<section id="H1A0B41DB0E32439FAC000181D46E6837" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Solid Waste Rail Transfer Facilities Regulation Act of 2008</short-title></quote>.</text></section> 
<section id="H3AC47194EE3F41CC885FA99749D83734"><enum>2.</enum><header>Regulation of solid waste rail transfer facilities</header> 
<subsection id="HD5B690A3A9E648128BC6DB0846FB95AA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/109">Chapter 109</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="HE32133FD5D0A43A7B48264C87F768F6E" display-inline="no-display-inline"> 
<section id="H8FCB14AED9E14BF5AC339CA4378054B6"><enum>10908.</enum><header>Regulation of solid waste rail transfer facilities</header> 
<subsection id="HDF7E67B484B349D0B37188004EE0F49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each solid waste rail transfer facility shall be subject to and shall comply with all applicable Federal and State requirements, both substantive and procedural, including judicial and administrative orders and fines, respecting the prevention and abatement of pollution, the protection and restoration of the environment, and the protection of public health and safety, including laws governing solid waste, to the same extent as required for any similar solid waste management facility, as defined in section 1004(29) of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6903">42 U.S.C. 6903(29)</external-xref>) that is not owned or operated by or on behalf of a rail carrier, except as provided for in section 10909 of this chapter.</text></subsection> 
<subsection id="HCB3F2E29C53B49D8AF2EA4DF071439A2"><enum>(b)</enum><header>Existing facilities</header> 
<paragraph id="H64BB368470C24E2BA431BC751B8FE53"><enum>(1)</enum><header>State laws and standards</header><text>Not later than 90 days after the date of enactment of the Clean Railroads Act of 2008, a solid waste rail transfer facility operating as of such date of enactment shall comply with all Federal and State requirements pursuant to subsection (a) other than those provisions requiring permits.</text></paragraph> 
<paragraph id="H23DE4254303B4C979EEB4204020029D7"><enum>(2)</enum><header>Permit requirements</header> 
<subparagraph id="HDF62AA8FFB074E3D900310EBAA0939C7"><enum>(A)</enum><header>State non-siting permits</header><text>Any solid waste rail transfer facility operating as of the date of enactment of the Clean Railroads Act of 2008 that does not possess a permit required pursuant to subsection (a), other than a siting permit for the facility, as of the date of enactment of the Clean Railroads Act of 2008 shall not be required to possess any such permits in order to operate the facility—</text> 
<clause id="H15EBB782C72443518263C2D09FDBF633"><enum>(i)</enum><text>if, within 180 days after such date of enactment, the solid waste rail transfer facility has submitted, in good faith, a complete application for all permits, except siting permits, required pursuant to subsection (a) to the appropriate permitting agency authorized to grant such permits; and</text></clause> 
<clause id="H76D6C768F5AC49DBA3C6166FC0002D26"><enum>(ii)</enum><text>until the permitting agency has either approved or denied the solid waste rail transfer facility's application for each permit.</text></clause> </subparagraph> 
<subparagraph id="HEB614D8BAC1143519EAB756144099243"><enum>(B)</enum><header>Siting permits and requirements</header><text>A solid waste rail transfer facility operating as of the date of enactment of the Clean Railroads Act of 2008 that does not possess a State siting permit required pursuant to subsection (a) as of such date of enactment shall not be required to possess any siting permit to continue to operate or comply with any State land use requirements. The Governor of a State in which the facility is located, or his or her designee, may petition the Board to require the facility to apply for a land-use exemption pursuant to section 10909 of this chapter. The Board shall accept the petition, and the facility shall be required to have a Board-issued land-use exemption in order to continue to operate, pursuant to section 10909 of this chapter.</text></subparagraph></paragraph></subsection> 
