<official-title>To require the Secretary of Agriculture to provide crop disaster assistance to agricultural producers that suffered qualifying quantity or quality losses for the 2008 crop year due to a natural disaster.</official-title>

<section id="H2938D3C25AFE43D9A0421E6239744FD0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farm Relief Act of 2008</short-title></quote>.</text></section> 
<section id="H146E71111EC34B3893E68CE196746074" section-type="subsequent-section"><enum>2.</enum><header>2008 crop disaster assistance</header><text display-inline="no-display-inline">Section 9001 of the U.S. Troop Readiness, Veterans’ Care, Katrina Recovery, and Iraq Accountability Appropriations Act, 2007 (<external-xref legal-doc="public-law" parsable-cite="pl/110/28">Public Law 110–28</external-xref>; 121 Stat. 211) is amended—</text> 
<paragraph id="HE31FA9F3F412438C9DF17775D28321A5"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HE8FE89B456CA49C6BEAFAB7A575C63D"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>There are hereby</quote> and inserting the following:</text>

<paragraph id="H8F07451B82DB44F7AAC5489BF9DFD7FF"><enum>(1)</enum><header>In general</header><text>There are hereby</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H62580DCBE91C461784739153A55CDBED"><enum>(B)</enum><text>by adding at the end the following:</text>

