		<official-title>To prohibit the installation on a computer of certain
		  <quote>peer-to-peer</quote> file sharing software without first providing
		  notice and obtaining consent from the owner or authorized user of the
		  computer.</official-title>

		<section id="H890CC4E7BA384081B789FE4D20F20233" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Informed P2P User
			 Act</short-title></quote>.</text>
		</section><section id="HCD849998874C4B69BF3843E28212D8F"><enum>2.</enum><header>Conduct
			 prohibited</header>
			<subsection id="HB94212A247B8479FAF7787D6D000CBC2"><enum>(a)</enum><header>Improper
			 installation without notice and consent</header><text display-inline="yes-display-inline">It is unlawful for any person who is not
			 the owner or authorized user of a protected computer to cause or induce the
			 owner or authorized user of the protected computer to install any component of
			 a peer-to-peer file sharing program that intentionally obtains files on the
			 protected computer, or makes such files available to another computer without
			 first providing clear and conspicuous notice that such program obtains files on
			 the protected computer, or makes such files available to another computer, and
			 obtaining the informed consent to the installation of such program for such
			 activities from the owner or authorized user of the protected computer.</text>
			</subsection><subsection id="H0AF01B1D0F064657B65187CDB81F9182"><enum>(b)</enum><header>Preventing the
			 disabling or removal of certain software</header><text display-inline="yes-display-inline">It is unlawful for any person who is not
			 the owner or authorized user of a protected computer to prevent reasonable
			 efforts by such owner or authorized user to—</text>
				<paragraph id="H577B0C6B1340410FACC11CF48905FFFE"><enum>(1)</enum><text display-inline="yes-display-inline">block the installation of a peer-to-peer
			 file sharing program that intentionally obtains files on the protected
			 computer, or makes such files available to another computer; or</text>
				</paragraph><paragraph id="H15F2AF104B63473587E6CF92DEB526D"><enum>(2)</enum><text display-inline="yes-display-inline">disable or remove any peer-to-peer file
			 sharing program that intentionally obtains files on the protected computer, or
			 makes such files available to another computer.</text>
				</paragraph></subsection></section><section id="HC850733F033D4C03BDE900DF2651D372"><enum>3.</enum><header>Enforcement</header>
			<subsection id="HD6093401834B46FA84348ED990A67C02"><enum>(a)</enum><header>Unfair and
			 deceptive acts and practices</header><text display-inline="yes-display-inline">A violation of section 2 shall be treated
			 as a violation of a rule defining an unfair or deceptive act or practice
			 prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (15
			 U.S.C. 57a(a)(1)(B)).</text>
			</subsection><subsection id="HA126BE493B4242DCB16C249440C52EC3"><enum>(b)</enum><header>Federal Trade
			 Commission enforcement</header><text>The Federal Trade Commission shall enforce
			 this Act in the same manner, by the same means, and with the same jurisdiction
			 as though all applicable terms and provisions of the Federal Trade Commission
			 Act were incorporated into and made a part of this Act.</text>
			</subsection></section><section id="H56C14828DF004B3694B869534B3B13A2"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
			<paragraph id="H2C3FD0F2EF9F4564A5A2EA383538D225"><enum>(1)</enum><text>the term
			 <term>protected computer</term> has the meaning given such term in section
			 1030(e)(2) of title 18, United States Code; and</text>
			</paragraph><paragraph id="HEDA98BA29ECA401F8E9B85AF3D339E44"><enum>(2)</enum><text>the term
			 <term>peer-to-peer file sharing program</term> means computer software that
			 allows the computer on which such software is installed—</text>
				<subparagraph id="HB16A5A9D284A4CCD90C2407585997631"><enum>(A)</enum><text>to designate files
			 available for transmission to another computer;</text>
				</subparagraph><subparagraph id="H297B0CEE3A934D7290AB29AFF5B86817"><enum>(B)</enum><text>to transmit files
			 directly to another computer; and</text>
				</subparagraph><subparagraph id="HF6EFD7E3AB41479AA8BCD95554BBCA75"><enum>(C)</enum><text>to request the
			 transmission of files from another computer.</text>
				</subparagraph></paragraph></section></legis-body>
