD463"><enum>12.</enum><header>Federal Advisory
			 Committee Act not to apply</header><text display-inline="no-display-inline">The
			 Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the
			 Commission.</text>
		</section><section id="H4C97F79DA2F1471B90DE72331E95001E"><enum>13.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H7FC8F8269CC14216A128FA9F0908554C"><enum>(1)</enum><header>Education</header><text>The
			 term <term>education</term> means learning occurring in public schools in the
			 United States from pre-kindergarten through the 12th grade, including
			 homeschooling.</text>
			</paragraph><paragraph id="HE5C16784F1444717ABEDE800FFB2B703"><enum>(2)</enum><header>Educational
			 equity</header><text display-inline="yes-display-inline">The term
			 <term>educational equity</term> means the educational policies, and practices
			 necessary to—</text>
				<subparagraph id="H59EAE10301964F2F84D09B5FD6A2AAEC"><enum>(A)</enum><text display-inline="yes-display-inline">meet the educational requirements of each
			 student, regardless of his or her socioeconomic status, national origin,
			 gender, or the location of his or her school;</text>
				</subparagraph><subparagraph id="H678D7911C0E14B4E96C905AD02172D2F"><enum>(B)</enum><text>foster the maximum
			 development of the potential of each student; and</text>
				</subparagraph><subparagraph id="H43F266473F0E438397A38867078B9B4D"><enum>(C)</enum><text>ensure that each
			 student has the knowledge and skills needed to participate effectively in
			 community life as a worker, citizen, parent, or leader, and as a role model for
			 future generations.</text>
				</subparagraph></paragraph><paragraph id="H6668561FC4774C44B3AE383CF3589C7B"><enum>(3)</enum><header>Educational
			 needs</header><text>The term <term>educational needs</term> means the academic
			 and developmental requirements for a student to achieve his or her maximum
			 academic potential, determined after taking into account the unique abilities
			 and circumstances of the student.</text>
			</paragraph><paragraph id="H2D601931723849B18874728F353DCF84"><enum>(4)</enum><header>Comptroller
			 General</header><text display-inline="yes-display-inline">The term
			 <term>Comptroller General</term> means the Comptroller General of the United
			 States.</text>