<subsection id="HCBB25E469B8E416CAA2357F75FC5DE84"><enum>(c)</enum><header>Definitions</header> 
<paragraph id="H16E3A184840646BAB139FA0068F1964E"><enum>(1)</enum><header>In general</header><text>In this section:</text> 
<subparagraph id="HCBCBB2D4291E490E90BA6D60B7C6C9CF"><enum>(A)</enum><header>Commercial and retail waste</header><text>The term <term>commercial and retail waste</term> means material discarded by stores, offices, restaurants, warehouses, nonmanufacturing activities at industrial facilities, and other similar establishments or facilities.</text></subparagraph> 
<subparagraph id="H2880FB47F5C24E2BA2A593F7BF9CA2ED"><enum>(B)</enum><header>Construction and demolition debris</header><text>The term <term>construction and demolition debris</term> means waste building materials, packaging, and rubble resulting from construction, remodeling, repair, and demolition operations on pavements, houses, commercial buildings, and other structures.</text></subparagraph> 
<subparagraph id="HA711146E38D843A595B25CC7B15F583D"><enum>(C)</enum><header>Household waste</header><text>The term <term>household waste</term> means material discarded by residential dwellings, hotels, motels, and other similar permanent or temporary housing establishments or facilities.</text></subparagraph> 
<subparagraph id="H38646A75F982494EB42886FFD43E8782"><enum>(D)</enum><header>Industrial waste</header><text>The term <term>industrial waste</term> means the solid waste generated by manufacturing and industrial and research and development processes and operations, including contaminated soil, nonhazardous oil spill cleanup waste and dry nonhazardous pesticides and chemical waste, but does not include hazardous waste regulated under subtitle C of the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6921">42 U.S.C. 6921 et seq.</external-xref>), mining or oil and gas waste.</text></subparagraph> 
<subparagraph id="HC94197B7C09E4715B6B970F11526EB00"><enum>(E)</enum><header>Institutional waste</header><text>The term <term>institutional waste</term> means material discarded by schools, nonmedical waste discarded by hospitals, material discarded by nonmanufacturing activities at prisons and government facilities, and material discarded by other similar establishments or facilities.</text></subparagraph> 
<subparagraph id="H22B0640B44784E6CAABF2B2EB9F2F87"><enum>(F)</enum><header>Municipal solid waste</header><text>The term <term>municipal solid waste</term> means—</text> 
<clause id="HC01D6C6D73E84E1592CF5D3F5002CB4"><enum>(i)</enum><text>household waste;</text></clause> 
<clause id="H527DF2DD6A754E36B39267457E33BD4"><enum>(ii)</enum><text>commercial and retail waste; and</text></clause> 
<clause id="H05DFC5D9E95B429CBD56E0F0D4B53C59"><enum>(iii)</enum><text>institutional waste.</text></clause></subparagraph> 
<subparagraph id="HF22201839F2F45C7B7E273F8264EA2A"><enum>(G)</enum><header>Solid waste</header><text>With the exception of waste generated by a rail carrier during track, track structure, or right-of-way construction, maintenance, or repair (including railroad ties and line-side poles) or waste generated as a result of a railroad accident, incident, or derailment, the term <term>solid waste</term> means—</text> 
<clause id="H15B96B1EBDB5439092FC8CEA14E0CD38"><enum>(i)</enum><text>construction and demolition debris;</text></clause> 
<clause id="HF40CDE61FF914EA400532779B406C3A3"><enum>(ii)</enum><text>municipal solid waste;</text></clause> 
<clause id="HF5C9F04BE70744A99F44234298E2F952"><enum>(iii)</enum><text>household waste;</text></clause> 
<clause id="H556D05E607CF4F13B5EB7300C81D5F23"><enum>(iv)</enum><text>commercial and retail waste;</text></clause> 
<clause id="HCE214244D5E843318FEEBA687671C63"><enum>(v)</enum><text>institutional waste;</text></clause> 
<clause id="H5B38F8221BDC46B0BCEEBBA4A4462F19"><enum>(vi)</enum><text>sludge;</text></clause> 
<clause id="HDABD59A05B9A473FA7186F16F6C6DD3"><enum>(vii)</enum><text>industrial waste; and</text></clause> 
<clause id="H309549C86C5B49AA80E068D98365D43"><enum>(viii)</enum><text>other solid waste, as determined appropriate by the Board.</text></clause></subparagraph> 
