		  advertising and disclosure requirements with respect to tax refund anticipation
		  loans, and for other purposes.</official-title>

		<section id="H2FCCC8F141CD434ABD70007DD9278C48" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Tax Refund Anticipation Loan Consumer Protection
			 Act</short-title></quote>.</text>
		</section><section id="H6895D616C1DF4D6FA2E44727A8B3F222"><enum>2.</enum><header>Advertising and
			 disclosure requirements</header>
			<subsection id="H5B65F8E4291649EF87A1024BFD9ABF1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 128 of the
			 Truth in Lending Act (U.S.C. 1638) is amended by adding at the end the
			 following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H7C2868F63FE442E69029505F32143F43" style="OLC">
					<subsection id="H5355B2B0818E48C0AA54AB15CB9D4589"><enum>(e)</enum><header>Advertising and
				disclosure requirements for tax refund anticipation loans</header>
						<paragraph id="H4C466E80EBAC45499C17B90047D88655"><enum>(1)</enum><header>Definitions</header>
							<subparagraph id="H34EFEB227F3E47BDBA4628D263AA973C"><enum>(A)</enum><header>Income tax
				refund anticipation loan</header><text display-inline="yes-display-inline">The
				term <quote>income tax refund anticipation loan</quote> means any short-term
				extension of credit, whether in cash, through a stored value card, in the form
				of a down payment or deposit in connection with a transaction to which the
				consumer is a party, or otherwise, to a consumer in exchange for—</text>
								<clause id="H63D9F8AEE34D4BBB834E1DFF34C10788"><enum>(i)</enum><text>the sale or
				assignment of the consumer's anticipated income tax refund or rebate to the
				creditor or the income tax refund anticipation loan originator; or</text>
								</clause><clause id="H5F23EB77BFA64621BBF1AFC3A726C42D"><enum>(ii)</enum><text display-inline="yes-display-inline">an arrangement authorized by the consumer
				pursuant to which such anticipated income tax refund or rebate secures,
				directly or indirectly, the repayment of such extension of credit or will be
				credited against any balance owed by the consumer on such extension of
				credit.</text>
								</clause></subparagraph><subparagraph id="H3D0DA8BCC3134114B49B95B738A579DD"><enum>(B)</enum><header>Income tax
				refund anticipation loan originator</header><text>The term <quote>income tax
				refund anticipation loan originator</quote>—</text>
								<clause id="H1EC448C6536443E500EEB1200049841C"><enum>(i)</enum><text display-inline="yes-display-inline">means any person, including any income tax
				return preparer, electronic tax return filer, or check cashing service, who
				engages in income tax refund anticipation loan origination;</text>
								</clause><clause id="HABD96FB5401048EE9DC3C2C27E14639F"><enum>(ii)</enum><text display-inline="yes-display-inline">includes any person who represents to the
				public, through advertising or other means of communicating or providing
				information (including the use of business cards, stationery, brochures, signs,
				rate lists, or other promotional items), that such person can or will provide
				or perform any of the activities described in any clause of subparagraph (C);
				and</text>
								</clause><clause id="H0742653678554C9D956F3C3E6C301640"><enum>(iii)</enum><text display-inline="yes-display-inline">does not include who performs purely
				administrative or clerical tasks on behalf of a person who is described in any
				clause (i) or (ii).</text>
								</clause></subparagraph><subparagraph id="HEFC3D09F51E347D78326EFDD09B842AA"><enum>(C)</enum><header>Income tax
				refund anticipation loan origination</header><text>The term <quote>income tax
				refund anticipation loan origination</quote> means—</text>
								<clause id="H20CC5F9DCCB043E2951182EACD69ADFC"><enum>(i)</enum><text display-inline="yes-display-inline">accepting an income tax refund anticipation
				loan application for direct or indirect compensation or gain, or in the
				expectation of direct or indirect compensation or gain;</text>
								</clause><clause id="H1CF663F065B0423B94D77598782B54BB"><enum>(ii)</enum><text display-inline="yes-display-inline">assisting a consumer in obtaining or
				applying to obtain an income tax refund anticipation loan (whether or not such