<paragraph id="H0140ADA09AB443DEA0750589FEB8A155"><enum>(2)</enum><header>2008 crop disaster assistance</header> 
<subparagraph id="HBE87AD29A1FA4FAF89000155C73CC058"><enum>(A)</enum><header>In general</header><text>There are hereby appropriated to the Secretary such sums as are necessary, to remain available until expended, to make emergency financial assistance under this section available to producers on a farm that incurred qualifying quantity or quality losses for the 2008 crop due a natural disaster or any related condition, as determined by the Secretary.</text></subparagraph> 
<subparagraph id="H8953D08F99F141C782256CD2EA10AD5"><enum>(B)</enum><header>Sugar and sugarcane disaster assistance</header> 
<clause commented="no" display-inline="no-display-inline" id="H7C49DE4386CF41C2AE01DA3E02A50026"><enum>(i)</enum><header>Florida</header><text>There are hereby appropriated to the Secretary such sums as are necessary, to remain available until expended, to make payments to processors in Florida that are eligible to obtain a loan under section 156(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272(a)</external-xref>) to compensate first processors and producers for crop and other losses due a natural disaster or any related condition, as determined by the Secretary, in Florida during calendar year 2008, by an agreement on the same terms and conditions, to the maximum extent practicable, as the payments made under section 102 of the Emergency Supplemental Appropriations for Hurricane Disasters Assistance Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/324">Public Law 108–324</external-xref>; 118 Stat. 1235), including that the 2008 base production of each harvesting unit shall be determined using the same base year crop production history that was used pursuant to the agreement under that section.</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H468AAFDB8F5D40B380B09CB9EBA5B482"><enum>(ii)</enum><header>Louisiana</header> 
<subclause id="H8F7CC493C43F4392B4F000C947A3001C"><enum>(I)</enum><header>Compensation for losses</header><text>There are hereby appropriated to the Secretary such sums as are necessary, to remain available until expended, to make assistance available to first processors of sugarcane that operate in a county affected by a natural disaster, or obtain sugarcane from a county affected by a natural disaster, in Louisiana and that are eligible to obtain a loan under section 156(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272(a)</external-xref>), in the form of monetary payments or commodities in the inventory of the Commodity Credit Corporation derived from carrying out that section, to compensate producers and first processors for crop and other losses due to the natural disaster or any related condition, as determined by the Secretary.</text></subclause> 
<subclause id="H796AB7FFC6A04EC69DB45E4873F5DD13"><enum>(II)</enum><header>Administration</header><text>Assistance under this clause shall be—</text> 
<item id="HC418F92B63AE49FE81532891C0CF6DEA"><enum>(aa)</enum><text>shared by an affected first processor with affected producers that provide commodities to the processor in a manner that reflects contracts entered into between the processor and the producers, except with respect to a portion of the amount of total assistance provided under subclause (I) necessary to compensate affected producers for individual losses experienced by the producers, including losses due to saltwater intrusion, flooding, wind damage, or increased planting, replanting, or harvesting costs, which shall be transferred by the first processor to the affected producers without regard to contractual share arrangements; and</text></item> 
<item id="H763874ACBF554CB8A1CEBAFB224C3620"><enum>(bb)</enum><text>made available under such terms and conditions as the Secretary determines are necessary to carry out this clause.</text></item></subclause> 
<subclause id="H82E6002C938540B4854BC4A834D7E351"><enum>(III)</enum><header>Form of assistance</header><text>In carrying out this clause, the Secretary shall—</text> 
<item id="H3F2FD96CCB5B46F899E58970A3CB0290"><enum>(aa)</enum><text>convey to the first processor commodities in the inventory of the Commodity Credit Corporation derived from carrying out section 156(a) of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7272">7 U.S.C. 7272(a)</external-xref>);</text></item> 
<item id="HCD9BF2AF30984833BAFC9148A4412BD4"><enum>(bb)</enum><text>make monetary payments to the first processor; or</text></item> 
<item id="HC0024E52C7A64192A77E4060F2A71962"><enum>(cc)</enum><text>take any combination of actions described in items (aa) and (bb), using commodities or monetary payments.</text></item></subclause> 
<subclause id="H76B7FF2BD9B34BC79440B2B4994BF006"><enum>(IV)</enum><header>Loss determination</header><text>In carrying out this clause, the Secretary shall use the same base year to determine crop loss that was elected by a producer to determine crop loss in carrying out the hurricane assistance program under section 207 of the Agricultural Assistance Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/7">Public Law 108–7</external-xref>; 117 Stat. 543).</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="H366535EFAB944F9E915275A7CF2A85F"><enum>(iii)</enum><header>Texas</header><text>There are hereby appropriated to the Secretary such sums as are necessary, to remain available until expended, to assist sugarcane growers in Texas by making a payment in that amount to a farmer-owned cooperative sugarcane processor in that State, for costs of demurrage, storage, and transportation resulting from natural disaster or any related condition during calendar year 2008.</text></clause></subparagraph> 
<subparagraph id="H5BBDBEBF8D0545E5922C2739B7FC06E"><enum>(C)</enum><header>Relation to supplemental agricultural disaster assistance program</header><text>A producer on a farm that accepts assistance made available under this paragraph for a crop loss is not eligible to receive supplemental agricultural disaster assistance for that crop loss under subtitle B of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1531">7 U.S.C. 1531</external-xref>) or title IX of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2497">19 U.S.C. 2497 et seq.</external-xref>).</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H2C544A0D9A7346628C60EA04A49EF800"><enum>(2)</enum><text>in subsection (b), by striking <quote>this section</quote> each place it appears and inserting <quote>subsection (a)(1)</quote>.</text></paragraph></section> 
<section id="HAB9218C3B75B449484CC82D14C50BE"><enum>3.</enum><header>Aquaculture grants</header> 
<subsection id="H302F8CCAE82549E699EA71C750518C0"><enum>(a)</enum><header>Definition of eligible applicant</header><text>In this section, the term <term>eligible applicant</term> means a producer of animals described in section 10806(a)(1) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/21/321d">21 U.S.C. 321d(a)(1)</external-xref>) during the 2008 calendar year.</text></subsection> 
<subsection id="HBCC0A22C5853452883FF5DA82C89483E"><enum>(b)</enum><header>Aquaculture grants</header><text display-inline="yes-display-inline">Of the funds of the Commodity Credit Corporation, the Secretary of Agriculture shall use $50,000,000 to provide grants to appropriate State departments of agriculture (or other appropriate State agencies) that agree to provide assistance to eligible applicants through animal feed providers that agree to make the assistance available on a pro rata basis to eligible applicants based on documented feed use by the eligible applicants during the 2008 calendar year to help offset feed costs or economic losses caused by natural disasters.</text></subsection> 
<subsection id="H8DEEDC1DDF7549879F64C4C2BD9D2FCA"><enum>(c)</enum><header>Duty of Secretary</header><text>The Secretary shall ensure that—</text> 
<paragraph id="H3066DFC02412419186E4FF3B845ED221"><enum>(1)</enum><text>funds made available under subsection (b) are apportioned in an equitable manner among the States that receive funds under this section; and</text></paragraph> 
<paragraph id="HE005773096624598B4C0A4920789D6CB"><enum>(2)</enum><text>assistance is made available based only on documented feed use.</text></paragraph></subsection> 
<subsection id="H5BCBE317270B4550B11EA9D7B536E734"><enum>(d)</enum><header>Regulations</header> 
<paragraph id="H38BBF6EBC33C445AB09960E32C6799BB"><enum>(1)</enum><header>In general</header><text>The Secretary of Agriculture may promulgate such regulations as are necessary to implement this section.</text></paragraph> 
<paragraph id="H2A4EA4CD00CA49BFB594493E93047BCF"><enum>(2)</enum><header>Procedure</header><text>The promulgation of the regulations and administration of this section shall be made without regard to—</text> 
<subparagraph id="H4E5C0136B0FB4334AFF0AEA1EF7C293B"><enum>(A)</enum><text>the notice and comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text></subparagraph> 
<subparagraph id="HA8F3562F1A944AC38B00D0B3DBA36DA7"><enum>(B)</enum><text>the Statement of Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices of proposed rulemaking and public participation in rulemaking; and</text></subparagraph> 
<subparagraph id="H779F570281C14F658BE35B21A24DC47E"><enum>(C)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text></subparagraph></paragraph> 
<paragraph id="H6659EE5A6F3D461300C71E62FE95083D"><enum>(3)</enum><header>Congressional review of agency rulemaking</header><text>In carrying out this subsection, the Secretary shall use the authority provided under <external-xref legal-doc="usc" parsable-cite="usc/5/808">section 808</external-xref> of title 5, United States Code.</text></paragraph></subsection></section>