<subparagraph id="HD748E408B5344C9D88F487C88D33AB8C"><enum>(H)</enum><header>Solid waste rail transfer facility</header><text>The term <term>solid waste rail transfer facility</term>—</text> 
<clause id="H0A1B50C8EF00497693F8D1E23102B064"><enum>(i)</enum><text>means the portion of a facility owned or operated by or on behalf of a rail carrier (as defined in section 10102 of this title) where solid waste, as a commodity to be transported for a charge, is collected, stored, separated, processed, treated, managed, disposed of, or transferred, when the activity takes place outside of original shipping containers; but</text></clause> 
<clause id="HA686DC74AC2F4DCCB9223BA1487902D8"><enum>(ii)</enum><text>does not include—</text> 
<subclause id="H361C81CFE15A4C0683C98F12A790D711"><enum>(I)</enum><text>the portion of a facility to the extent that activities taking place at such portion are comprised solely of the railroad transportation of solid waste after the solid waste is loaded for shipment on or in a rail car, including railroad transportation for the purpose of interchanging railroad cars containing solid waste shipments; or</text></subclause> 
<subclause id="HB8CFD5BADA82450E910044BC22AA4553"><enum>(II)</enum><text>a facility where solid waste is solely transferred or transloaded from a tank truck directly to a rail tank car.</text></subclause></clause></subparagraph> 
<subparagraph id="H474F3643275D486287E011003832221E"><enum>(I)</enum><header>Sludge</header><text>The term <term>sludge</term> means any solid, semi-solid or liquid waste generated from a municipal, commercial, or industrial wastewater treatment plant, water supply treatment plant, or air pollution control facility exclusive of the treated effluent from a wastewater treatment plant.</text></subparagraph></paragraph> 
<paragraph id="H8605DE5697154D21B55EEA603E1B7C72"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1), the terms <term>household waste</term>, <term>commercial and retail waste</term>, and <term>institutional waste</term> do not include—</text> 
<subparagraph id="H71EC49AF982E4C6E87A97B53C894002B"><enum>(A)</enum><text>yard waste and refuse-derived fuel;</text></subparagraph> 
<subparagraph id="H455C9D3A83D84941B4B3D96DCE332DC8"><enum>(B)</enum><text>used oil;</text></subparagraph> 
<subparagraph id="H2E3C16FF8C0F430FBE9F8500100052B2"><enum>(C)</enum><text>wood pallets;</text></subparagraph> 
<subparagraph id="H3428E035F7B44ED9B5953F9BF777221B"><enum>(D)</enum><text>clean wood;</text></subparagraph> 
<subparagraph id="HAADCCEA899A940D1BA52BEC000000D3"><enum>(E)</enum><text>medical or infectious waste; or</text></subparagraph> 
<subparagraph id="H3F024C7BE9394A469970CAF7A3F0A749"><enum>(F)</enum><text>motor vehicles (including motor vehicle parts or vehicle fluff).</text></subparagraph></paragraph> 
<paragraph id="HDA265A4099CC4DDEB5EBDA309114BA3F"><enum>(3)</enum><header>State requirements</header><text>In this section the term <term>State requirements</term> does not include the laws, regulations, ordinances, orders, or other requirements of a political subdivision of a State, including a locality or municipality, unless a State expressly delegates such authority to such political subdivision.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H650D4501C6E841CBBECD0D16D8401DA"><enum>(b)</enum><header>Conforming amendment</header><text>The chapter analysis for chapter 109 is amended by inserting after the item relating to section 10907 the following: </text>

<section id="HA70193067D8D4C5DA62CC7B1EB59B4AA"><enum>3.</enum><header>Authority for Environmental Protection Agency to make modifications to protect human health and the environment</header><text display-inline="no-display-inline">With respect to <external-xref legal-doc="usc" parsable-cite="usc/49/10908">section 10908</external-xref> of title 49, United States Code (as added by section 2(a) of this Act), the Administrator of the Environmental Protection Agency may, with respect to the Solid Waste Disposal Act, make modifications to the policies established in such section to the extent determined appropriate by the Administrator to protect human health and the environment. Any such modifications shall be made by regulation.</text></section>