				assistance is described as a loan to the consumer) for direct or indirect
				compensation or gain, or in the expectation of direct or indirect compensation
				or gain; or</text>
								</clause><clause id="H9445422A12304EA495D3C5D131FCDBD0"><enum>(iii)</enum><text display-inline="yes-display-inline">offering or negotiating terms of an income
				tax refund anticipation loan, for direct or indirect compensation or gain, or
				in the expectation of direct or indirect compensation or gain.</text>
								</clause></subparagraph><subparagraph id="H04ACA77A4B424398992E18FD00943E89"><enum>(D)</enum><header>Income tax
				return preparer</header><text display-inline="yes-display-inline">The term
				<quote>income tax return preparer</quote>—</text>
								<clause id="HE7192A518E284F90956391789E809712"><enum>(i)</enum><text>has the same
				meaning as in <external-xref legal-doc="usc" parsable-cite="usc/26/7701">section 7701(a)(36)</external-xref> of the Internal Revenue Code of 1986;
				and</text>
								</clause><clause id="HB0FF4FEB9B95491092D4B9C344C56302"><enum>(ii)</enum><text display-inline="yes-display-inline">includes any person who prepares for
				compensation, or who employs 1 or more persons to prepare for compensation, any
				return of tax imposed under State law.</text>
								</clause></subparagraph><subparagraph id="H759C6F7E3585414F92DCE99A6CA70A4"><enum>(E)</enum><header>Compensation</header><text display-inline="yes-display-inline">For purposes of this title, the term
				<quote>compensation</quote> when used in connection with the preparation by any
				person of any return of tax for a consumer, includes any compensation or gain
				directly or indirectly received by such person for acting as an income tax
				refund anticipation loan originator for such consumer with regard to such
				return.</text>
							</subparagraph></paragraph><paragraph id="H095E3658FFBA433B8F974F56FBF655F9"><enum>(2)</enum><header>Advertising
				requirements</header>
							<subparagraph id="HC1119F0EE4EC4D9EB92062FCECA6D966"><enum>(A)</enum><header>Prohibition on
				confusing refund with loan</header><text display-inline="yes-display-inline">An
				advertisement for an income tax refund anticipation loan may not—</text>
								<clause id="H54A096FC06134B27A214555372624988"><enum>(i)</enum><text>describe an income
				tax refund anticipation loan as a tax refund or rebate; or</text>
								</clause><clause id="HA69BD6D943404718B24258E790FA72FA"><enum>(ii)</enum><text display-inline="yes-display-inline">advertise or solicit tax preparation
				services as including the possibility of obtaining an immediate or rapid income
				tax refund or rebate if the immediate or rapid income tax refund or rebate
				involves an income tax refund anticipation loan origination.</text>
								</clause></subparagraph><subparagraph id="H3D12AB786BBA4405000876FA0065587B"><enum>(B)</enum><header>Information
				required to be provided in ads for income tax refund anticipation
				loans</header><text display-inline="yes-display-inline">Any advertisement for
				an income tax refund anticipation loan shall include the following information
				with respect to such loan:</text>
								<clause id="HDD109F9A6B5647DE9FF480AAE8075963"><enum>(i)</enum><text>Any fees imposed
				by the originator in connection with the origination of such loan.</text>
								</clause><clause id="H88ADB569602F4B18AE635943F3C1A0F8"><enum>(ii)</enum><text>The annual
				percentage rate applicable with respect to such loan and any fees imposed by
				the creditor in connection with such loan.</text>
								</clause><clause id="H91CD15324F4D48B1A0EB9850C61EB199"><enum>(iii)</enum><text>The name of the
				creditor, if other than the originator, with respect to such loan.</text>
								</clause></subparagraph></paragraph><paragraph id="HABFA7B4C543C406F8178AEAF0046323E"><enum>(3)</enum><header>Contract and
				disclosure requirements</header>
							<subparagraph id="H14ED3AFB23FE4558A419E1AE50F1AD29"><enum>(A)</enum><header>Contract
				requirements</header><text display-inline="yes-display-inline">No income tax
				refund anticipation loan origination services may be provided by any income tax
				refund anticipation loan originator for any consumer unless a written and dated
				contract (for such services) which meets the requirements of subparagraph (B)
				has been signed by the consumer.</text>
							</subparagraph><subparagraph id="H777121924A2D41D88F99E614F316D4A1"><enum>(B)</enum><header>Disclosure
				requirements</header><text display-inline="yes-display-inline">No contract
				referred to in subparagraph (A) meets the requirements of this paragraph unless
				the following information relating to the income tax refund anticipation loan
				is included in such contract (in writing) and is verbally communicated to the
				consumer (regardless of whether any of such information is also required under
				this chapter to be provided by the creditor to the consumer):</text>
								<clause id="HDA7EF55CEFDF4672A0924C9D7FDC693F"><enum>(i)</enum><text display-inline="yes-display-inline">The purpose and the amount of all fees
				associated with the loan that will be imposed by the originator, the creditor,
				and any other person involved in the transaction.</text>
								</clause><clause id="H1BD3DDAA5194490DB100F82B129FEE67"><enum>(ii)</enum><text display-inline="yes-display-inline">The estimated amount of the Federal or
				State tax refund.</text>
								</clause><clause id="H6F6B25B794694777B900755F40183D5B"><enum>(iii)</enum><text display-inline="yes-display-inline">The fact that the consumer will be
				responsible for the repayment of the entire loan amount and all related costs
				and fees regardless of whether—</text>
									<subclause id="H30712BFDB0194FCB0091B7006C6F355B"><enum>(I)</enum><text>the individual
				receives a refund;</text>
									</subclause><subclause id="H98D599287131405FAC9CABED20ACC55F"><enum>(II)</enum><text>the amount of the
				actual refund is greater than or less than the amount of the estimate of the
				refund; or</text>
									</subclause><subclause id="HF0E4F6AFE4D24C269E6BB1E7414F68C2"><enum>(III)</enum><text display-inline="yes-display-inline">any mistake or miscalculation was made by
				the income tax return preparer in the preparation of the tax return or in
				determining the amount of the refund.</text>
									</subclause></clause><clause id="H6CF8DB8A51FF42B09E3EBF84213B0643"><enum>(iv)</enum><text>The date by
				which, on average, a refund could be expected to be received using a refund
				direct deposit program if the consumer filed the return electronically.</text>
								</clause><clause id="H77525DC04FC145C7BC8FF1FECFBC3543"><enum>(v)</enum><text display-inline="yes-display-inline">Information on obtaining low- or no-cost
				income tax preparation, electronic filing and direct deposit of refund services
				from Volunteer Income Tax Assistance Program (VITA) for low- to moderate-income
				individuals and military personnel and their families or Tax Counseling for the
				Elderly (TCE), which will allow the consumer to receive a refund in usually no
				more than 10 days.</text>
								</clause><clause id="H08D5262BA9074B79A7F99439D71D1CFC"><enum>(vi)</enum><text display-inline="yes-display-inline">A website and a toll-free telephone number
				for locating the nearest Volunteer Income Tax Assistance Program or Tax
				Counseling for the Elderly office.</text>
								</clause></subparagraph></paragraph><paragraph id="H24890C5B3A734E4E84A8CEC2D0ABC958"><enum>(4)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 130 shall be applied for purposes
				of this paragraph substituting <quote>income tax refund anticipation loan
				originator</quote> for <quote>creditor</quote> each place such term appears in
				such
				section.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HACEC55038CB749C7A302809101A602D"><enum>(b)</enum><header>Prompt model
			 disclosure form publication</header><text display-inline="yes-display-inline">The Board of Governors of the Federal
			 Reserve System shall publish model disclosure forms for implementation of the
			 amendment made by subsection (a) with regard to income tax refund anticipation
			 loans, in accordance with section 105 of the Truth in Lending Act, before the
			 end of the 6-month period beginning on the date of the enactment of this
			 Act.</text>
			</subsection><subsection id="H3F7D6BFD03C54593B9812C8000F4D17B"><enum>(c)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply after the
			 end of the 60-day period beginning on the date of the enactment of this
			 Act.</text>
